Complaint: I have already filed one complaint with you, you said you heard from the lender and it usually takes 60 days to get resolved so I waited and logged in approx. 40 days later to see status and you had closed account. you received misleading and wrong information from the lender as I keep doing now. the lender has caused a hardship in ruining my credit with wrongful reporting but caused a hardship to the buyers as well they aren't able to do any on their home because of this lien. it all started in XX/XX/XXXX shortly my husband had passed I tried to resume which I did on time payments for a long time but started struggle as loan fully indexed to principal and interest payments and the heloc also went up. I asked the lender multiple times both in writing and verbally to drop my impound account this would have made the pmt more manageable however they didn't so I was forced to sell the home. in XXXX I knew we were selling the home so I told Ditech to credit my impound account to the XXXX payment they did not in late sept. early XXXX they sent a pay off demand to escrow ( they had plenty of time to add the XXXX interest ) but for some reason they didn't. escrow paid them off short the XXXX payment I spent the next months when notified asking them to release the impound account they never did again in writing and verbally. I received threats and payment request in excess of XXXX they change weekly not knowing the amount to ever send in by the way the payment was only XXXX short. Once I notified you guys they did send me a letter and spoke with a supervisor who gave me a pay off until XX/XX/XXXX and told me to wait and send in after I send impound account letter to them via fax I did that they received but never sent me new letter. they sent you the same pay off but prior to the XX/XX/XXXX I received a letter certified dated XX/XX/XXXX asking for XXXX + again. now it appears they took my impound account paid the new buyer taxes for them last month go figure now they owe me my impound account back and I owe them nothing for this stress. please review and take time each letter received and see the contradictorily dates have them reconvey the mortgage at once like they should have in the beginning for the buyers have them do their due diligence which is correct and legal and please shut them down they are preying on the elderly and the misinformed. the 3rd attachment has multiple letters attached please read in its entire and see how they conflict on and contradict each other the last few are fax confirmations that they received the impound request and note they made acknowledgment to you that they acknowledged we asked them to credit the impounds to XXXX payment they even tell you they received directions and acknowledged that in the their repose complaint to you under file complaint attached.

Complaint: This is the second complaint that I have needed to file against Ditech. There have been more negligent actions which I will explain and my original complaint was not even fully covered in the response.
I am currently working with a lawyer and the county tax collector to get full transparency on how much this company 's mistakes as caused issues with my lien, mortgage, credit and finances.
To start, the first complaint discusses how my property taxes were not paid. The response was, " In response to your concern regarding the payment of your property taxes, please note that your property taxes are paid in four ( 4 ) installments each year. It appears your fourth installment was due on or about the time your account service transferred to us. At the time your account boarded our servicing platform, the information provided to us by the prior servicer did not indicate a payment was due for your property taxes, which suggest the timing of the service transfer may have overlapped with the property tax due date. Please note that a property tax disbursement was sent on XX/XX/2018 to your taxing authority to pay the fourth installment. In addition, Ditech has paid any late fee assessment charged by your taxing authority. '' This does not cover the fact that my property went into a tax sale and was SOLD. It does not discuss that despite it being XX/XX/XXXX in which was not paid, that taxes were not paid until XX/XX/XXXX, AFTER I had to file a complaint. I had been calling about this for two months.
At this point, with all of the negligence of this company : 1.Sending me to collections because of their mistake of my mortgage payments, when I was never even late.
2. Taking SIX months to fix this problem, AFTER I filed a complaint. I called several times each month trying to get this sorted out.
3. Not paying my taxes. Causing a lien and tax sale on my home, which was bought.
4. Not contacting my Home Insurance to pay it. This was realized when I received a bill from them.
5. Allowing my escrow to go {$6300.00} dollars in negative without telling me, causing me major financial issues.
The company did not even mention my requests for all their faults. Which is that I want to refinance. And I expect them to pay any interest that I gain because interest rates have gone up. I also expect them to pay closing costs. I do not have any confidence this company will pay my bills in the future. Now that there is a bank that has investment in my property because of the tax sale.
I am also looking into the property tax numbers and it looks as if Ditech is having ME pay for the fees and interest that was accrued because of the tax sale and late property tax payment. This is against the law.
I have spent numerous hours on the phone because to speak with a representative, it is a minimum of 20 minute hold. Then another 30-45 minute hold for a supervisor. I still never heard from the supervisor XXXX XXXX. I spoke with another supervisor XXXX, who kept me on hold for 45 minutes. Was very quip in her tone. And was unable to offer me any help in any of these above topics. I explained how long I wait on the phone and requested a direct phone number, as I have so many issues with the company and she said that supervisors do not get phone numbers, which is another lie.
I will be retaining a lawyer unless my requests are met.

Complaint: I have been diligently calling to ask for a reinstatement because I want to keep my home Im currently saving up funds to pay in full. The problem also is Ive been in contact with Ditech Mutiple times and calling to ask about the calls that they told me they would listen to due to the agent I called to set up my supplemental payment plan with must have mistaken and keyed in the wrong numbers of the account number I read to them over the phone. I They still have not responded to me about the calls. I call in and ask and they tell me they are busy with there bankruptcy and all and someone is working on it. I dont know what else to do because they are still investigating this .This is my home they are messing with. Ive lived in my home nearly 6 years now. I applied for loss mitigation through Ditech due to a medical hardship I had to have XXXX XXXX XXXX and developed a XXXX XXXX that I had XXXX I was very ill and out of work with no sick leave, as well as I work for the XXXX XXXX and it was during the shutdown as well and I applied but I have FHA and they told me I had to wait two years. Thats okay but I should have more options and I dont think they even read my five page medical hardship that I sent in with the documents for the loss mitigation I say that because I sent it in on XX/XX/XXXX and I received a answer by XX/XX/XXXX and was immediately thrown into foreclosure. I talked to a agent and they informed me that the account number that I told them when I called in to change my bank account information for the supplemental plan drafts from the bank and Ditech said the numbers came back as a invalid account. They never told me this until after it was too late and I didnt receive a letter until end of XX/XX/XXXX and the only reason I got it is due to calling Ditech and requesting it be sent to my email. Ive got several documents Ive kept all files all the faxed papers Ive faxed to them along with all my medical notes and bills and check stubs it all. I wouldnt be in this situation I feel if they would have done there job right the first time. Im still battling illness and working full time I just want to get to the bottom of it all. Thank you.

Complaint: My current Home Equity Loan is with Ditech, recently I received a letter saying my account number would change due to a system upgrade, this was to have taken place from XX/XX/XXXX until XX/XX/XXXX with the system being up and running by XX/XX/XXXX. As of this complaint the system is still no working and customer service reps or myself can not view my account or history online or via the XXXX #. This has caused a great deal of stress as I need information to complete my XX/XX/XXXX taxes, I have called multiple times ( hold time is typically 25-35 minutes ) then told the system is still not up and running yet and to call back the next day. They are in violation of several responsible servicing rules and regulations as they can not provide detailed loan information to me, yet l am expected to make ontime payments.

Complaint: My mortgage was transferred to a new company effective tomorrow and nobody ever provided any notice at all. The only reason I know is because of the welcome e-mail that I received today, 1 day before the transfer is effective. They are supposed to provide 30 days notice. Ditech did not do this.

Complaint: We had a forbearance period on our mortgage loan due to superstorm Sandy. Ditech has now sent us a letter of default due to us being in that program.
Our account now shows {$32000.00} in arrears which is impossible. At {$1400.00} per month in interest the total if any would be {$17000.00}. But we are not supposed to be in arrears due to our participation in the Sandy forbearance program.
During the 1 year period we payed our monthly escrows. Ditech is still stating that we are in arears with our mortgage and they haven't applied our mortgage payments correctly to our account. They have not been applying it to escrows and keep doing escrow advances to cover insurance, MI, and tax payments. I found out this was the reason that we received a notice of cancellation for our homeowners insurance. Ditech was waiting for a managers approval to pay the premium as there was not sufficient funds in our escrow account due to their ( lack of ) accounting.
Ditech has just transfered the servicing to another lender efeective XX/XX/XXXX which will make this even harder to solve with a company that knows little of what we have went through for the past few months.
Attached is : 1. A letter from Ditech from XX/XX/XXXX requesting us to sign a mortgage modification for a loan term of 40 years where our address and information was changed to XXXX XXXX XXXX in XXXX, MO.
2. A letter from Ditech from XX/XX/XXXX addressed to XXXX XXXX XXXX in XXXX, MO when we requested a payment history and why payments were not being properly applied.
3. A letter from Ditech from XX/XX/XXXX with terms of forbearance program.
4. Cerificate of Eligibility from NJ Consumer Affairs for Sandy Impacted Forbearance.
5. A letter dated XX/XX/XXXX we sent to ditech outlining our compaints.
6. A certificate of occupancy for our home dated XX/XX/XXXX.

XXXX XXXX XXXX Mortgage : XXXX XXXX XXXX XXXX, Unit XXXX, XXXX, HI XXXX To Whom It May Concern : Over the past 6 weeks I have faxed several written requests to your customer service fax number filing a formal power of attorney notice for the subject property and requesting a copy of the appraisal associated with the mortgage. To date, I have not received the appraisal.
Additionally, I have made several calls to your mortgage servicing phone number ( located in the XXXX and staffed by foreign nationals ) and have had a horrific experience. The wait time to speak to someone was never less than 30 minutes. I had to lead the service rep step by step through the Power of Attorney document that I had filed with you to ensure my contact information was updated to even get them to speak with me, even though the POA had been submitted weeks before. On two occasions the phone line went dead shortly after it was answered. In two instances I was assured that the documents would be emailed to me and they were not. In one instance, I insisted that the foreign rep connect me with a knowledgeable U.S. Ditech staff member to assist me. After assuring me that the call would be transferred to a U.S. staffer, I spent another 10 minutes holding on a silent line before hanging up.

Complaint: Ditech continues to send a statement that shows a past due amount for insurance of XXXX That was already paid with the XX/XX/2019 pmt. on XX/XX/2019.
This has been addressed with the Ditech company 2 times on approx, XX/XX/XXXX.
Was assured by the representative that an amended and corrected statement would be sent within 24hrs. plus mailing time.
I received another statement on XX/XX/XXXX that reflected the same incorrect XXXX Past Due plus the current insurance amount. of XXXX.
Upon phone call on XX/XX/2019 I was told that the funds were being reallocated and that I should wait on the next statement to see if it was corrected. Next statement should be arriving before XX/XX/XXXX which is past the scheduled payment date of XX/XX/XXXX.
This is unfair credit reporting.
