Complaint: I am extremely exhausted and frustrated. In XXXX I truly fell on hard times and reached out to Ditech for a loan modification, I was told it couldnt be done because I didnt have enough equity in my home. I called XXXX and was relaying my problem to one of their associate when Ditech Called me back to say theyll do the modification because there was equity in my home.They offered to modify my loan and gave me a trial payment for three ( 3 ) months.In XXXX Ditech sent me the modification papers to be notarized which I did and return to them.Suzette out of Florida was the person communicating with.She informed me that the papers were received and the system was being updated and after such my statements would no longer show the arrears.
The monthly statement were still showing the arrears and the amounts were different.When I received the tax paper for XXXX it showed that I only pay $ XXXX.as interest for the XXXX.
In XXXX of XXXX I received a call from XXXX stating that he will be sending me modification papers to be notarized he gave me no explanation, however I had the papers notarized and returned to the address in XXXX called me on a Monday while I was at my doctors office to inform me that the notary didnt write the State on the papers so Ill have to do it again .I did 3 sets of modification papers to be told on XX/XX/XXXX That the dates have passed Ditech will not do the modification because it will increase my payments.

Complaint: Every year since I move into this home which was XX/XX/2016 my escrow has been miscalculated. First year I was off {$810.00} with a Deficiency payment of per month which my payment jumped from XXXX to XXXX. The following year it was off {$2300.00} with a deficiency payment of {$56.00} and mortgage payment of XXXX. Now this following year it was a shortage/and or deficiency of XXXX with deficiency monthly pay of {$140.00} which now I am paying {$200.00} for monthly regular payments for escrow with an additional {$140.00} on shortage payment. The insurance have not change over the years still in the same price range. the first year I paid out of pocket for a year in advanced.

Complaint: Bought property and mobile home in 1997, we have always paid our own property taxes. We never requested for mortgage to be escrow, now we only have 2 more years to pay home off. This year our tax return did not come in as usual, we managed to pay mobile home taxes. Property tax carried into XXXX, when I went to tax office, I found out that Ditech ( XXXX Az. ) had paid taxes XXXX I was not aware of this, now my mortgage has been turned into escrow account ... Here are the numbers that bother me and Ditech refuses to be fair and work with me..I understand that account was running behind a month and had late fees, that was brought curffent this month with payment of {$2000.00} ... Only 2 years left on mortgage, payment increased from {$740.00} to {$1000.00} a month.. Our property taxes average {$1300.00} if paid in XXXX ... Mortgage payment increase is {$330.00} more a month, in 10 months it's {$3000.00}. I can pay next year taxes this year, plus since it turned into escrow account {$12000.00} we're added to final mortgage amount. I requested for the {$1500.00} to be added to final mortgage to pay back..request was denied. I seriously feel that Ditech is taking advantage of me.. I have talked to reps and supervisors, and sent written request, nothing has been resolved.

Complaint: On XX/XX/XXXX, I received an Escrow Shortage Notice that required a payment of {$4700.00}. A Cashiers Check for the amount of {$4700.00} was mailed to their office on XX/XX/XXXX for the shortage.
Another Escrow Shortage Notice was received on XX/XX/XXXX for an amount of {$4800.00}. Which is outrageous because I had just sent a payment in XXXX, XXXX and that payment was NOT noted or credited to the account from the Notice that was received in XX/XX/XXXX.
WHERE IS THAT MONEY?
I have attached copies of the XX/XX/XXXX Escrow Shortage, the Cashiers Check and XX/XX/XXXX Escrow Shortage, copies of Property Tax Statements that show an increase of {$210.00} from XXXX and a copy of the Declaration for Homeowners Insurance of {$2100.00}.
I DEMAND this company to justify why I should expect to pay {$9600.00} in Escrow.
Im paying double in Escrow than on my mortgage note!!

Complaint: In XXXX of 2018, a XXXX XXXX payment was sent to Ditech Financial Services to catch up the mortgage on the house I am currently staying in. From that point, the normal monthly payment was sent in XXXX. I called to set up for automatic payments to be set up in order to keep the account current so that there would no longer be a payment issue. When I was on the phone with the customer service representative, they representative informed me that the company denied taking any form of payment and would not work with me on making the account current unless I paid for their lawyer fees. I was then told that my money was sent back to me via XXXX XXXX. The money was never returned to me and I went to seek legal counsel. The lawyer advised me not to pay Ditech Financial any more money due to them refusing any form of payment. I have tried to make the account current and I have also tried to guarantee payment through automatic bill pay. The company has refused to work with me and has now decided to foreclose on my home without trying to work with me.

Didn't receive enough information to verify debt
Complaint: I normally receive statements from DiTech on or about the XXXX day of each month. As of XX/XX/2019 I had not received my normal monthly statement. I called the customer service number XXXX. This call took place on XX/XX/2019 at XXXX PDT. I spoke with XXXX. She transferred my call to another DiTech employee. I stated that I had not received my bill, I requested the date on which the bill had been placed in the mail, I requested where the bill had been placed in the mail. He could only reply that the bill had been prepared with XX/XX/2019 statement date. This did not answer the question as to when and where the statement had been placed in the post. He stated that he did not have this information. I requested for a replacement statement to be sent.
That this basic information is not available to DiTech mortgage holders indicates the intentional act of management to keep its employees and its customers uninformed as to the operation of their MSR processes. From an operational perspective, DiTech is not able to provide any believable assertion that DiTech has either the staff or the financial resources with which to present the DiTech business offering to the public.

Complaint: repeated letters to collect a debt that was written off by the company and no longer exists on my credit report. Debt is over 10 years old. Company keeps sending me info about their chapter XXXX problems. I have wrote to them XX/XX/2019 telling them to stop and they responded with a an auto reply that day saying they received it. Then one week later with an email saying they would be in touch with an answer. Then on XX/XX/2019 I got another letter about chapter XXXX. I don't see how that is of any interest to me. I don't need any further info or contact from this predatory lender.

Complaint: I have been trying to keep come current on my mortage.
Had conversations here and there where representives told me all along that as long as i was making payments and not over 240 days late i should be fine.
Had been making my payments up until XX/XX/2019 when my mortage servicer advised all past due payment had to be made in full. I wad asked by represententive ro borrow the money and pay past due amount and get it over with. Something to which i beleive is so unprofessional.
Later receiving a letter where mortage servicer is in bankruptcy.
Making me wonder if this is a reason why my petittion for a loan modification is not being handled the proper way.
And later receiving a letter with a new acct # from original acct.
Asked for loan modification to my mortage servicer. Which i just kept getting letters requesting same missing information. Never received a denial, only application to submit or missing information letter.
After they referred loan to forclosure.
With no progress on loan modification requested. which lead me to hire a loan advisor to help with loan modification.
On or about XX/XX/2019 an other loan modification paper work was sent through loan advisor. On or about XX/XX/2019 loan advisor called on a 3 way call to verify on documentation sent. And was advised that no modification paper work was received. To which loan servicer resent.
On or about loan advisor called me to mention that we have a 3 month trial period before final modification.
Yet We since have received same letter requesting missing information, which is sent every time requested.
Im now here with a letter that has a sale date on my property.
I am being honest explained at the time reason of hardship via letter attached on modification paper work and phone with repprisentives. I have also explaines hardship is now over since XXXX and was ready to come current.

Complaint: Mortgage Company Ditech which held 2 mortgages for properties that I owned reported each and every payment LATE. The mortgages were auto debited from my bank account on the XXXX of every month for 16 years! This year I discovered all payments had been reported late, credit bureau investigated and repaired false info. DITECH STILL reported the last 2 payments as LATE. I have exemplary credit and this is preventing me from obtaining a loan that I need. I called Ditech in the beginning of the loan ( 2004 and was told that there was no issue thought the listed on my invoice that each last payment was late. It is very unfortunate that they would take advantage of the consumer like this. No late fees, no late payments were ever made. Loans are paid off but now last 2 payments still appear as chronically late on my credit report.

Complaint: After paying off a Ditech mortgage, Ditech sent an escrow check to the wrong address. The party that received the check forged my name and cashed the check.
I have asked Ditech via phone calls, emails and web requests using their available tools and contact methods over 12 times. When I reach someone, they say it will be sent in 10 days and it never arrives.
The copy of the check is needed to file a police report.

Complaint: My wife and I closed on our mortgage XX/XX/XXXX with Ditech and worked with customer loan processor XXXX XXXX and senior home loan specialist XXXX XXXX. Our first payment due started XX/XX/XXXX at {$930.00}. Five payments were made to Ditech on XX/XX/XXXX for {$930.00} ( XX/XX/XXXX Due date ), XX/XX/XXXX for {$940.00} ( XX/XX/XXXX due date ), XX/XX/XXXX for {$1000.00} ( XX/XX/XXXX due date ), XX/XX/XXXX for {$950.00} ( XX/XX/XXXX due date ) and XX/XX/XXXX for {$950.00} ( XX/XX/XXXX due date ). On a letter from Ditech dated XX/XX/XXXX we were notified that our loan would be transferring to XXXX XXXX XXXX d/b/a XXXX XXXX. The letter included the statement The servicing of your mortgage account is being transferred, effective with your payment due XX/XX/XXXX. It also stated All payments made on or after XX/XX/XXXX should be sent to XXXX XXXX. On XX/XX/XXXX I lost my job but was able to pay our XX/XX/XXXX payment on XX/XX/XXXX. We received our first statement around XX/XX/XXXX from XXXX XXXX stating amount due of {$1800.00} which was including an overdue payment. I called XXXX XXXX on XX/XX/XXXX and they said not to worry that Ditech would be forwarding payments to XXXX XXXX and to allow 60 days for this to happen. Each statement we received from XXXX XXXX included the past due payment along with late fees. Around XX/XX/XXXX I called customer service and they said to send supporting information as to the XX/XX/XXXX payment and they would research it. On XX/XX/XXXX I sent them information from my bank showing the payment had debited my account. After no response I called customer service on XX/XX/XXXX again and spoke with XXXX XXXX who replied via email that I will be your single point of contact until a resolution is found. I sent her 4 emails between XX/XX/XXXX and XX/XX/XXXX along with 3 calls and did not get a reply. On XX/XX/XXXX I emailed XXXX XXXX customer service, XXXX XXXX and copied Ditechs XXXX XXXX and XXXX XXXX and explained the situation and also included my banks stamped copies of my bank statements. XXXX XXXX did reach out and forwarded my email to XXXX customer service on XX/XX/XXXX and I also included a proof of payment statement from my bank. To date there has been no reply via email, phone or mail from Ditech. Even when I was unemployed for 8 weeks I have continued to pay my mortgage and even payed over the minimum to Ditech and XXXX XXXX. This has been very stressful for my wife and I and we do not feel that we should be bearing the brunt of accounting lapses. We have tried to communicate as respectfully as we can during the past 4 months and neither institution seems to care about the {$950.00} payment we made. Every month we continue to get late notices, phone calls and text messages about the alleged missed payment. We dont have money and do not plan to make a double payment and we hope that you can further look into this matter since we dont seem to have any pull.

Complaint: I have a letter from Ditech Financial, LLC settling my mobile home mortgage loan for {$15000.00}. I mailed them a good check for {$15000.00} to pay my account in full. They have posted that {$15000.00} payment as a regular payment and no one at Ditech seems to know whats going on with anything EVER and could care less about fixing the issue. They have given me a deadline of XX/XX/2019 per the letter to pay this account in full for {$15000.00} which I sent to them. I need some help forcing Ditech Financial to adhere to their end of this bargain and agreement dated XX/XX/2019. Can you please help me?

Their investigation did not fix an error on your report
Complaint: In XX/XX/XXXX, I requested that XXXX conduct an investigation into the false reporting being Done by my mortgage holder, Ditech Financials. Ditech Financials had been falsely reporting to XXXX, that beginning in XX/XX/XXXX and ending on XX/XX/XXXX, I had been defaulting on my mortgage note. As a result of this false reporting, my credit report precipitously decreased from XXXX down to XXXX. If Ditech had done any sort of investigation, it would have learned that my mortgage was paid automatically by my bank before the XXXX of every month for the entirety of the loan period. It would have learned that Ditech had been misapplying the payments to another mortgage account I held. Ditech did not have a proper accounting and servicing system that would and should have prevented Ditech from misapplying funds from one mortgage account to another, particularly since the funds had been paid automatically by my bank for the duration of the time Ditech serviced both loans.
Instead, XXXX simply changed my credit report to closed and transferred to XXXX which had assumed the mortgage from Ditech. I disputed the matter with XXXX which ceased the false reporting and conducted an investigation. It's investigation caused Ditech to repay the monies to me and I in turn paid the monies to XXXX which brought my loan current. XXXX was unable to fix the false reporting of Ditech, its predecessor. XXXX violated its investigatory responsibilities of the Fair Credit Reporting Act.
