Complaint: DITECH CHEATS CUSTOMER OUT OF HIS PMI REFUND! Ditech Financial LLC received a refund ( {$95.00} excess PMI payment, from the XXXX ) on or about XX/XX/XXXX, after a closing on a sale. Ditech then sat on this money. It finally mailed a company check for the aforementioned amount ( my refund ) to me approximately one year later! I received the check on XXXX XXXX, XXXX, and deposited it immediately. It was rejected and returned to me, with the reason : CLOSED ACCOUNT In other words, Ditech wrote me a 'hot ' check! A letter to Ditechs office of record, ( in XXXX XXXX, MN ) regarding this matter was never responded to. Several calls to their listed contact number ( XXXX ) on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX ( all XXXX ) have resulted in negative action to make good on this check. Ditechs Director of the Escalation Check Reissue Department, XXXX XXXX, in Ditechs XXXX, FL office, has consistently and deliberately blocked every refund request ( s ) turned in by lower-rung customer service individuals attempting to have the funds reissued and the matter closed. Given Ditechs history of Chapter XXXX filings, I can see why certain individuals in positions of responsibility choose to cheat every customer at any opportunity. Even though companies like Ditech cant change their stripes, they should certainly be held legally accountable for the deliberate cheating of their past and present customers, with a stern Caveat Emptor warning to future ones.

Complaint: In XXXX of 2019, my mortgage company, Ditech forwarded notice of intent to forclose within 60 - 90 days if payments were not met. In XXXX of 2019, I contacted XXXX 's ( XXXX XXXX XXXX XXXX XXXX ) XXXX XXXX program to work out a loan modification program. We submitted documents to substantiate our request. In XXXX of 2019, my home was in line for forclosure for failure to make timely payments. The scheduled date was XX/XX/2019. On XX/XX/XXXX, I was accepted into a trial payment program which lowered the cost of my mortgage by {$300.00}. I entered into the agreement and made timely payments that began in XXXX. The last payment was made in XXXX. After finishishing the required payments, Ditech indicated they were ready to proceed with a 360 degree loan modification, but there was a lein of $ XXXX on the home and the lender of that loan needed to agree to take second position and sign a subordination agreement. The company was XXXX XXXX, a federally funded program. They paid my mortgage for me for 2 years during a long illness I had. After the program eligibility was over, they place a 5 yr lien on the property that is released once the time frame is met. XXXX XXXX agreed to take second position as asked for the documentation. Ditech forwarded me the proposed agreement, that outlined what was owed to Dietech, what was owed to XXXX XXXX, and the proposed terms. XXXX XXXX informed Ditech that per Federal Regulation that XXXX XXXX is under, it is required they ( Ditech ) provide a final total in writing. During a phone call on XXXX with both parties and myself present, Ditech stated they do not provide what was being asked. XXXX XXXX then said they would accept a final payout from them in writing to satisfy the Federal Government requirement. The request was made by Ditech official to obtain the payout letter before the call was over. Ditech has given me until XXXX to get the subordination agreement signed. I called everyday since then to obtain the payoff and to date they still have not provided it. XXXX XXXX can not sign the agreement unless all regulations are followed and Ditech refuses to do so in a timely manner. I have asked for an extension on 4 occasions to allow for the payoff letter from their attorneys to get generated so we could move on with the loan. Today is XXXX. Ditech underwriters said they will not give me an extension because they followed all the rules and don't have to give XXXX XXXX what they asked for. Further, they said that all the payments I made thus far will be null and void and I will have to go through the long process all over again and wait to see if they will accept me back into the program. My problem is that even if I can get back into the program, we will run into the same problem where they will have to produce the paperwork the way the Federal Government requires and I will be in the same position 6 months from now because it will still have to go to XXXX XXXX for the subordination agreement,.

Complaint: My primary mortgage company Ditech was on the verge of bankruptcy processing, my account has been transferred to XXXX started on XX/XX/2019. Ditech sent false report that do not match the real monthly payment to new service XXXX, also Ditech sent a delinquent credit report. The US Bankruptcy court sent a notification in XX/XX/XXXX, which made me stop 1st check of {$550.00} ( escrow shortages ). Ditech sent a letter about my mortgage loan service transfer to XXXX around XX/XX/2019, that is the reason to stop the 2nd check of {$500.00} ( the check sent on XX/XX/19 ) From XX/XX/XXXX to now, I called the both Ditech & XXXX many time to seriously state that the two stopped checks all for escrow shortages, not made for a regular monthly mortgage payment, because escrow shortage is optional, as customers like I have the right to choose Yes or No. These two stopped checks does not concern the regular monthly mortgage payment, because of the monthly payment funds {$1400.00} withdrawal from my bank every monththat is pure fact. Also I sent the two monthly payment proof ( the paid check copy and bank statements ) by email and by mail to the both Ditech & XXXX I always asked them to provide a banks chargeback source for XX/XX/XXXX payments, but Ditech could not do provide any documents, and refused to admit that the XX/XX/XXXX payment was counted as credit.

Complaint: XX/XX/2019 my home flooded. It took two months to get a flood insurance preliminary proof of loss. The POL was sent to first mortgagorXXXX XXXX Disaster loans for endorsement. XXXX sat on the check for 5 weeks before sending it back to me because I was informed they had me send it to the wrong address. The check came back XX/XX/XXXX and was forwarded to Ditech Morgage who told me they would have it back to me in 5-7 days. Ditch received the check XX/XX/XXXX. The check was forwarded with a letter explaining that I had been flooded out of my home for 5 months and the reasons why, a copy of the Proof of Loss, and a copy of the bids for hvac, electrical, and plumbing repair, which is the same thing I forwarded to during the previous flood four years ago. On XX/XX/XXXX, Ditech calls and demands copies of contractor licensure. This was not required for my last flood loss only 4 years ago. It is my belief that Ditech, a mortgage company in bankruptcy, is simply tieing up my payment in their bureaucracy in order to use the money in the interim and stall as much as possible in paying me so I can repair my house. I have been out of my home for 5 months. There is no power or heat there. I am living in a rental, losing the income from the rental and making payments on both houses, both the rental and the one that is uninhabitable. Winter is coming on, and if I dont get my home repaired, the plumbing may freeze & burst causing yet more damage, caused by Ditechs delays in forwarding my fema repair check. I need some help getting Ditech to release the check. Complaint: All happened today, the day this complaint was submitted. I tried submitting this complaint multiple times after calling twice. Disgraceful. This complaint is directed toward Ditech Financial LLC, the company that owns my mortgage. I tried reaching out to see about loan modification or forebearance, very temporary until XXXX. Background : After reevaluating my finances due to taking a XXXX dollar pay decrease from military orders sending me to Texas and my wife being forced to quit her job, Ive determined I need help with payments until XXXX when Im in a better financial situation ; a forebearance plan came to mind. Problem : I contacted your representatives who told me there was nothing they could do due to the fact my loan was owned by XXXX XXXX ; that I would have to be in a delinquent status. I called back shortly thereafter for a second opinion and was put on the line with a specialist. This specialist could not give me a single reason why I couldnt do this, nor was willing or able to provide written documentation as to why I would not be able to go through with a forebearance plan. She simply said no without any written regulation to back it up. Does this not sound ridiculous? Does this not affect credibility with your company?

Complaint: I made a payment to Ditech XXXX, 2019. When XX/XX/XXXX's payment was due, I couldn't make it online because it said I owed XXXX. I called and spoke to a Ditech representative who stated that they were doing computer upgrades and it will reflect soon. Same with XXXX. Same with XXXX I called in XXXX after emailing them NUMEROUS times and was told they had NO record of my XXXX payment. I immediately faxed the confirmation they EMAILED to me in XXXX and and a copy of my bank statement showing the payment coming out. I received notice in XXXX that they received my letter that I sent to them and it would take 30 days to complete the review. In XXXX I received another letter that it would take another 30 days. TODAY I received ANOTHER letter that it would take ANOTHER 30 days AND letter that foreclosure proceedings were started. It should NOT take 90 days to SEE that I made the payment and their system is XXXX up! I am attaching to you the confirmation from DITECH that my payment was made AND showing it coming out of my bank account. THIS NEEDS TO BE THIS NEEDS TO BE CLEARED UP IMMEDIATELY!! I have NEVER MISSED a payment with Ditech since they had my loan with them!

Complaint: This is my 3rd complaint against Ditech Loan Servicing. By the time they answer this complaint the home will be on the market for sale. I along with my siblings are the successors in interest of my father 's home. Ditech has been contacted by me several times and my Lawyer as well. My attorney sent a QWR in XXXX and Ditech has failed to answer it. Instead they have forced me to correspond with XXXX XXXX, a Debt Collection Attorney. I have not been contacted by anyone from Ditech. I asked their attorney for a person of contact that I could speak to and he did not answer me. I also asked him if he could guarantee that there would be no encumbrances on the title when it went to close, No Answer! Ditech sent me a statement with attorney fees added to it. These fees are due to the illegal sheriff 's sale that they attempted in XXXX. They have repeatedly Violated RESPA laws and continue to do so. I would like a Qualified Person from Ditech to phone me at XXXX so that I may have some answers to many questions concerning the sale of my Father 's home and his mortgage file. I do not trust Ditech as they have 100 's of consumer complaints as well as filing bankruptcy twice in eighton month 's. I am attaching the file of my QWR and Ditech 's latest statement that was sent to my Father and not me.

Complaint: I had a mortgage with Ditech Financial Corp. I had trouble paying my mortgage and was put onto a repayment plan. The plan was successful and representatives from Ditech said that I was once again up to date on payments. I began paying my mortgage as I should by XX/XX/XXXX. In XX/XX/XXXX I received a letter saying that I no longer had a mortgage due to a decision made by Ditech. They would no longer finance my home ( with on time payments ) because I had a history of not making my payments on time. Ditech then sent back my payment check and would no longer accept payment. Twice a week, Ditech reps came to the house and left a note on the door for inspections. At this point, the mortgage was up to date, but Ditech would no longer accept payments. I went to XXXX, CT court and worked with a housing expert who let me know my options. It was found that I was on time with payments. Ditech then foreclosed on my house in XX/XX/XXXX. I had spent roughly {$68000.00} in lawyer fees and back payments to Ditech and they never accepted the mortgage was up to date. I LOST MY HOME. A home that I paid for and was making monthly payments on. I only became in arrears when I lost my job, but I was able to catch up with my mortgage in 8 months time. I had to move into an apartment and lost the only home my XXXX XXXX year old adopted son knew. It was Ditech representatives based in Florida that told me that I was ok and my mortgage was up to date, though each time I called them I had a different representative and could not get a hold of the original rep. My account was switched over to representatives upwards to 15 times. I don't have a home anymore. I was forced to leave. The home I had sits untouched since the day I left and I miss it dearly. I just want to recover what was mine and move on from this horrible disaster.

Complaint: I have been speaking with several Ditech representatives about the possibility of a loan modification since it was suggested to me by a Ditech rep in late XX/XX/XXXX when I realized I would be late with mortgage payments due to a short term financial hardship. I explained that I was experiencing short term financial hardship and agreed that I would be interested in exploring the idea of a loan modification. The modification paperwork and application was sent to me and I received it in late XXXX. I collected all of the necessary documents required on the modification checklist and faxed my documentation to the Ditech Loss Mitigation Fax number on the bottom of the Ditech Loan Modification checklist sheet. The documents were faxed 3 times on XX/XX/XXXX. The fax number was not returning a response which is why I faxed it a few times. I called to see if my documents were received on XX/XX/XXXX and was told to check back in a day or two because the Ditech Loss Mitigation department gets backed up and that they had been having some issues with faxes. I called back again 2 days later and was informed by an agent that the documents still had not been uploaded onto the imaging system. That agent ( Booker ) provided me with a totally different fax number to customer service and asked me to fax it there so that a customer service agent could upload the documents instead. That agent also told me that Loss Mitigation often gets backed up with paperwork and he wanted me to get the documents to customer service to try to get the modification review process started quickly before my account got too far behind. I then faxed the documentation to the newly provided fax number the very next day. I faxed it 2 times and called a day later to confirm receipt by Ditech. Ditech agent once again informed me that the documents had not yet been received. I asked for a manager to help me to resolve this fax issue and was directed to speak with XXXX at ext # XXXX. She informed me that she was a manager and asked me to try a different process. I felt that she was genuinely trying hard to help me to resolve this issue. XXXX asked me to do an e-fax to a third fax number which would be sent directly to her and she committed to getting the documents to Loss Mitigation upon receipt of the e-fax. I faxed the documents again for the 6th time to the new number given by XXXX the next morning. XXXX said she would note my account immediately upon receipt of the fax so that when I called back in to check on the status, an agent could confirm receipt of my documents by reviewing her notes. I called back 2 days later to see if the fax had been received and was informed by XXXX ( agent ) that there was not a note on the account saying that the fax was received. XXXX offered to walk over to Dionnes desk to check with her to see if the fax was received. After placing me on hold for a few minutes XXXX returned and confirmed that all of my paperwork had been received and XXXX would be getting it to Loss Mitigation ASAP. He also set up a payment by phone for me and discussed that I should pay what I could afford in the meantime while the loan modification was being processed. He did inform me that the account was getting close to 120 days delinquent. I called Ditech back again today XXXX because I had not heard anything yet on next steps. I spoke with XXXX who confirmed that several notes are in the system on my account indicating that I have been inquiring about my fax status and the loan modification for weeks, but she also told me that there was nothing in the system indicating that XXXX had actually received the fax and she proceeded to try to collect on the account. After I explained to her my concerns about how horrible this experience has been she proceeded to tell me to call XXXX back tomorrow XX/XX/XXXX to speak with her directly about the eFax because as an agent she couldnt view that information in her system. She said the office was about to close for the day and instructed me once again to try back tomorrow and request to speak with XXXX or a manager. She also let me know that my account was 128 days past due and mentioned that she could see in some of the notes on my account that I have been dealing with this issue for quite some time and have spoken with many different agents about Loss Mitigation and my modification request. Each time I call it seems as though none of the agents at Ditech know whats going on relative to my account and the loan modification process. Each person asks me why my account is behind and tries to collect on the account even though I have explained my issue to upwards of 6-8 different agents since XXXX. Im currently at a loss for what to do next and am filing this complain in an effort to get action and to express my concerns as my account is getting more delinquent as this confusion continues at Ditech. I am requesting a return call from a manager in Loss Mitigation who can confirm receipt of my personal/confidential financial information that was sent multiple times via fax and seems to be floating in limbo at Ditech. I also need a manager to confirm that the modification process has started. I would also like to know next steps in this process.

Complaint: I had a mortgage with Ditech Holdings. They apparently went bankrupt in XXXX of 2019 and my mortgage was sold to another lender. I sent my XXXX payment to the new lender and it was returned. This cause my Ditech account to move to 30-59 days past due. I called and figured out that I needed to send my XXXX payment to Ditech and did so. I was informed that since Ditech went bankrupt and the loan was sold, it was illegal for them to report to the credit bureaus unless the account was more than 90 days past due. I got everything squared away and have been paying the new lender. I then noticed that Ditech REPORTED to the credit bureaus and my score dropped by 50 points. I immediately contacted them and demanded they remove the report. They added a " Remark '' but didn't remove the initial report to my credit. I've disputed with the credit bureaus, but they state Ditech will have to agree to remove the original report. I have called and emailed and they simply have not done it. I checked and it was ILLEGAL for them to have reported due to the fact that the loan was sold due to their bankruptcy. I have NEVER missed a payment for anything and am enraged by this illegal action that has negatively impacted my credit score/reports and my ability to obtain future credit!

Complaint: Beginning XX/XX/2019 a fraudulent address was brought to my attention by XXXX. I followed the XXXX recommendations. In XX/XX/2019 I called my mortage company, Ditech Financial, LLC about my XXXX monthly billing statement. Ditech sent my billing statement to the fraudulent address. Ditech customer service received a power of attorney paperwork for a change of address without verifying the address which I informed Ditech was fraudulent. Ditech informed me that the only way to get a new account number was to refinance with Ditech. WHY WOULD I REFINANCE WITH DITECH WHEN THEY GAVE OUT PERSONAL INFORMATION WITHOUT MY PRIOR APPROVAL.
