Complaint: XX/XX/XXXX I received a letter from my mortgage services DiTech financial stating, Ditech has conducted a review of your mortgage loan ... ... the review determined that you previously paid {$360.00} in excess post-petition payments ... .these amounts will remain on your account ... please consult your next monthly statement for detailed information regarding your mortgage loan, as this remediation May have changed your unpaid principal balance and/or the date when your next payment is due. I carefully checked the next two statements and went online and viewed my account in particular the transactions page which shows all money going in or going out of the account. This overpayment never showed up anywhere. I called Ditech several times since XXXX the second time I was told that an investigation team was going to track down where that money went. I heard nothing back each time. I checked every statement since that letter and never saw my money applied anywhere. Ive had two escrow analysis done since that letter both indicating a shortage hence my monthly payment increased each time. I carefully checked both of these analyses and that money was never applied to principle, interest, held in suspension, escrow or anything else. The last time I called I was on the phone for 2hrs and 44min. This woman XXXX ext. XXXX Bankruptcy customer service, looked everywhere for this money. She even went back prior to the letter to see if they lumped it into some other amount. It just wasnt there. She spoke with her supervisor XXXX twice and checked a few other places it may have been that ( she ) I didnt know about. Still couldnt find it. A concerning fact is that she told me that there were NO other notes on my account about previous calls or investigations or research of this matter! XXXX was doing her best but it appears that money was received by Ditech, it belonged to me, they acknowledged it belonged to me, they have the money and have not returned it to me. XXXX attached the letter to an order to elevate the matter to the bankruptcy team. She swore she would call me back later that day or the next day ( call was made XX/XX/XXXX ). Big surprise they never called.

Complaint: My home loan and insurance were recently separated into two different accounts. The home loan account is paid bi-weekly via electronic payment through my bank account. The insurance account is not eligible for electronic payments through the ditech site or my bank for some unknown reason.
XX/XX/XXXX, prior to the changeover, which indicated a payment due XX/XX/XXXX of {$450.00} and a deferred balance of {$4800.00}. When the new computer system came online, it stated that my payment due XX/XX/XXXX was {$530.00} which represents my normal principal and interest payment. This is, obviously, incorrect. It also states I have and Advance Balance of {$4800.00} - also incorrect - these funds were deferred not advanced and that one word makes a huge difference.
All payment through the XX/XX/XXXX payment were correctly applied. The following payments were made to the home loan account after XX/XX/XXXX which should have been applied as follows based on daily interest at 11.5 % over 14 days between payments : Beginning principal balance approximately {$42000.00} after XX/XX/XXXX payment but XX/XX/XXXX statement says {$42000.00} so we'll go with that XX/XX/XXXX {$290.00} interest : {$180.00} principal {$100.00} new principal balance {$41000.00} XX/XX/XXXX {$290.00} interest {$180.00} principal {$100.00} new principal balance {$41000.00} XX/XX/XXXX {$290.00} interest {$180.00} principal {$100.00} new principal balance {$41000.00} XX/XX/XXXX {$290.00} interest {$180.00} principal {$100.00} new principal balance {$41000.00} The insurance account was paid on XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX with payments of {$75.00} each. The first XXXX were applied correctly leaving me an insurance due amount of {$130.00} due XXXX. However, the payment made on XX/XX/XXXX - though the correct account number which was confirmed with ditech on XX/XX/XXXX was on the check - was applied to my home loan account as {$13.00} interest and {$61.00} late fees. the XX/XX/XXXX payment of {$75.00} was applied to the insurance account.
Let me be very clear about this : I OWED NO LATE FEES!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
However, payments were put into the unapplied account - which while I disagree with the concept I understand that until a full payment is received it can sit there and then be applied and appropriately dated to actual receipt date thereby calculating interest the right way. Reallocating the payment may take a phone call - which I've done before with no problem but not now! I have been paying bi-weekly for seven years and it as been handled appropriately until this change.
This is how my payments were applied : XX/XX/XXXX payment {$290.00} to unapplied XX/XX/XXXX payment {$370.00} to interest ( 27 days of interest?????????? ) and {$290.00} was pulled out of the unapplied amount - I don't know where it went!!!!!
On XX/XX/XXXX someone magically paid {$200.00} worth of late fees that I didn't owe!
XX/XX/XXXX payment {$180.00} to interest ( at least that's about 14 days of interest but calculated on a very incorrect principal balance ) and {$100.00} worth of late fees that I still didn't owe!
My insurance payment on XX/XX/XXXX for {$75.00} was allotted to 1 day of interest of {$13.00} on XX/XX/XXXX and on XX/XX/XXXX {$61.00} worth of late fees that I still don't owe!
XXXX payment was applied to the unapplied account On XX/XX/XXXX I confirmed the insurance account number and asked that the payment due discrepancy be investigated with Breezy On XX/XX/XXXX I was told by a foreigner reading a script that they would not reallocate my payments out of the unapplied amount.
On XXXX I was hung up on three times before I ever got a human being.
On XXXX I was told by a foreigner, XXXX, that my payment would be reallocated.
On XX/XX/XXXX I spoke with a knowledgeable person, XXXX, who stated that the problem would be fixed with the next computer update.
On XX/XX/XXXX another knowledgeable person, XXXX, explained that the computer system was still not right but the account should be correct by the end of XXXX.
On XX/XX/XXXX a rude person named XXXX asked me just exactly what did I want him to do that no one else I've spoken to so far had been able to do to which I responded I'd like my payments accurately applied so he sent me to his supervisor XXXX who told me that I shouldn't pay bi-weekly and that she couldn't see any of my payment history but she would send the account to be researched.
On XX/XX/XXXX XXXX told me that he would take care of moving the insurance payment to the insurance account.
On XXXX I spoke with XXXX XXXX who was working on fixing my account. I spoke with her again on XXXX when I found out that principal balance is now being reported to be over {$46000.00} when it is less than {$42000.00}.
There is a reason I pay bi-weekly and it can not be changed. It is not for ditech to tell me how to make my payments as long as they are made timely - which they are! This advance amount is a deferred amount and is not collectable until the end of the loan. At {$5.00} per late fee some 75 months or 6 1/4 years worth of late payments have been appropriated that I never owed. These errors are causing interest to be accruing based on incorrect principal amounts.
As of XX/XX/XXXX my account is still grossly incorrect and none of my payments made since XX/XX/XXXX have been corrected and 1 of my insurance payments is not applied to my insurance account.

Complaint: I have had some health and financial setbacks in the last 2 years. I have been trying to get a loan modification from Ditech for over a year and a half. However here in the last month they have agreed to give me the Flex Modification which lowers my payment by {$200.00}. I tried to negotiate a lower interest rate but was refused. Currently I have 18 years till the loan is paid with a 4.37 rant. The mod offered will keep my current rate but extends the terms to 40 years. I really could not understand the 40 year extension and really don't want to sign to the extension. Also in the modification documents there's a clause that states I have to get written consent from the mortgager to sell my house, I wanted to know why such a clause was stated in the verbiage. If I should sign this modification, I don't want this clause to interfere with me refinancing in a year. I have talked to Ditech representatives which says I can refi at any time but will not state this in written in the documents. Ditech will not remove the clause stating I have to get written consent prior to selling my house.
Also Ditech sent me letters that state they loan is being transferred. I have receive welcoming info from the suppose to be new servicer. Then Ditech called me to say the loan is not being transferred. I really don't who to believe considering all the bad reviews listed about Ditech. Ditech has filled bankruptcy twice in the last 2 years. Where do this put me and my loan perspective.

Complaint: DiTech Mortgage ( formerly Greentree ) held my mortgage on a house I owned in XXXX XXXX, NJ from XX/XX/XXXX to XX/XX/XXXX. Two issues that have STILL NOT been fixed by them despite repeated promises to do so : They still owe me over {$7200.00} in escrow overpayment/refund. I have called them two or three times every month since XX/XX/XXXX and STILL do not have the money. I have lost interest on that money, have been unable to pay my daughter 's tuition bill with some of it and, quite simply, it is MY money.
They falsely reported to the credit bureau companies that I missed or was late on payments 9 times when they held my mortgage. It has been proven to them repeatedly that they are wrong. I never missed a payment, was always on time and usually EARLY.

Complaint: Our mortgage payments are handled through our online bank. We normally send Ditech $ XXXX/month, which is above the monthly payment. We have never been late and have never missed a payment since we got the mortgage in XX/XX/XXXX. We sent Ditech 's Escrow department ( XXXX ) a check for {$100.00} in XX/XX/XXXX, to cover the increased escrow cost. Instead they applied the funds to our principal and raised our monthly payment by {$9.00}. This is not the first time they have done this. Secondly, we sent a letter dated XX/XX/XXXX, requesting PMI removal and authorized the appraisal of our home at our expense. We received a letter dated XX/XX/XXXX denying the cancellation of PMI stating that our mortgage is " scheduled to reach 80 % LTV XX/XX/XXXX. '' Before we requested cancellation in XX/XX/XXXX, we checked their policy and there was nothing about " 80 % loan to value. '' We are both retired and feel that if these actions are not unlawful, they are unethical.

Complaint: Started receiving certified signature letters from mortgage lender that account is past due. Lender stated if account is brought current within a date set that the property would go into foreclosure and be sold. Contacted lender and verified account is current. Have received over 20 letters in less than 2 1/2 weeks from the lender stating the account is past due. I have contacted the lender twice and spoke to several representatives verifying the account is current. Was told the letters were a mistake. But still currently receiving letters every day.

Complaint: I requested my paper work on XX/XX/2019 for my pay history and also for my payoff .I have two remaining payments on my home that I have all the paperwork for but ditech refuses to send me my paperwork .Ditech says we owe 5 more payments .But I have received letters from them stating totally different amounts so that is why I requested my payment history from ditech I have called so many times asking them where my paperwork is and every time they give me lame excuses.I have made all of my payments to them to date we even over payed them ..I have all my paperwork to prove this.When I have called them about where my paper work is within three or four days later we get a letter from ditech stating our insurance isn't exceptable and we better get it fixed or they will place force their own on us .I have always had my own insurance the whole twenty years { I have all my proof of this } .I am tierd of dealing with real rude and nasty people from ditech .And to top it all off yesterday we got a notice in the mail that Ditech fieled for chapter XXXX for the second time .This company needs to be shut down not given a waver of dismissal for their bad miss handling of company funds.They prey on lower income people and ditech calls us high risk ..how dare they ... they are filing for chapter XXXX AGAIN..thankyou

Complaint: I paid off my mortgage 12-15 years ago with XXXX XXXX. In XXXX of XXXX I went to my bank, XXXX XXXX, to apply for a home equity loan to update electrical. I previously had a credit score of XXXX and XXXX XXXX told me they wouldn't give me a loan because my credit score was so low. XXXX XXXX told me that there was an outstanding mortgage on my paid for home which had been taken out in XXXX. I did not apply for or get a mortgage on my home. XXXX XXXX told me that the mortgage on my home was held by Ditech Financial, LLC. I have called Ditech numerous times and asked them to send a copy of the mortgage with my signature to me. Ditech has refused to do so. Someone has committed fraud by taking a mortgage secured by my home without my knowledge or permission. I want Ditech to provide the information and I want the mortgage removed from my home since it is fraudulent and it is affecting my credit adversely.

Complaint: This Complaint is against Ditech Financial LLC, Ditech Holding Company or wahtever name they chose to do business under today. I've attached documents showing my Escrow Analysis documents from XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. These documents show an increase in my county tax payments. I believe these are accurate. These documents also shows an increase in my combined Property Insurance which I do not believe are accurate at all. I did not request any changes to my Property Insurance coverage and I have tried to contact the company, but I never get anyone to answer the phone. I also have just received a letter concerning Ditech filing for Bankruptcy so I did some internet research and found thousand 's of complaints against Ditech and their Holding companies. Many of these complaints are very similar to mine and go far beyond my experiences with this company. I believe Ditech my be charging me for property Insurance that is not required under my mortgage agreement or by city , county or state law.

Complaint: I have a mortgage and escrow with Ditech. I received an annual escrow analysis dated XX/XX/XXXX that states only 1 of 2 county tax bills had been paid in XXXX.
On XX/XX/XXXX, I both called and wrote an email to Ditech asking for clarification on the missing XX/XX/XXXX payment.
Today, I received a letter from Ditech stating " all taxes are paid current and there are no prior year delinquencies '' without any verification or further explanation. Another copy of the XX/XX/XXXX escrow analysis was included which clearly states only 1 of 2 tax payments was made in XXXX.
My county tax department shows I still have an amount due from XXXX.
I have wasted too much time on this issue to deal with Ditech 's incompetence in researching their mistake. I will be cancelling my escrow with Ditech and file complaints against them as well.
