Complaint: To whom it may concern, My name is and I am a customer of yours, account number, in XX/XX/XXXX My wife and I had entered chapter XXXX bankruptcy due to overspending and being heavily in debt. We never missed a payment but realized that we were not getting ahead. When our case was filed, the courts ordered an escrow analysis on our account. When the results came in it was noted that our account was short the cushion that is required, so in turn raised our payment to accommodate the shortage. We were never mailed said analysis nor were we notified. Even after the analysis was done, we received a statement with our old amounts on it even after the date was given on the analysis said they would raise. When we finalized our case and signed all the paperwork, we did not notice the raise in our payment. So, we continued to pay the old amount for 48 months. If we would have received an analysis, or if would have been sent to the courts or my attorney, the next year I could have adjusted my payments then I would not be in this predicament. In XX/XX/XXXX we received a statement with all the numbers on when that hadnt been the case before due to the federal law and the new changes. After reviewing the statement, I noticed that we had what was called monies in suspension so I inquired about this and that is when I found out about the arrearages. I instructed my Wife, who pays the bills in my house as with most households to start paying a little extra on top of the new amount. So, we proceeded to do so for the 12 or so months. In XX/XX/XXXX I pursued this matter even more and started to do my own digging and concluded that your company has not done an analysis for XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. After many phone calls to your customer service dept. We finally realized this, however no one in the department would or could not answer the reason why. So, the person I was dealing with expedited an analysis for XX/XX/XXXX and the previous years however those years were not performed. I have been calling about this matter for 2 months now, if not every morning but close to it. I have reached the customer care person, the escrow person the director of that division and so on. After receiving the payment history from my insurance company and my property taxes and performing my own analysis there are some discrepancies that need to be addressed. Bankruptcy is stressful enough but the process of getting this straight is very taxing. And all I want is when I come out of Bankruptcy in XX/XX/XXXX that it is a smooth transition and I can move forward without any further blemishes on my credit report. I am writing this letter for your assistance in this matter as I am not getting anywhere with the customer service, I keep calling every day. I am a man that if I owe, I will pay but you must give me proper documentation stating so. Thank You

Complaint: On XX/XX/XXXX I closed on my first home. At closing, the projected payment for escrow was based on the previous owner 's exemption status of Over-XXXX, XXXX. Due to her exemptions, she was 100 % exempt from county and city property taxes and paid {$0.00} taxes. Clearly, I'm not over XXXX and XXXX and these taxes were not accounted for in my new escrow account, despite the tax certificate documentation. The lender did not accurately disclose my tax liability and deceived me to qualify for an FHA loan. In XXXX XXXX, I received an Annual Escrow Analysis from my current loan servicer citing a severe escrow shortage of {$6800.00}. My mortgage went up from {$1500.00} to {$2400.00}, a monthly increase of {$950.00}. I retired on XX/XX/XXXX and am on a fixed monthly pension of {$3100.00}, but now I've defaulted on my loan facing possible foreclosure. However, I am under review for a loan modification. My current mortgage is {$1100.00} for PI and {$1100.00} escrow for taxes/insurance. I am paying almost as much for my escrow as I pay on my loan. There's something inherently wrong with that. As a first time home buyer at closing, we expect the professionals to do their jobs, with truth in lending. I was deceived and totally unprepared for this massive shortfall that has impacted every facet of my life to date.

Complaint: Ditech mismanaged 3 extra principle payments. 2 of which are resolved. The third {$300.00} payment from XX/XX/2018 is still not applied. We have been sending letters back and forth since XXXX of 2018. We have sent bank statements at the request of Ditech only to be told a month later that they now needed copies of the cancelled checks which we provided. We believe they are purposely delaying in anticipation of their bankruptcy proceedings. We have copies of all communications from Ditech and all the letters we have sent. With all the letters and statements and copies of checks we have 20 to 30 pages.

Complaint: In XX/XX/XXXX, My mother, passed away. XXXX, XXXX, I went to City Hall to file the paperwork to become the Executor of her Estate because I was her only child. Going through mail I found statements from the mortgage company, Green Tree Mortgage, stating that she was behind in her payments on the $ XXXX loan that she had taken against the house that was already paid for. She tool out the loan to get repairs done on the house. I called them to make arrangements on the delinquent payments. The agent said that they needed the death certificate and the estate paperwork to discuss the loan with me. I did send, fax, the necessary documents needed to so that I could assume responsibility on this loan. I did make payments XXXX and XXXX, XXXX towards the billing. The payments were accepted. I called several times, XXXX - XXXX to see what I needed to do to assume the mortgage in my name. During the several attempts to get this done I would get a different agent and they would look up the account and say that they did not have the death certificate or the estate paperwork. I am not sure if it was lost because of the loan being transferred to Ditech Mortgage. I went through the process on several occasions of getting the documents to the company so that I can get a resolution. I would give the agent the fax number that I sent the information along with the information that I had from the receipt that I had from the fax confirmation sheets. In XXXX, I received a notice to contact the City of XXXX because the house was now in foreclosure. I attended the court date and was assigned to a housing counselor. I went through the necessary finance classes and completed them and worked with the housing counselor with a financial packet to the mortgage company. I also was able to change the deed to the house in my name with the assistance of Community Legal Services in XXXX. During XXXX, we submitted Act 91 and I was denied. We sent several completed packages getting responses back as we need updated banks statements or other documents that were submitted with the assistance of the housing counselor. I never received a response from them regarding the modification on the loan. In XXXX, I received another letter from the City of XXXX about the property again. I went through going to the necessary classes again with the assistance of the housing counselor. We submitted a completed application and financial packet for the modification. The letters from the mortgage company were addressed to my deceased mother asking for her income and her information. I was the one submitting the information in my name with my documents. We addressed this issue with the mortgage company 's attorneys. I received a denial letter stating that my income wasn't sufficient so we submitted a new application adding my son 's income since he is living with me while going to XXXX College. I received a letter XXXX, XXXX saying the my income is sufficient but I am not eligible for the modification. This has been an ongoing stressful process. I want to assume the payments so that I can keep my home and pay the loan off.

XXXX at ditech in XXXX Arizona mentioned that she could not send us a statement. our option was to pay an amount that she gave us and include this new mortgage account. at this point I asked for a copy of my agreement/ obligation to pay this company. I am still waiting for a copy of this agreement/ note with them.

They sent me documents and said they could settle with them and lower my apr payment and current balance and said not to pay them nor contact them as they would do all that during the process..XXXX XXXX was the sr case manager he was with XXXX XXXX XXXX XXXX XXXX XXXX XXXX . XXXX Fax : XXXX XXXX He told me to mail money orders via USPS to this address XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX CA XXXX phone is XXXX which I sent them payments as advised I starting getting late payment notices via ditech I asked XXXX repeatedly bout it he said not to respond or contact or pay that he is taking care of it ..after a foreclosure notice I contacted ditech and found out I was scammed and brought to the attorney general 's attention and they investigated and was able to get my money refunded to me but has no authority of reversing my credit and I have tried asking ditech to remove my 90 day late on my credit report back XX/XX/XXXX by writing them a letter of hardship on what happened to me explained everything and they denied it I again called XX/XX/XXXX they again denied it but said they will send another request to have it removed ... please contact the attorney general out of North Dakota to search the case thank you I want the 90 day late removed from my credit report from ditech they said it will be on for 10 yrs

Complaint: Ditech was contacted by phone to start the process of releasing escrow management to me the borrower. There was an extended hold time ( about 30 minutes ) and once connected the agent gave a facsimile number to send a request. That task was performed that afternoon ( XX/XX/2019 ). I received no response to the sent facsimile after about a month so I called again. After another long hold time I confirmed the facsimile information and resent the request on XX/XX/2019. Again I received no response from Ditech. After another several weeks I called again. Again another 20-30 minute hold time ( is this a discouragement tactic? ) I spoke to another representative and was this time given a web address to upload my request. This is the same request I have made in the previous attempts. This information was uploaded to that site on XX/XX/2019. I still have yet to receive a reply from Ditech regarding this matter. I do still receive my mortgage statements, however. I should note that I am not deliquent ( nor ever have been ) and have a LTV of about 15 %.

Complaint: {$5600.00}. This amount was kept in a restricted escrow account for payment to a contractor after an insurance settlement for mold repair. Ditech has been outright lying to me and the insurance adjusters as to the status of releasing these funds. They claimed they released them in XXXX of 2019 but I am still waiting for payment. The contractor has threatened to put a lien against my property for not paying the balance of the work he completed.

Complaint: In XX/XX/2019 I paid in full all amounts due on my mortgage to bring it current. The amount I paid was {$11000.00}. On XX/XX/2019 I received a bill saying that {$250.00} was past due. When I called Ditech Financial I was told they had misapplied funds to the escrow account and that error was to be corrected. I was told everything was in order and there was no back payment due. I asked for a corrected bill but was refused and told to pay the next mortgage payment due. I did so and that payment was received on XX/XX/2019. I received a billing from Ditech Financial alleging that there was a late charge due of {$30.00}. When I asked from where did that late charge come, I received a non-responsive answer of the our records show ... variety. When I asked for specifics I got the same response and told to dispute it if I wanted to do so. There is no back payments of any kind due. I am totally current. I did notice that Ditech Financial paid out {$30.00} from my escrow account to cover local real estate taxes due but that is not an arrears payment but an advance which they recover in the next payment. Billing me alleging a past due amount is totally false. I will appreciate whatever you can do to settle this matter in my favor. Since Ditch Financial is in bankruptcy court in NY XXXX XXXX I wonder if this billing is part of a strategy to bring in cash during reorganization? Thank you again for your assistance. XXXX XXXX

Complaint: My mortgage is XXXX. On XX/XX/XXXX, I made my a full payment. Since then, I read in my XXXX magazine, if you make 2 half payments a month, it's like making an extra payment a year. So I made a XXXX payment on XX/XX/19 and a XXXX payment on XX/XX/19. Thereafter, XX/XX/19 and XX/XX/19, XX/XX/19 and XX/XX/19. Now I should be paid up through XXXX. I get my billing statement for XXXX and it says that XXXX is due on XX/XX/19. Ditech applied XXXX of the XX/XX/19 payment to XXXX to the principal and XXXX to escrow and held the XX/XX/19 payment in Funds in Suspense and the charged a late fee of XXXX on top of that. They denie that's what they did. Now I see another late fee applied to my XXXX payment after they received XXXX on XX/XX/19. Please correct this accounting nightmare.

Complaint: I was on a repayment plan from three months ; XX/XX/XXXX - XX/XX/XXXX, of which payments were due on the XXXX of the month ; My regular monthly payments were {$1400.00} and the repayment plan amount was {$1.00}, XXXX. In XX/XX/XXXX, I called Ditech to inform, that the XX/XX/XXXX payment was being returned, due to my direct deposit pay was being deposited after that date, which the representative indicated that was fine. As a result, the payment was received XX/XX/XXXX ; XXXX was paid on time XX/XX/XXXX ; XXXX 's was paid on time, and. XXXX was the month I would resume my increase payment of {$1500.00} ; l of which I paid {$1500.00} for the month of XXXX, During my conversation in XX/XX/XXXX, with the Ditech representative, I was advised. that once the re-payment expires in a XX/XX/XXXX, monthly payments would increase to {$1500.00}. Prior to her informing me of the increase, I had no idea, I never received correspondences via mail, email or phone. I received a call Saturday, XX/XX/XXXX from Ditch stating I was ( 60 ) days late and owed {$2600.00}. I was floored, for I honored the re-payments and thought I would be current once completed. The representative requested for me to provide my bank statements for the time period I was on the repayment as proof of payment ; Although the call was on a Saturday my bank was opened I immediately went to XXXX and the bank manager fazed the same day. On XX/XX/XXXX, I called Ditrech, to inquire the status of the investigation to the outcome as to why I was still in arrears. I spoke with XXXX x XXXX ; she was amazing, through her professionalism, she was able to identify why I was in arrears. She indicated that the calculations, that were calculated by Ditch, were prepared incorrectly. As the result, the payment plan was less the amount owed. I thought to myself, here we go again ( happened in XXXX ). Ditech has caused yet another financial hardship. Based on her calculations and my recent payment of {$1500.00} received ;, total I need to pay for ( 6 ) months {$1900.00}. Why do I find myself constantly battling with Ditch for employees who are not professional, lack being detailed oriented, lazy and are working just waiting to punch out frim their shift. Im frustrated for this is not my first complaint about the mishandling of my account. Why do I have to be the one to pay for the lack of work ethnics, knowledge and from your employees? This DItech organization has no idea or lack to the understanding as to how they are placing folks in jeopardy of their home.? I do not think that the lack of planning and adequately addressing consumers needs should all fall on me I would like a resolution Thanking you i n advance

Complaint: This is a complaint about ditech financial LLC mortgage. Their underhanded tactics in making XXXX elderly seniors lose their home. They received my payment on XX/XX/XXXX through their website. They did not apply my mortgage payment to my loan, they placed the money in a unapplied suspended account fund. They receive the full amount for my monthly payment that was due for the month of XXXX. I spoke with one representative on XX/XX/XXXX and another representative on XX/XX/XXXX. Both representative stated they will send a letter to correct my account. But nothing has happened it's been two weeks now. Complaint: Ditech XXXX XXXX, et al, has sent me 2 notices that they are involved with the U.S. Bankruptcy Court XXXX District of New York and I have my Mortgage with them. I called Ditech to get info and they said my Mortgage is not involved, but why did I get these papers? The papers say If I want to be involved with the Bankruptcy lawsuit, I need to contact a Atty. but I can not afford one. I am XXXX, I have XXXX. I have never missed a Mortgage payment. I requested the two females to email a statement that verifies me that my Mortgage is Not involved with this lawsuit and no one would. The papers clearly state that IF I do not take action I will not be able to collect any money if my mortgage is involved by this lawsuit filed. Again, I can not afford to hire a Atty. to investigate this matter, My mortgage is 75 % of my monthly income from my XXXX Income and I do not think this is fair that Ditech may be RIPPING me and others off for their error ... .They should respect me and let me know IF they have cheated me, after all they threaten me every month that they will charge me a huge late fee IF I do not pay them on the due date.
