Complaint: 1 ) Received A " Committment Letter '' for refinance of existing mortgage from Ditechz XXXX Loans on XXXX 2 ) Committment Letter contained the foillowing terms : a ) Discount points/Origination credits : 0.3750 % b ) Commitment Expiration Date XXXX 3 ) On or around XXXX XXXX XXXX, a Ditech representative who acted as my loan processor and provide me instructions on the paperwork flow and signing instructions sent an : Adversary Letter via email saying my loan was denied because I did not meet the conditions. 4 ) On or around XXXX XXXX XXXX, Ditech manager called me via phone and after hearing my complaint against XXXX XXXX, stated she was in need of additional training, the Adversary Letter would be withdrawn and I would be assigned a new loan processor. 5 ) A new loan processor was never assigned to me or contacted me from XXXX up until today XXXX. 6 ) Numerous attempts to reach Ditech about my loan documents via email to XXXX XXXX, XXXX who is listed as the contact person for my loan has been unresponsive. Ditech Mortgage Loan contact phone rings constantly with no pick up and when their is a pickup, the line goes straight to busy signature. 7 ) On XXXX discovered on-line at Ditech XXXX there was several closing documents to complete my financing waiting for my signature on XXXX, XXXX, XXXX, and XXXX. Each document penalize me for not signing the documents by increasing the points from its XXXX XXXX 0.3750 % to a ) XXXX - 1.850 % b ) XXXX - 0.975 % c ) XXXX - 2.150 %

Complaint: Dear Sirs, I am writing to inform you that in XX/XX/XXXX, a deal of sale was made in the name of my brother with the company XXXX XXXX, it is worth mentioning that my bro was only cosigner as head of the account appeared my mom and that was done that way for credit reasons and that the person in charge of the payments was me that company left Texas fleeing because they scammed a lot of people including me. However, I continued with my payments every month as agreed I do not remember what year but XXXX XXXX sold to Green Tree I do not remember In which year, I also do not remember that Green Tree has changed the number of the initial account the fact is that they paid continued Given month after month, in XX/XX/XXXX, I made a payment agreement with Green Tree, paying {$340.00} per month, I don't remember until which year But several years ago, Green Tree sold it to Dytech following the same payment and the same account number, in XX/XX/XXXX, I had transport problems accepting myself for the first time in almost 20 years, making my payments as usual, because I only had part time of the work making it impossible to pay two monthly payments and in the third I began to give my payments again in XX/XX/XXXX, I received a letter from Ditech informing me that I had a delay to what I immediately went to them and was constantly communicating via phone and email and they responded by telling me that they would check and review my case and they would talk to me or answer me to give me a solution, that they were working together to help me fix this situation, something that I never had an answer, on many occasions they asked me for letters where my brother granted me ample power on the account and they never accepted the letters, they rejected me, I don't know how many months they last in which they finally accepted the letter. The case is that when they accepted it they told me that the only thing they wanted was that I will pay around {$5000.00} and they told me that No one could refinance and that {$32000.00} was owed, since the mobile home initially cost {$30000.00}. The fact is that I have been paying uninterruptedly for almost twenty years and nobody ever advised me or told me how to fix this matter, an issue that the company always knew how it was, when they supposedly were going to help me fix and update this account, I even asked them to add or charged it to the capital for me to continue with my payments as usual, the fact is that Approximately in the month of XX/XX/XXXX of the present, they blocked the account because I wanted to check the account and said that there was not so much me as my brother were trying But they never gave us an explanation of why, even they didn't find it in their system either, they said that they didn't have that account. However, I continued to make the payments until I received a letter saying that they would no longer accept the payments for what I went to with a Person, she advise and told me that they would not send more payments because I did not know where was going to give my money. In XX/XX/XXXX of the same year, I received a letter telling me that the payments that I had been given they could not accept were going to be returned as of the following week I received another letter in which I was informed that the account number had changed and that it was already another number and that I could generate an account and make the payments online, however when creating the account and entering I was asking again {$5000.00} afterwards there were no longer XXXX wanted {$10000.00} remember that for expenses of lawyers something that was impossible for me to pay. Nobody has that money to be able to give him a single payment and less on these dates, they were sending letters wanting my brother to declare bankruptcy which he never did because he does not live here is in another state and because there he also grabbed lawyer and pay again another {$5000.00} was impossible to fix this issue, they had already taken note that I was the one who lives in this mobile home and that I am responsible for making payments and that my bro never paid anything, So they never agreed to Being a type of arrangement with me, on XX/XX/XXXX, I receive an email where they send me a notification, notifying me that they declared bankruptcy them the Dytech company, in that same notification they quote a Website and a number 1 800 to which I can go before of certain date the annex and there comes everything detailed because there it says that I could choose to keep the property however that Website and that 800 number will never work I tried many times and in the in said that there was no or an error ocurred and at 1-800 no one ever answered only an answering machine saying that it will leave a message that the call would be returned to me, something that until today has never been possible. nobody called back and they only sent me one person on XX/XX/XXXX of the present notifying me that they want me to evict the house because the debt amounts to {$32000.00} and that they bring a court order signed by the judge which I consider an arbitrariness being that I live here with my mother mother of 87 years of age, I am a single mother and I have my XXXX minor children my son of XXXX years and my daughter of XXXX years, both students, yesterday, XX/XX/XXXX, I received An email where I am summoned to court on XX/XX/XXXX, attached the last two letters. Waiting for a favorable response from you, since I am of limited resources.

Complaint: I have been with Ditech as a mortgage service company for many years. Every month i pay my bills on time through my bank 's bill pay service. Beginning in XXXX Ditech stopped applying the payments to my account and began a constant harassment via mail and phone towards me for non payment on the account. I have gotten my banks bill pay department to supply all proof that the money was paid to Ditech for both XXXX and XXXX XXXX payment. I have called and talked to them at least 12 times in the last month and they always reply that they are researching to call back in 3 days. It has been 2 months now. This week i told them to either resolve the payment application to my account this week or i would initiate legal action against them.

Complaint: This is regarding my Ditech loan # XXXX. This loan was taken over by Ditech from the original servicer in XXXX or XX/XX/2019. I had my payments automatically deducted from my checking account with the initial servicer. I requested the same from Ditech as soon as I was notified that it was taking over my loan. Payments were successfully made the 1st and 2nd month. However, Ditech did not autodraft the 3rd month and then triggered a late fee and penalty. I called, paid two months at the same time, requested that they reverse the late payment and restart my autodraft. This then happened again in XXXX/XXXX. I have now paid {$1000.00} in late fees. I now have seriously derogatory strikes on my credit that must be removed. I just paid my XXXX bill ( today, XX/XX/19 ) manually because the autodraft is again not set after 3 requests to fix it. It now says I am not eligible for autodraft. I know that this is not a communication issue. Ditech knows how to communicate on everything else. They just fail to do so when it can cost me money and marks against my credit report. Indeed, I have received over two-dozen e-mails from Ditech over the last 4 months telling me about my refinance options and ways to save money. I've received other e-mails from Ditech regarding my eligibility to participate in a lawsuit against Ditech for improper servicing errors and expenses. I don't know what else to do. I need these fees taken off. I need my credit report corrected. I can manage not being on auto-pay but I would prefer being serviced by a provider that does not take advantage of me.

Greentree was in violation of CERCLA and provided written notice. XXXX XXXX offers that she responded to SEVERAL FILINGS THAT XXXX XXXX ENTERED AFTER THIS ORDER WAS IN EFFECT, THEREFORE XXXX XXXX ONLY RESPONDED TO WHAT HE FILED, XXXX XXXX HAS NOT ATTEMPTED TO SELL THE PROPERTY. The Constable stated that the Eviction was proceeded with because I failed to pay a XXXX bond, wait a MINUTE HERE, XXXX XXXX IS THE OWNER OF THE MOBILE HOME AND NOTHING HAS CHANGED THAT OTHER THAN FRAUDULENT DOCUMENTS FILED BY XXXX XXXX. On XX/XX/XXXX XXXX XXXX was in possession of the Mobile Home. XXXX XXXX had XXXX XXXX evicted on XX/XX/XXXX, where is the STAY IN THIS PROCEDURE EXERCIZED BY XXXX XXXX? 1. On XX/XX/XXXX XXXX XXXX and XXXX XXXX received a Application for Order to Foreclose and Default Order by us mail. After reviewing the DEFAULT PRDER, XXXX XXXX knew something was very wrong. 2. XX/XX/XXXX XXXX XXXX went to the XXXX County District Clerk to inquire about the Notice she received by US REGULAR MAIL. XXXX XXXX was provided a copy of the Mailed Copy to XXXX XXXX and XXXX XXXX SIGNED BY XXXX XXXX ( who is affiliated with XXXX and XXXX XXXX XXXX ) The firm Representing Green Tree XXXX. 3. Exhibit A Attached hereto The Summons was mailed to XXXX XXXX and XXXX XXXX and Occupant of the Property XXXX XXXX XXXX XXXX XXXX SD XXXX. 4. Because Exhibit A was mailed to the address of Green Tree and not the correct address of XXXX and XXXX XXXX and Occupant of Property it was not ANSWERED. 5. The correct Mailing address for the Summons containing Application for Order of Foreclosure XXXX and XXXX XXXX were never served this summons. 6. After XXXX XXXX made the XXXX County District Court AWARE of this ERROR, The summons was mailed to XXXX XXXX and XXXX XXXX at their address of XXXX XXXX XXXX XXXX, Texas XXXX. 7. Exhibit B Attached hereto is a Summons containing Application for Order of Foreclosure, DEFAULT ORDER, They never corrected the Default order, XXXX XXXX did not realize this till much later, she was so over whelmed with the Legal act she needed to answer. 8. Therefore MISTAKE # 1 was improper service of a Summons Violation of RULE 106 ( a ) ( 2 ) and 736.6 in the 735 and 736 rules and regulations of a PROPER FORECLOSURE WITH PROPER NOTICE, THIS IS ALSO GROUNDS FOR A NEW TRIAL IN THE EVICTION MATTER Which has been assigned Cause # ___________. 9. XXXX and XXXX XXXX filled a petition of Appeal and they were still evicted from the Mobile Home OWNED BY XXXX XXXX BECAUSE SHE DID NOT POST XXXX, XXXX Bond and filed a Indigent document. 10. XXXX and XXXX XXXX have invested over {>= $1,000,000} of sash money into the Mobile Home XXXX to XXXX and this is three times THE COST OF THE BOND. 11. XXXX XXXX has filed contempt of court claim in which XXXX XXXX offers he FRAUDULENTLY FILED A CLAIM OF OWNERSHIP TO THE MOBILE HOME AND HE HAS NO STANDING IN THE OWNERSHIP OF THE MOBILE HOME IF ITS DECIDED HE HAS ENTITLEMENT TO LAND HE STILL WOULD NOT OWN THE MOBILE HOME, XXXX XXXX will provide a copy of this to the FBI AND LET THEM DETERMINE WHO HOLDS OWNERSHIP OF THE MOBILE HOME AND THE PROPERTY. 12. On XX/XX/XXXX XXXX XXXX provided a Certified copy of a Death Certificate of XXXX XXXX, XXXX XXXX also cancelled Instrument numbers XXXX and XXXX. 13. XX/XX/XXXX XXXX XXXX then filed a Full Reconveyance of Deed. 14. XX/XX/XXXX XXXX XXXX filed The Warranty Deed in the XXXX County deed records. A year had passed since notice provided to the Lender and they never responded. 15. Green Tree XXXX has no recording of Business with the Secretary of State, XXXX XXXX will provide certified Copies from them. 16. XXXX XXXX brought this matter before the court and claims no liability or responsibility of the sale? They were not ASSIGNED UNTIL XX/XX/XXXX Over a year after this was filled? 17. XXXX XXXX FIRST ANSWER covered the Assignment matter straight to the point of no QUESTION? Filed XX/XX/XXXX, yes it was filled before she was officially served XX/XX/XXXX. Because she was made aware of it before being served, a Second answer was filed XX/XX/XXXX. 18. The entire mater boils down to this, XX/XX/XXXX XXXX XXXX and XXXX XXXX were provided written verification from CFPB they were victims of the STIPULATED CONCENT JUDGEMENT entered between Green Tree and FTC AND CFPB. Green Tree knew they held no standing in bringing Foreclosure therefore XXXX XXXX XXXX XXXX. on behalf of Green Tree XXXX. Mistake # 1 XXXX XXXX was not a trustee until they fraudulently filed on XX/XX/XXXX backdating the assignment? Mistake # 2 Green Tree XXXX DOES NOT EXIST IN TEXAS SECRETARY OF STATE RECORDS. Mistake # 3 XXXX and XXXX XXXX were not properly served per 736.3 and TEXAS RULES OF PROCEDURE RULE 106 ( a ) ( 1 ) Mistake # 4 XXXX and XXXX provided a fraudulent statement to the Court, FRAUD UPON THE COURT. XXXX XXXX Argued every point and they all ignored her. Mistake # 5 Claiming The Company name DITECH after filling the Lawsuit. Mistake # 6 Judge XXXX signed a Order of Foreclosure missing a NOTARY? Mistake # 7 XXXX XXXX pointed out the document claimed to be the note was Fraudulent and copied from the XXXX County Clerk office, no original document. Upon XXXX Explanation to the Judge the Attorney for XXXX and XXXX jerked the document out of her hand before she was finished speaking. ( THE JUDGE ALLOWED THIS AND SO MUCH MORE ) Mistake # 8 XXXX XXXX as Trustee on behalf of Green Tree XXXX has been verified as INDENTURE TRUSTEE, THIS IS SOMETHING NOT OUTLINED IN THE CONTRACT. THERE WAS NO MENTION OF BACKED SECURITIES AND SECIRITIZATION. Mistake # 9 Green Tree assigned all rights unto XXXX XXXX XXXX on XX/XX/XXXX. Then Green Tree accepted payments from the XXXX Monthly from XXXX to XXXX? Mistake # 10 XXXX XXXX HELD STANDING, POSSESSION OF THE ASSIGNMENT FROM GREENTREE XX/XX/XXXX. NOT GREEN TREE. GREEN TREE signed all rights over to XXXX XXXX on XX/XX/XXXX. Mistake # 11 XXXX XXXX committed fraud by any sale to XXXX XXXX, XXXX XXXX and Green Tree have no rights to claim this property. Please read the contents of the Consent order, XXXX XXXX offers that this ORDER SHALL BE EXECUTED IN THIS CURRENT MATTER, IF THIS COURT DOES NOT HOLD JURISDICTION TO ENFORCE THIS ORDER, XXXX XXXX DEMANDS THE COURT RECUSE ITS STANDING TO ENFORCE AND TRANSFER THE MATTER INTO A HIGHER COURT WITH THE ABILITY TO ENFORE AN ORDER THAT XXXX XXXX HOLDS RIGHTS OF ENFORCEMENT OF. A copy of this entire complaint, request for Contempt Order and copies of XXXX XXXX XXXX filings have been submitted to the FTC as a complaint of NON ENFORCEMENT OF THE COURT ORDER RENDERED AND VIOLATED. A copy will also be provided to the XXXX County District Attorneys Office for a review of XXXX XXXX execution of fraud in claiming XXXX XXXX sold her mobile home to him, SHE DID NOT. XXXX XXXX request that the Court grant the JUDICIAL REVIEW which was requested to start with and the opposing side has kept the review from proceeding, this is a demand for due process. XXXX XXXX will satisfy the courts requirements to establish a proper assignment was not exercised, the opposing side wants you to believe XXXX XXXX has been un-successful in these attempts, for one they have not been granted, furthermore Honorable Judge XXXX XXXX has reviewed this assignment process twice in her court and both times determined there were title issues and ruled in the favor of XXXX XXXX. Complaint: Ditech did not run a correct escrow analysis on my account which shows my property taxes has changed which I have a {$600.00} surplus that needs to be issued as a refund and change my monthly payment to the correct amount. Ditect is still not reporting my correct mortgage balance each month to all 3 credit agencies. Ditech as not cancel my escrow account at my request which is allowing them to float my monthly payments each year.

Complaint: XX/XX/XXXX, per their website and telephone records, my mortgage company Ditech Financial LLC reflects they have not received my XX/XX/XXXX and XX/XX/XXXX mortgage payments. They say my last payment of {$730.00} was received on XX/XX/XXXX. I have my statements from my XXXX XXXX that my XX/XX/XXXX payment of {$730.00} was sent electronically and cleared my bank on XX/XX/XXXX. Also my XX/XX/XXXX payment of {$730.00} was sent electronically and cleared my bank on XX/XX/XXXX. These payments were sent by bill pay as I have done since XX/XX/XXXX. Beginning at the end of XX/XX/XXXX I have called many times to clear this up to no avail. I was told to have my bank fax my statement to them that showed that the XX/XX/XXXX payment was made. My bank faxed to them at the end of XX/XX/XXXX. XX/XX/XXXX, I received a letter saying my payments were 2 months behind. XXXX was given for what I could do for the situation. Pay what is due. Foreclosure and sale of my home was mentioned. XX/XX/XXXX, I called Ditechs customer service at XXXX, and talked to a lady named XXXX. She said their bill pay system was down in XX/XX/XXXX. She did find my XX/XX/XXXX payment and will remove the late fee ( {$28.00} ) and the negative report on my credit report. She was to call me back to let me know it was corrected. No call back. XX/XX/XXXX, I called customer service again and talked to a male but did not get his name. I asked for XXXX. He said he did not know anyone by that name and there were no notes in my file. Of course I had to tell him the whole story. He put me on hold, talked to XXXX ( XXXX ) and she told him she has sent the info that I paid on XX/XX/XXXX to the department that will research it. He was very condescending from the beginning of our conversation. I asked for his manager, boss, or supervisor that could give me clarity on the situation. He was adamant there was no one else I could speak with as the research department has no phones. I was so upset and stressed with the situation. My daughter got on the phone with him. He said he did not like the way she was talking to him. She said she did not like the way he was giving her XXXX year old mother the run around. He said everything was fine until my daughter got on phone. She said that was not true or she would not have asked for someone above you. XX/XX/XXXX and XX/XX/XXXX, I received additional letters from Ditech reminding me the 2 payments were behind. In XX/XX/XXXX letter, they did give me the name and phone number of my assigned account representative, XXXX XXXX at XXXX XXXX. XX/XX/XXXX, I called the extension of XXXX but XXXX XXXX ( ext. XXXX ) answered and said she could help me. I told the whole story again. XXXX XXXX was the kindest and most professional person I have talked to yet. She saw the notes from my calls and would do everything she could to have the problem resolved. She asked that I watch the account and if not corrected by XX/XX/XXXX to call her back. XX/XX/XXXX I called XXXX XXXX back but XXXX answered who said she could help. She said I was 2 payments behind and was I prepared to make those payments today. I asked her to please transfer me to XXXX XXXX who knows the whole story from our conversation on the previous Monday. XXXX said she could discuss it with XXXX and put me on hold. Came back and said XXXX did not answer. She said she will email XXXX and find out the status. I asked how/when will I find out the status. She said it will resolve itself in time. I told her I will be filing a complaint with the Consumer Financial Protection Bureau today. She said OK mam and transferred me to a voice survey, which I gladly answered. XX/XX/XXXX, XXXX telephone and website info shows I owe 2 payments with late fees totaling {$1500.00}. On XX/XX/XXXX, I will owe another {$730.00}. As I have said above, the XX/XX/XXXX and XX/XX/XXXX were paid and cleared my bank.

Complaint: I paid Greentreen/ Ditech Mortgage on XX/XX/2019. The mortgage company claims no receipt of payment. My Bank statement clearly show the money was debited for XXXX on XX/XX/2019. The mortgage company has threaten to report my Credit as negative and charge a late fee. I provide the bank statement and proof of ACH delivery to Mortgage company.
