Complaint: So, my account was sold to another company, and Ditech Financial stated they mailed me a check for the overage on my escrow when sent me my end of year Financial Escrow Account Disclosure Statement, which was well after XXXX when I received it. I called them shortly after I received the statement in early XX/XX/2019 to find out where my check was and after waiting fifty nine minutes and thirty-six seconds I was finally able to speak to someone. She took my information and said she would send me out another check. Well, it now XX/XX/XXXX, and I still do not have a check ; however, what I do have is yet another Financial Escrow Account Disclosure Statement dated XX/XX/2019, stating a check was sent. I still do not have my overage check in the amount of {$140.00} that I have supposedly been sent twice now. I

Complaint: Ditech has chosen to exercise their option of taking payments that are under/above the statement amount and placing them in an Unapplied Funds or Suspense Account. This triggers the 30-day late report to the creditors. The domino effect is ignited and the customer has trouble keeping their payments current and it snowballs into a Servicer Manufactured Default. I am disputing the following late payments for this reason. Disputing Late Payment of XX/XX/XXXX : Payment received by Ditech on XX/XX/XXXX see attached statement. The payment should have been {$1800.00}, they received {$1800.00}. Instead of applying the payment, they exercised their option of Unapplied Funds. In addition, a second payment was sent on XX/XX/XXXX for {$2100.00}, amount on statement {$2000.00}. Disputing XX/XX/XXXX, not 60 day payment of {$2000.00} was received by Ditech on XXXX, see attached payment history. In addition, on my XX/XX/XXXX Statement Date, it says that no principal was paid in XX/XX/XXXX, but interest totaling {$17000.00} was received and paid. While the customer is always trying to catch up and Ditech seems to be in the business of Escrow Abuse and using the Unapplied Funds option to create a Servicer Manufactured Default. It is apparent that I am in this vicious cycle with this company. I can never get ahead as they exercise their option, a loophole to harm hard working paying individuals. This home was purchased in XX/XX/XXXX, it was refinanced in XX/XX/XXXX with XXXX XXXX who sold the loan to GreenTree, now Ditech, and it has been a challenge to keep up with their pernicious practice of placing the entire monthly payment in a suspense account when only the escrow account is short. This home is our only family asset after losing all savings and retirement in XX/XX/XXXX. My intent is to keep, maintain and repair my home and am trying to refinance to accomplish that necessity while rebooting our finances. We are self-employed and our business generates the funds to afford our home. Income does ebb and flow, which has also caused me to be late on occasion, it is not by choice and certainly my intent is to get ahead of the payment, not be in arrears. In addition, the Escrow Analysis has been sent annually in XX/XX/XXXX, and suddenly, a second one came in XX/XX/XXXX, just three months later with an increase that mathematically did not add up. I have disputed this directly with Ditech. This company is unethical and all I want is my credit repaired in order to refinance with a new, reputable mortgage company.

Complaint: In XX/XX/XXXX I refinanced a VA mortgage. During that refinancing process apparently I was overcharged {$150.00}. Ditech Financial did not return that money to me as part of the closing process. Likely they discovered it on a later audit. Although knowing my contact information as it had not changed since the closing they chose not to mail me a check. In early XX/XX/XXXX they did mail me a letter to my proper address, not with a check, but with a claim form to get a check. On XX/XX/XXXX I sent that completed claim form back to them. They still did not send me a check. on XXXX XXXX I received a notice from the Ca State Controller that they owed me money and were asking for it to be forfeited. On XX/XX/XXXX, I sent Ditech an email which they responded to on XX/XX/XXXX wanting another claim form filed. Clearly they don't want to pay me the money. I will upload my XX/XX/XXXX submittal of the claim form as well as its receipt from the Ditech Fax, my notice from Ca California State Controller and my email from an accountant at Ditech again demanding I fill out the same form I have sent them.

Complaint: XX/XX/XXXX To : DITECH Ref : Account No. XXXX. Dear Sir/Madam : On XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX, we have requested from DITECH to correct some issues, I have found related to our account. The first one was made by XXXX XXXX on reference to the payments made to this account, in whom she was not reflected and appeared to be the account closed improperly. She has not declared bankruptcy, and consequently all reference to the payments must be adequately reported. We received a letter from DITECH, dated XX/XX/XXXX, informing they have received the request at that date, but, since then, we dont have received any response. The two others are related to the Escrow Account. On XX/XX/XXXX, I requested from DITECH to correct the Escrow Analysis, indicating where the errors were found, specifically an Escrow Shortage of {$4300.00}, who comes up from nowhere, since the Property Taxes, {$1900.00} and the Homeowners Insurance, {$4000.00} for a total of {$6000.00}, were paid on full, with my monthly escrow of {$500.00}, totaling {$6000.00}. The response, we received from DITECH, reiterates the same error, and there is no explanation of from were it comes up the shortage of {$4300.00}. I decided to call at he Customer Service, to find any one to understand the situation, but it was worst. They repeat what is on the Escrow Analysis. Nobody can understand what I say. On XX/XX/XXXX we signed up the Mortgage modification with DITECH, where was established a monthly payment of {$1600.00}. These payments have been made monthly through a Bankruptcy trustee, according to the law. By the end of XX/XX/XXXX, DITECH reduced the monthly payment from {$1600.00} to {$1500.00}, but the amount sent was the same {$1600.00}. The difference was deposited on the unapplied funds, totaling by the end of XX/XX/XXXX, {$1200.00}. The only way to reduce monthly payments can be if there are enough funds on the escrow account to pay for next year taxes and insurance. In effect, by the end of XX/XX/XXXX there was {$7000.00}, less the insurance and taxes paid, that lets {$1300.00} remaining for XX/XX/XXXX. Note than we didnt receive by mail an Escrow analysis for XX/XX/XXXX, nor XX/XX/XXXX. This last one, I took notice when I opened an electronic account with DITECH by the end of last year. The supposed Escrow shortage has been applied to the account, then the monthly payment has been increased by {$360.00} more on the escrow, additional to the {$500.00}, for a total of {$870.00} only for escrow. The monthly payment was fixed on {$1900.00}, and since then, the monthly payments are not applied to the account, because they dont meet this figure. Then DITECH first have stolen our {$1300.00} of money from the Escrow Account, and second its charging us for a {$4300.00} that We dont owe. We received a letter dated XX/XX/XXXX, to iform us of an ongoing investigation, but we didnt have received any results, instead a Final Escrow Report dated XX/XX/XXXX with the same figures we are questioning. There are more irregularities and illegal actions commited by Ditech on reference to our account. We expect and deserve a detailed explanation. Thank you XXXX XXXX XXXX XXXX

Complaint: Ditech misplaced a payment, in XXXX. In the meantime they charged me {$290.00} late fees over 7 months. But mind you my payments were paid on time each month. They credited me {$230.00} for these late fees. Where is my other {$64.00} that I was wrongfully charged? And due to Ditech thinking I was paying late each month, they took any additional principle paid and added it to interest. So they have managed to take over {$350.00} of my money that they did not have a right to. Another problem is they had my street address on my statements, and we do not get street mail delivery, but no one could try and find out why these statements were getting returned. So I got no notice of any thing. They have since sold my mortgage to some one else and I have no idea who because I have not gotten any notice. I asked them to email a copy and they have yet to do that. I do not know who to send my mortgage payments to. They refuse to do anything to help me and went so far as to have a supervisor hang up on me.

Complaint: I have tried to refinance my property through XXXX. While trying to refinance XXXX advised me that Ditech Financial LLC has a Lein against my property for a second mortgage that was paid in full on XX/XX/XXXX. I have attempted to get this resolved with Ditech since XX/XX/XXXX. I have made calls to Ditech, sent E-mails and letters to their company with documents proving that I have paid this second mortgage in full. Now I have lost {$1100.00} because of Ditech holding an Illegal Lein against my property. Ditech 's so called Customer service has not contacted me in any way to get this resolved. My next action will be to retain a Lawyer an file a Lawsuit against Ditech Financial LLC. Because Ditech is Illegally holding a Lein against my property, I can not Sell, Refinance or get a second mortgage on my property. Ditech owes me {$1100.00} so far in damages. Do not repeat do not get a mortgage through Ditech!!!

Complaint: To CFPB My name is XXXX XXXX XXXX, I had a loan with XXXX XXXX XXXX, lost my job around XX/XX/XXXX and applied for a load modification. My loan modification went though, and I was making my mortgage payment with no issues. Then XXXX XXXX XXXX sold my mortgage to Green tree/Ditech. I NEVER MISSED A PAYMENT, ANOTHER FORECLOSURE WAS PLACE ON MY HOME AGAIN ( XX/XX/XXXX ) IM ASKING DITECH TO STOP THE FORECLOSURE ON MY HOME Ditechs records show that you agreed to a loan modification in XX/XX/XXXX, while this loan was being serviced by XXXX XXXX XXXX XXXX ( XXXX XXXX XXXX ). On XX/XX/XXXX, the servicing of your loan was transferred from XXXX XXXX XXXX, to Ditech. The transfer in servicing did not alter or change the original contract. The modification agreement had not been applied to your account as of the date of the transfer. Ditech applied the modification to your loan on XX/XX/XXXX. In response to your complaint, Ditech contacted XXXX XXXX XXXX in order to assist with reviewing the application of your payments prior to the application of the modification. Ditech determined that {$1800.00} had been received prior to the application of the modification and was not appropriately applied to payments due after the effective date of the modification. This left the account past due after the application of the modification. The enclosed payment history shows that you have been submitting payments that are short of the total amount due. Please note that Ditech is unable to apply partial payments to your loan. Any payment received that is insufficient to satisfy one full loan payment is placed in unapplied funds ( UAF ) until enough funds are received to make a full loan payment. The partial payments have also contributed to the delinquency on your account. Due to the delinquent status of your account, Ditech referred your account to foreclosure in XX/XX/XXXX. Once a loan has been referred for foreclosure, Ditech may deny any payments that are insufficient to bring the account completely current. Ditechs records show that funds were returned to you on two occasions after the loan was referred for foreclosure : {$960.00} on XX/XX/XXXX, and {$910.00} on XX/XX/XXXX, for a total of {$1800.00}. Ditech advanced {$1800.00} to your account on XX/XX/XXXX, to correct the modification payment application error at the time that the loan was transferred to Ditech. This amount was applied to the UAF balance on the account. The account now reflects that it is past due {$1700.00}. If you resubmit {$1700.00} of the {$1800.00} that was returned to you in XX/XX/XXXX and XX/XX/XXXX, the account will be brought current. Ditech apologizes for any inconvenience you have experienced as a result of this issue. Ditech has ceased our foreclosure activity, waived any late fees or foreclosure fees, and once we have received the {$1700.00} to bring the account current we will be issuing a correction to the credit bureaus to reflect that your account has been current since the effective date of the modification. Complaint: In XXXX of XXXX, I was behind a couple of months in my mortgage. It was suggested by the company rep that I spoke with to apply for a loan modification and to hold off on making a payment because if it was approved it would bring me current and possibly lower my monthly payment amount. Since having bought my home in XX/XX/XXXX I had became XXXX and my husband had taken a 50 % cut in hourly wage due to losing his job after an on work injury. I filled out the necessary paperwork that was required for this application to start this process. I was then told to call weekly to see if there was any kind of an update on the application. After a couple of weeks, I had called and was told that the dept that handled those applications was 7 weeks behind on their work and to continue to call back weekly. Every week I called this company and it was only during those calls that I would find out anything about the processing of my application. During those calls were the only time I would find out if the company required any other information from me. As you can see by the attched file I was still sending Ditech additonal information on my loan modification. During the prior months, I had to repeatedly resend the same information to the company and had filled out the application 4 different times, once because I was sent the wrong application to fill out. Due to the company 's delay in processing this application, I had to resend current pay stubs and bank statements because they wanted the most current. Many times I was unable to upload the required documents to their website on my account because their website was having problems, thus I was forced to send them to the company via email. I had to pay my payments in 2 parts during the months previous and I had made a partial in XX/XX/XXXX to complete the amount they had in unapplied funds for full payment. In XX/XX/XXXX I was speaking with a rep from their company to get an update, which at that time they were still processing my application, and I told the rep that I needed to send a payment to them. I was told NOT to send any money because it would be returned to me due to the fact that I was in pre-foreclosure. I had not received any notification of this prior to this conversation. It seems that they claimed that I had received something back in XXXX or earlier. I was left hoping that the company would hurry up with my application and that things could get back on track. I repeatedly told them all I wanted to do was to start making my payments again. I had previously tried to set up an auto bank draft for my account using their website but the website would not allow me to do this without being current. I explained my problem with one of the reps and was told yeah you have to be current to do this, which made no sense to me because setting up a bank draft would have assured the company that they would at least be getting monthly payments. They had set up bank drafts in the past to debit my account for 1-time payments several times without me being current. My home was built in XXXX and it had already had 3 previous owners that this company had foreclosed on. I continued to call weekly about the modification application. Then in XX/XX/XXXX, I had an insurance claim made on my home for my roof. The company had put insurance on the home when my husband was out on workers comp and we found out that the insurance company we had was not taking the insurance premiums out of the workers comp check, the same company that paid the workers comp payments was also the same company that we had our homeowners insurance with. We were issued an insurance check for the replacement of the roof and it was sent in our name and that of Ditech. We were instructed by Ditech to sign that check and to return it to Ditech and that they would pay the contractor. Ditech later sent us a portion of that check made out to us and the contractor. We signed that check and gave it to the contractor. Ditech still is holding a portion of our insurance check in the amount of {$1600.00}. I have repeatedly requested that they send us the remaining amount that they are holding so the contractor can be paid. Ditech continues to change their mind as to what they need in order to send us that check. Both the contractor and myself have sent Ditech the paperwork that they request several times with it always being the same paperwork. I was told once that we needed and inspection before they could release the money and after 2 or 3 weeks and not hearing from Ditech or an inspector I called Ditech and was told that I didn't need an inspection. Then they would request the same paperwork from me again. Both the contractor and I would send the paperwork both through email and through fax. Now here we are in the last part of XX/XX/XXXX and I was told we need an inspection. So far no one has come to do any kind of inspection. I was told that I would hear from someone in 10 days. Ditech made the contractor sign a release form preventing them from putting any kind of lien on the home before they would release the first portion of the insurance check. Now I have someone wanting to buy my home and I am not sure how I will get Ditech to release their claim on the home. I had received notice from an attorney sometime back stating I needed to pay x number of dollars to prevent the foreclosure. I requested from that attorney the name and address of the original creditor, which I sent that request certified mail. It took a few months before I even got that information from the attorney. Now Ditech has filed chapter XXXX once again and prior to this being information being made to us we received notice that Ditech had canceled our homeowners ' insurance. I called Ditech to find out why this was done. I was informed that it was because I was being assigned a new account number and that once their system was updated that my insurance would be put back in place with no lapse in coverage. My original contract states that if Ditech has to place insurance on my home that the amount of coverage that they are allowed to place and charge me for will be in an amount no greater than the amount that is the balance of what we owe on our home. Ditech has placed and charged us for insurance premiums on insurance that is double in the amount that we owe on the home. When I questioned Ditech about this I was told that that was all they could get and that they had to put that amount on there. This is a breach of contract and we have been paying for coverage that we should not have been charged for. I need someone to help me and others like me to stop this company and their thieving practices. I'm sure that because my home was financed with the same company by the previous owners that they were foreclosed on for similar reasons.

Complaint: We bought our home in XXXX XXXX was are mortgage company. Through the years from XXXX and XXXX, are mortgage jumped to XXXX, XXXX XXXX XXXX, XXXX, XXXX, XXXX, Greentree, XXXX XXXX and everyhome now Ditech. We were never told about our mortgage being sold. Ditech is forclosing on us with a note dated from XXXX XXXX. There documents say they received our loan from XXXX in XXXX.but we were paying Greentree since XXXX. Because everhome sold our loan to them. That's the only time we got notice sale of our mortgage. We can never get anyone on the phone to discuss our loan. We had to use are son 's phone because it had a different phone number and immediately someone answered. But didn't show us having an account with them. So she transferred me. And was left on hold for an hour and 45 minutes. Just hung up. They say we can modify but keep saying there missing things. Now we're a little over a year of them refusing to except payments and not answering the phone. Also kept sending everything they asked for but keep getting letters and statements with different amounts owed. Or items missing. Horrible to drag customer 's along the longest they can, and cause them to get father behind when we could have payed our mortgage 4 months after the missed payments. There customer service knows nothing and you never talk to a representative. Something needs to be done.
