Complaint: I have attached a copy of the letter that I have repeatedly received in the mail for the last 5 years or so.My husband passed away 13 years ago and the house we lived in, and had both of our names on, I moved out of and filed bankruptcy on 6 years ago. After his passing, I contacted the mortgage company to inform them and sent them a copy of the death certificate as soon as I had it. This company has changed names several times over the years, but is currently going by Ditech Financial ( used to be Greentree Financial ). During this time, I was repeatedly harassed, had very rude customer service representatives treat me like garbage. I finally filed bankruptcy. Now, I'm receiving letters ; at my new residence, addressed to my late husband who had never lived there, obviously. I have tried several times to reach the email address on the letter to Ditech, but it keeps bouncing back. I prefer to communicate by email so that I have a letter trail/proof of communication. So far, I have not been able to make contact.

Complaint: I have a mortgage with Ditech. Ditech went into bankruptcy in XXXX if I understand correctly. I did not receive instructions on how to pay the new company. I waited. When I finally heard from the " new '' ( it's probably the same people I bet, they have a history ) company, XXXX, they are using Ditech 's website, which is very strange - nothing has changed there. I called the 800 number and got a customer service rep and asked for status, then paid the past due amount in full on XX/XX/XXXX. Immediately Ditech issued another statement stating that I owe the default amount. This isn't right. It should currently be paid up. They also sent me a large package stating my account is in default.

Complaint: I am attempting to refinance my Ditech mortgage. During the title search process it was found that Ditech reported a second mortgage dated XX/XX/19 for {$0.00} XXXX XXXX # XXXX. I do not have a second mortgage with Ditech just my primary. I have been contacting Ditech since XX/XX/19 and have not heard back on the status of my inquiry. I ask that they remove this second lien on my title and that they provide me a written letter stating the details of my one and only mortgage with them and that this second XXXX lien was reported in error. I reached out to HUD to review this information and they stated that they have no record of any loan on my property or in my name as my loan with Ditech is a conventional loan and not an FHA backed loan. I am trying to get a leaky roof repaired ASAP with my cash out refi that I am seeking and now have gone months with no request and the water leakage is causing more unnecessary damage and there is no one that Ditech allows me to speak to regarding my inquiry. They just ask me to fax in a letter and I will get a response within 30 days .... well it has been 3 months and I have not gotten any resolution nor has a manager reached out to me about this ongoing issue. They are in effect, holding me XXXX and causing more unnecessary damage to my property due to their nonresponsiveness.

Complaint: Consumer Financial Protection Bureau Online Dispute Only To Whom It May Concern : In XX/XX/XXXX I submitted a complete modification package to Ditech Financial LLC. Over a period of several months I submitted updated documents whenever requested, such as recent bank statements and pay stubs. I also submitted with the original modification a hardship letter, whereas I explained in detail the several pressing issues I was facing such as unpaid medical bills, charged off collection accounts, and a short term employment situation that was eventually resolved. Through a third party power of attorney all correspondences can be accounted for, including several telephone calls where a Ditech representative suggested a streamline modification could be approved by Fannie Mae. I never received a letter dated XX/XX/XXXX where I was declined a modification based mostly on a credit score. Ditech never submitted such a letter either directly to me by regular or certified mail, or by email. Just a week prior to this date Ditech Financial LLC requested updated pay stubs and bank statements. It was during this timeline where Ditech was involved in its second bankruptcy since XXXX. While in the bankruptcy process Ditech tried on more than one occasion to offset and eventually release any ongoing claims pertaining to foreclosure procurements and abusive collection procedures. Decisions were handed down with the U. S. Bankruptcy Trustee in the Ditech case, as well as a state court in the Southern District of New York. My rights were protected while I was in the modification process as it went against the federal trustee protection of Ditech consumers they serviced loans for on behalf of Fannie Mae. My rights against this illegal foreclosure was also in violation of my rights under the amended Fair Debt Collection Practices Act of XX/XX/XXXX. I request intervention on this illegal foreclosure action by a multitude of federal and state agencies. My overall financial situation has improved significantly and my creditor collection matters will be completely satisfied by XX/XX/XXXX. Obtaining a modification refusal on credit score grounds is completely illegal and unconstitutional. The merits of this argument alone is enhanced simply by a defaulted mortgage history. My income debt to income ratios are significantly improved by the settlements on all collection accounts, the pay off on all medical bills, and I brought myself back to financial wellness by using an alternative debt reduction process outside a bankruptcy petition. I demand the reinstatement of my rights to complete the Ditech modification process, and I am going to once again submit updated bank statements and pay stubs. Even though Ditech Financial LLC might be under new ownership, it is the responsibility of all connected parties to protect my rights under the Fair Debt Collection Practices Act, in addition to the federal trustees decision to maintain consumer rights pre-merger.

Complaint: continuation from XXXX. Additional documents showing that the amount of my monthly payments are different on three different letters from Ditech XX/XX/XXXX 90 day temporary agreement {$1300.00} XX/XX/XXXX default letter $ XXXX/ XXXX XX/XX/XXXX letter {$1400.00} These changes in amounts cause the final delinquent amount to almost double making it even hard catch it up in one lumpsum. I called to ask what other options are available to find out that no modification will be granted without subordinate agreement and a payment plan can not be granted until past due amount is within 90 days.

Complaint: I have a mortgage with Ditech. In XXXX of 2019, I was approved for a modification and placed on a 90 day trial which I completed. Once completed Ditech informed me that they would send out a notary to complete modification process. That did not take place. Ditech has now sent a letter to me resending modification because I have a line of credit with XXXX XXXX XXXX XXXX. One loan has nothing to do with the other. Now Ditech is asking for a lumpsum payment to prevent foreclosure. Having an FHA loan qualifies me for several modification options including partial claims where a one time claim is filed for the insurance fund to pay delinquent amounts to bring my mortgage current. If approved I am responsible to pay amount back to FHA if I sell or refinance house. Ditech is refusing any assistance to force me into foreclosure. They are asking for the lumpsum of {$10000.00} by XX/XX/2019.

Complaint: I have been trying to cancel the PMI on my mortgage for years now and Dietch Financial keeps finding reasons why they can't do that. Most recently, I submitted to have my PMI cancelled and they told me I need to have an appraisal done on the home. An appraiser came to my home on XX/XX/XXXX and completed the appraisal. After hearing nothing from Ditech for a month, I reached out to them to obtain a copy of the appraisal. Today, Ditech left me a voicemail and told me that the appraisal that was done in XXXX was not done correctly and they need to do another appraisal. I have still not received a copy of the appraisal not was I told what was wrong with the first appraisal, just that it was wrong. When I called Ditech back at the number the agent provided, I had great difficulty getting connected with the agent who called me even though I had her direct extension. After a few attempts to connect with I was finally ( gruffly ) transferred to her extension. I got her voice mail and I left her a message letting her know that I approve having another appraisal done. I think Ditech is shrining me along to get more PMI payments out of me because we are now coming up on two months after the initial appraisal and I'm not being told we have to do another appraisal.

Complaint: On XX/XX/2019 I spoke to a Ditech representative, she set up electronic payment arrangement plan for my to pay back the pass due amount for XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX, totaling at little over {$3200.00}. Today I was informed the mortgage is in foreclosure and I must pay over {$7500.00} to reinstate the mortgage. Apparently it went to foreclosure on XX/XX/2019. I spoke with two representatives today, each had different information to share. The first one said I will receive a reinstatement letter with past due amount plus legal fees due and the second representative informed me the payments electronically taken will be returned. I thought I was on a payment plan to repay loan. I am not getting correct information and I don't understand why payments were never applied.

Complaint: On XX/XX/2019 my mortgage increased from {$870.00} to {$1100.00}. I was told by a Ditech LLC representative that it increased due to escrow and my property taxes went up by {$2000.00}. I have requested documents on the formula that was used to calculate my new mortgage amount and they keep giving me the run around and stating that they sent out letters back in XX/XX/2019. I haven't received any letters other than offers to refinance. I explained to the representative that my mortgage rate is fixed and there is no way my mortgage went up by {$270.00} per month. I asked to speak to a manager and I was told there weren't any available. I would like to resolve this matter to include an itemized form as to how they calculated my new mortgage payment. After doing some research this is a shady practice that this company is known for. They have since filed for bankruptcy and has sold my mortgage to another company but I still make payments to them.
