Complaint: Green Tree Servicing lost all my personal papers when switching over to ditech receiving harassing phone calls starting at XXXX XXXX. to XXXX tried to call them back they would give me the runaround transfer me tried to say I was behind on a payment I have reference numbers to prove I wasn't found out my money was in lingo they serve me papers 4 court the paper said I was served was not for me they were for somebody else I've got their personal loan information different name wasn't even my name they makes my lawn up with somebody else 's loan I've called several times they said they can't explain it I said I need it fixed now they're trying to put me in foreclosure with somebody else 's stuff

Complaint: Ok Im escrowed in and on XX/XX/XXXX ditech sent out XXXX dollars to XXXX County tax office. They had the parcels mixed up and paid lot number XXXX taxes instead of lot number XXXX which is mine.. I got 2 notices in the mail that my taxes were not paid so I called and did all the foot work myself to figure out where the payment was messed up and what happen. Well ditech sent out my payment of XXXX dollars on XX/XX/XXXX to pay my taxes and they fixed my parcel number in the system. Now they are charging me for the money they sent out incorrectly and making me pay the difference until the refund from the county comes through. I have spoken to the tax office and they have already refunded the money to lot number XXXX because ditech paid XXXX then her mortgage company paid so they refunded the second payment that came through which happen to be the wrong one. Tax office told me that they have already sent a refund and it is out of there hand and ditech keeps telling me they are waiting for a refund and until it comes through I will have to continue paying the larger amount to cover there mess up. I didnt make the wrong payment so why am I being held responsible for paying for another person or companys mess up.

Complaint: XX/XX/XXXX XXXX County reduced my property taxes as I now qualify as a senior citizen. My taxes were reduced from {$7200.00} / year to {$3900.00} / year in XX/XX/XXXX.
Ditech collects escrow to pay property taxes and home insurance. I continue to pay existing mortgage of {$2400.00} till the end of XX/XX/XXXX and into XX/XX/XXXX. This is well above and beyond what I need to pay to keep escrow funded.
XX/XX/XXXX Ditech fails to confirm the tax amount due and sends a payment of {$3900.00} to XXXX County. This amounts to an overpayment of {$3900.00} which was refunded to me by XXXX County later that year. ( see Ditech XX/XX/XXXX Tax Payment attached ).
XX/XX/XXXX Living out of state at the time ; did not receive XX/XX/XXXX's bill so made an electronic payment of {$2400.00} to Ditech. This is the same amount I had been paying for entire XX/XX/XXXXknowing I continue to pay too much.
XX/XX/XXXX Received a bill for {$2500.00} plus {$87.00} late fee. It appeared Ditech thought I had under paid XX/XX/XXXX's bill by {$40.00}.
I am contesting the {$87.00} late fee. This is entrapment! Here 's why : 1.Why wasn't I notified about the alleged {$40.00} short? There was no attempt to contact me to rectify the problem. It should also be noted I have NEVER been late the entire time I've been in this house ( 16 years ).
2.On XX/XX/XXXX Ditech knew they were overpaying property taxes when they sent in the 2nd half of my property taxes. XXXX County assured me Ditech is informed of the new rate. I am notified immediately if my escrow account comes up short for one reason or another. Why am I not notified when the converse is true?
3.In XX/XX/XXXX, Ditech adjusted my mortgage payment and had another opportunity to correct escrow by verifying property taxes and insurance. They did not and seems would rather me continue to overpay as that oversight is in Ditech 's favor.
4.May XX/XX/XXXX's payment is {$2100.00} ( shown attached, it took that long to get a correct statement ). That means I overpaid {$340.00} in every month since my last tax bill was paid. That includes XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX : I WASN'T {$40.00} SHORT, I WAS {$1300.00} OVER!!!!!!! And I get fined????
In an effort to resolve this issue I have been in touch with customer service on a number of occasions.
Call # 1 : XX/XX/XXXX XXXX told me she would put in a request to have the late fee withdrawn and my escrow corrected. Nothing happened.
Call # 2 : XX/XX/XXXX XXXX told me they were sending me a new statement. Was obvious nothing was going happen.
Call # 3 : XX/XX/XXXX - XXXX put me in touch with the tax department where I talked with XXXX who attempted to fix the problem. I later received a bill for {$5100.00}. Huh????
Call # 4 : XX/XX/XXXX XXXX spoke with XXXX and XXXX who then fixed the problem. FINALLY!!!
From the above exchange, it becomes obvious Ditech 's operations are inefficient and prone to errors. Which brings me back to the {$87.00} late fee PLEASE REMOVE IT. Playing dumb is no excuse for overcharging.
p.s. I can not find a single positive review, among thousands, about Ditech on the internet. If I was Ditech, I'd make customer service my # 1 priority as it is adversely affecting the bottom line.

Complaint: In XX/XX/2017, ditech changed my escrow amount and did not notify me. Due to a {$60.00} adjustment of my taxes, they changed my escrow amount, but did not notify me of the change. They claim to have mailed me a statement saying so, however, I did not receive any statement from them outlining the escrow change.
I made my regular monthly payment of {$2400.00}, as usual, unaware that now ditech was expecting a monthly payment of {$2500.00}, due to adding an additional escrow, and so considered my monthly payment {$43.00} short.
ditech did not contact me at all during this time to inform me of the shortage, and I was unaware until I received my next statement, upon which I immediately called to pay and correct the difference. However, ditech has assessed me a {$77.00} fee over a discrepancy of {$43.00}.
ditech 's customer service representative told me over the phone that they were charging the fee simply " because they could '', and said that ditech had no obligation to inform me that my escrow had changed. They refused to remove the fee, even though I have always ( and continue to ) pay my monthly payment on time, that I was unaware that they changed my escrow without informing me, and that the fee of {$77.00} charged was almost double the disputed amount of {$43.00}. ditech 's rep said I had agreed to the fee when I received my mortgage, which is completely untrue, as ditech purchased my mortgage from another company and I have never filled out any paperwork with ditech or my previous lender authorizing such an egregious fee amount.
ditech refuses to remove the fee, and has repeatedly begun calling me and sending me collection letters over the {$77.00} late fee.
ditech 's abuse of escrow to charge a 178 % late fee is tantamount to loan sharking, especially given they claim to not need to notify me about changing my monthly payment. Having read other stories online, this seems to be a common practice ditech is using to abuse mortgage lending and make profit by changing escrow amounts without notifying customers and then charging high late fees.

Again Ditech is violating codes of the California civil sections 2924.11 2923.7 and the are in violation of the business code section 17200.et seq and most of all ACCOUNTING!!

Complaint: I paid my mortgage for the month of XXXX. There were issues with paying over the phone. I mailed in my money order XX/XX/XXXX. I still haven't received the money order back. I have never ever been late on any of my mortgages or credit cards. I was excited about Ditech. However, I see I'm overpaying. I have XXXX children at home and a XXXX in the hospital XXXX XXXX XXXX XXXX. This company hasn't even tried to help us lower our mortgage payment. Now they reported we are 30 days late. I strongly believe they reported this late payment to prevent us from refinancing with a new company. My mother and I have never ever missed one payment with any company. My mother had a credit score of XXXX and now it's XXXX. This is such a horrible experience. Even though my money order hasn't been returned. We still paid XXXX mortgage for the second time XX/XX/XXXX. We scheduled another payment for XXXX in hope the money order would return in time. This negative credit report in inaccurate. Also, the company sent us foreclosure documents already instead of asking us what happened. This is very traumatic. Why would we receive foreclosure assistance? Lastly, my kids told me someone from Ditech left a note on the door to call them. This is very invasive. I am very nervous about the mortgage company coming to my home.

Complaint: I've just placed a complaint with the CFPB and the company stated they fixed my issue and it's still NOT fixed. Complaint # XXXX from XX/XX/XXXX. I just sent a complaint that the deceptive payment system will not correctly applying my payments. They replied that they fixed the issue causing this. We'll they haven't I just applied my XX/XX/XXXX payment and once again it's not fixed now it's completely applying my entire payment straight to all principal only. It should be paying my XXXX to XX/XX/XXXX regular payment and the XXXX to principal. This company is nothing but headaches and deception. How is this even legal? I need my issue fixed to apply as it should my regular payment and the extra to principal it's not rocket science we're in XX/XX/XXXX!

Complaint: When closing in XX/XX/XXXX, Ditech did not explain that I would have to file for homestead exemption in my state. I only learned of this AFTER they raised my payments in XX/XX/XXXX to cover the " underage '' for payment of county taxes. I had to contact the county, fill out and file paperwork to get it backdated. I did so, but it took the county a few months to process everything. In XX/XX/XXXX, Ditech did two analysis, but only sent a check for {$180.00}, even though they had received a check from my county at the end of XX/XX/XXXX or beginning of XX/XX/XXXX. I did get a reduction in my mortgage payments in XX/XX/XXXX. I called FOUR times to have them send the check to me ( the county had to send it to Ditech for reimbursement to us since Ditech had sent the county the money ). EACH time I was told NO other analysis had been run and that they would escalate it. This is approximately $ 1,400-plus that they have kept over the 30 days allowed. It wasn't until my wife blasted them on their XXXX page that we had any positive communication. She posted on XX/XX/XXXX, and again on XX/XX/XXXX. The claimed to have mailed a check, but as of XX/XX/XXXX, no check has arrived. I believe they have violated federal law on keeping the money longer than 30 days and refusing to refund the money, even though they acknowledge " the check is in the mail. ''

Complaint: A request for an Unemployment Forbearance Plan was submitted on XX/XX/XXXX. The 5-month Unemployment Forbearance Plan was approved XX/XX/XXXX ( effective XX/XX/XXXX through XX/XX/XXXX in the amount of {$390.00} ). However, on XX/XX/XXXX a Flex Modification Trial Plan Notice was received dated XX/XX/XXXX with an effective date of XX/XX/XXXX. A borrower solicitation call was also received from Ditech on XX/XX/XXXX in which the Loss Mitigation Representative ( XXXX ext. XXXX ) indicated the loan was not on an active Unemployment Forbearance Plan and the loan was not eligible for an Unemployment Forbearance Extension. I advised the representative that the next plan payment was due XX/XX/XXXX. In addition, I advised that I was still unemployed and according to XXXX XXXX guidelines ( D2-3.2-02 : Forbearance Plan for Unemployed Borrowers effective XX/XX/XXXX ) the Servicer ( Ditech ) must evaluate the borrower for an extension of the Unemployment Forbearance plan if the borrower remains unemployed during the final month of the Unemployment Forbearance plan. I also advised the Servicer must receive written approval from XXXX XXXX prior to offering an Unemployment Forbearance plan with an initial term longer than six months.

It appears Ditech erroneously cancelled the Unemployment Forbearance due to the Modification Trial Plan Solicitation mailed XX/XX/XXXX.
