Complaint: I received a bill from Ditech for my XXXX Mortgage payment with a due date of XX/XX/2019. I am very careful to pay on time. I paid the mortgage bill amount on XX/XX/2019. Ditech cashed the check and took the money. Today, on XX/XX/2019, I received a bill from XXXX. Apparently Ditech sold my mortgage to XXXX. The XXXX bill has a XX/XX/2019 due date. It also does not show the application of my XXXX payment to the balance. In other words Ditech took the money and did not apply it to my loan. I have tried emailing and calling Ditech but they do not respond. I tried to log-in to the website, but since my loan is no longer serviced by them I can not log in. You help is appreciated,

Complaint: I called Ditech Home Loans in XXXX about the letters I continue to receive for payment of a property that they say themselves was XXXX in a bankruptcy in XXXX. Also this property recently, XX/XX/XXXX, was Foreclosed on. I told them this fact as well as them telling me they had to keep contacting me about this account. This is a foreclosure now and nobody has a mortgage on the property any longer. Noone has a mortgage any longer. It did go through bankruptcy and now is a foreclosed piece of property. I would appreciate being left alone by these people. I lost everything because of him.

Complaint: I have a home loan that is serviced by Ditech Financial. They have been ripping me off for months through an illegal " escrow account '' and will not respond to my multiple emails about the issue. They are applying {$88.00} of my monthly payment ( starting in XX/XX/XXXX ) each month to an " escrow account '' for " earthquake/A, '' whatever that is. I did not initiate an escrow account with my mortgage for taxes or anything else, nor have I ever requested or authorized one. Nor is there any legal basis for them to initiate one unilaterally. Our taxes are paid, our private homeowners insurance policy has always been in place. I recently spoke to Ditech 's own insurance services group and they confirmed there was NEVER A LENDER PLACED POLICY ON MY LOAN. They had no information about my escrow account and directed me back to general customer services. It's near impossible to get their customer service people to answer the phone. When I have gotten through, on XX/XX/XXXX, I was told they would open an escrow account review and it would be done in 30 days. That I would receive a copy of the review. I never got any response, despite multiple follow-up emails via their website. It's now XX/XX/XXXX. When I call the other customer service people told me they have no information, they can't contact their own escrow department, I just have to wait, etc. When I ask to speak to a manager I'm put on hold for over 45 minutes only to finally give up. If you look at the customer reviews of this company on the consumer affairs website it's clear this company is ripping people off all over the country through their unethical and illegal accounting practices. Some have lost their homes. It's a complete disgrace. Someone needs to do something about this and hold the people running this company accountable. Complaint: Ditech Financial recently responded to my letter with respect to the First Date of Delinquency being reported to the Credit Bureaus. Although I appreciate the response, the information remains inaccurate. ( Attached is Ditech Financial response ) Ditech originally was reporting to the credit bureaus a date of first delinquency as XX/XX/XXXX, after their " investigation '', they state the actual first date of delinquency has been updated to XX/XX/XXXX. ( Attached Ditech Financial response ). This continues to be inaccurate. Ditech also provided the loan modification from XX/XX/XXXX. ( Loan Modification attached. ) The modification took place with XXXX, the mortgage was sold to Ditech in XXXX of XXXX ( Attached Loan Assignment ) The Fair Credit Reporting Act defines the first date of delinquency as : According to the Fair Credit Reporting Act ( FCRA ), negative entries can remain on your credit reports for 7 years from the " Date of First Delinquency '' ( DOFD ). The DOFD is the date a consumer first becomes 30 days late, never brings the account current. Luckily, I have attached statements showing delinquency from XX/XX/XXXX. They have all been attached to this complaint by date. The information is as follows : Statement Date Past Due Amount Shown on Statement XX/XX/XXXX {$1500.00} ( There was no payment made in XX/XX/XXXX ) XX/XX/XXXX {$1500.00} XX/XX/XXXX {$1500.00} XX/XX/XXXX {$1500.00} XX/XX/XXXX {$3000.00} XX/XX/XXXX {$3000.00} XX/XX/XXXX XXXX XX/XX/XXXX {$3000.00} XX/XX/XXXX {$1800.00} XX/XX/XXXX {$3400.00} XX/XX/XXXX {$3400.00} XX/XX/XXXX {$3500.00} XX/XX/XXXX {$2000.00} XX/XX/XXXX {$3600.00} XX/XX/XXXX $ XXXX XX/XX/XXXX {$3800.00} XXXX was the last XXXX statement, mortgage was sold to Ditech. The first statement from Ditech shows a past due amount {$4600.00}. Ditech reporting the first date of delinquency now as XX/XX/XXXX remains inaccurate based on all the statements and attachments. At that point in time the mortgage was several months past due. The date of delinquency is defined as the fist time the mortgage goes past due and not brought current. This mortgage has not been current since XXXX XXXX per the attachments of statements.

Complaint: I had auto pay set up on my account for the XXXX of every month. Ditech took XX/XX/XXXX payment out of my bank on XX/XX/XXXX which caused my account to overdraw. I incurred a {$38.00} nsf fee because of this. I have contacted them 13 times since XX/XX/XXXX asking them to re-imburse me for the fee. I have faxed them the paperwork that they requested 3 times and e-mailed it to a representative while on the phone with her so that she could verify that she received it. Several of the representatives have told me that they can take the money out of my bank account early. I told them that is not true. Others have told me that it is being taken care of which has also not been true. Some have told me that they didn't post it to my mortgage account until XX/XX/XXXX so it is not their fault. Their application for autopay states that if it is set up to be taken out of your bank account on a holiday or weekend, they will take it the following business day. Also, I checked my XXXX XXXX account yesterday and Ditech had put a remark on there stating, " Account information disputed by consumer, meets FCRA requirements ''. My score went down 7 points and that is the only thing that isn't positive on there. I have not disputed anything with them as far as credit goes. I have only called them to tell them that they need to pay me the {$38.00} NSF fee that my bank charged me for them taking the money out of my account before they were supposed to.

Complaint: When I purchased my home in XXXX of 2018, there were two separate parcels as part of the sale, my home and a contiguous piece of land. These had two different parcel numbers under the same address with a total real estate tax amount of {$12000.00}. ( {$740.00} + {$12000.00} ). Unbeknownst to me, someone had mis-entered the 2nd smaller parcel 's number on my mortgage account for my escrow and my next door neighbor 's property was listed in my escrow account as the second parcel on my property. This resulted in the mortgage company ( Ditech ) paying for the real estate taxes for both my house and my next door neighbor 's house with the second smaller parcel on my property 's taxes not being paid properly. This error was in the amount of {$9100.00}. As a result, my escrow account was completely depleted and an escrow analysis was then performed resulting in an increase of my monthly mortgage payment from {$3600.00} to {$5500.00}. I tried several times via phone and email to reach Ditech only to receive a letter in the mail stating they had 30 days to research and resolve the problem. However, this 30 days has since come and gone.I 've just now called the tax assessor 's office ( XX/XX/XXXX ) and they have indicated that there has been no attempt to correct the error on my account. In the interim, Ditech transferred my loan over to another company called New Rez. They are now demanding the monthly payment of {$4900.00} because that was the last amount sent to them by Ditech as the amount I owed with no mention of this pending investigation. I have called New Rez to apprise them of the situation and sent an email requesting that this be investigated as well. This new payment was due on XX/XX/XXXX and I have a 15 day grace period to pay the amount but they told me that I would be penalized if I did not pay the full amount.

Complaint: I had a second Mortgage with Ditech. I refinanced my first and second mortgage together and Ditech was paid in full on XX/XX/19. Prior to this second mortgage being paid off, Ditech withdrew a XXXX payment from my automated payment. Once the mortgage was paid off on XX/XX/19, I had a total of {$1200.00} that ditech owed me for over payment of the payoff along with the XXXX they withdrew from my bank account. Once Ditech closed the loan and showed it paid in full, they applied this {$1200.00} to escrow which I never had an escrow on this loan since it was a second mortgage. They are trying to tell me they have 20 days to refund escrow but I have tried to explain to them that this is not escrow money and just an over payment after the loan was paid off. I have already received the escrow money from my first mortgage but for some reason Ditech is refusing to refund my over payment money to me. I need assistance in getting this money. I have copies showing where the loan was paid and how much they currently owe me.

Complaint: I received a letter from Ditech Financial LLC stating : " This is a legally required notice. We are sending this notice because you are behind on your mortgage payment. We want to notify you of possible ways to to avoid losing your home. We have a right to invoke foreclosure based on the terms of your mortgage contract. '' The letter continued on with the options BUT the reason this is an issue is that I have made the final mortgage payment. I obtained a payoff quote on XX/XX/2019 stating the amount of the payoff on the account was {$460.00}. I was informed the funds needed to be certified and sent to the payoff address instead of the regular payment processing. I obtained a money order from XXXX XXXX in the amount of {$460.00} dated XX/XX/2019. I then mailed the payoff quote and money order to : Ditech DEPT CH XXXX XXXX XXXX, XXXX through my local post office with tracking. Tracking # XXXX which was said to be delivered on XX/XX/2019. On XX/XX/XXXX I called Ditech and spoke with XXXX ext. # XXXX to ask why I still had a balance on my account that was showing past due {$460.00}. She informed me that my payoff check had indeed been received and was processed on XX/XX/XXXX but that their computers were being upgraded so that nothing was showing as to the account being cleared and paid off. She told me to call back in a wee and it would be taken care of by then. So I then looked at my account on XX/XX/2019, a week later and the balance was now showing {$690.00} past due. I again called Ditech and the person I spoke to didn't give me her name. I explained the whole situation again and asked how can I have an increase in balance a week later when the payoff amount would be the TOTAL due on the account and nothing more. I can't owe more than what the payoff amount is. She told me the system is updating and I just need to be patient and there is nothing she can do. I told her that now its saying past due which is being reported on my credit as late payments and she said again there is nothing she can do because the system is updating and it will get fixed when it gets fixed. I informed her they can't do this and my credit is being affected and I will be getting a hold of a lawyer and she hung up on me. I have all the documentation of when the check was received and the exact payoff letter. I can not be in foreclosure if they would process things in a timely manner. Basically the money is there but not applied to my account and they are adding on more payments even though they can't do that.

Complaint: I hope you can help me. We live in XXXX Californa. We bought our house 3 years ago. We are retired and have been a home owner for 52 years. This has never happened to us before and I want to know if it is right. We financed through XXXX XXXX. The first year it was fine and then they sold our loan to Ditech. Our payments were XXXX. We were notified that there was a shortage in our escrow fund and we either had to pay a lump sum of XXXX or our house payment was going up 100 dollars. We let it go up. So now our house payment is XXXX and this year we were contacted again and told that there was still an escrow shortage and we either had to pay XXXX or house payment was going up again 100 dollars. I dont think this is right. We have never had this happen before. Last year my sister bought a house here in XXXX and the same thing has happened to her. They just contacted her and told her she either had to pay XXXX or her payment was going up 300 a month. Can we have someone investigate this and see if they are cheating us. We are all retired and living on a fixed income. If they payments go up we may not be able to keep our homes. Thank you in advance for anything you are able to do. XXXX XXXX and XXXX XXXX
