Complaint: I have two mortgages with Ditech, and have had them for years. In XXXX I scheduled my XXXX payment for both of my accounts. I did not recieve the typical email confirmation, so I called in, and was given the confirmation number. I explained that I had two accounts, and was assurred that the payments were both there. On XX/XX/XXXX, I received an alert from the credit bureau that my credit score had dropped due to a 30 day late notice on Ditech mortgage. I immediately contacted them, made another payment, and began the process of sending information to get the 30 day late removed. Finally, on XX/XX/XXXX, I received a letter from Ditech that they would change the infomation reported to the credit reporting agencies. Just getting that letter took several hours of calls, and going through several people, but I was happy I got it. I was assurred this would be reflected on my credit report in 3-5 business days. As of today, XX/XX/XXXX, it has not happened. I am now working directly with the credit reporting agency in hopes of fixing this situation soon, as I have been turned down for loans due to this problem. But, then it gets better. I paid my payment in XXXX for both loans again. I was traveling for most of the month, and had not reconciled my bank account until yesterday. Now, the payment for the other loan has not cleared for XXXX!!! I went on line to check yesterday, and it was reporting as if it had not been paid. I paid immediately, and this morning started the process all over again for this loan. However, after being on the phone for almost an hour, and talking to someone who did not seem to understand what I was asking, I was sent to a manager and told my account is closed and with another loan company. I need to contact them for customer service. They, of course, can not help me with Ditech, and I was aware that as of XX/XX/XXXX, I was to go through the new company. However, this is a XXXX issue. I know Ditech is undergoing re-organization, ie, bankruptcy, because they sent customers a letter a couple months ago. I understand they may be having troubles that may take a little longer to get fixed. However, I am a long time customer with them and I have never had anything like this happen. Now it has happened twice in a couple months. I am frustrated, and fearful that they are going to repot yet another 30 day late on my account, and I can not do anything about it.

Complaint: My previous lender is reporting my mortgage as " included in bankruptcy. '' Per my attorney if a debt is reaffirmed at the same time as your bankruptcy it is not included in the bankruptcy. I have sent the reaffirmation to Ditech Financial showing that the reaffirmation was included along with the bankruptcy, so it was not included. XXXX is reporting it correctly. Ditech financial refuses to change the reporting to now included with bankruptcy.

Complaint: I am having problems with my mortgage company which I just found out they added my hours to a foreclosure list. I had been on chapter XXXX which I completed in XXXX. In XXXX I had to file for a 4 month chapter XXXX which I completed. Since the second chapter XXXX I have made my payments on time and they are trying to foreclose my house. I made my payment in XX/XX/XXXX for XXXX and they put it in a suspense account. I made my payment on XX/XX/XXXX for XXXX and they refunded that amount back to my account. I don't know why they are doing this. I have evidence of having completed both chapter XXXX in good standing and evidence I have been on time with my payments thereafter. I feel it is plain harassment and am reaching out to your office for help in this matter. I have received correspondence and a text for realtors telling me they saw my property in a fore closure list and are reaching out in case i'd like their assistance to do a short sale for fore closure. The last two options are not an option when I completed my chapter XXXX 's and have been paying my mortgage every month on time. Upon your review of my complaint I will be more than willing to submit proof of my case.

Complaint: In XX/XX/XXXX I applied to XXXX XXXX to refinance my Ditech mortgage. I was approved for the loan in the amount of {$260000.00} at an interest rate of 5.375 %. Ditech was contacted several times by me and XXXX XXXX beginning XXXX XXXX in an attempt to secure a payoff amount for my current mortgage. The representatives at Ditech were aware that I was attempting to refinance my loan and assured me that payoff information would be sent to XXXX XXXX in a timely manner however, that was not the case. My original closing date was XX/XX/XXXX but Ditech failed to provide the payoff information before the closing date. After numerous attempts get payoff information by myself and my representative from XXXX, Ditech finally sent the information on XX/XX/XXXX with a payoff amount of {$380000.00} which included a daily per diem interest rate of {$1300.00}. Needless to say my loan through XXXX was rejected and I am back into foreclosure with Ditech. I truly feel that if Ditech had processed my request in a timely manner I would have been able to secure the loan through XXXX. Anything that you can do to assist me with this situation would be greatly appreciated.

Complaint: In XX/XX/XXXX I modified my mortgage for a 30 year fixed rate which created a monthly payment of XXXX. In XX/XX/XXXX I lost one of my part-time job and Ditech told me about a mortgage foreclosure prevention agency in North Carolina. I applied and qualified, the granting agency through their credit consumer advised me that I did not have to pay the mortgage once I qualified for the grant. When I applied XX/XX/XXXX I was one month behind. Six months after the grant started paying my mortgage, Ditech arranged with the granting agency to increase my monthly amount to XXXX per month. When I contacted Ditech they told me the original amount of XXXX on the loan modification would be restored when the grant period ended. Well almost a year later my amount was never restored to what the loan modification was and further they dont even have the loan modification now am I the one that is crazy, I have acopy of the agreement with signatures. So am I crazy no, but I am now facing foreclosure and my dad who is XXXX and very sick with XXXX and a double XXXX XXXX and XXXX XXXX XXXX lives with me. I am getting very sick and am at my wits end. What ditech has done to me and how they have failed to handle any of my complaints to correct the problem has made things worse. Further they have at times past denied I called and made a complaint. I don't know what else to do I just want the amount reinstated.

Complaint: Ditech has arbitrarily changed my monthly payment due XX/XX/XXXX to include an absurdly high monthly escrow request. This started with an escrow analysis in XX/XX/XXXX which was in error and I immediately informed Ditech of the error. I have sent numerous emails through their internal system, sent faxes to their published fax numbers, and qualified requests to their published qualified request address and have received no correspondence regarding the error and it has not been corrected. I made my mortgage payment already for XX/XX/XXXX and it has been received. Unfortunately, Ditech has misapplied it, dividing it arbitrarily between principal and escrow rather than the first to the principal and interest payment due with the balance going to escrow.

Complaint: Ditech is currently reporting a closed account ( closed XX/XX/2017 ) as " Pay Status : >Account 30 Days Past Due Date< '' This account has been closed and paid in full for two years and now shows the current status as 30-60 days past due. Our credit score has dropped on all three reporting agencies 40-70 points. We have disputed several times with the agencies and Ditech just " confirms '' the information. I have written and called Ditech several times with no avail. We need help PLEASE! This is being reported on both my Husbands and my reports.

Complaint: I originally took out a loan for a property in XXXX XXXX with XXXX XXXX XXXXXXXX. That loan was an adjustable rate mortgage. The loan was subsequently sold to Ditech. The loan is in the adjustment period and I would like to refinance it. The problem is that Ditech does not have a license to originate loans in XXXX XXXX. They can service them, but not originate or refinance them. Ditech 's solution to wanting to refinance my loan was to contact a lender in XXXX XXXX -- however, taking out a new loan is much more expensive that just refinancing. So the problem I am having is why a company can own a loan from a state in which they can not originate them? It leaves their customers with much less flexibility.

Complaint: I refer you to a previous complaint XXXX XXXX which is closed. XXXX from DiTech informed me that I would be reinstated into the HAMP program. I was not and am now in foreclosure. History : I recieved a modification from Green Tree in XX/XX/XXXX. After I signed the permananet modification, Green Tree raised my mortgage amount to my original payment without notice. The agreed upon payment I made was placed into a suspension account. GreenTree did not give me a reason. They said if I didnt make the increased payment I would be thown into the street by the sheriff. I did not make the increased payments since the payment was not the agreed to amount. I requested a HAMP modification. Ditech offered me a HAMP. Although I agreed to automatic withdrawals, Ditech did not debit the funds. When I would call to inquire, they advised me they could process my payment but it would cost {$12.00}, which I paid. I made another 8 payments waiting for a permanent modification agreement. In XX/XX/XXXX I recieved a " trial modification letter '' dated XX/XX/XXXX. I did not sign the permanent XXXX upon the advice of XXXX from XXXX who was investigating. In XX/XX/XXXX I signed the HAMP. Almost immediately I received a letter raisng my mortgage by $ XXXX/mo. I made one payment. I am now in foreclosure.

Complaint: We had a loan with Ditech ( Loan Number XXXX ). Our previous servicer was XXXX XXXX XXXX. We endured a hardship beginning in XX/XX/XXXX and started the loan modification process with XXXX XXXX XXXX. We completed all of our paperwork and submitted it to XXXX XXXX XXXX. During the review process, we received a letter from XXXX XXXX XXXX stating our new servicer would be Ditech Financial, LLC effective XX/XX/XXXX. I spoke to XXXX XXXX XXXX regarding the modification status and was told that our modification was going to be handed by Ditech. I followed up with Ditech between XX/XX/XXXX through XX/XX/XXXX regarding the loan modification. During this time, I kept being told our application/documents were either old or incomplete. I submitted paperwork 3-4 times to Ditech. On XX/XX/XXXX I received a letter stating the modification could not be processed because of incomplete paperwork. I called Ditech to find out what paperwork was incomplete. I was told the REAL reason why the modification is not going though is because we already had more than 1 modification and have reached our limit. This was news to us! If this were true, why were we offered the modification by XXXX XXXX XXXX in XX/XX/XXXX and continued to go through the modification process through XX/XX/XXXX? In XXXX the following payments were made in an effort to catch up as best as we could : XX/XX/XXXX - {$1900.00} XX/XX/XXXX - {$1900.00} XX/XX/XXXX - {$1900.00} XX/XX/XXXX - XXXX XX/XX/XXXX - {$3800.00} ( via money order ) + an additional {$3800.00} ( via money orders ) In XX/XX/XXXX a check in the amount of {$1900.00} was made to Ditech but {$1900.00} was cashed according to the bank. In XX/XX/XXXX we were offered a Supplement Repayment Plan Agreement wherein we were to pay {$2800.00} a month beginning XX/XX/XXXX and continue through XX/XX/XXXX. Once completed, we would be current. Even thought there was an additional $ 900+ above the {$1900.00} we were already paying, we agreed to the repayment plan in an effort to make things current and avoid foreclosure. We received the Supplements Repayment Plan which explained all of the terms, the amounts to be paid with due dates, etc. Ditechs agreement specifically stated that if we make the supplement repayment payments on or before the due date Ditech will not initiate foreclose proceedings or, if foreclosure has already been initiated, we will not proceed to foreclosure sale. We made our first payment in XX/XX/XXXX for {$2800.00} and our second payment in XX/XX/XXXX for {$2800.00}. When we made our payment in XX/XX/XXXX my bank confirmed the check was not cashed. On XXXX XXXX my check sent in XXXX was returned to me. On XX/XX/XXXX I called Ditech at XXXX and spoke to XXXX at XXXX XXXX regarding my returned check sent in XXXX. She explained our check was returned because we are going through foreclosure. I explained we are under a Repayment Plan Agreement offered by Ditech. When I asked to speak to a Supervisor, I was placed on hold. XXXX came back to the phone and only told me that her Supervisor said the foreclosure status was removed and that I can send in my check in XXXX. I mailed my check for XXXX to Ditech on XX/XX/XXXX. Again, my check was never applied to the account and was returned to me on XX/XX/XXXX. Although I received letters from Ditech stating their moving forward with the foreclosure was in error and to resend the check, they continued the foreclosure process. When we received our XXXX and XX/XX/XXXX statements, they showed an outstanding balance of {$19000.00}, Corporate Advances of {$81000.00}, etc. Ditech breached its Supplement Repayment Plan Agreement by not accepting our agreed upon payment of {$2800.00} in exchange for not initiating foreclosure proceedings. As we were adhering to the Supplement Repayment Plan Agreement, Ditech initiated foreclosure proceedings which is dual tracking and in violation of the California Homeowner Bill of Rights. A certified Qualified Written Request dated XX/XX/XXXX was sent to Ditech referencing their breach of the Supplement Repayment Plan Agreement, dual tracking, discrepancy in payments made versus monies owed, a request for the breakdown of monies as noted in our XXXX and XX/XX/XXXX statements, a request for forbearance, and a request to come up with an amicably feasible amount between both parties in light of Ditechs unfair and unlawful handling. Ditech was advised that under Section 6 of RESPA they were required to acknowledge my request within 20 business days and resolve the issue within 60 business days. The certified letter was signed by a XXXX representative on XX/XX/XXXX. Ditech NEVER responded to our QWR letter dated XX/XX/XXXX. Instead, we received a NOTICE OF SERVICING TRANSFER dated XX/XX/XXXX advising that XXXX XXXX XXXX XXXX XXXX was going to be our new servicer effective XX/XX/XXXX. Not only did Ditech breach the Supplement Repayment Plan Agreement and underwent dual tracking which is in violation of the California Homeowner Bill of Rights, Ditech also failed to meet the duties of responding to the Qualified Written Request as defined in the Real Estate Settlement Procedures Act by ( 1 ) not providing a written response acknowledging receipt of the correspondence within 5 days ; and ( 2 ) not providing a substantive response/making appropriate corrections in the account of the borrower to include any and all credits/conduct and investigation/provide the borrower with a written explanation or clarification which states the reasons the servicer believes the account is correct within 30 days. Our loan is currently with XXXX XXXX XXXX XXXX ( Loan Number XXXX ). We have requested answers as to the discrepancies regarding the misapplication of monies versus amounts owed as well as an explanation as to why our Supplement Repayment Plan Agreement was breached by Ditech. Even though XXXX XXXX XXXX XXXX has taken over the handling of our mortgage, they maintain the position that they had nothing to do with Ditechs handling of our loan yet they ( 1 ) denied our request for a new Supplement Repayment Plan, ( 2 ) denied our request for a loan modification based on the fact that we did not have enough income and we have too much equity in the property, and ( 3 ) are moving forward with the foreclosure initiated by Ditech while we were involved in a Supplement Repayment Plan Agreement. Due to the inconsistent amounts owed, monies paid and not applied to the account, outstanding interests, late fees, Corporate Advance charges, etc., we are unable to pay the {$80000.00} plus arrear amount. Therefore, XXXX XXXX XXXX has recorded a Notice of Default on XX/XX/XXXX. Although we became delinquent due to an unforeseen injuries and death, we attempted to make better the situation by aggreging to a Supplement Repayment Plan Agreement in order to avoid foreclosure and become current. Instead, Ditech unlawfully initiated foreclosure proceedings, made various violations pursuant to the California Homeowner Bill of Rights and RESPA, resulting in XXXX XXXX XXXX XXXX proceeding to foreclose on our home where we have lived in for 19 years and started a family consisting of XXXX daughters. Our goal is and has always been to keep our home and continue making payments. We are seeking your assistance in making right the wrongs and coming up with an amicable solution that will allow us to continue to make payments and keep our home.

Complaint: I had a flood in my basement and recieved a check for the damages, which was also written out to the mortgage company DITECH, I have made several attemts to call them to see what I need to do with the check as they need to sign it as well. I have waited between 15 and 55 minutes on hold with out ever getting through, and it even went so far as when I told this to regular customer service and asked to speak to a supervisor, his rude response was I have other customers and rudely hung up on me I even went on their website and filled out the form to have them contact me but to no avail Please help me All i want and need is a response I already filed a complaint to you they gave a lame excuse and meanwhile they sold the mortgage to XXXX whoo has not recieved the check yet and i waited 4 months and still never recieved a penny

Complaint: I have reason to believe the mortgage company we are in partnership with over our modular home, Ditech ( a XXXX XXXX ) whose headquarters are in XXXX XXXX, SD XXXX ( XXXX ), is taking advantage of the loan servicing agreement by either placing hidden fees in the cost of the monthly payment or misappropriating the monthly payment in various ways. I purchased the XXXX modular home in XXXX of XXXX with a high interest rate of 13.75 %, but a loan agreement for 20 years, which will signify the end of that loan agreement this year in XXXX. However, I still owe {$13000.00} on the principal balance and a deferred balance of {$1800.00} with several calls to Ditech 's Customer Service department several times in the last few months beginning Monday, XX/XX/XXXX ( XXXX ) and ending today, Thursday, XX/XX/XXXX ( XXXX ). And since that time I have had nothing but issues with changed account numbers, a separate account number specifically geared for home owner 's insurance and requests for ALL the paperwork regarding our contract agreement and recorded call-in notes. Ditech 's Customer Service department has assured me they were taking care of my business relationship with them, but they've failed me in more ways than I care to explain at this time and now, I want answers as to why I still must pay {$13000.00} on a modular home for another 3 to 4 more years on top of deferred payments amount of XXXX because something they've done is the exact opposite of ethical and fair. The account numbers for home loan balance is : XXXX OR XXXX. The account number for home owner 's insurance is : XXXX.

Complaint: Ditech recently sold off our loan, and we have not heard from them or the new company. Currently, as of XX/XX/XXXX, Ditech is asking for excessive late charges, has something unique on my bill which is holding " funds in suspense of XXXX. I have tried to contact Ditech and make a payment but the account is closed, yet they are asking for a series of payments with a due date of XX/XX/XXXX. I have yet to hear from the new company servicing the loan. I am concerned that Ditech is racking up late fees, adding funds in suspense and making the balance as high as possible and then sending it off to another company. We had a major injury in the family and went to one income but we have a long history of being current. I would like to make sure that my payoff balance is fair and that I have not been taken advantage of in this transfer process. Why hasnt the new company sent me correspondence? Why is ditech sending me a bill with a future due date? What is " Funds in suspense '' Can you please make sure that Ditech has treated us fairly. We have been in contact with them and have been trying our best. They have 20 minute wait times and it is hard to get through

Complaint: I sold my home and closed on XX/XX/XXXX. The escrow amount sent to me in check form was XXXX. This check was deposited and came back as insufficient funds. Ditech is the Mortgage company who I had my mortgage loan through. When I called they said that they would issue a new check. I have called several times on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and on XX/XX/XXXX and they always tell me an excuse. Either they duplicated it and it was cancelled, that it may have been lost in the mail and we will issue another one, the first reason was that too many checks were being processed and that it was mailed late and now no reason, we will call you back. So I wait. My wife has also spoke with two different managers to try and resolve the problem and they keep giving us excuses. When I call they tell me they will send a new check and one never arrives. I have asked for it to be overnighted and still no check. I have also asked on XX/XX/XXXX to wire funds into my checking account and they told me they could not do that. I am getting no where quick and now we are heading into XXXX, over 3 months of trying to get my escrow balance from them and I am getting the run around. They are rude and make excuses every time I call.
