Trouble during payment process

Mortgage: Conventional home mortgage

Complaint: Over the course of 2018 my payment amount was changed 3 times. While trying to stay on top of these changes, my XXXX and XXXX automatic payments went out roughly {$50.00} short. I did not receive notice that this had happened until the XXXX payment was already reported 30 days late. At this point, the balance was paid, the account brought current, and the online banking payment amount made correct. In the time since I have attempted several times to communicate this with Ditech, but they have been uncooperative. They claim that correspondence was sent notifying me of the issue, but I never received it. In a similar fashion, they have been completely incompetent in sending correspondence in my attempt to resolve this. It wasn't until the XXXX payment was already reported late, that I received a phone call. Due to their inability to maintain any semblance of consistent payment amounts, and lack of communication in the event of the problem, I should not be held responsible.

Attempts to collect debt not owed

Debt collection: I do not know

Debt was result of identity theft
Complaint: I received a letter from the IRS dated XX/XX/XXXX saying that they received a XXXX from Ditech Financial LLC claiming I had a debt of {$20000.00} in XXXX and I needed to pay taxes on the Cancellation of debt, about {$3000.00} dollars. Ditech Financial LLC XXXX XXXX XXXX XXXX, AZ XXXX I mailed and faxed a dispute on XXXX to Ditech explaining I have never applied for any kind of credit from Ditech Financial LLC. I requested a copy of the 1099-C and any information they may have regarding this fraudulent debt under my name. I suggested investigation should be open immediately within Ditech Financial LLC to get this matter resolved as soon as possible and clear my name. I informed, faxed evidence of identity theft to the IRS personnel XXXX XXXX XXXX, stating that was not my debt and asked for an investigation to be opened with tax fraud to get this off of my name. The IRS didn't do anything and is still trying to collect taxes on the debt from Ditech. I received no letters or phone calls or any action was taken to resolve this matter from Ditech or the IRS, today is XX/XX/XXXX and nothing has been resolved. I informed the Credit Bureaus as soon as this happened and they placed an Identity theft alert on my profile right away. I have contacted local police to open an investigation as an attempt to get this resolved.

Struggling to pay mortgage

Mortgage: FHA mortgage

Complaint: My name is XXXX XXXX XXXX and my dad passed away XX/XX/2018. He left behind a mortgage with ditech financial. My dad was current on his mortgage when he passed. I took over the mortgage and I fell behind and I called the company in XX/XX/2018 and requested help and a nice guy name XXXX assisted me. I later became behind again due to me having my own bills. My dad percentage rate is a 13 % and I was told to apply for a modification. I was told that I had to be living in the house hold. I told them that I wanted to assume the mortgage and they emailed me the forms along with all of the required documents. I provided a recorded Quit Claim and they stated that the type of loan he had. I could not use it until the property was in my name. I had waited for almost two months and they finally stated that no one opened the account and they apologized. the representative then stated that they would have the case escalated. I waited several weeks and received a letter stating my case was denied for failure to provide all documents. I was very furious because I had sent all documents and my case was overlooked and now they want me to reapply and provided all documents and they want to run my credit again and I don't think this is fair. I would like to get my payments current and have my interest rate lowered and I would like them to reopen the case. The deceased name is XXXX XXXX XXXX and the account number is XXXX and my number is XXXX. I look forward to hearing from the company really soon.

Struggling to pay mortgage

Mortgage: FHA mortgage

Complaint: I fell behind due to my husband having XXXX XXXX and losing income. I am in a better place right now to be able to afford the payments but I put in for a loan modification and they tried to give me a trail plan and the payments were almost {$400.00} more than my mortgage payment and they are trying to raise my interest rate from 4 to 6 % I filed for bankrupcty to try and get myself together and I am making payments to the account and the company keeps mailing out statements where my payments are higher than they are supposed to be. No one sent me anything as to why the payment amount goes up every month and i mailed letters requesting this information and no one ever gets back to me. They wont talk to me over the phone and I am scared to death,. I am trying to do the right thing but they are playing games. I would like a fair modification but all they want to do is play games. I need help. I feel from the very beginning I had a problem with the loan and they pushed it through because I had money to put down on the house.

Trouble during payment process

Mortgage: Conventional home mortgage

Complaint: On XX/XX/2019 my mom, XXXX XXXX, ( I have her power of attorney ) made her last mortgage payment to diTech on line and it has posted. On Saturday, XX/XX/2019 she received a letter saying that her last payment was short {$74.00}, which was very confusing to all of us ( it is due by XX/XX/XXXX!! ). She called them today ( XX/XX/2019 ) and was told that this was a fee to release her account. My mom is XXXX years old, ill and on a very fixed income. She feels like she may be getting scammed or taken advantage of because she was completely unaware of any fees to close her account as she has been paying on time faithfully for the length of the loan. It seems if any " fee '' is incurred for them to send her her paperwork it should be no more than the cost of a postage stamp. She is very stressed over this because she feels like if it is fraud, her bank account info will be in the wrong hands, but if it IS legit she is not going to have the payment in on time. She seems to be in a no win situation at this time. Any help you could provide for her would be greatly appreciated. Please feel free to contact me at anytime via cell # XXXX. Regards, XXXX XXXX POA documents available if necessary

False statements or representation

Debt collection: Mortgage debt

Indicated you were committing crime by not paying debt
Complaint: In XXXX I purchased a manufactured home. I have been making automatic payments on the XXXX of the month, every month since then. In XXXX Ditech became the loan servicer for this account and continued to collect these automatic payments. The amount due has always been in my account and deducted. I have never been late. On XX/XX/XXXX I received a billing statement from Ditech claiming that I was late on my mortgage payments and that XXXX and XXXX had not been paid. Both payments had been deducted from my account on the first of the month and are documented in my bank statements. On XX/XX/XXXX I called Ditech to correct the error. I spoke with a man named XXXX. He told me that for some reason Ditech claimed I had a {$50.00} late fee and was holding the remainder of the funds in suspension. He agreed that I had never been late and that the late fee was an error. He spoke with his manager and assured me that his department put in a request to rectify the error and bring my payments up to date ( remember Ditech has my money, they just aren't crediting it to my account ) and that everything should be fixed by Tuesday of the following week ( XX/XX/XXXX ). I asked him what he meant by request and what I should do if this 'request ' wasn't honored. He said it would be, that his department put the request in to another department that would make the changes. No guarantee, of course, but what can I do over the phone? On XX/XX/XXXX, Ditech again deducted my XXXX payment from my account. However, they also reported to the credit agencies that I was late on my payments. My credit score has dropped from XXXX to XXXX. This will cause irreparable harm to my finances and most likely result in increased APRs on my other accounts, which I can not afford and should not be experiencing, as I've worked diligently for over 30 years to pay all of my bills on time. Interestingly, when I called Ditech 's XXXX number and gave my account information, the system reports my payments as current.
