Complaint: Hi CFPB, I've refinanced my house in XX/XX/XXXX. Not long after that, in XX/XX/XXXX, my contract was then transferred from the original bank that refinanced my house : XXXX XXXX ( debt collector : XXXX ) to a new debt collector called Ditech. The problem is that, because of a miscommunication between the companies and me, I should have started to pay Ditech in XXXX, but, instead, I've started paying in XXXX. After paying Ditech, I was informed by XXXX that I should send a check to them in order to cover XXXX, what I've done and can proof. So, then, I've called Ditech and they told me that were going to use the XXXX payment to cover XXXX and should be all set. They never did. Instead, they've paid XXXX for XXXX, so then XXXX received two payments, one from me, and one from Ditech. Last month I've contacted Ditech to negotiate my interest rates and they finally discovered the problem. As soon as this happened, they've started to charge me two mortgages, instead of one and also started to send letters threating me about foreclosure. I've called Ditech and said that they have to get reimbursed by XXXX. They said that they can't do anything about it and that I should ask XXXX to reimburse me instead, so then I should use the money to pay Ditech until the end of this month, otherwise, it will have consequences ( more threats via phone ). I've sent two faxes, one to Ditech and one to XXXX, showing my proof of payments. I've contacted XXXX, but they said that just solve problems like this via fax. The problem is that the time is passing by and they've never replied to anything, even though my fax has my phone number, email and all the details of my account. When I call them, they say that don't have any information about my account. I want to solve this asap as this will affect my credit and also because I don't want to pay interest rates, as this was never my fault. Thank you so much for your services CFPB. Complaint: Ditech is refusing to give me statements regarding my mortgage payments. They sited CFPB rules stating they are not allowed to because I had filed bankruptcy in the past. My bankruptcy closed with all debts payed in full XX/XX/XXXX. They stopped sending me statements in XX/XX/XXXX. They have however sent me two escrow analysis statements in this time period. I just want to be able to see my statements. I am not currently in bankruptcy nor have I been since XX/XX/XXXX. They're only response when contacted is " per CFPB rules we are not allowed to send you statements ''

Complaint: I brought my home with an FHA loan in XX/XX/2016. My taxes are supposed to be paid through my escrow account. I have made all required mortgage payments and was never delinquent. It turns out the mortgage company was paying taxes to an incorrect parcel number for this entire time. The correct county never received any tax payments because the parcel number that was being paid was in a different county. The mortgage company is now demanding that I pay the delinquent taxes and all the fees. I don't feel I should be liable for this since I was making all the required payments and I was told that my taxes were payed through escrow. The escrow company has tripled my mortgage payments to recover the $ XXXX that was delinquent. I can not pay this and I am afraid they will take my home. If nothing else they should try to work with me to resolve this in a reasonable way instead of increasing my mortgage payments to such an unreasonable amount. from XXXX to now XXXX This doesn't seem fair and cant be right. Please help

Complaint: My " XXXX/ XXXX loan was deemed predatory and was supposed to be discharged in XX/XX/2010. For my home at XXXX XXXX XXXX XXXX, MA XXXX. Lender abandon the loan, " Green Tree Servicing '' and now 6 years later " Ditech as successor by merger '' is trying to foreclose. I have never been shown the original " Wet ink '' proof of debt, in 12 years of requests. As per Massachusetts 940 CMR. My state attorney general has already sewed in civil court but they won't comply and show proof or discharge the mortgage. I have proof of invalid assignments of mortgage by Massachusetts XXXX County XXXX registry of deeds, due to known " Robo Signers '' ( XXXX Massachusetts Registry of Deeds, affidavits on file ). I live in a non judicial foreclosure state and my mortgage has long been a time bard debt and can't be collected under operation of law.

Complaint: Ditech is my mortgage company and my town taxes are included in my mortgage payment. I have been paying taxes quarterly but at the end of XXXX, Ditech paid a full year in advance. I received a letter from Ditech dated XX/XX/2019 and was informed that my escrow account was {$3100.00} in arrears. I was informed that I had to pay that amount by XX/XX/2019 or my mortgage would increase by {$290.00}. I consulted with Ditech on several occasions to fix this problem.. I asked Ditech to get the money back from the town and revert to quarterly payments. I spoke with the town today and they said that they offer mortgage companies quarterly payments or they will give a 2 % discount if a whole year is paid in advance. I spoke with Ditech again today and was informed that if they are offered any discount at all, they take it and do not inform the customer of the change. I called the town again and asked the town to refund the money to Ditech so that I could do quarterly payments and I was informed by the town that Ditech has done this to so many residents in the town that the town absolutely refuses to refund any money. As a result, my mortgage will go up about {$300.00} a month. I am extremely upset about this unfair situation.

Complaint: In XXXX of XXXX XXXX XXXX XXXX our mortgage company account number # XXXX gave us emergence relief do to Hurricane Irma for 3 months. After 3 month or on XX/XX/XXXX we started payment again to XXXX XXXX until our loan was approved for modification in XXXX of XXXX. Last payment from us to XXXX was XX/XX/XXXX XXXX.In XXXX of XXXX XXXX sold our loan to Ditech new account # XXXX in the process XXXX XXXX XXXX did not record our new modified loan. In XX/XX/XXXX of XXXX we started sending our payments to Ditech account # XXXX for 5 months our last payment was sent to Ditech on XX/XX/XXXX. In XXXX of XXXX Ditech sold our loan to XXXX new account # XXXX from XX/XX/XXXX to current. Currently Ditech is reporting to all Credit Bauru we are 180 days late from XXXX of XXXX. This is not correct we were never late on any payments. I have disputed Ditech report to all major credit companies on many occasion without any result. Ditech told me XXXX is the entity responsible for 180 days late payment, when I speak to XXXX XXXX XXXX they are telling me they have not reported any late payments and it is Ditech problem not XXXX issue.

Complaint: My properties Hazard insurance ( policy number XXXX ) for the period XX/XX/XXXX thru XX/XX/XXXX for the amount of {$3800.00} was paid by my mortgage company, Ditech, in the form of 2 checks to the insurance company in the amounts of {$140.00}. on XX/XX/XXXX and {$3700.00} on XX/XX/XXXX. I have those check numbers from documentation from insurance company if needed. On XX/XX/XXXX I was charged {$320.00} for what was labeled Earthquake Insurance disbursement. I was again charged {$100.00} monthly in XX/XX/XXXX thru XX/XX/XXXX. I was charged {$100.00} in XX/XX/XXXX and {$100.00} in XX/XX/XXXX. It took me 6 months starting in XX/XX/XXXX to get the mortgage company to finally admit these Earthquake disbursements I was being accessed was for forced placed insurance. I have never gotten an explanation as to why they started to charge force place insurance when they had paid the hazard insurance on the property. When you call customer service to ask a question you are put on hold for up to 45 minutes and then phone generally disconnects before the individual returns with your answer. Also since this company uses foreign call center s for it customer service it is very difficult to understand what they are saying especially when they are reading from a FAQ. They have limited ability to understand what you are trying to convey to them to be able to act on it properly. I have asked the mortgage company for a refund on the {$1300.00} they have charged me in forced place insurance when I was in compliance by having hazard insurance on the property. I was also charge {$15.00} in XX/XX/XXXX and XX/XX/XXXX, which I still can not get a valid explanation for yet. This haggling with them for over a yea to get this resolved has got to stop, please.

Complaint: I had a house that was foreclosed in XXXX or XXXX. The house sold at a sheriffs sale for less than I owed. In XX/XX/XXXX a judge granted Dietech mortgage a judgement against me that I had no clue about. I own outright a home in XXXX XXXX Indiana on XXXX XXXX XXXX. I sold this home and made an accepted cash offer on another home af XXXX XXXX. Upon a title search by XXXX XXXX during their second search the judgement for Ditech showed up. XXXX XXXX Attorney XXXX XXXX, myself, XXXX at XXXX XXXX and XXXX XXXX at XXXX XXXX have all been engaged in numerous three way calls to Ditech and even their attorneys and Ditech has incompetently turned this into a fiasco that has yet resolved. We all were seeking a payoff amount or letter stating the amount of a release of the judgement sent to XXXX XXXX so we can close. Ditechs incompetence in this matter has resulted in delay of closings on two properties, contractors not being able to start, utility transfers of service being scheduled and rescheduled, movers canceled, realtors not receiving their commissions, and the list could go on. Ditech said the loan is closed, and referred us to various internal department heads, various external companies and turned this into a fiasco due to their lack of knowledge of a judgement. At one time Ditech referred Attorney XXXX XXXX and myself to XXXX, one of their Department heads who didnt even know what a foreclosure was! XXXX XXXX The Attorney for XXXX XXXX XXXX hopes to get a call from someone who can assist in this mess! The number to XXXX XXXX is ( XXXX ) XXXX. Help us please it has been a mess!

Complaint: I had a mortgage with DiTech Company in the last several years. Recently I sold my property and the closing already took place in the first week of XXXX 2019. Outstanding loans have been paid off. However, the mortgage company which is DiTech still took out from my checking account for the mortgage payment of {$1200.00} on XXXX XXXX, 2019 even though the loan has been paid off. I called the company at least 3-4 times since XXXX of 2019 to address this issue because I want my money back. They keep saying that they will mail me the check and until today XXXX XXXX, 2019 no check has been sent to me.

Complaint: Ditech took over my account from Green Tree who I have been with since XXXX. My monthly payment is XXXX a month. I became behind one payment and called to schedule XXXX be added to each future monthly payment to make up for it, which they agreed with. I have since made 2 payments of XXXX but noticed on my statement that they are not being applied to my mortgage. Ditech shows I have not made a payment for XXXX, which I did ( XXXX ) but was not applied to my mortgage. Second was sent by mail ( XXXX ) XXXX and will not be applied to my mortgage. Ditech has a statement that says until the past due is paid payment will be held in a separate suspense account ( what is that? ). Those payment will not go toward my mortgage until I pay what they say I am past due. So, my agreement with them to add XXXX a month is bogus. I tried to call and the extension for a representative is no longer in service. Also, my payment is due on the XXXX but a rep. told me if I pay it by the XXXX there is no problem, I have been doing so. I emailed the contact they gave me to change my due date to suit my schedule and found out it was bogus. I am scared they are scamming me since I have been receiving documents that they are going through law suits for this very thing. Please help, I don't want to lose my home over one late payment and them not honoring an agreement.

Complaint: I have asked to be able to be removed from the requirement to pay PMI insurance on my mortgage, as I more than meet the threshold requirements of equity to debt. I have requested in writing to Ditech for this to occur, they replied that I am unable to be removed from PMI until the 11 years have transpired. Is there any other remedy for this situation? I thought the rules were that it was until I reached the equity threshold OR then11 years were reached not and or both.
