Complaint: I am making payments regularly to pay my mortgage in advance by sending in weekly or biweekly payments to pay additional principal each month. I am not doing this because I can not afford my mortgage. I am paying to pay additional funds towards my principal.
Instead they are putting my funds in suspense, not applying my overpayment, and sending me loss mitigation. Right now with a credit of over {$780.00}, I have late fees on my account despite an overpayment. I do not understand why they are refusing to take extra money. Shouldnt I be allowed to pay more?

Complaint: When our home mortgage was transferred to Greentree Financial we did not receive a notice that our mortgage had been transferred from XXXX XXXXXXXX until we had already Made the current payment to XXXX XXXX XXXX. XXXX XXXX XXXX did not transfer the payment to Greetree. We disputed errant application of the payment, sent faxes with documents but never got it resolved.
Green tree trans freed the loan to DiTech Financial. In XX/XX/2019 I XXXX XXXX spoke to a DiTech representative who said that if I made Payment of {$1900.00}, which was {$500.00} more than the original payment of {$1400.00}. for three months, that missing payment would be caught any interest incurred would be added to the en of the 30 year loan. The loan was subsequently transferred in XX/XX/2019 to XXXX.
Today, although XXXX had been authorized to deduct the payment, in XX/XX/XXXX and XX/XX/XXXX they failed to deduct the payments, when I called to correct their oversight, which I also did in XX/XX/XXXX ( the payment was deducted on XX/XX/XXXX instead of XX/XX/XXXX as authorized, I was told that DiTech had not applied the money to that disputed payment. They applied that {$1500.00}. To escrow and other charges they could not specify Our loan # isXXXX.
Please help, we are senior citizens retired with health problems. My wife has has XXXX twice, XXXX XXXX and a XXXX XXXX and I need XXXX XXXX. We are on a fixed income, trying to do the right thing.

Complaint: This complaint is for DITECH Financial LLC and XXXX XXXX - both equally responsible.
Ditech was my servicer - they filed Bankrpt and mortgage assigned to XXXX XXXX XXXX ( XXXX ). Rec 'd letter XX/XX/XXXX from XXXX XXXX explaining all. With Ditech, I was on auto-pay ( $ XXXX/mth withdrawn on XXXX of month. ) I contacted Ditech - website shows auto-pay terminated XX/XX/XXXX - and I did internet chat with CS person who confirmed I.
Letter from XXXX XXXX states " During a transfer of servicing, the bll pay service infor. w/your bank must be changed so that XXXX will receive your monthly payment. This change can only be made by you. The bill pay serv.WILL NOT make the adjustment if requested by us and they will not forward the payments '' There were 2 blank auto-pay forms included - I still have both - never auth. by mail.
On XX/XX/XXXX get an email that they are ready to handle my account, can sign up for online serv. etc. At NO time did I sign any forms elect. or paper or any bank infrom.
I did internet chat with CS person an they stated also that no auto-pay could be done w/out signature/bank inform.
I sent in check for XX/XX/XXXX ( {$750.00} ) they received it on XXXX I then noticed that there was ANOTHER {$750.00} removed on XX/XX/XXXX - AUTO-PAY from LoanCare. I couldn't get into my account - nothing was set up at that time, so no access. It wasn't until I found these 2 payments XX/XX/XXXX? that I went into online and set up acct - to access my loan info - again I GAVE No permission or bank inform.
I tried calling/emailing them - no response. I checked site and tried to cancel the auto pay but it wasn't completely set up so wouldn't let me. It said next pay due XX/XX/XXXX - showed I paid for XXXX and XXXX in XXXX so I let it go thinking issue is over.
Today I was informed by bank that I am OD AGAIN - XXXX took out a 3rd payment XXXX claiming it's now for XXXX and I will owe again XXXX.
I am now overdrawn a 2nd time, owe almost {$300.00} in OD fees to bank for the two episodes, my XXXX credit score is going to be trashed when they report this, I have to put all my regular bills on hold and pay them late - which costs late fees and potential rate hikes or put on high interest CCs to avoid late pays. I don't have savings or " extra cash '' laying around to cover this BS.
What recourse do I have - I can't be the only one they have done this to - who else can I report it to?
I have tried again to cancel the auto-pay, am betting it doesn't work and am betting they don't fix the account to show I've made 3 pay - which would mean no collecting until XXXX - and I'd bet the property it's going to take an act of XXXX to get the 3rd pay refunded and get payment for all the OD charges, late fees and interest that ' going to come out of this mess.

AND REMOVE A LENDER WHO IS OUT OF BUSINESS FROM OUR DEED AT THE COURTHOUSE.
Summary : XXXX XXXX was the original 2nd lender on our mortgage 15 yrs ago. ( 80/20 ) Then the debt has been sold several times and then Ditech bought out the last company. The loan was written off in XXXX but Ditech keep sending collection notification and calling trying to collect on $ XXXX so call debt. This debt which was a 2nd loan used to close my home mortgage. We hired an Audit firm to review our original loan documents and there were several discrepancies that were found when our loan was processed/closed. Based on the violations we had the right not to continue to pay the monthly payments on the 1st and 2nd mortgage. The 1st Mortgage servicing company modified our loan due to these discrepancies. Each time when it was sold, we informed the agency who bought the debt as to why we are not paying for a loan that is in violation. So now Ditech is stating they have a make shift lien on my house because since they owned the debt paper. But the deed at the courthouse has the original lender XXXX XXXX on it ( Which no longer exist ). I ask Ditech why don't they put their name on the deed since they owned the debt ( a XXXX from collections ) said that is not good business since?

Complaint: In XXXX of 2006, we purchased a home and the took out a second mortgage which was eventually sold to Ditech. We had our payment set up on automatic debits and the company either sold the loan or sold their company.
We never paid this loan late. We have tried to contact the company many times with no success.
We are asking them to remove our late pays from all three bureaus.

Complaint: DiTech is the subordinate lender to a home that foreclosed and sold at auction in XX/XX/2018. The first lender charged off the debt shortly after the auction but DiTech has been dragging its feet in closing out this account/charging it off. I've made numerous calls and was once told that the charge off had been approved and was going through the routing process. Now in more recent calls, no one can tell me what is going on with my account. DiTech is dragging its feet! I haven't owned this home for nearly 1.5 years. My last payment to DiTech was nearly 4 years ago. They need to dispense with my account immediately. DiTech is a horrible company.

Complaint: My loan was with Ditech. I became unemployed and missed payments, they kept chatging me field rep fees. I argued about this, sold furniture from my house and borrowed from a friend to bring current. They charged more fees. Then did yearly assessment in XX/XX/XXXX and raised my house payment. Then sold my loan to XXXX who did another yearly escrow assessment and raised my house payment again. I just got a job making significantly less than before. Ditech didnt apply payments right and chrg fees. I cant get proof of this because they have blocked me from my online acess since loan sold. XXXX is just as bad, uneilling to help, told me if i dont pay new amount ill lose my house and not their problem i cant afford things. I never was late on house payment till XX/XX/2018. Now im getting charged more fees from this new company and it seems like they are wanting me to lose my house. I signed the petition against ditech on lawsuit, after i did is when my loan went to XXXX and they are worse. I dont know what else to do.

Complaint: **On XX/XX/2019 I made an online mortgage payment of {$1100.00} to Ditech Financial LLC to pay for XXXX. The payment, unbeknownst to me, was not applied because I mistakenly transposed the last two digits of my bank account number.
**When I noticed that the money had not been withdrawn from my account after several days, I phoned my bank and learned that no request to withdraw had been received from Ditech .
**I phoned back and forth between Ditech and my bank for about five days asking about XXXX XXXX payment. Finally, a CSR from Ditech assured me that the payment had, in fact, posted as " received '' on XX/XX/XXXX.
**It was not until on or about the XXXX of XXXX I received a voicemail from a CSR from Ditech who left no detailed message but left a number for me to call Ditech .
**On XX/XX/XXXX, I received a form letter from Ditech informing me that my payment for XXXX was returned for non-payment. Nothing was mentioned about Ditech reporting to the credit bureau.
**Prior to this incident, I had begun the process of refinancing my home. It was because of that process I learned that Ditech had wasted no time in reporting a LATE payment on my mortgage to the credit bureau.
**The next time I called Ditech to dispute the negative credit bureau entry and was told to send an appeal/request via U.S. mail or fax to have the negative report reversed. I did send the fax. I included the fact that this was the fault of a simple error and due to the extenuating circumstances, they should reverse that report.
**Yesterday I received another letter from Ditech stating that they will have to " look into the matter '' and I should expect a reply in 30 days. What is there to investigate? I have told them what occurred, it was a SIMPLE typographical error. I have not missed a payment or been late until this incident. WHAT is there to investigate?? This is unnecessary.
Incidentally, I owned my first house for 23 years and was NEVER late nor missed any payment.
**Ditech has served me an injustice. I did everything I could possibly do to verify my payment was on time. But due to their slow moving collecting system, payments take days to go through then even more days to be returned then more days to go through again. If Ditech was better organized, and their personnel better trained, and they had a faster collecting system could have possibly been avoided. And consider the fact that I was told my payment had been received AND posted as PAID. How can they justify such a hasty move to the credit bureau?
**I am sure you can understand my frustration. I am trying to refinance as well. The right thing for Ditech to do is to take that negative report off my credit file with the same haste that it was sent.
**This statement can be corroborated by Ditech playback of their calls that are recorded with customers.

Complaint: XXXX XXXX : Called ditech regarding error on XX/XX/2019 Billing Statement. Billing Statement indicated Past Due Amount for XX/XX/2019. I advised Customer Rep. payment was made and check cleared by my financial institution.
Customer rep. verified, advised statement was " mailed before payment was received. '' She could provide no reason why no notice of lack of payment and/or Notice of Late fees was mailed.
I requested a duplicate statement reflecting an accurate account of the on-time payment, current balances of Principal and Escrow balances, as well, as the lack of late fee assessment.
It is important to know the request for amended statement was based on prior experiences with this company and their lack of coordination and/or communication within and among departments. In addition, the company 's endorsement has been and will be required regarding insurance matters.
However, there was a stipulation in the agreement that allows me to handle my own taxes that, in essence, allows ditech the option of reversal of payment through them, if it is deemed payments were not consistent.
Based on previous experiences with ditech and their previous entities, this complaint is prophylactic in nature, as such alleging late payment history can trigger a reversion of my tax monies to their hands.
I do not hold any confidence or trust in the performance and practices of ditech or their predecessors.

Everytime I call they acknowledge that I have an account and then state I can not make payments. This loan was XXXX current with Ditech Servicing prior to this transfer. Complaint: 1. XX/XX/XXXX the company I was working with Sold and downsize, my department was the 3rd tier of lay offs and I struggled for employment. The mortgage company at the time was Greentree Services, I applied and approved for a loan modification program 2. I set up direct payments from my bank to GTS to ensure timely monthly payments.
3. Early XX/XX/XXXX GTS called stating the XX/XX/XXXXpayment had not been received and asked for the XX/XX/XXXX mortgage payment over the phone ( which I gave them ) I paid my bank {$30.00} stop payment fee on the 1st payment. I have bank documentation ( attached ) proving GTS DID receive payment in October but GTS DID NOT post until XX/XX/XXXX. I was told " don't worry about it '' 4. XX/XX/XXXX Payment was issued from my bank and Submitted on time 5. GTS returned the XX/XX/XXXX mortgage payment bank check back to me, stating I was rejected from the program due to none payment in XX/XX/XXXX.
6. Communications with GTS During the next year and a half ( XX/XX/XXXX -XX/XX/XXXX ) GTS told me to mail and fax all bank records, documents, statements, tax records, loan modification packets providing the proof of XX/XX/XXXXpayment. ( documents attached ) 7. I faxed and mailed GTS 10-15X at {$2.00} a page, Mailing documents @ {$1.00} per envelop to NO AVAIL 8. XX/XX/XXXX ( NOW DITECH ) I found foreclosure papers nailed to my front door and now I am in fear of loosing my home, being homeless and financially ruined. Acquiring charges daily since XX/XX/XXXX in addition to compounding fees, charges, late and annual fees, lawyers fees totaling and adding up to {$45000.00} to my mortgage balance.
9. I was drained mentally and financially ruined because of GTS/DITECH The XXXX XXXX and XXXX during this time frame was so unbearable I am still haunted and XXXX when I think about the situation today and panic at the thought of reliving it.
10. I had NO recourse, no one would listen, no one cared, no one provided advice. I felt as though there was no other choice but to file bankruptcy, which did XX/XX/XXXX.
11. Now 3 years later -XX/XX/XXXX Ditech sends me a loan modification packet low monthly mortgage payment ( roughly {$850.00} ) I was was advised by legal aid ( bankruptcy and legal assistance for low income ) 12. Take the deal NOW and run. LA told me I could NOT negotiate the {$45000.00} in fees added to the mortgage balance. Keep in mind I bought this house for $ XXXX in XX/XX/XXXX( XXXX yrs ago ) My pay off balance NOW is {$190000.00} ( whats wrong with this picture? ) 13. Fast forward to XX/XX/XXXX. DITECH/GTS and whatever other names they operated under. have now filed Bankruptcy. They will wipe away all debts, restructure, reorganize, and properly walk away with millions if not billions of dollars " smelling Like a rose '' operating under the same code of ethics destroying consumers once again. How is this Fair or Ethical?????
14. Nevertheless, in XX/XX/XXXX I was given the opportunity to file a " proof of claim '', which did as a debtor of DITECH ( documents attached ) 15. I am so far down of the list of debtors My fear is I will NEVER receive a dime, or retribution for the damages DITECH imposed and continues to impose on me still to this date.
16. I am current on my payments yet the last statement I received was ( 6-7 months ago ) XX/XX/XXXX from DITECH-Reflected I was behind {$2500.00} behind on payments ( NOT TRUE ) 17. Being harassed again! letters are posted to my door DITECH people drive by taking photos of my property ( I asked the last person taking photos what they were doing, why and for whom- DITECH ) 17. I received a DITECH loan assistance packet in XX/XX/XXXX which I submitted in XX/XX/XXXX. I HAVE NEVER RECEIVED A RESPONSE FROM DITECH - calls made to no avail ( unethical ) 18. The XXXX XXXX is unbearable, I am XXXX and reliving the fear of losing everything all over again. Fear of repetition of not being heard, not having a leg to stand on, losing my dignity again. I am suffering the consequence of an incompetent and unethical company DITECH! WHY HAS THIS BEEN ALOWED TO HAPPEN for so long AND WHY / HOW CAN THEY CONTINUE TO GET AWAY WITH IT!!

Complaint: I was contacted to apply for a XXXX FHA Mortgage by my current mortgage holder. After getting the approval I let them know I was going to shop the rate and I did. I found another company who was offering me the same mortgage program for .75 % lower rate. I also let them know I was going to shop that rate back to the original loan originator and they said that wasn't a problem. Fast forward a few weeks and due to the original loan originators unwillingness or inability to match or come close to the same rate I decided to go with the second company but let them ( the original ) know if things went sideways with the second i'd come back for theirs.
I was told by the original company they were going to close my file down regardless and I asked them not to. There were no further communications from me to them, or them to me. The second company filed for a release of the FHA Case number on Monday XX/XX/2019. Later that day I got an email from the original loan originator asking for additional information from me which I provided. I figured they were positioning themselves in the event something went south with the second company. The FHA guidelines indicate a 3 day grace period to release the case as I was already clear to close once the second company got the case number.
Today, Wednesday XX/XX/2019 at XXXX this morning I received a call for the original company and was asked if I wanted to release the FHA case file to the second due to a refinance. I said yes. About 10 minutes later I received a call from the original company which I was unable to accept. An hour and I hear from the loan coordinator at the second company indicating i'm still clear to close ; however, the original company still hasn't released the FHA case file. I sent an email to the original company demanding the release, and after a series of unprofessional emails ( which I have retained ) from them denying any responsibility and in effect taking no responsibility for the failure of them to perform under FHA guidelines due to internal processes.

Complaint: I reported my complaint to you back in XXXX and XXXX of this year about ditech not giving me my payoff for my mortgage loan .They responded to it with nothing but lies .the dates they gave you were phone calls from me to them about the same problem. I received two separate letters from Ditech stating they were checking into my problem and it would be thirty days befor they would respond. Well its now XX/XX/XXXX and still nothing from them .All I know is their filing for another chapter XXXX but will not return my request for my payoff.If I try and call I am put on hold for over an hour and half.

Complaint: On XX/XX/XXXX, I contacted Ditech Financial regarding an incorrect, negative report at all three of the credit bureaus concerning a debt that is at {$0.00}. I contacted them by phone, fax, and email. A copy of the communication is attached, which shows the house sale by foreclosure, and subsequent house purchase seven months later to a new buyer.
On XX/XX/XXXX, after no response, I contacted Ditech again by email requesting a status update and communication from Ditech concerning this serious error. I received no response from Ditech.
On XX/XX/XXXX, I contacted Ditech by phone and spoke with seven customer service representatives, who passed me around and told me to call XXXX XXXX. I spoke with XXXX XXXX who apologized for Ditech trying to " get rid of me and the issue '', but they confirmed that the only outstanding loan on the property belongs to the people who purchased this home in XX/XX/XXXX, and told me to call Ditech back.
Finally, I reached a woman named XXXX XXXX, with Ditech, on XX/XX/XXXX, she looked into the issue and then confirmed that the issue was rectified on XX/XX/XXXX, by email, and that incorrect information has been reported against me at the credit bureaus. A copy of the email is attached. She stated that the credit bureaus had been resubmitted the information and my balance was {$0.00} for this debt. This was corrected in XX/XX/XXXX, by Ditech.
Then in XX/XX/XXXX, Ditech resubmitted the fake information back to all three credit bureaus and now have debt collectors calling me for a falsified outstanding debt. They call at all hours of the day.
On XX/XX/XXXX, I was denied a loan based on Ditech 's false reporting of this debt to the credit bureaus. I sent XXXX XXXX at Ditech an email on XX/XX/XXXX, requesting immediate action or I would be seeking relief for Ditech 's egregious behavior. I am seeking intervention as Ditech should not be allowed to purposely report false information, after confirming the original information was false, in order to harm a consumer. I am requesting this department to assist me in rectifying Ditech 's treatment of me, continued harassment, and their continued reporting of false information to the credit bureaus.
