Complaint: On XX/XX/XXXX I engaged a lender to start the refinance process of my home and gave that lender the right to pull credit reports for my wife and myself. On XX/XX/XXXX, I received an email from Ditech, my current servicer, indicating they received a notification when customers have a credit inquiry from another mortgage lender. Within that email was an incentive from XXXX XXXX with Ditech indicating that if we chose Ditech to refinance a {$250.00} Visa gift card would be sent to me.
Such an incentive is an unethical way to obtain business as is any system set up to trigger an alert if a customer has a credit inquiry from another mortgage lender. It is an unfair and deceptive technique to use to obtain business and any incentive given for using a lender is unethical.

Complaint: I am currently having a problem with my mortgage company Ditech Financial. I received major damage to my property through a windstorm on XX/XX/18. My insurance company wrote me a check for repairs which is being held my Ditech Financial. I am eager and willing to make all repairs as soon as possible however Ditech will not release the needed funds for the repairs. Ditech is relying on unreasonable requests from me. I have been in XXXX XXXX for 35 years and will make self repairs. However, Ditech Financial will not allow this. I have already completed large amounts of the repairs to prevent further damage. I have been dealing with Ditech on a daily basis and they have released very minimal amounts of money. I will be unable to make my continued mortgage payment on the property due to Ditech not allowing me to complete repairs. I am in fear of losing this home due to foreclosure caused completely by Ditech 's unwillingness to use common sense. I have been supplying Ditech with all the paperwork they require but they have been uncooperative. Ditech will ultimately cause more damage then the storm did. It should be a crime for a financial institution to hold your money hostage and delay repairs of my property. They should be a helping hand not a road block. I have sent several letters and request with no responses. I do not know what else to try. I am currently making complaints to whom ever may be able to help.

Account information incorrect
Complaint: I have an issue with my XXXX credit report, it's showing that my closed account with DITECH is paid but foreclosure procedures started in XX/XX/XXXX. This is incorrect information as the account was paid in full in XX/XX/XXXX. I have disputed this information for the first time in XX/XX/XXXX I have a letter from DITECH supporting this information and I have presented this to XXXX. The dispute results states that they contacted DITECH and they said the report is correct despite the legal document that I have, signed by DITECH and issued onXX/XX/XXXX stating the contrary.
I have contacted XXXX multiple times to get help on this issue but they won't change the report affecting and damaging my ability to get any type of credit due to incorrect information in their report. In my last call to XXXX ( XX/XX/XXXX ) the operator told me that i have to contact DITECH as they can not change my reporting even with the legal documentation i have provided showing the opposite.

Complaint: Im writing again to see if CFPB can resolve this matter for once and all At this stage Ditech has ruined my credit with untruth late payments offences in my credit score, in which there were no reasons what so ever to ignite these actions based on the following story All started in XX/XX/XXXX when the Ditech Financial LLC sent me a bill charging a new hazard insurance, which was too costly in comparison with the market. It took me several months to demonstrate that I sent my coverage back in XX/XX/XXXX. By XX/XX/XXXX they realized it was a mistake in their part, but they harassed me for all this period, and also they sent my account to debt collector and a foreclosure agency, in which they did it again in XX/XX/XXXX In XX/XX/XXXX my mortgage payment changed from {$620.00} and to {$640.00}. I did not receive a letter on time to schedule the XX/XX/XXXX payment, but I did change the amount in XX/XX/XXXX, so the only shortage I had was {$17.00} to complete the XX/XX/XXXX payment. This is the only mistake I made.
I contacted them to pay the {$17.00}, but they told me it was fine, after three or four call conversations with their CSR. Then, in XXXX Ditech Financial LLC started again to send me a bill charging an amount that was way over the {$17.00} without any explanation and the harassment started all over again with Foreclosure letters. My last two conversations with them were a temporary closure as their CSR told me that everything was fine.
Nevertheless, the harassment did not stop there ; they start again in XX/XX/XXXX to send my letter with a different amount and then the Foreclosure letter started again. Since they do not have an office in Florida it has been a loose cause and I was actually fed up with this matter.
FYI, I have been unemployed since XX/XX/XXXX and I already had one property that went through a foreclosure process and the unit is gone. I have been trying to cope with this mortgage against all odds, but their behavior has been extremely irresponsible I have been paying this mortgage since XXXX without any complains, until Ditech Financial LLC took over the servicing of my loan A year ago, in XX/XX/XXXX, Ditech replied the following statement : We are in receipt of the complaint filed with the Consumer Financial Protection Bureau ( CFPB ) regarding the servicing of your loan by Ditech Financial LLC ( Ditech ) and the delay in cancelling the lender placed hazard insurance policy. Ditech takes your complaint seriously and appreciates this opportunity to respond. Ditech regrets that you feel you have been mistreated in any way during the servicing of your loan account. Ditechs mission is to provide exceptional levels of service and it is Ditechs policy to treat every customer with respect. Pursuant to your request Ditech has confirmed that a do not call has been placed on the account. Ditech records reflect that the lender placed insurance policy on the loan account was cancelled retroactively to XX/XX/XXXX. Due to an inadvertent error, the escrow account and payments due on the loan account were not adjusted accordingly. Your concerns regarding your loan account have been escalated to upper management. The payments made to the loan account will be reallocated and the escrow account will be corrected. Any late fees will be waived and any negative information that has reported to the Credit Bureau Reporting agencies will be updated. Please allow additional time for corrections to reflect on the loan account. Ditech sincerely apologizes for any inconvenience this has caused. After several months, Ditech apparently corrected their inaccuracy of the above complaint ( XXXX ). I visited the company website on XX/XX/XXXX to review the changes and adjustments after they acknowledge their mistakes, which triggered this ordeal. I found that the past due payments were cleared and the payment amount is up to date. They adjusted my fixed payment to {$630.00} ; I updated this amount in my bank account to make automatic monthly payments.
Notwithstanding, I realized that Ditech generosity was shallow because what they did, after admitting their mistakes, pass all fee charges and escrow errors to my principal amount, which increased from {$110000.00} on XX/XX/XXXX to {$110000.00} on XX/XX/XXXX. Meaning that they didnt solve the problem, they just passed the burden to my principal account, at my cost. No solution was taken by Ditech regarding this issue.
Bottom-line, they havent corrected this issue accordingly, and to show CFPB what its the logic behind this ordeal, I have written the following statement for your view and analysis : Ditech have been servicing my account for more than 3 years and since then I dont understand why my payment had increased and changed so many times after XX/XX/XXXX, when my property taxes, which is the only payment made by Ditech from my escrow account, has been dropping since XXXX.
XX/XX/XXXX - {$610.00} XX/XX/XXXX - {$620.00} XX/XX/XXXX - {$630.00} XX/XX/XXXX - {$650.00} I only have to accumulate an amount in escrow for my property taxes, so please get somebody from Ditech to analyze and explain why this mess has been originated by Ditech.
In addition, my principal was increased to cover your mistakes or errors from {$110000.00} to {$110000.00} in XX/XX/XXXX, an increase of {$1100.00} that have to be credited back to actualize my real principal amount.
I have opened my case several times without success, but I want to conclude this matter to move on with my life. I never had some many changes in my payment amount ever in my entire mortgage life span that started in XXXX Best regards

Complaint: I have been working with my mortgage company, Ditech, for several months to remove my PMI from my mortgage account. I payed for an appraisal at Ditech 's direction, only to later be told that the home would not qualify to drop PMI for several months. After the appraisal was completed, I was informed that the PMI would dropped at the loan 's 2 year mark on XX/XX/XXXX. On XX/XX/XXXX, I called Ditech to confirm the PMI had been dropped, and requested a refund for the prorated dates I had paid for with my XXXX payment. The PMI has not been dropped, and I was informed that the PMI was paid for the upcoming month, therefor my XX/XX/XXXX payment would cover my PMI through the end of XXXX, and would be prorated.
Today, XX/XX/XXXX, I spoke with Ditech again and was informed the PMI still has not been dropped, and that PMI was actually payed for the previous month. They said to expect to pay the full PMI amount for my payment due XXXX XXXX, and then to receive a refund for the prorated amount which would be applied to my ESCROW account. They still have not answered why my PMI has not been dropped, nor have they confirmed a date when I can expect to receive confirmation of the PMI being dropped.
This process is ongoing, and the initial process was initiated in XX/XX/XXXX. The current date is XX/XX/XXXX. Over 6 months for a process including multiple letters, over 20 phone calls, dealing with over a dozen representatives, and this is after I was initially told should only require a single letter and an appraisal. The original estimated time fame was approximately 3 weeks after my written request was submitted.

Complaint: We have an existing mortgage with Ditech. In XX/XX/2017 we got approved for a trial period plan modification. We had to make three consecutive payments in XXXX, XXXX and XX/XX/2017 to be eligible for a permanent modification. We paid the the XX/XX/2017 and XX/XX/2017 payments. When making the XXXX payment we had mailed a check but Ditech had not received the check as of XX/XX/XXXX so a representative from Ditech called us to find out when they would be receiving XXXX 's payment. We informed them that we had mailed a check but since they had not received it yet we would stop payment on the check that we had mailed and make the payment electronically so it would not affect the trial modification. So on XX/XX/2017 we had a stop payment put on the check and made the payment electronically. We figured since the payment was made electronically to Ditech we would okay with the modification and our checking account would not be overdrawn when the check was presented against the account since we had stopped payment on the check. We thought everything was okay and were approved for a permanent modification. We did not realize that Ditech had credited our account for both payments ( the electronic payment and stopped check payment ) so instead of removing the second payment from the account in XX/XX/2017 Ditech waited until XX/XX/2017 to deduct the stopped check payment from our account therefore putting our Mortgage a month payment behind. We do not understand why this was done in XX/XX/2017 and not in XX/XX/2017. We have copies of the stop payment from the bank and and a copy of the check showing Ditech had presented the check to be paid in XX/XX/2017 not XX/XX/2017. If the payment had been deducted at the proper time before the modification paperwork was finalized we would not be behind on the mortgage again. This is the second complaint against Ditech. Back in XX/XX/2017 we had filed a complaint against them because we had applied several times for a modification and they kept stating they did not receive paperwork and such but we had sent the paperwork certified mail and we able to prove that they had indeed received it and shortly after the complaint they had offered us the trial modification. We would appreciate any help in this matter. We have a son with XXXX XXXX XXXX which is taking a huge financial toll on us even with health insurance. It is necessary for him to have XXXX on a daily basis ( his body no longer produces any XXXX ) along with XXXX XXXX XXXX and other XXXX and everything is very costly. We are so upset that we had gotten ourselves back on track just to be put right back in the same situation. Thanks again for everything.

Complaint: I sold my house and while waiting for the closing date I was in contact with Ditech Financial LLC. They informed me that as long as the mortgage was paid in full by the end of the month that I would not be penalized. The closing occurred on the XXXX of XXXX. Payment was not wired to Ditech from the title company until the following day since the closing happened after XXXX EST on XX/XX/2018.
Ditech was paid in full on XX/XX/2018 yet they reported me to the credit bureau as being 30 days late. This is preventing me from purchasing a house due to the drop in my credit score.
I have never been late on my mortgage payment. I have contacted Ditech several times via fax and phone, yet they have claimed to not have complete records of such correspondence. I have hired a lawyer.

Complaint: 1. For the last 16 months Ditect has not responded to 16 certified mails requesting a monthly mortgage statement. ( All dates and tracking numbers available upon request. ) No response at all. They have previously responded to address, email and phone number. No mortgage statement has be sent to me. Our records indicate the entire mortgage was paid in XX/XX/XXXX with the last payment, Check # XXXX. Certified mail w/returned signature : XXXX XXXX XXXX XXXX. There has been no response to the request for the delivery of Deed of Trust or the Promissory Note.
2. Because not statements have been received for 16 months, reviewing the tax statements from XXXX Ct , CO. it appears there was an overage of approximately {$150.00}. Where has this money gone? Was it rolled over into the next years tax account? No refund was ever sent to the mortgager.
3. Physical records indicate payments received i.e. XXXX of the month via certified mail. Their documents to Credit Reporting bureaus show late fees accessed and reported late payments on XXXX of the month. This has happened several times resulting in a decline of over 100 points in my score. This is blatant consumer fraud, the same as the Attorney General of Massachusetts fined Ditech {$1.00} XXXX to settle allegations it had violated Massachusetts debt collection laws. This is in violation of the F.C.R.A.
4. It has been necessary to consult council and we are proceeding with legal actions against Ditech. They refuse to release Deed of Trust although all principle has been paid. According to our records, accompied by monthly certified mail receipts, there are no late fees. Each month was paid in full before the due date. We pay the insurance, and because of no response from Ditech, can only guess where the current tax escrow is.
