Complaint: I had a loan with XXXX had problems and stop making payments then contact XXXX to work a solution got offer a trial period finish 6 month trial period and no answer from XXXX about loan modification transfer to Green Tree where I was offer a loan modification where my principal increase in over {$140.00} and the interest increase to 6,125 % no answer from Green Tree about what program was used for my Loan Modification. I pay 18 months and after the 18 payment got inform that my taxes for 2 tears where not paid hard to understand since the 2 years in question where not consecutive my payment was increase in the amount of {$1200.00} a month making my payment from {$4200.00} to {$5300.00} ask the bank to review this new numbers and I was advised to continue making new payments till they work something out to return to the original payment which was almost % 50 of my income. nothing happens for few months and suddenly Green Tree said for me to make a payment because they have arrive to a new terms for my Modification That was a LIE they just closed for business and open with a new name but send a letter telling me that nothing change. at this moment I hire an attorney and initiate a loan modification submit paperwork many times and after 10 months My modification got denied BECAUSE the loan was past due more than 6 months After this attorney I have file 3 more modifications with 2 different attorneys and one with the HUD help, my last denied was last week they did not display the new guidelines for the denied just said that the new P & I its higher than old P & I Consistently XXXX green Tree and now Ditech used the same tactic delaying the paper work and denied the modification I see consistently I have Not received a fear treatment and after many attempts to solve the problem they have not respond in a way beneficial for both parties. I have copy of all documents from XXXX to green Tree to Ditech if necesary

Complaint: I contacted Ditech in XX/XX/XXXX following Hurricane Harvey. Ditech offered a 90 day forebearance and stated they would send me out forebearance documentation. As of XX/XX/XXXX, I never received the forebearance documents but instead began receiving foreclosure notices from an attorney out of XXXX stating my home is in foreclosure and I had 30 days before I loose my home. I informed the attorney 's office that I was not aware of a foreclosure due to being in a forebearance and she suggested contacting Ditech to remedy the problem. I contacted Ditech several times ( two to three times a month dating back to XX/XX/XXXX ) after that and was told the foreclosure code was an error and would be escalated to a manager to correct ; however, Ditech never corrected the error resulting in me receiving all types of solicitation notices about the home being in foreclosure. Due to Ditech 's error and the company constantly stating not to make a payment until the error was fixed has me now with over a {$5000.00} mortgage payment. I have started the process for a loan modification, which again I do not received any correspondence from Ditech and the only way I know of what's happening with my loan is when I call. I sent the paperwork for the loan modification in XX/XX/XXXX and when I called to get an update I was told I was missing documents. I was levied and explained to the agent that I had not received anything from Ditech informing me of the missing documents. I also told the agent the same thing I've been staying for months, which is I do not get mail, phone calls, or any type of notification from Ditech and I feel the mortgage company is purposely trying to take my home. As of today, XX/XX/XXXX the error code is still showing in Ditech 's system even though every agent has stated the error would be fixed. I spoke with XXXX and then the supervisor XXXX on XX/XX/XXXX. They were rude and unprofessional on the phone and insulted me throughout the call. I explained to them the error but was told my both of them that I was mistaken and the foreclosure was correct. I told XXXX if he would read the notes from XX/XX/XXXX to present he would see the error and I told him about Ditech 's lack of communication regarding anything with my home. He stated I will never receive anything other than informational documents due to never reaffirming the property after a bankruptcy I had over 7 years ago. This is the first time I am hearing of this and I told him that. He finally read the notes and saw where the forebearance was approved in XX/XX/XXXX and the code was entered in error. My complaint is I believe with 100 % of my heart and mind that Ditech is fraudulently trying to foreclosure on my home. I asked XXXX what legal recourse do I have against them foreclosure if I am never informed that there is a problem. He could not answer me. These fraudulent tactics can not continue! The government needs to do something about this company. I am a XXXX XXXX survivor and have been in remission for a little over a year. This stress is unhealthy and unwanted by me. This is the second time Ditech has tried a malicious attempt to fraudulently foreclosure on my home. Enough is enough. I filed a company with CFPB in XX/XX/XXXX when they kept returning my mortgage payment I mailed to them for three months and then Ditech started the foreclosure process for nonpayment. I contacted CFPB and they corrected their fraud and now this. Please help consumers stop this company from all of these illegal practices.

Complaint: For the tax year of XX/XX/XXXX, the District of Columbia Office of Tax and Revenue sent me a property tax bill of {$10000.00} ( for the second half of XX/XX/XXXX ) because they incorrectly deemed my property as vacant. Accordingly, my escrow service ( Ditech Financial LLC ) paid the amount of {$10000.00} to the District of Columbia within the appropriate time-frame. The payment was posted on XX/XX/XXXX. I subsequently contacted the District of Columbia and submitted the appropriate paperwork to prove that my property was in fact occupied ( and not vacant ) and the District of Columbia issued a corrected property tax bill in XX/XX/XXXX reflecting what the charge should have been for the second half of XX/XX/XXXX : {$1800.00}, and also acknowledging the amount of over-payment : {$8800.00}. After receiving this corrected bill and acknowledgement in XX/XX/XXXX, I contacted the District again to ask how I can get refunded for the over-payment. The District told me to have my escrow service request the refund from them since the escrow had made the actual payment. So in XX/XX/XXXX, I contacted Ditech Financial to request the refund. They told me that they do these types of requests all the time and that they work with the District frequently and were very familiar with refund process. Ditech told me they would request the refund from the District and the refund would probably take several weeks to process. XX/XX/XXXX rolls around and I receive my Escrow Analysis for the XX/XX/XXXX tax year from Ditech and they tell me that because of the $ XXXX payment in XX/XX/XXXX, my escrow was in arrears and my new monthly payment as of XX/XX/XXXX would go up about {$800.00}. I called them that a refund should have been requested and processed by now in order to avoid the massive increase in my monthly payment. Ditech claimed they requested the refund from the District but still had not heard back and that the District was likely still processing it. I did not trust this response and contacted the District myself and was told that Ditech never requested a refund at all. The District checked all the way back to XX/XX/XXXX and did not see any request from Ditech regarding my property. So on XX/XX/XXXX, I contacted Ditech and told them that they never made a refund request to the District. Ditech told me they had faxed the request in XX/XX/XXXX and numerous times after that. I called back the District and they said that they don't process fax requests and that all refund requests must be submitted via email at : XXXX. I called back Ditech and gave them this email and told them that they should have emailed the request instead of faxing it. Ditech claimed that they have a working relationship with the District and always fax their requests. Ditech also refused to contact the District themselves to verify that I was correct or to even directly speak with them to see what had happened, even after I had begged them to help me. However, Ditech told me that they would now submit the request via email. I called Ditech back the following day on XX/XX/XXXX to confirm that they emailed the request. They told me that they added the email to their notes and that it would go through at the end of the day. On XX/XX/XXXX, I contacted the District to see if they finally received my refund request from Ditech via email. They told me they had not and checked their records all the way back to XX/XX/XXXX and XX/XX/XXXX. I called Ditech and they told me that they could not determine if they had sent an email and their notes indicated that they would FAX a request. I told them this was unacceptable and they refused to connect me with a supervisor and claimed their back-end " research '' department was handling the issue. I gave them the email again and begged them to send the District an email requesting the refund and they told me to call back the next day to see if the email would finally be sent. This is unacceptable and they are refusing to help me get my refund. At this point I have overpaid the district by over {$8000.00} via my escrow account and am paying an extra {$800.00} a month on my mortgage to make-up for the deficit. I dont know how much longer I can afford this massive payment and Ditech is not assuring me that they will get me my refund. They refuse to email the District per my instructions and even refuse to contact the District themselves which they should have done from the very beginning. The District has been very helpful and accommodating to me, assuring me they will process the refund once Ditech submits the request, but Ditech refuses to do so.

Complaint: In preparation for closing the sale of my current home I contacted Ditech, my mortgage company, for payoff information approximately six weeks prior to the closing for payoff balance, etc. I asked if that month 's payment and the next, if the closing had not taken place by then, could be rolled into the payoff total that I was receiving. That was done, however, now that Ditech mortgage has been paid in full and I am trying to be approved for a new mortgage I have learned that Ditech posted two months late payment to my credit score that came in the week I was to close on the new mortgage. This, of course, has caused the approval to be delayed which may cost me the purchase of my new home. I was ill advised by Ditech and have pleaded with Ditech to remove these late payments but so far have not been able to succeed. I have owned homes for over 40 years and have never had late payments before this posting.

Complaint: We are an existing customer of Ditech for our home mortgage. In XX/XX/XXXX, we refinanced, via HARP and had over {$500.00} taken off our monthly payments. So we just closed one loan account and opened another within the same company. After 6 months, the Escrow Statement came and we were {$4100.00} short in the escrow account. This is impossible since we had almost {$8000.00} put on top of our mortgage when we closed on the new loan, {$3100.00} of which was allocated to the escrow account. We started calling the company in XX/XX/XXXX to have this corrected and have the escrow account analyzed and rerun. This did not happen and we got another escrow statement and now are short {$3500.00}. We also found out that our XXXX for our taxes were underreported in XXXX because at closing Ditech paid our township taxes as well as the Title Company. The town kept the monies and just kept moving it forward. However, since Ditech did not pay the entire tax amount, the XXXX is short one quarter worth of taxes - {$2000.00}. To this day we are still short that money. We called days in a row, starting on XX/XX/XXXX, one day 5+ hours on the phone going over the tax assessor information and payment history for the new loan. When the loan was closed on XX/XX/XXXX, {$3100.00} was put in the escrow account. On XX/XX/XXXX, the money was taken out of the account, putting the escrow at XXXX!!! The description next to it says " - {$3100.00} XXXX Esc to Mortgagee Dis. '' Rep after rep and supervisor after supervisor and no one will help us resolve this. We finally got a supervisor, XXXX XXXX XXXX to give us her e : mail address so we could send the payment history from our township tax assessor and she had told me that she definitely saw the problem and would help us fix it once she reviewed the tax document. As of this date and sending 3 follow-up e : mails to her, we have not heard anything back from her. If we call the XXXX number again, we would have to start from scratch and explain the issue and it's quite complicated unless you have reviewed all the documents. As soon as we explain there is also a tax issue, without the customer rep even saying hold on, we are immediately transferred to the tax dept. that can only verify the payments that have been made to the mortgage and that's it! They can not speak to the escrow, or the gross mistake that was made as soon as the loan was closed. Also, it was explained to us, at the closing, that we would not be starting the 30 year clock over with HARP, that we would just be flipping the loan where we currently stood, which was at 20 years. Not only are we paying more, we started the clock over for 30 years and had {$8000.00} charged in closing costs, put on top of our mortgage and NO ONE at Ditech can tell us where that money went, especially the amount allocated for the escrow. The $ XXXX monthly savings for our mortgage is creeping back up to that exact amount and the hours of time spent refinancing, stress trying to get it fixed was not worth it at all. At this point, we don't know where to turn to get this resolved. Please help us to get our account corrected.

Complaint: My mortgage was sold 4 times since original purchase date of XX/XX/2004. I have been making payments automatically from my bank account since purchase. Just realized that my credit score is around 600s and there is no reason why my score can be that low as I am never late on payments. Very good payment history with the lenders paid off multiple cars multiple times no issues there either. I checked to see what makes it so low, come to find out DITECH I guess previously called GREEN TREE who are known for XXXX homeowners for many years and tons of complaints online they have been reporting me late on my mortgage every other month or sometimes multiple months in a row for over a year. I called the company and I was told because my payment changed and it was short $ 10- {$15.00} for a few months instead of notifying me that the payment is short they start reporting them late and would not apply the payments for that current month, hold the payment until I pay the next month then they cover that shortage from that months payment apply that to previous month and make the full payment and report me late for the current month. Because I don't check my credit as often as I should I never realized they ruined my credit and because of them I pay high interests on cards and would not qualify for a loan which I was about apply for a loan for a commercial property for my business. So, I called them they said I am late on payments and that I am one month behind, and I told them I am never late on payments and that can't be true, I told them I have every single statement since I purchased the house and confidently I said I can prove them they are wrong after multiple calls realizing the tone in my voice they realized that they cant fool me they said not missing payment but my payments were short then they said I have {$560.00} unapplied funds, because I was short for $ 10- {$15.00} for multiple months instead of letting me know writing a letter to cover the shortage they chose to let that ad up to a total of {$210.00}. I always make $ 10- {$15.00} extra every month just to be safe and not that it is much but thinking at least it would go to principal. But what was I thinking it wasnt even covering my payments according to them, But why would they do this because they want to ruin peoples credits then they can charge higher interest rate as many mortgages are adjustable rate including mine, and there are stories similar to this online from many homeowners. So the total of {$210.00} supposedly that I owe them is not an issue I am sending that payment right away just send me all the statements where I was short but I am sending you that payment right away just write a letter to credit agencies that I wasn't actually late there was a shortage which was paid in full, and they said no. I said that is not fair ruining honest peoples credits for such a small amount especially when the mortgage has been paid since 2004 even with all the mortgage crisis there was no problem with the payments and they said no. I tried to speak with a supervisor and they actually put me on hold for minutes then the line got disconnected. I called them again of course start to explain everything from scratch and this time I asked them to also provide me with my note as these people are the forth mortgage servicer since purchase, I wondered if they even have my note. They said they are emailing it to me as we speak after confirming my email address and said they will send a copy in the mail too and still have not received anything neither on my email or regular mail and it has been more than two weeks. Before we hang up I told them if this is not going to be resolved I will seek other options and one being writing a complaint with Consumer Financial Protection Bureau, and the person on the phone was very careless and I was told I can do what I choose to do. So as a conclusion, DITECH previously Green Tree ( I assume same company ) intentionally ruins peoples credits, they want you to fail so they can benefit from it and they have no willingness to solve the problems that they've created in fact they seem happy that they achieved their goal of creating another bad credit customer.

Complaint: On XX/XX/XXXX, I called my mortgage company to ask them to stop paying my local real estate taxes out of my escrow account because I was doing that now. On XX/XX/XXXX, my mortgage company paid my real estate taxes anyway, {$2000.00}. On XX/XX/XXXX, I closed my escrow account so they wouldn't pay any of taxes again. I then had to fight with my City to refund the extra tax payment. They did so by sending a check to my mortgage company on XX/XX/XXXX. XXXX. ( see e-mail confirming that ) So, I then started calling my mortgage company to get those funds. Each call lasted between 15 and 25 minutes. At each call I asked them to call my cell phone if there were any problems with my request. XX/XX/XXXX : they said they received the check but have not yet processed it. XX/XX/XXXX : same story XX/XX/XXXX : they have received it and will process my request XX/XX/XXXX : I was told there was a problem because the funds were deposited into a non-existent escrow account, so another procedure had to be started. And they would expedite my request and I should get it in a week. XX/XX/XXXX : I was told that it takes two weeks to process the request, so it should be done in another week. XX/XX/XXXX : I was told they sent me a e-mail on XX/XX/XXXX with some questions they needed answered. But I did not receive such an e-mail, but what are the questions and I will answer them. They said they didn't know, but they offered to start the process anew. XX/XX/XXXX : I called to tell them I was contacting my state Attorney General. My state attorney general said to file a complaint with the CFPB, so here I am.

Complaint: I am having with my mortgage servicer Ditech, Formerly Green Tree Servicing. They have the same employees from Green-Tree because I was told by an employee after I was abused again on the phone. Im sure that you are aware, but in case you arent Green Tree Servicing was issued over 60 million in fines for bad practices. I am unfortunately one of their customers and I have nothing but issues with them from the time my loan was sold to them. I am first and foremost a human. I became sick. I was receiving abusive phone calls from them every day of the month after the first day of the month. Any dealings with them were starting to be ignored by me and I stopped answering my home phone all together as I was just simply overwhelmed, sick and beginning to break down emotionally. I have a crazier situation in my neighborhood, but it would take a much longer letter to explain. I got a mortgage modification, and after about a year of this modification my mortgage went up in price. I am a human and as a human we make mistakes, so for five months I did not realize my payment went up. Green Tree because of the escrow shortage made it a full payment ( considered it to be that I missed a month-Instead of treating it like escrow. I was told by a supervisor on XX/XX/XXXX & I recorded the phone call that they would not report escrow as being late, yet that is exactly what they did. I had continued making my regular payment on-time, without the escrow increase unaware. When I realized it I immediately started to send extra. Ditech ( formerly Green Tree ) admits I made a payment arrangement with them. After making a payment arrangement how can you continue marking the on-time payment that includes and extra payment towards the escrow late? They admitted I made a payment arrangement with them & yet they continuously mark me 30 days & 60 days late. I was being marked late from XX/XX/XXXX XXXX the whole year of XXXX. I am in possession of the credit report, the printout from the mortgage company of the dates when they received the payments. I am getting no-where on the phone and they are unwilling to take those lates off of my credit. I get the run-around on the phone. These lates are not just marks on a paper, this is my life we are dealing with. Right now I found the perfect house, but I can not get mortgage approval ( its the only thing holding me back ) its urgent as I dont want to loose out on that home, its perfect amount of space, taxes are good, away from this community and private. I am trying to get a better life for my kids, we are currently a family of XXXX in a 860 sq ft home. The private community in which I live is a struggle. While I am grateful that I own a home, and I have a roof over my head, its not a toxic situation and I am asking you to please help me. This is bad practice. Please follow up urgently.

Complaint: I originally got approved to have a home built on my property by a company called XXXX XXXX and later they sold my loan to several other comp, anies every five years my loan get sold, I can remember a few names one is lending tree and now Ditech has the loan. I tried to refinance my loan thru lending tree they said that they don't do refinancing, And here is the kicker a company name lending Tree called me said that they could lower my mortgage payment and they said that I had to send nearly three thousand for fees, so I sent the money and found out that it was a scam the people that was a part of the scam was caught and was sentence to prison, my thing is I called lending tree the number that was on my mortgage payment and later after I hung a scam company under lending tree called me, how did these people know that I had wanted to refinance my loan, I think and know that this was an inside job. I was pressured at the time I signed the contract, I was nearly homeless so I sign the contract because the lady said that if I didn't sign that they would not do another contract if I didn.t sign that one, my intrest rate is very high I tried to refinance again I was told that my contract doesn't allow me at all to refinance and that Ihave to pay the amount of interest until the loan is paid

Complaint: I have a home in XXXX new York. I fell back on my payments due to lack of income and tenants stop paying rent. I tried to modify my loan. However my lender Ditech which is the second mortgage lien on property has refused to help me. My first lien lender modified my first mortgage and I have kept my payments on time for over four years! Ditech has decided to litigate and cause me heavy legal fees instead of modifying my loan. I believe that the bank is violating my civil rights because of my race and religion. There are many of their clients in a similar situation where Ditech Modified their loan without any documents. They gave them a streamline modification. This is unfair and I want to pay and have shown my ability to pay my first mortgage after a successful modification. I should be afforded another opportunity. I can afford to pay {$1800.00}. a month if more is needed I will get it.

Continued payments on the home until XX/XX/XXXX All calls to Ditech starting inXX/XX/XXXXwere greeted with the " home is bankruptcy '' you are not responsible for the debt. They would not assist with any details on how I could save the home from foreclosure and request for modification prior to XX/XX/XXXX were denied because the loan type is a retail installment agreement. Interest rate is 11 %. No one would consider refinancing because of the foundation issues. XXXX XXXX & the Loan Servicer Ditech are predatory companies

Complaint: Background : Ditech sent an Annual Escrow Account Disclosure Statement dated XX/XX/2018 stating that my escrow account had a shortage of {$410.00}. I paid my escrow shortage in full. It was recorded by Ditech on XX/XX/2018. Prior to receiving notice of an escrow shortage, I paid my XX/XX/2018 mortgage payment in the amount of {$1500.00}. This payment was recorded by Ditech on XX/XX/2018. However, due to the shortage of {$29.00} ( monthly increase in escrow ), my XX/XX/2018 payment was applied to principal only.

Complaint: The mortgagor ( my dad ) passed away, was the only one on the loan and didn't leave a will. My mom appears on some documents as third party. Unfortunately the home is on foreclosure and the mortgage company only gave 30 days to come up with the money of the full debt and/or to speak to them regarding the mortgage. However the current mortgage company won't provide any information as to what are my mom 's options as to paying for the mortgage. I'm the older daughter and I'm trying to get pre-approved to get a mortgage and have begun the process however I need time to be able to complete this process and payoff my mother 's loan. We called the mortgage company to try to get information as to what are our options to transfer the loan to my mom 's name and one rep advised to send a copy of my dad 's death certificate which was sent to them numerous times to for it to be updated to the account so that we may be able to get account info but every time we call we get different answers from reps and most of the time they won't talk to us. They said that they will need a will, executive of estate or order by judge but we can't apply for any of these because this process will take way to long and by that time we may lose the property. My mom lives on a fixed income and can't afford to pay expensive legal fees. We are desperate and don't know what to do. We want to speak to the mortgage or their representatives to let them know that we want to save the property and we are working on getting a pre-approval to payoff the loan with them but they won't speak to us.

Complaint: On XX/XX/XXXX i received a letter from my second mortgage company, GREENTREE, that i had been approved on my Home Equity account for a FULL PRINCIPLE FORGIVENESS due to a settlement w XXXX XXXX XXXX and the Department of Justice. the letter went on to state " You do not need to take any further action to accept this offer. Your Home Equity account balance will " AUTOMATICALLY '' be forgiven UNLESS you call us. ( My Bankruptcy atty had been CC 'd on the letter but was never mentioned in the letter. My bankruptcy had been discharged XX/XX/XXXX .i understand i was no longer responsible personally for the debt, but this letter released the property as security for this loan. i still own this property and the first has continued to be current ) on XX/XX/XXXX i received a letter from XXXX XXXX XXXX that Ditech ( formerly Greentree ) had transferred the right to collect payments from me to XXXX XXXX XXXX ... The amount that they intend to collect is {$40000.00} the letter said to send a letter if you dispute the debt which i did. i called and spoke w XXXX XXXX and once again disputed the debt. He gave me his email sent an email XXXX so i sent another correspondence. i was afraid they might start foreclosure proceedings and i am a well known realtor in my community and the thought of reliving my name in the paper kept me up many many nights!!! i am proud to say i have been reestablishing credit. On XX/XX/XXXX i received another letter from XXXX XXXX XXXX that Greentree told them my attorney XXXX XXXX sent the extinguishment letter BACK and therefor the EXTINGUISHMENT WAS NOT PROCESSED!!! ( on the date of this letter the Bankruptcy had been discharged so he was no longer my attorney ... ) Greentree did not have the authority to process or not process the extinguishment. This was decided in a class action lawsuit with the DEPARTMENT OF JUSTICE! The Security Deed should have been cancelled! it has been 3 YEARS that Greentree did not abide by the ruling. i am not an attorney but it is definitely a violation of federal collection laws. i have all documentation that i will gladly send ... any assistance will be greatly appreciated!!!

Complaint: I paid off my mortgage onXX/XX/XXXX by wire transfer- - today isXX/XX/XXXX - - 76 days later they still have not sent the escrow refund for over {$2100.00}. I have called every few weeks to no avail. They have not given me a reason. Just keep telling me they will send an email to their manager. Please assist getting my the refund due to me. I paid them on time for years, send them roughly {$200000.00} in payments and I can't even get a timeline from them on my refund for the amount that was over collected by them.
