Complaint: I had been a person that had my mortgage with Ditech. I had contacted them in XXXX because of a hardship and asked for a forbearance. The date was on XX/XX/2019. I spoke with XXXX at XXXX XXXX the called lasted until XXXX. I told him about the hardship and he told me they could help me, but it wouldn't be before XX/XX/XXXX. Before XX/XX/XXXX, I received a statement from XXXX XXXX saying, they now hold my mortgage. I did call XXXX the day I received the statement. The gentlemen said, they couldn't do anything for me for 60 days. I had been promised by Ditech, that the forbearance would be given to me. They didn't tell me they were filing bankruptcy and they were going to hang me out to dry. I have never had to do this type of thing before, so I pray I have all the information that you need, to check into the mess! Please can you help me!!!??

Complaint: XXXX we received notice from court for DiTech structuring. Notice says we make our loan payments to the same place as before on the same schedule. No issues in XXXX. XX/XX/2019 auto payment of {$1800.00}, see bank confirmation of payment. XX/XX/2019 statement says behind in payments and asks for 2 payments {$3600.00}, Also changed PO box for payment delivery. Called DiTech XXXX. Many long messages about restructuring. Dial 0 for a person and no one answers. Message says " Call back during normal business hours '' no matter when you call. Many calls and we push buttons to request more information and a person answers that is part of the restructuring of DITech, but can not help. Just plays a message which says DiTech is in business and make your payments as you always have. Where did our money go?

Complaint: A copy of the body of the letter sent to Ditech on XX/XX/XXXX is attached : On XX/XX/XXXX I applied for a loan modification, but after calling Ditech for clarification on additional information that was being requested, I was subsequently told by the service representative that actually, I was not eligible for a modification at this time.
Per the representatives suggestion, I formally rescinded my request, waited till the start of the new month, then called back to set up a temporary Repayment Plan. That call was made on Monday, XX/XX/XXXX, and after speaking to another agent, my request was approved. Formal notice of that approval was sent out on XX/XX/XXXX and I called Ditech and accepted the offer prior to XX/XX/XXXX, as stipulated by the instructions in the preceding notice.
At that time, I asked the agent ( XXXX ) if it would be acceptable for me to make my payments by the XXXX of the month XXXX XXXX offered for normal payments. I was placed on hold while XXXX spoke with a supervisor, and when he returned, I was told that yes, it would be fine if I made my payment after the XXXX of the month, as long as it was no later than the XXXX.
On Friday XX/XX/XXXX, I called and made my first installment payment for {$2600.00}. The fee was waived, and I was all set for the month of XXXX. The confirmation number for that payment is # XXXX.
Then, on XX/XX/XXXX, a notice went out stating that I was in default on the loan, and in order to cure the default, a total of {$9800.00} must be submitted by XX/XX/XXXX. As you can imagine, this comes as a shock and surprise given the fact that during the XX/XX/XXXX and XX/XX/XXXX phone conversations, it was explained to me that as long as I continued making my installment payments each month, no further collection activity would be pursued. I would also like to point out that during the execution of a previous Loan Modification, I was given permission to send in my payments by the XXXX of each month, and I did this for the duration of the trial without having further collection activity directed towards me.
Even after rescinding my original Loan Modification request, I continued to receive notices regarding an application which had already been cancelled. The first letter was another request for information. The second was a formal denial of the request ( which again, had already been rescinded ) because the requested information had not been received. All of this occurred, after the Repayment Plan had been established and approved, so I didnt think much about the extraneous communication just chalked it up to back office processing that was out of sync but this most recent notice of default is obviously more serious, which is why I am requesting that your records and subsequent correspondence be corrected and brought up to date.
Based on the representations made to me, and the good faith effort I demonstrated in complying with the terms of the Repayment Plan, I would like a correction made in writing that I AM NOT IN DEFAULT on my mortgage loan, and that the plan I agreed to prior to XX/XX/XXXX will continue as prescribed over the next five months until the total past due balance has been paid in full.

Complaint: XXXX I was notified by the City of XXXX that my XXXX tax bill was incorrect due to an error- an incorrect calculation resulting in an overage charge of XXXX dollars. The calculation was XXXX which was actually only to be XXXX and that the corrected information was sent to my mortgage company as well as a refund would be sent by the city of XXXX. I have never seen the refund reflected in my escrow account, nor did I ever receive an overage check of XXXX or XXXX from Ditech.
XXXX after noticing my automatic mortgage payment increased by over 200 dollars once again due to an incorrect escrow analysis. I finally took the time to investigate why my escrow is so off. I noticed that on the XX/XX/XXXX escrow analysis that the total taxes they calculated was once again XXXX more than what was actual paid to the XXXX County Treasury. After confirming with XXXX County that my tax bill is XXXX, and that Ditech is charging my escrow XXXX. I called and spoke to XXXX XXXX, who assured me she would open a dispute and have my escrow analyzed and investigated and she would call me back with 48-72 hours. I faxed Ditech 12 pages of tax statements indicating the overage, as well as the letter form the city of XXXX. I did not receive a call back with in the time that was promised. I have tried contacting them at least 3 other times since with not resolution. The Ditech Tax department does indeed state that it should only be XXXX, but nothing is being done about the overage payments credited to my account.
I contacted my Loan officer, the city of XXXX, and XXXX County to verify that all my accounting information was correct. The recommend me filing a complaint to XXXX. It appears that my escrow is off by more than just XXXX dollars, and that a refund of XXXX was never applied to my account and I have been over assessed by at least XXXX form XXXX and now into XXXX. I am not getting any help from Ditech. Conveniently, after filing a complaint I am told my loan is not been sold to XXXX beginning XX/XX/XXXX. I have left a message with a Ditech supervisor, XXXX XXXX at ext XXXX who is supposed to be calling me back on Monday. However, with Ditech 's history I am doubtful he will return my call. Please Help! Thank you!

Complaint: My Father passed away on XX/XX/XXXX. Since then my siblings I have filed with XXXX XXXX County as the heirs and owners of his home. We contacted Ditech in XXXX to inform them of our Father 's death and our inheritance of his home. We filed an affidavit of ownership and my siblings elected me as their representative. I have been asking Ditech for information regarding his mortgage and repayment of it since mid XXXX. In XXXX I started corresponding with Ditech via phone and email so that I would have a paper trail. Ditech refused to acknowledge my authority and also refused to acknowledge us as heirs. We submitted all the documentation that they asked for several times due to them misplacing or losing the documents. My Father 's home needed many repairs and we are still in the process of making them. I have spent thousands of dollars for these repairs and am two weeks from completion. If the repairs would not have been made we would have taken a great loss because his home would not have sold for what he owed. I have an excellent realtor standing by to put the home on the market. She believes it would sell in less than two weeks. Today XX/XX/XXXX I received nine letters addressed to each of my siblings, myself, my Father and his Estate. The attorney did not send Letters to my siblings at their address instead they were sent to my Father 's address. The attorney has all addresses for my siblings, therefore have sent the notices to the wrong address. These letters are to inform us of the Auction of my fathers 's home on XX/XX/XXXX. I believe that Ditech has broken the Law by not communicating with me about the assumption of his loan or the amount of his payments or his due balance. They have not responded to almost all emails that I have sent and there has been no follow up or follow through with them. We were prevented counselling due to the fact that Ditech would not acknowledge us as the owners of his home therefore HUD counsellors would not speak to us. We are in dire jeopardy of losing his home due to Ditech not following RESPA Laws and refusing to speak to me.

Complaint: According to the Final Escrow Account Disclosure Statement, my escrow balance as of XX/XX/2019 was {$2200.00}. I was told by the original loan servicing company that the funds were transferred to the new loan servicing company on XX/XX/2019. However, as of XX/XX/2019, the funds new loan servicing company has not received the funds. I have made several phone calls to the original loan servicing company, have spent an excessive amount of time attempting to receive confirmation that the funds were transferred, but have yet to receive documentation or proof that the escrow balance was transferred to and received by the new company. As a result, my monthly mortgage payment has been increased by {$670.00}. During my last call to the original company, I spoke to a supervisor who promised to provide me with the requested proof of transfer ( i.e., method of transfer, tracking number, etc. ), by the close of business on XX/XX/2019, but I have received no information, documentation, e-mail or telephone call from the manager.

Complaint: XX/XX/2016 I received a letter from Ditech stating my mortgage payment has not been received, thankfully for me I keep very good records and at the time I was paying via money order because I was not going to pay their ridiculous fee of {$12.00} to pay online. I called Ditech and let them know I paid my mortgage and I don't understand what the problem is. They told me I had to go to the business where I purchased the money and get proof which cost me {$24.00} on top of the late fee they were trying to charge me. After so many phone calls and broken promises from the incompetent people that work at Ditech I was able to get the situation taken care of weeks or months later. Come to find out they applied my payment to someone else 's account. The next thing that really broke the camels back was when I received a notice in the mail XX/XX/2016 from Ditech stating they paid my taxes which are not escrowed, we pay out of pocket every year. I called them and told them to take their money off so I could pay my taxes, they refused stating I was delinquent on my taxes. In my County our taxes are not due until XX/XX/XXXX so again Ditech was messing with my account information once again, they stated they inadvertently entered our account and paid our taxes when it should have been another members account. I was promised a letter of resolution and a call to our county treasurer to reverse the payment off so I could pay my taxes. After all this time we are now being sued for the tax payment and being threatened by the collection agency working with these losers. Please do not do business with this incompetent company. Customer service has no clue what is going on and they are extremely rude. Needless to say after the tax incident I went with a credit union in my hometown and have not had one single problem with them.
One other note : this company has already file bankruptcy twice that I am aware of.
