Complaint: I applied for a va cash out refinance with a broker on XX/XX/XXXX and was quoted a 3.5 interest rate on his paperwork loan estimate. On XX/XX/XXXX, I got the disclosures and paperwork from ditechs showing XXXX closing costs and a 3.625 rate. My broker told me we were over the max amount allowed for fees to a veteran and would waive the XXXX processing fee to get us below that amount. He has stalled me from then until XX/XX/XXXX, sending me his own rate lock confirmations from ditechs showing a 3.5 lock and assuring me that even though I did not sign their paperwork, I was locked in. We had appraisal and termite done and I was assured the closing docs would reflect the 3.5 rate and would close by XX/XX/XXXX. In the meantime, my current lender called me and after seeing my paperwork told me he had not provided proper legally mandated disclosures to confirm the rate. Late Friday XX/XX/XXXX, after 2 weeks of stalling, I was told we were cleared for closing and he was " working on the rate ''. I was angry when my insurance contacted me to advise my mortgage had been substituted with ditech. I immediately contacted him but got no response until I received an email telling me that due to va loan regulations, the lender could only give me 3.625. I was paying points. They were charging me XXXX for just that buy down. I backed out but how is this legal?

Complaint: I switched hazard providers, and sent to Ditech Escrow department the balance of the escrow refund from previous provider with instructions to apply toward escrow. Ditech incorrectly applied these funds. The amount sent was {$1700.00}. Part was applied towards a payment and the rest towards escrow. This resulted in a much higher monthly payment. I called 6 times, spoke with a representative / manager and each time was told that this was recognized and corrected. It has not been corrected and when I now make my monthly payment, it ends up in an " UN-applied funds '' account. This has made me delinquent and causing negative credit reporting. No one has been able to correct my account, included manages that have promised my confirmation call or email to verify the correction of the misapplied funds. HELP!

Complaint: In previous complaint XXXX, Ditech Financial apologized for its negligence in failing to obtain my authorization prior to restructuring my loan and increasing my monthly payment by over 10 % and stated the issue had been rectified. It has not. My monthly mortgage payment should be {$1100.00}, and it shows it was decreased from Approx. {$1600.00} to {$1200.00}. This did not return my account to its prior status, and Ditech did not fulfill its commitment to the XXXX as stated. In this complaint, I am seeking the following resolution : 1. For my account to be restored to its status prior to Ditech acting against my will 2. Ditech to rectify the claims made against me to the credit reporting agencies 3. Financial settlement on this claim. Ditech has failed to apply my payment to the lowest interest portion of my loan andninstead retained additional payments I made for over one year, which I understand violates their legal obligations. This decision, along with restructuring my loan, and the numerous complaints to seek resolution have caused me financial and emotional monetary loss. I await an immediate response from Ditech and resolution in-line with commitments made.

Complaint: Ditech is a substandard lender and needs to be looked at further for thier illegal tactics. On XX/XX/2017 my son returned home from a four day trip to Florida. When he arrived and tried to use his key to enter the front door of our home, he was unable to because the home had a lock on the door and his key did not fit the lock so he went to the side door to enter the property, only to find out someone had been in the property. To make the long story short, after Ditech had hired a company called XXXX XXXX to take control on the home and prepare it for what was called winterized they went into my home and winterized my property with out notice to me they basically kicked me out of my house, placing plastic on everything and changing the lock and adding a lock on the front door. I had been trying to get a Deed in lieu from Ditech however they kept giving me excuses on why I did not qualify for the deed in lieu, the message they sent me said I did not qualify for a deed in lieu with a FHA home loan because I had not attempted to sale the home by short sale first, so I was denied the deed in lieu. So I contacted a real estate agent and gave them the information, who has had the hardest time contacting Ditech and speaking to anyone to get the necessary information to list the house on the market. Finally, the real estate agent reached some one and retrieved the information needed to start the listing process. In the mean time, Ditech went into the property to do an inspection to tell the agent how much to list the property for, then they gave the information to the real estate agent. The house is listing today, however I received a letter from Ditech telling me now that I dont qualify for a short sale I'm denied stating You were evaluated for a loss mitigation assistance based upon the eligibility requirements of the Federal Housing Administration ( FHA ) and XXXX the owner of your mortgage account. Based on a careful review of the information you provided to us you are not eligible for FHA Special Forbearance due to the following reason ( s ) - Your account is secured by condemned or vacant property and, therefore is not eligible for this program. We only moved out of the home after the property management took it over and Ditech clearly knew this because I called them and told them this during my complaint to them about going into my home violating our space taping up everything and ripping down window covering and everything else they did ... XXXX Ditech is playing games they do not care about consumers at all. Please investigate Ditech and this complaint and advise them to do the right thing and let me have a loan modification. I do have the paperwork verifying the above information. The only reason my property became vacant is because they violated my home changed the lock and added a lock violating our space and removing our normal access to enter the home though the front door because the lock was changed and an additional lock was added on the door.

Complaint: My daughter, XXXX XXXX XXXX, obtained a loan on or about XX/XX/XXXX to purchase a manufactured home from XXXX XXXX, a XXXX XXXX, Title Number XXXX, VIN # XXXX, XXXX XXXX XXXX XXXX XXXX, Description : XXXX XXXX, to which XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, XXXX, GA XXXX, placed a lien on the title issued by the Idaho Transportation Department. In XX/XX/XXXXmy husband, XXXX XXXX. XXXX, obtained a loan through XXXX XXXX in XXXX XXXX, Idaho, on 2.66 acres of land and the manufactured home originally purchased by my daughter as described in the paragraph above. This transaction paid the XXXX XXXX off and should have satisfied the lien that XXXX had placed on the manufactured home. My husband, XXXX XXXX. XXXX, died XX/XX/XXXX ; and I, XXXX XXXX XXXX, was appointed by the Court as Legal Representative. In XX/XX/XXXX or XX/XX/XXXX, exact date is unknown, I paid the loan with XXXX XXXX in full. XXXX XXXX issued a Deed of Reconveyance on the land and presumably on the manufactured home which my daughter, XXXX XXXX XXXX, had signed off interest in when XXXX XXXX lent the monies in XX/XX/XXXX. XXXX XXXX failed to provide the original Title issued by the Idaho Department of Transportation when the loan was paid in full, so it can not be verified that XXXX had signed a release of lien on the title to the manufactured home ; but, I can not imagine a lender wouldnt have demanded a release of lien upon providing funds for the payoff. XXXX XXXX has now been assumed by Ditech and XXXX XXXX has been assumed by XXXX XXXX. Neither Ditech nor XXXX would have had to service a loan on this manufactured home because the monetary obligations had been satisfied prior to both assumptions. Ditech was notified on XX/XX/XXXX, that they needed to provide a release of lien to the Idaho Department of Transportation on the manufactured home in question. On XX/XX/XXXX, after no response to my request, I again contacted Ditech and they asked for an Idaho Title Search to try to identify the original loan. The title search was provided the same day. On XX/XX/XXXX, Ditech wrote a letter stating they could not locate an account and I needed to provide them an address for the manufactured home and a complete social security number. I called Ditech at ( XXXX ) XXXX and talked with XXXX ( extension XXXX ) and she tried to connect me with the Manufactured Home Department without success. She said that she would submit the requested information which I had provided ; but, also gave me a direct number to contact the Manufactured Home Department myself ( XXXX ) XXXX. On XX/XX/XXXX, I again attempted to contact Ditech to resolve the matter. I was unable to talk with any human, but did leave several messages on their recorder. I also tried the original number given and encountered another brick wall. I read on the internet that Ditech is having financial problems which makes prompt resolution of utmost importance before another financial entity becomes involved. On XX/XX/XXXX, I also attempted to resolve this problem through XXXX XXXX who had assumed XXXX XXXX. XXXX XXXX having failed to return the Title to the manufactured home when the loan was satisfied. They were unable to identify the loan with my husband ; and, they told me that they were only required by law to keep the information for 7 years and since this loan was paid off in XX/XX/XXXX or XX/XX/XXXX, they didnt have the information any longer.

Complaint: XX/XX/XXXX, I called to Ditech and stated that my XXXX-year-old Son was killed after being struck head-on by an off-duty police officer who was driving recklessly on the wrong side of the highway. During that time, I was satisfying final expenses ; and requested a payment extension. The Ditech Rep stated that they would forward me the paperwork for the request. XX/XX/XXXX, I received a plethora robo phone calls from Ditech requesting payment for XX/XX/XXXX and XX/XX/XXXX payment, ; and with every single phone call, I had to agonize over the pain of explaining to them about the death of my Son. I asked them was it possible to log the information I provided them, in an effort to avoid constantly repeating, my XXXX year old Son was killed in a car XXXX and Ditech is working on extending the payments. However, to no avail, I had to continue to endure this suffering because no one bothered to take the proper steps necessary to accurately notate the account, and actually read it prior to calling me. XX/XX/XXXX, I accessed Ditechs online mortgage payment system to make two separate payments for {$690.00} each, for XXXX ; however, Ditech debited my account twice for {$2600.00} each time, for a total amount of {$5200.00}. I immediately called Ditech to make them aware of this error, and I was told by Ditechs representative that there was nothing that she could do about a Web payment glitch, and I would have to go to my financial institution and have them to perform a stop payment in order to reverse the charges and to get my money back. After the payments were returned to my account, I went to the USPS and purchase two money orders for {$700.00} each, for a total of {$1400.00}, with each {$700.00} money order labeled payment for XX/XX/XXXX and XX/XX/XXXX, respectively. Within the same month, I purchased another money order for {$700.00} for XX/XX/XXXX payment ; which clear all outstanding payments. XX/XX/XXXX thru XX/XX/XXXX, I have purchased money orders for {$700.00} which exceeds what is actually owed each month, and from XX/XX/XXXX to present I have continued to received harassing phone calls and letters of threat to take my home due to an unforeseen tragedy in my life, a glitch in Ditechs online mortgage system, and incompetent and insensitive Ditech employees. XXXX, XXXX, and XXXX were the only competent and compassionate employees out of the 50 or more of the Ditech employees that I spoke with that could identify the problem within their system, and could see that payments were being made. Further, I was told not to worry about it, the problem would be resolved, and the Ditech Rep apologized profusely on behalf of Ditech. Unfortunately, noting has changed. I continue to be harassed and threatened with letters of foreclosure for Ditechs mistake.

Complaint: Escrow has been requesting the Payoff Demand from Ditech a XXXX XXXX every other day since XX/XX/XXXX, with NO RETURN Payoff Demand send. Ditech has send the owner many packages to assume the loan, which is not what the owner wants to do with her property. The property is in Escrow should have closed escrow XX/XX/XXXX and buyer is paying {$5000.00} to extent the interest on their loan. The owner has called Ditech and Ditech refuse to talk to her unless owner assume loan.

Complaint: Per Ditech 's response of the last dispute. We have found the information to be lacking in information to back the findings. We are attaching the statements for the 14 months of Interest Only payments on a Simple Interest loan. We find it hard to believe that payments over this period of time could all go to interest when some payments are clearly made less than 30 days apart. We since went through all 20 years of the statements we have collected and found these statements from XX/XX/XXXX to XX/XX/XXXX to of great concern. We have also attached the response from Ditech in the words of their own Paralegal XXXX XXXX " that the months where no principal was applied, payments were generally more than 30 days from the last payment made or past due interest was owed ''. Then states to " please refer to the enclosed payment history for breakdown of the payments applied toward principal and interest '' Yet there was no 'enclosed payment history ' for us to review.
