Complaint: I had a XXXX XXXX loan on my condominium. After Hurricane Harvey, I was offered a deferral period due to my home being flooded and needed extensive rehab before it was livable again. A person that I talked with told me that at the end of the deferral period, I would be given a modification and the interest rate would be reset to current market rates. This would have been a good deal for me, so I did accept the deferral as ( 1 ) I had no idea what kind of money was going to be needed from me to rebuild and ( 2 ) the current market rates were much better than the rate that I had. About 2.5 % better on the average.
My rebuild took much longer as the storm damage was so extensive in our area that it was hard to have materials delivered without a long wait. Thus, I didn't get a fully livable condominium until about XXXX or XX/XX/XXXX. I was out of my house for a full year.
Ditech came forward with a modification agreement asking me to sign where they added past due interest of {$4400.00}, eligible servicing expenses of {$18.00} ( why? ) and taxes and insurance of {$1100.00} ( double why???? ). Taxes and insurance are part of my escrow account, not part of financed money. And I don't escrow my insurance anyway, I pay it with my HOA dues and to XXXX myself. It doesn't go through the mortgage company.
What is most shocking though is they have amortized the loan out another 40 years (!!! ) when I had only 15 years to pay on my original mortgage. And they did not lower my interest rate, and they re-started amortizing the loan as a totally new loan. I would think a modification only modifies some of the terms, it should not start over as a completely new loan. They lowered my payment a little, but I did not ask for this and I did not need it.
If I had continued to pay my old loan, I would have paid {$31000.00} in interest from XX/XX/XXXX to the end of the loan. With the modification, I will pay {$95000.00} in interest.
I did ask a rep if they had lowered anyone 's interest rate, and I was told that yes, if the balance owed was already a large amount, they lowered the interest rate to make it easier for the mortgagee to pay.
Now Ditech is in Chapter XXXX bankruptcy. I feel very much held over a barrel to pay all this extra interest just because I deferred payments for a year, and based on inaccurate information.
It seems that I could continue to pay as if my old mortgage was in place and get out before 40 years pass ( I hope so since I am already XXXX years old! ). However, this is just wrong, They should not be able to do this to a consumer whose mortgage was not behind.
I have tried to refinance, but my credit score is just beneath what lenders want, so I am unable so far to do so.
Possible I would be forced into a sale and get rid of my mortgage, but then I would be faced with a market with real estate prices much higher than when I bought this place, so it is all out of my reach now.

Complaint: Ditech Financial LLC holds our mortgage for our home. Ditech has only recently corrected our address so we receive mail from them, they have mailed all correspondence to our street address for years although we have tried to correct the address multiple times especially in the beginning of our loan ( XXXX ). We eventually gave up and set up an ebt account so the payment came out of our checking account each month. We pay our own taxes and insurance. Ditech decided in XXXX of XXXX that we had not purchased homeowners insurance and did that for us and started an escrow account. Ditech took the principal and interest plus escrow as the ebt payment for XX/XX/XXXX. We noticed this right away and my husband called them and in a few months they refunded the overpayments and acknowledged that our homeowners insurance was in force and that we purchased that insurance ourselves. Our current homeowners insurance policy runs from XX/XX/XXXX through XX/XX/XXXX. When Ditech took the incorrect amount electronically from our checking account we cancelled the ebt autopay and started sending them checks for the principal and interest. We again tried to correct our mailing address so we could get payment coupons. No success. We just copied an old coupon and mailed it with the payment each month. In XX/XX/XXXX Ditech once again decided we did not have homeowners insurance and opened an escrow account. When we mailed our principal and interest payment for XXXX it was not sufficient to cover the whole amount and Ditech put our payment into a " hold/suspension '' account awaiting complete payment. They mailed the notice to our street address, we did not receive it. We mailed our principal and interest payment again in XX/XX/XXXX. On XX/XX/XXXX we received an email from XXXX Credit Card that they were lowering our credit limit due to a bad credit report from Ditech. This has caused us much distress, worry, anger, frustration. We contacted Ditech. Although i know it is incorrect i paid the escrow amount due in an effort to avoid more negative credit reporting. I have called them almost every day since XX/XX/XXXX. Everytime I talk to a different person and have to explain the whole issue again. I do think Ditech has finally updated our mail address in their system. Their insurance tracking department confirmed they have our homeowners insurance policy and it is effective XX/XX/XXXX through XX/XX/XXXX and the insurance tracking dept conferenced with customer service to confirm this. Insurance tracking said that information has been available within Ditech since XX/XX/XXXX. I want Ditech to remove the negative credit information from our credit report RIGHT AWAY. I want Ditech to refund our money for the escrow account. I want Ditech to confirm this will not continue to be an issue every few months. I want Ditech to acknowledge that our XXXX payment is principal and interest only. Can you please help me?

Complaint: My home was devestated by hurricane Michael in XX/XX/XXXX. In XX/XX/XXXX, I overnighted the insurance check in the amount of {$24000.00} to Ditech along with an overnight return envelope ( as instructed by Ditech ). After some confusion as to what the balance for the mortgage payoff was, it was determined to be between {$3000.00} and {$4000.00}. I was told it would take 14-16 business days to receive a check for the approximate {$20000.00} remaining after the mortgage was paid in full. This is the money to fix my home so that I have somewhere to live. I am XXXX and cant affort to continue my trustee payments and pay for additional housing. After numberous phone calls to Ditech that always end with no definitive answers, I did receive ( postmark XX/XX/XXXX ) my title to the mobile home which was dated XX/XX/XXXX. I have made at least 6 phone calls to Ditech since early XXXX when I received the title, all of which I asked to speak with a manager, and they have given several different reasons for the delay, including that accounts were frozen because of the company filing for chapter XXXX bankruptcy. No one returns calls or knows what any other department is doing. Yesterday I was told that the check was mailed to me on XX/XX/XXXX??? They didnt send it in the prepaid addresses overnight envelope that they requested so I cant track it. Now they would have to reissue the check and that would take 14 more business days. Why could they not tell me that it had been mailed when I called ... all the times I called? I think they are trying to buy more time and this has taken long enough! Ive read several other complaints about Ditech filed here with your agancy and it seems that further investigation is certainly warranted!

Complaint: My agent had already filed a complaint as Ditech was refusing to respond to our offer. Now after we have received the Approval To Participate HUD form XXXX, the negotiator ( XXXX XXXX ) refused to review the offer and send the approval. She says that there is an " additional marketing period '' till XXXX XXXX, there is NOTHING on the document that says that. My agent has done hundreds of FHA short sales and says this is NOT procedure, that the ATP is used to generate the approval.

This property was not discharged in my bankruptcy proceedings as purported so your accounting based on that inaccuracy is suspect. Complaint: We have been trying to work with Ditech/Green Tree since XX/XX/XXXX to request a loan modification. Each time a package was received, Ditech would request additional information via mail, we would provide the requested information, they would say that the originally submitted information was out of date and deny the application based on an incomplete application.
They have twice filed for foreclosure, both times while a loan modification request was being considered. In XXXX of this year, we had a hearing with a Judge on the foreclosure and based on the information submitted the lender was required to review our documents for eligibility. We received a denial letter, and that denial was based on a bankruptcy that was discharged in XXXX. We were offered no process or opportunity for appeals, even after we requested such from the lender.
I believe that this lender has not complied with the requirement of RESPA or FHA when it comes to evaluating the property for options for loss mitigation. We experienced a temporary loss of income when this happened, however after it became 90 days delinquent they would not accept additional payments from us, which has created a snowball effect of late payments.
Any help you can provide is greatly appreciated.

Complaint: I refinanced my mortgage XX/XX/XXXX. My old mortgage payout was overpaid by {$1000.00}, and I was told I would get a refund check. They eventually sent a check to me with my ex-husband 's name on it. We divorced in XXXX and his name was not on the home or the new mortgage. It had been on the old mortgage. I called and they had me send in a copy of the title showing my home was in my name only, and return the check they sent. I still didn't receive a replacement check and called three more times. They kept promising to send it, and then finally I received it today with my ex-husband 's name on it again. He lives out of the country and I have no contact with him, so he can't sign it. I can not redeem this check, as I explained that to them several times.

Complaint: I have paid the same default 3 times. I received the mortgage through divorce. I have sent Ditech my divorce decree, and the Quit claim deed. This company refuses to acknowledge my rights which are the owner of the home. I have been the responsible party of paying this mortgage since I separated from my ex since XX/XX/XXXX.
1st Time -- On XX/XX/XXXX ( I was two months behind on mortgage payment ), I cured a default of {$4000.00}. I submitted an entire payment of {$4700.00} to cure default. Ditech did not allocate money correctly. I submitted a Notice of Error and this company refused to allocate payments correctly which were described in the Default letter. Sent my ex-husband an escrow surplus check of {$1500.00} knowing the default was not cleared. The first time I paid these fees I compiled payments which consisted of 3 money orders, and XXXX XXXX. I kept copies of all payments sent to Ditech, as well as, post office certified mail receipts.
2nd Time -- On XX/XX/XXXX, Ditech sent another cure default letter for the same default out ( 2 months behind on mortgage payment ) for the amount of {$2300.00}. This amount shows clearly the default was not allocated correctly. Ditech put majority of the money in escrow. I submitted a payment of {$2800.00} to clear the same default and Ditech refused again to allocate money correctly. This time I submitted a complaint and Ditech paid on my default and left a balance of {$350.00} -- Corporate Advance Balance, {$130.00} Uncollected NSF Fees, and {$20.00} -- Other Fees. The second time I paid these fees I specified through individual money orders on how all money should have been applied for all fees. When I noticed the money was not applied correctly again, I called Ditech and the representative stated the money would be applied correctly and it never was. I kept copies of all payments sent to Ditech, as well as, post office certified mail receipts. Ditech sent an email stating the money was applied for the XX/XX/XXXX mortgage payment. Ditech still disregarded all labeled XXXX XXXX for cure default fees.
3rd Time -- On XX/XX/XXXX, Ditech sent another cure default letter for the same default out ( 2 months behind on mortgage payment ) for the amount of {$1500.00} As of today, XX/XX/XXXX, I sent Ditech {$1500.00} to cure the default this company will not pay correctly. The third time I paid these fees I through XXXX XXXX, and specified through individual money orders on how all money should have been applied for all fees. I paid Ditech {$1500.00} -- XXXX XXXX, 3 XXXX XXXX -- XXXX ( Late fees ) each, Uncollected NSF Fees -- {$150.00} ( {$20.00} extra by error ) -- Same fees from last time, Other Fees -- {$20.00} -- Same fees as last time, and Corporate Advance Balance -- {$350.00} -- Same fees as last time. My date for right to cure default is XX/XX/XXXX.
When the money is received by Ditech, I will owe for XX/XX/XXXX mortgage.

Complaint: Got surplus check & statement from mortgage escrow account dated XX/XX/2019 saying there's a surplus of {$2400.00}. It said to deposit or cash the surplus check. Deposited the check and 2 days later my bank informed me the check bounced and charged me a bounced check fee.
I called Ditech mortgage servicing to find out what's up and they said there was something wrong with the account the check was sent from and offered to direct deposit the check plus the XXXX dollar bounced check fee. I gave them the bank name, routing #, account # over the phone and it took almost a week for the funds to show up in my account ( deposited on XX/XX/2019 ) but the XXXX dollar bounced check fee was never paid. It was not even included in the direct deposit. I called Ditech mortgage servicing and was told that the request for the XXXX dollar bounced check fee was put in but did not get paid out. I complained again that when I called last time, I was assured the XXXX dollar bounced check fee would be sent with the direct deposit and it was not. I called again on XX/XX/2019 and told them I have the original amount but not the bounced check fee that's still owed to me. They put in another request but said it has to be processed and did not even tell me when it will be pushed through.
Later in the day on XX/XX/2019 I found out the company Ditech filed voluntary petitions for reorganization under Chapter XXXX of the XXXX Bankruptcy XXXX. I did not get mail or notice of this and found out online when I logged into my account on XX/XX/2019.
To date I still not have received the {$20.00} dollar bounced check fee they owe me for sending me a bad check.
