Complaint: The following complaint is about a requested loan for home improvements and how I was not allowed to close on the loan due to some required repairs.
I have been a customer of Ditech for 11 years as they were my mortgage lender. My home was to be paid off this month and since my financial relationship with Ditech was in good standing, I decided to extend the relationship by requesting and applying for {$70000.00} for a home improvement loan on XX/XX/2019 with XXXX XXXX. The processing was going smoothly. A loan officer XXXX XXXX gave me the good news that my loan was conditionally approved on XX/XX/2019. An appraisal was scheduled for XX/XX/2019. The appraisal was completed by XXXX XXXX. After the appraisal was completed XXXX and I discussed the appraisal which noted several repairs such as, peeling and wood damage around the windows, the exterior doors, main bathroom ceiling, living room ceiling, kitchen ceiling, overhang over the front door and the area immediately to the left and the crawl space. XXXX stated that the repairs are required to be completed before Ditech could close on the loan. Prior to the appraisal I was under the impression that the appraisal was just to appraise the value of my home. There was absolutely no mention that the loan was contingent on the required repairs noted by XXXX XXXX. I replied that I was confused because I applied for a loan where the money I was borrowing would be used for home improvements like the repairs noted in the appraisal. She asked me to have a talk with XXXX XXXX the originator of the loan. On a phone call, XXXX advised me to borrow the money for the necessary repairs from someone or somewhere else in order to close on the loan. In his final email XXXX alerted me that they could not close on the loan until the repairs were made per the appraiser.
My mortgage will be paid off by XXXX XXXX. I have since heard from XXXX about moving forward with the required repairs and the loan process. I told her that I was withdrawing my loan application and would look for another lender for my Cash Out Refinance loan.

Complaint: In XX/XX/XXXX Ditech notified us that we would be given a new account number. When that happened our interest rate went from 1 % to 7.50 % and payment went from {$87.00} to {$310.00}. This was not correct since the above was in effect until XXXX of XXXX, and even at that time the contract does not go to7.5 % it only goes to % 2 with a payment of {$100.00}. This was all per a loan modification ( " 2MP '' ) done in XX/XX/XXXX.
Each of the last 2 months we have been unable to make payment on the website as it shows the higher rate and payment. So we called and made payment on the phone with a representative for the correct payment amount. ( confirmation numbers are in documentation ). We continue to get calls and letters stating we are over 52 days past due and they have charged late fees.
When we speak with someone on the phone or we go onto the web site it shows the correct interest rate and payment but letters and phone calls state the opposite.
When we last spoke with a representative XX/XX/XXXX we were told, " We are working on it. We do not have a resolution date. We have over 11,000 accounts with this same problem. '' We are concerned about our credit report, almost daily letters, weekly phone calls and other possible repercussions since they do not have a resolution date. Since it has already been over 2 months since this all started, any help you can give us would be greatly appreciated.

Complaint: I have contacted Ditech MANY times about my concerns, but nothing ever gets resolved.
Every year, they send a XXXX statement to me, and I end up paying taxes on that amount. I have asked them at least seven times where this interest they have supposedly paid me is. Most recently, I asked in XX/XX/2019. I keep getting put off. I got a letter saying they were looking into the matter. Then I got a letter saying they were still looking into it. It's nearly the end ofXX/XX/XXXX, and no one can tell me where this interest they supposedly paid me got credited.
I have checked my account every month, gone through the escrow, funds applied to the principal balance, etc., but there's no record of my EVER being credited any interest.
This has been an annual battle, and I'm weary of it. I'm fine paying taxes I owe, but if I'm not getting the interest as Ditech is claiming, I should not be paying taxes on it.
More recently, when I went to pay off my mortgage ( on XX/XX/XXXX ), I noticed they charged me {$190.00} in late fees even though my mortgage due date is on the first of the month, and they had already processed my XX/XX/XXXX payment. I can't be paying late if I'm 10 days early.
Both of these issues seem like consumer fraud to me, and I'd like help getting this sorted out.
Ditech is useless when I call or write. I get a run around and " we're looking into it '' without ever getting resolution.

Complaint: I am in the process of Mortgage Assistance Application expecting the the mortgage servicer, the Ditech Financial , LLC, will complete this process and recommend one of few solutions to help me with mortgage payments due to a temporary financial hardship occurred because of the disastrous events happened with my property without our role in it - only a liability as the owners.
Today, XXXX XX/XX/2019, I receive a surprising letter from our mortgage services, printed on the CFPB template " Loss Mitigation Acknowledgment Letter _ Complete LMA Retention '' is changing the Mortgage Assistance Application into never asked Loss Mitigation application and asking for Retention and a completely different schedule of payments. Prior .representatives of the Ditech Loan Modification Department , 5 times, when we were adding information to the Mortgage Assistance Application, have agreed to put hold on regular payments of the mortgage due to the special circumstances in this case.
The current change will create a necessary burden of additional {$10000.00} which should be removed and the today 's letter retracted.
I understand that Ditech Financial LLC is in financial problems ( bankruptcy chapter XXXX filed recently ) but misleading customers to collect unearned profits is not a legal manner of solving their problems.

Complaint: I prepaid approx 52 % or {$200000.00} toward a balance of {$370000.00} with Ditech. The {$370000.00} was shown on the statement from Ditech dated XX/XX/2019. I mailed one check for {$200000.00} as prepaid principal on or about XX/XX/2019. It finally credited in 2 parts, {$50000.00} on XX/XX/2019 and then {$150000.00} on XX/XX/2019. The loan is an annual adjustable with the rate adjusting with the XXXX payment each year. A Ditech representative advised me to ask for a loan modification which would translate into a reduced payment going forward. Loan modification docs were sent from Ditech to me by XXXX. They required a signature from me, 2 witnesses and a notary. This was all done one XX/XX/2019 at my attorney 's office and copies sent back to Ditech in the enclosed return envelope by way of XXXX. My attorney retaining copies of all. It was signed for by XXXX XXXX at Ditech on XX/XX/2019 at XXXX XXXX. Tracking # XXXX in XXXX, FL. The 11 payments prior to the principal reduction had been {$2400.00}. After the modification the 12th payment which was for XX/XX/2019 payment dropped to {$1100.00}. This seemed fine. Then the statement arrived dated XX/XX/2019 showing a balance of {$170000.00}. This seems fine. However on the following statement dated XX/XX/2019 the required payment is showing as {$2500.00}. This is way, way off it should be about {$1200.00} on a 19 year amortization which is the time period left in the contract. I have made 8 contacts with Ditech over the past month plus. Including the hold time they have averaged about 45 minutes each. I have sent letters and had live chats with Ditech reps. I always get the same run around " it is being reviewed '', " we see the problem '', " I can't change your payment '', " you are not allowed to talk with anyone who can change the payment because they don't take calls ''. This has been well over a month and now the payment is almost due. I am unable to get this mess corrected. I understand that filing for BK and having court supervision makes things complicated for Ditech. It is clear and obvious they all the docs since the XXXX payment was modified and properly reflected the principal reduction and loan modification. According to the phone reps at Ditech if I don't make the requested payment it will be reflected as late on my credit report!

I need to clear this matter up ASAP Ditech financial is " Clouding my Title '' without proving evidence that I owe a debt. To my knowledge I never took out a second mortgage.
This is very alarming ...

Complaint: date XX/XX/19 amount {$650.00}. Ditech agent proceeded to take two payments of {$650.00} when during the recorded phone call I told her I only had enough for one payment and when I get paid next week I would sent next payment. I looked at my bank account today after the gas station said there was no money on my debit card for gasoline. What I saw was an overdraft for {$500.00}, a {$28.00} charge fee from the bank, and a deficit on the account of {$160.00}. that is when I saw two ach to ditech each for XXXX. I then went to my email and saw two confirmations one minute apart even though only one payment was authorized. I have emailed ditech but have no money now for XXXX as like many others in the country, I live paycheck to paycheck and the little left til paycheck next week was just enough for XXXX. I am sure the company will say it was a mistake, but I would like to say a mistake with consequences. Possibly this double payment mistake has happened to others

Complaint: I have been trying to get an issue with my escrow account resolved for almost 3 weeks with DiTech. I have had THREE different escrow analyses performed all in a span of 14 months : XX/XX/XXXX : paid {$49.00} shortage XX/XX/XXXX : paid {$4100.00} shortage XX/XX/XXXX : asking for another {$5900.00} by XX/XX/XXXX I know that my tax liability did not increase by 46 % between XX/XX/XXXX and XX/XX/XXXX.
I do not know why they are not taking the {$4100.00} payment that I made on the escrow analysis performed on XX/XX/XXXX into account for the analysis performed on XX/XX/XXXX.
If you account for the amount I just paid on the analysis dated XX/XX/XXXX ( {$4100.00} - check cleared my bank on XX/XX/XXXX ) and add the new proposed amount by DiTech on the analysis performed on XX/XX/XXXX ( {$5900.00} ) there is a total of {$10000.00} of a " escrow shortage ''.
There is no way that I should have to pay out {$10000.00} to an escrow account in a 3 month span, so I figured I would call DiTech to get some information.
I called DiTech on XX/XX/XXXX at XXXX CST and had to wait on hold for 50 minutes only to be told by the agent that he isn't sure what is going on but is sending my account to a " researcher '' where I am to call back myself in 10 business days ( XX/XX/XXXX ) to get an answer.
I called DiTech a second time on XX/XX/XXXX at XXXX CST as requested only to sit on hold for another 51 minutes. The agent " XXXX '' finally informed me that she has no information in regards to this matter and that it is still being " researched ''. She took down my email and told me that she will reach out to me by the end of the week with an update, but I have yet to hear from anybody.
I can not get any information from my mortgage company in regards to my mortgage and why my escrow account is calculating incorrectly. DiTech has recently filed for bankruptcy and their customer service is severely lacking in the ability to provide basic information on a mortgage that has been in their care for well over a year.

Complaint: When my home mortgage loan began with Green Tree, I signed up for their bi-weekly automated payment program and they initiated the withdrawals from my bank account. One month later my loan was transitioned to Ditech and initially nothing had changed ( due dates remained the same and the automated bi-weekly program continued ). In XX/XX/XXXX, the due date on the monthly statements changed ( 1 day earlier ) and late fees started to accumulate despite the companies automated bi-weekly payment plan. In XX/XX/XXXX, Ditech discontinued their bi-weekly automatic payment plan, so I initiated bi-weekly payments to be paid by my bank without any gaps in payments. All of a sudden, my payments were being applied to bogus late fees that had been accruing without my knowledge. Upon a detailed review of my account payment history, it became evident that principal payments had been applied 3-5 months late. However, the more serious concern is that when I finally got the company to reverse the late fees, 2 payments that should have been applied to principal were instead applied to a future months payment. I have spent many months trying to get this situation corrected, but have been unsuccessful, as their customer service department / call center makes it nearly impossible to reach the same supervisor on subsequent calls. I truly believe that my issues originated with system updates and that if this has happened to me then this has likely happened to other Green Tree / Ditech customers that were utilizing the company 's automated bi-weekly payment program.

Debt was result of identity theft
Complaint: In response to Ditech 's letter, I have included the FTC Identity Theft Report and the Police Report in order for them to investigate further as they stated. As you can see, Ditech 's Mortgage Statement and Ditech 's Insurance Policy names me as the borrower and Ditech as the Lien Holder. Ditech has created a fraudulent account using my personal identification to unjustly enrich themselves. By creating a fraudulent account with my name and without my authorization, Ditech is in violation of the False Claims Act and a conspirator to defraud the U.S. Government.
Because discharges of debts and new mortgages are not publicly recorded, these are excellent opportunities for Banks, Lenders, Mortgage Servicers, Foreclosure Law Firms and Title Companies to create fraudulent documents when needed to defraud the U.S. Government, Insurance Companies, Investors, Homeowners and the U.S. Tax Payers. A perfect example of this is that my property was previously and currently listed on XXXX for sale by XXXX XXXX XXXX. In XXXX XXXX loan purchasing sale contract in Addendum A it states : ( 5 ) No Recording. Buyer agrees that neither this Contract nor any notice or memorandum hereof shall be recorded in the Public Records of County or State where the Property is located or any other public records. Buyer shall constitute a material breach by Buyer of this Contract and shall entitle Seller to invoke the defualt provisions hereof.
XXXX has stated that they received their loan file from Ditech. Both XXXX and Ditech have been receiving HUD disbursements in violation of the False Claims Act. In reference to my loan and subsequent foreclosure and eviction, Ditech and XXXX have violated the False Claims Act, SEC Laws, the FTC, the Fair Debt Collections Practice Act, the Fair Foreclosure Act, the Dodd Frank Act, the National Mortgage Settlement, committed perjury on the Courts and Bankrutpcy Fraud. Submitting fraudulent documents and omitting documents to the court to obtain a judgment in your favor, makes the basis for any case, weather ultimately favorable or not, fraud and the case itself and the documents contain therein still fraudulent.
I am XXXX XXXX due to an accident and suffer from XXXX XXXX as a result of my injuries. This disturbing process of foreclosure and eviction has exasperated my already painful and XXXX medical conditions and caused new ones to develop. My husband has XXXX XXXX XXXX and also suffers from XXXX XXXX, and is seeing a XXXX for XXXX due to these false claims, the foreclosure, and the imminent eviction from our home.
