Complaint: The property is in foreclosure by the 2nd mortgage company. We have filed bankruptcy but have a buyer for the property. We have been trying to obtain the Payoff Information from Ditech Mortgage with no results. If we do not have it by XX/XX/XXXX the house will be sold at auction.XX/XX/XXXX - I requested Payoff from Ditech 's bankruptcy dept and was told it would take up to 10 days. On the XXXX day I followed up only to find out the request had been cancelled because they could not send it to me ... .it would have to go to my lawyer.
In this same time frame the Escrow company ( buyer ) was requesting the info as well. They were told that they would need the last 4 digits of our SSN 's. Gave them that, they submitted the request. This request was cancelled as well because now we were being told that they needed to submit a form with our signatures.XX/XX/XXXX - Followed up again. Only to be told that the prior requests were cancelled. They would take the request again and put a 3 day rush on it. Was also told they could ONLY send it to my lawyer. I verified the address on file. It was correct.
Escrow company ( buyer ) requested again as well. Faxed signed authorization for the request. Ditech could confirm that they could see the request, but that it was still pending.XX/XX/XXXX- Followed up again - Requests still pendingXX/XX/XXXX - Followed up again - Requests still pendingXX/XX/XXXX - Followed up again - Requests still pending XX/XX/XXXX - Followed up again - Requests still pending XX/XX/XXXX - Followed up again - Was told they JUST received the request from the Escrow company onXX/XX/XXXX and that it was pending. They could not confirm where in the process the request for the payoff to be sent to my lawyer was. Was told that they would put a rush on this new request.
I am at a complete loss here. I actually have a buyer for the property and would like to get this resolved. If this does not get taken care of the 2nd mortgage company is selling it at auction.

Complaint: In XXXX Greentree LLC was whom I made my payments too. The hid checks and charged me late fees. I had been trying to do a loan modification.., It took me two years and 8 applications. I finally got a mediator to assist me so they would stop with this deceit. When the banks received the money from the government XXXX XXXX XXXX hid me so deep that I had no IDEA they had my mortgage. In XXXX I became XXXX XXXX. And was XXXX at XXXX Hospital . They called me to collect XXXX XXXX I was short on my mortgage payment. They constantly harassed me. My point is I received a call that there was a lawsuit against them. It was to late when I reported them. The gentleman told me to file a complaint. I now sit with a {$62000.00} deferred balance that should of been forgiven. Being the dishonest company that they were. I challenged it and they told me. It was like driving a car off the lot.. It depreciated when you drive it off the lot.
I have been sick with XXXX XXXX for 7 years now. And I have finally had remission. I am back on my feet and trying to resolve these issues.
XXXX XXXX holds my mortgage and Ditech took over XXXX XXXX. That's to whom I make my payments too.
I am not sure what to do. I know this whole mess is the deceit of a company and their employees who made profit off there collections.

Complaint: This case involve sending a principal payment of a $ XXXX cashier check funds received by Ditech ( XXXX XXXX XXXX, XXXX XXXX, SD XXXX ) on XX/XX/2018 to my loan Acct number XXXX and it is being held in an unapplied funds account with them. The loan principal amount on the day of record was {$120000.00}. I also requested in my correspondence that Ditech complete the loan pay off with my escrow funds currently in the amount of {$710.00}.
Ive attempted to resolve this matter several times with no success. On their statement sent out yesterday, it actually notes their Misapp. Below are my resolution attempts.

Complaint: I contacted Ditech on XX/XX/XXXX advising of an unexpected financial setback and to request payment deferral for XX/XX/XXXX and XX/XX/XXXX as this would allow me financial recovery and put me back on track with my Ditech mortgage. The lady that I spoke with ( name? ) took the time, as did I, to process the deferral request by phone. I was assured of approval over the phone. Since this initial phone call I am being bombarded with repeated " Loan Modification '' forms. I have told them repeatedly DEFERRAL ONLY. Not interested in changing/modifying my loan! I checked back with Ditech on XX/XX/XXXX before next payment due date to ensure the phone deferral was completed. It is then when I was advised by XXXX that it was denied! I then found that my monthly income was noted on my initial deferral request in XX/XX/XXXX incorrectly. She indicated my income as being $ 500+ more than my actual amount provided. So.. XXXX and I went through another phone deferral process. Then, on XX/XX/XXXX I returned a Ditech call from " XXXX '' questioning payment status. I told him about the last deferral update request made with XXXX and his response to me was, " I'm the account manager and don't know nothing about no XXXX ''! So this was my 2nd Wasted deferral attempt. I also received a typical letter from Ditech dated XX/XX/XXXX regarding deferral paperwork with a paragraph that reads in bold, " If you were approved for deferral during a phone conversation with your account representative submitting additional info as referenced is voluntary. You may, without submitting any additional info, continue with agreed upon terms as discussed ''. Why are my phone deferral requests not acknowledged by Ditech? Why the constant deception? XXXX then agreed to another phone deferral attempt for XX/XX/XXXX-XX/XX/XXXX. For the record, I made a monthly payment with Ditech on XX/XX/XXXX and the monthly XX/XX/XXXX payment of XXXX was accepted with no account concerns or issues given by XXXX ( payment representative ). I then continued to submit all hard copy paperwork via certified mail as I was later advised on my 3rd request with XXXX that it was needed, regardless of what is stated in writing. I sent all p/w via certified mail on XX/XX/XXXX and called days later to confirm receipt. I was advised by XXXX that they didn't have it, so it wouldn't be processed. I then received a letter from Ditech dated XX/XX/XXXX requesting more information in addition to what they have received. (? ) They had indeed received the certified paperwork. Throughout this time consuming, troublesome, stressful process, I have received many phone calls from many different reps and not one has any knowledge of account status whatsoever other than it's overdue! When I return a call and begin expressing the issues, we're disconnected. This is a recurring issue with Ditech. When we are in the process of addressing and solving my loan issue that is completely solvable, we disconnect. I have been unknowingly explaining it away as a bad connection on my end so they have increased using the " bad phone connection '' as an excuse on the XXXX report. I have since checked with my carrier and there is no reason whatsoever that we would be disconnected from my end. When I immediately return the call, the rep that was helping me is NEVER available so the process starts all over again with every call. This is extremely stressful.
Also, on XX/XX/XXXX I submitted the mentioned XXXX XXXX XXXX report explaining my situation and lack of any meaningful communication with Ditech. I even began sending them emails of concern via their online site. They would acknowledge my email but never respond! In their XXXX response they blame my phone for communication disconnects. There's been a lot of frustrating back and forth with no solution. The deferral deception began in XX/XX/XXXX. It's now XX/XX/XXXX and they still are deceiving and misleading me. I have tried all communication possible but still to no avail.
As for calls, last but not least, on XX/XX/XXXX I spoke with another rep, XXXX, only to be told that " for some reason they haven't processed my deferral and since it's been a while, we need to do it again. '' I kindly accepted. This is deferral request number 4 and it takes appr an hour to complete. I was advised by XXXX that I was approved and all I had to do was pay past due insurance and it would all be done, complete! I was so very ecstatic and relieved. As we continued to make the insurance payment the call was disconnected. ( again ) I immediately called back and as always, '' he's not available. '' ( again ) I then received a letter on XX/XX/XXXX stating that I owe {$400.00} for insurance so I mailed a money order to Ditech for that amount. I had forgotten of my XX/XX/XXXX payment made of XXXX. It was decided in XX/XX/XXXX to use XXXX of that payment toward insurance leaving mortgage payment balance of XXXX. This should have been used for insurance but I mistakenly mailed the money order for payment. I need Ditech to account for the {$390.00} left over from my XX/XX/XXXX payment. For good measure I phoned them moments ago only to be advised by another totally unknowing rep that, " I see no deferral requests and no money order! '' The one that I sent to pay insurance ( overpay ) on XX/XX/XXXX.
But she did see where I applied for deferral in XX/XX/XXXX. (? ugh ) I then stopped the call. I can't take anymore of the deception and complete lack of knowledge of my account There numerous lack of service and deception details but hopefully this is enough to solve the matter at hand.

We feel we have been treated very unfairly not only by Ditech Financial LLC ( whom we do NOT have any signed Loan Documents or Contract 's with ; but by their Attorney, XXXX XXXX XXXX XXXX of XXXX, XXXX , & XXXX, XXXX.
the letter see received, saw on XX/XX/XXXX from XXXX XXXX XXXX XXXX of XXXX, XXXX , & XXXX XXXX dated XX/XX/XXXX states : Pursuant to 15 USC 1692g. you are given the following notice : Ditech Financial LLC by and through its servicer, Ditech Financial LLC is the creditor to whom the debt is owed.
1. Ditech is not the Creditor.
The Creditor on the Mortgage Loan is XXXX XXXX XXXX XXXX and they are no longer involved in any Mortgage transaction involving our original Loan Agreement.
According to FDCPA Definition of a Creditor ( 4 ) ; 1692a. Definitions ( 4 ) The term " creditor '' means any person who offers or extends credit creating a debt or to whom a debt is owed, but such term does not include any person to the extent that he receives an assignment or transfer of a debt in default solely for the purpose of facilitating collection of such debt for another.
Ditech did not offer or extend credit creating a debt. Consumer had no offer to accept. And there was no performance as a Creditor as Ditech did not offer or extend credit to create a debt.
In my reply to the Attorney dated XX/XX/XXXX, I asked for proof of our Signatures showing a Contract or Agreement we had with Ditech Financial LLC.
The Lawyer responded with with unofficial copies of the original Mortgage with XXXX XXXX XXXX, and no documentation of proof we have any Creditor/Consumer agreement with Ditech Financial Services, LLC. as I requested they send me! This letter we also did not receive or see untilXX/XX/XXXX, dated XX/XX/XXXX.

Legal actions by debt collectors ( a ) Venue Any debt collector who brings any legal action on a debt against any consumer shall ( 3 ) in the case of an action to enforce an interest in real property securing the consumer 's obligation, bring such action only in a judicial district or similar legal entity in which such real property is located ; or ( 4 ) in the case of an action not described in paragraph ( 1 ), bring such action only in the judicial district or similar legal entity ( A ) in which such consumer signed the contract sued upon ; or ( B ) in which such consumer resides at the commencement of the action.

3. Every statement or document, including but not limited to Loan Modification Offers etc., we received from XXXX XXXX XXXX XXXX./Ditech Financial, LLC . always made the Statement and Reference they are a Debt Collector.
The FDCPAs definition of a Debt Collector which I believe to also logically include the Term Servicer is ; 1692a. Definitions ( 6 ) The term " debt collector '' means any person who uses any instrumentality of interstate commerce or the mails in any business the principal purpose of which is the collection of any debts, or who regularly collects or attempts to collect, directly or indirectly, debts owed or due or asserted to be owed or due another.
4. How can Ditech Financial LLC be both the Creditor and a Debt Collector/Servicer?

As I was reading through the Fair Debt Collections Act I found these regarding False or Misleading Representations ( 2 ), & Furnishing Certain Deceptive Forms ; 1692e. False or misleading representations.
A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section : ( 1 ) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.
( 2 ) The false representation of ( A ) the character, amount, or legal status of any debt ; ( stating Ditech Financial LLC is the Creditor ) 1692j. Complaint: I receiived a letter from Ditech Mortgage regarding refinancing of my home loan in late XX/XX/XXXX. I had about four years to pay off my loan, and inquired about the HARP loan. I was assured by everyone I spoke to that if I refinance it would be under the HARP loan and that within a year I could refinance at a guaranteed reduce loan rate. So, I decided to do the refinance in XX/XX/XXXX. I extended it for an extended time, because I wanted to give myself a year to catch up on other bills, and I knew when the year was up my rate would at least be a point or two lower, and I would go back to my original payment.
XX/XX/XXXX I called just to ensure when I could begin that refinancing process. I was assured in XX/XX/XXXX I could do my refinance with the HARP loan. So, I call again closer to the date in XX/XX/XXXX and I was told I did not have a HARP loan. I was upset and they transferred to a number where no one picked up the telephone. I called back on XX/XX/XXXX to once again to ask about my HARP loan. I spoke to a young man named XXXX on XX/XX/XXXX around XXXX XXXX I asked him to confirm that I did have a HARP loan. He said yes you do and I am eligible for a refinance. Then I said, could you send me proof of my loan being a HARP loan. He puts me on hold and comes back and says sorry you loan is not a HARP loan. I told him you just told me it was. I said I wanted to speak to a supervisor. She came on line and told me I never had a HARP loan. I told her that is not true. I was told by every single person I spoke to up to the signing of the loan I had a HARP loan. This young man just confirmed I had a HARP loan. Now you tell me I do not. She then begins to tell me they have not done HARP loan in years, which is a lie.
The mortgage document I signed does not show HARP loan on it. I was not aware that it had to be stated, because I was assured by every single person I spoke to that it was a HARP loan. I was not asking for a hand out nor any special services. I was misinformed and blatantly LIED to about my loan from every Ditech employee I came in contact with. I want the loan I was promised a HARP. I am an American citizen, a veteran and a mother and grandmother. It is disgraceful how Ditech employees blatantly and continuously LIED to me. It made absolutely no sense for me to refinance with four years to pay off my mortgage in full, without a promise of a get. That get being a HARP loan with a promise of points taken off ( lower interest rate ) after a year.
Please help me resolve this issue. I have never been in such a position before in my life. I was a paying customer of theirs for quite sometime and for such blatant lies is making me so sick. How they sleep at night is a mystery to me, because I am sure I am not the only person they have done this to.
Thank you and I just want what I was promised. My lower rate after one year which was XX/XX/XXXX. Please let me know the next steps.

Complaint: I first applied for a loan modification and mitigation last Fall. After several attempts at getting all the required documents and information to Ditech Financial LLC, they finally informed the application was complete in XX/XX/XXXX. The mitigation is still in " research and underwriting '' as of XX/XX/XXXX. I call them twice weekly and they repeatedly tell me they will contact the supervisor or director to " escalate '' the decision. No one has given me further information or any indication of possible outcomes. I'm mailing a QWR and meeting with my lawyer next week in hopes of resolving this matter asap.

XXXX XXXX XXXX XXXX, XXXX XXXX Customer Service COMPLAINT Collections Dept XXXX XXXX Insurance Dept Final attempt on XX/XX/XXXX to contact Ditech regarding my mortgage account.
Loan XXXX was purchased by Ditech. Original loan holder XXXX XXXX XXXX.
I have experienced the worst ever management of my loan, from XX/XX/XXXX-2 XX/XX/XXXX Issues : 1 ) Force of insurance When insurance on the property was in place for 1 year date of purchase as stated in the closing and provided more then 6 times the declaration to Ditech by fax and call from agent at XXXX current insurance provider.
XXXX Department was contacted with a complaint of stacking insurance by XXXX XXXX XXXX XXXX. Ditech states insurance was expired or canceled.
Result : XXXX sent certificate of cancellation and no cost, monies will be funded. XXXX XXXX agreed it was an error. Ditech went unpunished. Time given to Ditech to contact the department of finance, reply back for me to contact Ditech direct to resolve the issue. while waiting correction and credit back to loan XXXX which did not happen as promised. My perfect pay history now shows force of insurance and default of payment.
2 ) Reports requested for XXXX property the end of XX/XX/XXXX around XX/XX/XXXX request was made. XX/XX/XXXX report arrived incomplete. 2nd report request which arrived in XX/XX/XXXX Annual Escrow Statement Arrived.
Ditech was contacted with errors on escrow reports as to the monies that was received by Ditech from XXXX XXXX was not reported in the report given.
Results : I XXXX contacted Ditech 's customer services dept asking a supervisor to contact me XXXX t XXXX. No contact made by Ditech. I called Ditech ask to speak with someone who can help me review my loan. Advised no one was available their in a meeting ask that someone contact me. Clear stating how many time I have place a call with no reply back.
I contacted XXXX XXXX XXXX XXXX ( manger ) XXXX XXXX as her to review my loan and assist me with contacting Ditech. 2-way conference call was made with XXXX/XXXX and claimed supervisor for Ditech. File is being worked on. 1Week few days I contact XXXX XXXX again with the same complaint now Ditech sending different statements with lot of different amounts on them. Ditech has bankruptcy, false claims of debts, using other names during business, reporting information using credit bureau, harassment, force of insurance on insured properties, corruption. Misleading customer with customer service personal acting as agents or account specialist without license or skills to comply with state and federal laws, or answer customers.
