I, XXXX XXXX in XX/XX/XXXX signed a 30 year mortgage so Ditech illegally changed the maturity date without my consent. As a result, incorrect payment amounts have been applied my principal balance each month.

Complaint: I have a VA loan with Ditech who has been misapplying the additional money that I have been paying since they took over my mortgage. I did not initially notice it because I was only paying a small additional amount over the monthly payment. However, over the last 5 months I have been paying over {$1000.00} additional to pay down the Principal of the loan and noticed they were holding the additional money in what they call a UF. It would stay there until I called in each month to tell them that each should be automatically applied to the Principal. When they would reallocate the additional money, they are suppose to apply it to the actual date that it was received, not the date I called in to report it. However, they continue to do this. My VA Loan contract in Section 2 states that any additional money over the payment should automatically go to the Principal of the loan unless there are other charges, e.g., late fee. I have never been late. I went through the XXXX to complain and was not satisfied with the response since they still did not abide by my VA Loan contract nor make the corrections. ( I have attached a copy of Ditech 's response to my XXXX complaint ). Additionally, my Certified Public Accountant performed an audit of my account in response to Ditech 's response which I have sent to the XXXX. I understand that the CFPB organization is the one that handles situations with mortgage companies and can investigate reported complaints. I am a XXXX veteran and hope that you can assist in getting this issue resolved.

Complaint: This is the second complaint I have filed with you all against DiTech Financial through your company. I have to say you all handled the companies response and closed the case with NO documentation to prove the lies they told. We have had an account with DiTech Financial since 2006. We have never missed a payment and NOT I repeat NOT been late one single month all these years. But when our loan is due to mature on XX/XX/XXXX we have a {$6000.00} balance. How is this possible is what we asked and we have gotten nothing but the total run around. We have been hung up on, lied to and disrespected by this company for months. We filed a report with you all in hopes you protected your consumers instead DiTech tells you we owe this outrageous balance due to late fees and a cancellation on our automatic drafts for our mortgage payments. This is NOT true at all. We did cancel our automatic drafts 2 months ago because they had yet another company restructure and told us we had to set up one monthly draft instead of the biweekly drafts we have made for years. So we agreed and set it up and guess what they did took out 2 full mortgage payments in one month after they claimed they could not do that. Then we played heck getting the money refunded. This is all happening while you all were supposedly helping us resolve this issue of the huge balance. So instead of DiTech Financial researching the account they mail me a 38 page payment history with a generic letter saying you owe the balance. No information no explanation at all. Then they tell you all we owe it for late fees. Anyone with any common sense would know if we had {$6000.00} in late fees they would have foreclosed on our home by now. But you all believe it and they submit as proof the original loan agreement from 2006 how does that prove we have not made our payments and owe the balance. It doesn't and you all have the nerve to close the complaint and not even contact me to give me a chance to defend myself in this you say it has been completely resolved. For who I ask? You because it was not us. How horrible is this. This is Consumer Protection I think not! You all are as bad and as low down as DiTech Financial. You need to reopen this and actually require proof of the so called solution not write it all off to save some work!! Stop pretending you protect or even help all the consumers because if this is help NO ONE NEEDS IT!!!!! As for proof I have all 38 pages of my payment history I will be more than happy to send you! I am attaching it!

Complaint: " Un-Applied payments. '' @ {$6000.00} in payments listed, but not applied to the balance of my loan. I tracked the balance. Those payments are listed with XXXX applied. I can not get them to explain or actually apply the payments. This represents @ 6 payments of {$1000.00} Please get them to apply the payments. It looks like theft when they accept 6 payments, but not apply them to my balance. Ditech is a bad company. It appears they went bankrupt several times, but still refuse to reduce the interest rate or apply those 6 payments.

Complaint: After many years of not being able to get out of my XXXX XXXX XXXX loan which came to them by way of XXXX by way of countrywide I was finally able to refi through the hope for homeowners program and get out of my adjustable rate mortgage and get a fixed mortgage, they, in turn sold my loan to Ditech. In XXXX I contacted Ditech in order to refi to a lower rate take out cash to pay of high interest credit card debt thus lowering my DTI .... Instead of responding to me they sold my loan to XXXX mortgage. I contacted FHA to find out about programs to help homeowners stay in their homes. They referred me to XXXX loans and they denied me even though I have the equity the credit score and the income ... .plus they did not offer me any government options ... But yet this is the company the government told me to contact for help. Out of the blue XXXX ... my now NEW servicer ... ... contacts me and says they can offer me a program to take cash out pay of my debt to go towards my Debt to income ratio at a cost of {$17000.00} and 10 years of pmi payments of over {$350.00} a month even though I have over 50 % equity in my home ... ..I owe XXXX and my home is worth XXXX. I have good credit and I believe that these companies are trying to take advantage and give me unfavorable rates and loans based on being single XXXX and female which is one of the first things they all asked me about. My complaint is to Ditech for selling my loan in order to not do a refi. This is not the first time I have had to battle these companies from trying to steal my home from me ... I spent 8 months in 2009 trying to clear XXXX XXXX XXXX attempt to take my home by them claiming I was not paying my mortgage on time which after sending them all the cancelled checks disputing their claim the were in error Nd stopped their attempt to take my home ... .but by then I was stuck in the Arm mortgage that took me years to get out of. I even contacted the DOJ at the time and they said XXXX XXXX XXXX did nothing wrong but year later they he to pay the government a huge fine for their part in the mortgage crisis. So yet again I am fighting to get fair and equitable treatment. Regards

Complaint: I have been trying to work with my mtg company just to figure out my options. They will not communicate with me. I send electronic messages through their website with no response other than the auto generated we have received your request. Same thing with postal mail. I get a letter that states my request has been received and will be answered in 30 days and after the XXXX days I just get another letter stating the same thing. I call the phone number and the person that answers tells me I have to speak with my assigned account representative and transfer me to said person whos name changes very frequently and I get voicemail every time. I leave messages with no return phone call. I submitted via their upload option an application for loan modification in XXXX with XXXX response. Strangely when I try to use the complaint system it gives an error and will not let me hit send. I have screenshots of all that has occurred on the website and voice recapturing a of all of my transfers to voicemails. I live in Louisiana and in XXXX after no phone calls again. I drove to the address on my bill in XXXX XXXX South Dakota and the building is deserted. I will include the transcript of the chat I had with them concerning this. I am also receiving letters stating my escrow account is in the negative and I need to pay thousands funny thing is I dont have an escrow account. I next got a letter stating that was a mistake only to once again get another letter that my escrow was behind. I fell behind due to a combination of the death of my spouse and job lay-off. During the entire time which started in XXXX I made a payment every XXXX days without fail. I just could never catch up the ones that were behind. So in XXXX of XXXX they offer me a loan modification and the loan XXXX who I spoke with on a weekly sometimes daily basis for 5 months instructed me over and over not to make my monthly payment because it would help to indicated my hardship and increase my chances of being approved for the XXXX modification. I expressed my concern about this several times only to be reassured that even if my application was not approved I would have other options and would not be expected to come up with any lump sum of money. I have recording of these conversations as well. Application was denied and I got a letter stating I had 30 days to come up with XXXX dollars. When I call to talk to the loan XXXX who promised this would not happen I was told he no longer worked there and we are so sorry but he advised you wrong. So off to an attorney my account went and the total amount I now owed was XXXX dollars. So I pooled every resource I had and took the money to an attorney in XXXX of XXXX told me I would be receiving a refund for them not having to pay to advertise my property and also for not paying the typical fees for sheriff sale. He said to expect around XXXX XXXX dollars back The paperwork stated this amount was to bring my account current through XXXX I was told my regular payments would be due on XX/XX/XXXX of XXXX and my loan maturity date was XX/XX/XXXX of XXXX. I might should have started with my ex husband was an XXXX and this loan is for a single wide trailer bought new in XXXX valued around XXXX ; XXXX. Financed at 8 % interest FOR XXXX FREAKIN YEARS! So I assure you I have more than paid for my home. So XXXX comes along and I go to my online account only to find it states my payments are behind What????? How can this be. I also see that there are unapplied funds on my account for around XXXX. The next day i call to discuss this I am told that the XXXX payment was never made. So here we go again. I ask about the extra money on my account and I am told I need to contact the attorney. I have request over XXXX times by phone and mail for a detailed statement of what my XXXX dollars was applied to and I want more of an explanation than attorney fees. And there are insurance disbursements for crazy amounts all the time. I have screenshots of that as well. I am just at a loss I have considered an attorney but was told the mtg company just filed bankruptcy so it wouldnt do much good. The only option to make payments is on ther website and it will only accept the full amount. Also I received a letter from my insurance company that stated my policy was canceled as requested by lender and return premium was sent to them. Where did that money go???? Crooks they are just crooks.

Complaint: I have setup payments wit this company for the last 2 years. They will only setup 6 months at a time. The day that the last payment is taken out they start calling me every hour on the hour. Its ridiculous to be harassed this much. I've been paying them {$300.00} a month for the past 2 years without fail. When I call to set up the next 6 months payments they give me grief and tell me that I need to take out a loan to pay this in full and that at the rate i'm going its going to take 12 years to pay it off. I mean if I could I would but I'm paying them monthly so what the XXXX does it matter.

Complaint: I have been late with payments a few times but am current with my account. I paid Ditech on XX/XX/19 $XXXX. The funds have been taken out of my bank account but like so many other times never posted for days sometimes weeks. Ditech is stating on my credit report as of today that my account is 47 days past due and still not reflecting my last payment was XX/XX/XXXX Ditech has reported that my last payment was made on XX/XX/XXXX. This keeps happening and I am trying to refinance. I just learned Ditech has been submitting late payment notifications on my credit report, which is not allowing me to refinance. I am not paying my XXXX payment until Ditech removes the 60 day past due notification from XX/XX/XXXX and both the 30 day past due notifications from XX/XX/XXXX and XX/XX/XXXX. They are reporting false information and I want ALL past due notifications removed. It is affecting my credit score and the ability for me to refinance.
