Complaint: These series of unanswered calls/ messages and not getting direct answers from every single representative started in XX/XX/XXXX when my hardship began. I was told by the new mortgage company at the time " Ditech '' that i would be able to apply for a loan modification ... I proceeded to do so within the following 2 days, due to getting all documents together for modification and needing a signature from at the time my husband which was not available. Faxed all paperwork, called Ditech to make sure it was received and was told no and i had to wait 5 days. Never got a call, email, text or letter until I viewed online that my home was in foreclosure with a sale date in XXXX XXXX I was contacted by a company to help me with the foreclosure having me file a ch XXXX along with making payments of XXXX monthly until my new payment/paperwork with Ditech was completed. XXXX, XXXX, XXXX, XXXX, XXXX, XXXX of XXXX came around and i never heard from either, but monthly payments were getting deducted out of my checking account. Received a letter from Ditech saying no payments were received and i would be in foreclosure again, so i filled out another application in XX/XX/XXXX and have the message i sent on my account asking if there was anything else pending or missing. Heard nothing, but got a letter from Ditech attorney on XX/XX/XXXX and had 20 days to respond. Faxed my 3rd application/rma paperwork on XX/XX/XXXX and never got a call back.. Followed up and was told they were missing pages and needing to do over but seemed that representative wasn't sure on what was missing. Hung up and called for a supervisor and she claimed that my check stub wasn't readable. Faxed again and nothing. Now it was spring time and again sent an application thru fax on XX/XX/XXXX. I could not get thru on website due to maintenance and long waits on hold. Sent a message on website ( which i have proof of all ) explaining on how many times my apps where faxed and even wrote on cover sheet of how many were sent with my number if anything was missed. In XX/XX/XXXX received a letter from a different attorney to initiate a collection of debt. XX/XX/XXXX another letter from attorney about foreclosure. XX/XX/XXXX a Notice of Acceleration from attorney. On XX/XX/XXXX Ditech sent me a letter and determined my application was incomplete and will evaluate for a loss mitigation option once all documents were received and will then respond to my request in 30 days. My 6th application sent I decided to Upload documents thru website on XX/XX/XXXX in hopes it would be better or faster.. XX/XX/XXXX received a letter of an incomplete application for the 7th time, left a message on website pleading them to contact me directly! XX/XX/XXXX received another letter in different form in regards to my credit score not high enough. XX/XX/XXXX received my message ( this was the Only letter i got in regards to messages on website ) and would be looking into it and will get a written response in 30 days. Since I have been reading online about how this happens often and i feel i was targeted the whole time which is unfair that I tried to get a payment i can afford and stay in home with my XXXX children. My house is set for foreclosure in 2 days and never been so disappointed not to mention worried about not having a roof over my families head. please help

Complaint: I have this account for 22-years. Ditech assumed servicing this account some years back. Until XX/XX/XXXX, for 22-years, this account has been paid on time each month. Then, in XX/XX/XXXX of this year, my headache with Ditech began. As best I can discern, in XX/XX/XXXX the firm moved my account from one internal system to another, thus deactivating my ACH payment. Apparently a letter was sent to me, but my accountant does not have record of having received it. In any event, in early XX/XX/XXXX, while reconciling my financial statements, my accountant noted the Ditech payments had not been withdrawn from my account. Payment was immediately sent to cure the deficiency and a request was made to resume the ACH payments. The Payment in XX/XX/XXXX was applied, according to the firms letter of XX/XX/2019 ( See enclosed ), to a suspense account and not properly applied to my account while we completed account maintenance. After my contacting your firm on XX/XX/2019, the funds were reversed and applied to my account. In the intervening time your firm reported this account as delinquent to national credit reporting bureaus. Your firm noted in your letter of XX/XX/2019 that Ditech reported the XX/XX/2019 due date as 30-days past due as payment was not received until XX/XX/2019 - despite the fact that simple math shows that this payment was not 30-days late by their own admission. In that same letter, the firm refused to correct the false reporting to the credit bureaus. The larger point is that the XX/XX/XXXX payment was not posted timely to my account because it took several calls to the company to have funds moved out of the suspense account and properly credited before we could ascertain the correct amount due. I initiated payment over the phone on XX/XX/XXXX once Ditech representatives verified the amount due. At that same time, I reset the process that was suppose to ensure ACH payments for future payments. This brings us to XX/XX/XXXX and XX/XX/2019. After receiving Ditech 's letter dated XX/XX/XXXX, I called the firm and sought to verify that the account was current and to set-up ACH payments. I initiated a telephone payment for the amount claimed due of {$190.00}. On XX/XX/2019 I was notified that the firm again reported my account as 30-days delinquent to national credit reporting bureaus. I again contacted the firm and initiated a payment in the amount of {$400.00}, which when combined with the XX/XX/XXXXpayment, I understood ensured that the XX/XX/XXXX, XX/XX/XXXX, and XX/XX/2019 payments were made. Now comes XX/XX/2019. On XX/XX/XXXX, I was notified by the national credit bureaus that the firm again reported me 30-days late. I called the firm on XX/XX/2019. I was told in that conversation that the payment of {$400.00} I made in XX/XX/XXXX was being held in a suspense account and had not been applied to my loan account. The Ditech representative was unable to explain to me the amount due, if any. The amounts discussed ranged from Im not sure, to over {$1000.00}. It is obvious that there is something fundamentally flawed inDitech 's business processes, and, more importantly, they have damaged my credit reputation by their inability to 1 ) maintain my ACH payments due to their business process changes, 2 ) properly record my payments when made, 3 ) and have systems that allow for consumers to have timely and accurate information about the status of their accounts.

Complaint: My name is XXXX XXXX XXXX and my address was XXXX XXXX XXXX, XXXX, NJ XXXX - XXXX County, NJ. My home is in foreclosure with Ditech Financial. I am attempting to proceed with a deed in lieu however, they advise me there is a judgement against me. IT IS NOT. The judgement is against XXXX and XXXX XXXX of XXXX, NY. It was filed in XXXX County, NJ by a gentleman named XXXX XXXX in the amount of {$11000.00}. How does this get corrected? The mortgage company will not listen and has been stonewalling me since XX/XX/2019 - advising me about this judgement last month. Please tell me how to fix this - I have no money as I am unable to find gainful employment in the state of NJ that will support an apartment and fear I will be homeless soon. Thank you.

Complaint: I have been working with Ditech to correct the reporting of my mortgage to the credit bureaus since the beginning of this year, thats right, the beginning of the year. Here we are on XX/XX/XXXX and I still have the same issues. In XX/XX/XXXX, Ditech admitted via letter that the information on my credit report with respect to their mortgage was inaccurate. The FCRA Date aka Date of First Delienquency should have been corrected to XX/XX/XXXX. I wanted for 5 1/2 months and then pulled my credit reports. To my surprise, nothing changed and the incorrect reporting remained. I then followed up with the better business bureau and CFPB about the issue again. I recieved two letters from Ditech apologizing for the error. They blamed an interbal system error and said the corrections would be made again. Last week, XX/XX/XXXX, I order my credit reports at my expense and low an behold nothing has changed with the reporting of the mortgage. Excuses after excuse, letter after letter admitting fault and incorrect reporting and they have yet to correct the issue with the credit bureaus. How is this even remotely possible. I have attached all three responses from Ditech on what the correct reporting should be. One response from Customer Service and two responses from their legal team. ALL SUPPORT MY CASE!!! And yet nobody can send the corrections to the credit bureaus???

I contacted XXXX XXXX, for they are the servicer. I suspect they have altered my billing history as well, because the document stating my billing history, sent to me had bogus information. I don't want to lose my home. I called the agency on Friday to see if my proof of payment was received. Not to my surprise, I was advised that the initial proof of payment did not suffice. As such, Now!, they requested for me to resend my bank statement showing the before and after the payment hit my account, requesting to see my balance after the payment was deducted from my account. I went to XXXX Friday, XXXX XXXX, retrieved the information and the bank faxed the documentation for me. When I arrive to work on Monday, XX/XX/XXXX, I will provide the same to you. The representative indicated that I needed to submit my bank statement indicating the balance of my account once the payment to Ditech was deducted from my account. This information was faxed on Friday, XX/XX/XXXX, from XXXXXXXX XXXX. In addition, I wanted to submit via email as well. Thanks much From : XXXX, XXXX Sent : Wednesday, XX/XX/XXXX XXXX XXXX To : XXXX ' <XXXX> Cc : XXXX Subject : XXXX XXXX c/o XXXX XXXX I received a call today from Mr. XXXX x XXXX from your company, indicating that XXXX payment was not being shown on my account as being paid. Attached please find the requested proof of payment. As discussed, the XXXX payment was returned ; the payment for XXXX was received XX/XX/XXXX, in the amount of {$1800.00}. The requested payment in the amount of {$730.00} was posted to the account of XX/XX/XXXX and was released from my bank account of XX/XX/XXXX ( debit card payment ). Up on the receipt of XXXX payment, my regular payments were to resume as of XX/XX/XXXX in the amount of {$1500.00}. Please see the attached for proof of payment. This is totally FRUSTRATING!!! I have been dealing with this company and the lack of knowledgeable employees since XXXX. Either being provided with inaccurate information, lack of conveying appropriate information and some staff members are not able to articulated information they are attempting to convey, why? Because they do not understand, Perhaps the understanding of the importance of handling accounts, that can effect one from becoming homeless should be made as a mandatory training and hiring individuals who are professionals. Its like playing Russian Roulette overtime I call Ditech, hoping that I will get an representative that can comprehended and speak clear English. I also called to verify that the information provided to me was correct ; in that the incorrect amounts were calculated. I was instructed today by XXXX x XXXX Representative of Ditech, to request in writing. Since it appears that Ditech is attempting to cover their error, not too sure if they will confess, in writing, that they made an error. I spoke with three representatives and all conveyed the same information : XXXX x XXXX ; XXXX x XXXX ( Loss Mitigation ) and XXXX x XXXX. In any event I resolved the issue on my own. It appears, once again Ditech has yet again made a mistake.The Ditech representative XXXX x XXXX conveyed that the initial repayment plan calculation that were prepared by Ditech was in error. As such, the amounts that I paid for three months, {$1700.00} were insufficient. Therefore by Ditech providing me with the wrong amounts to pay, in addition to the increase of my mortgage payments, that were not part of the calculations, has placed me yet Yet again, in additional arrears. For the next ( 6 ) months, the amount of {$1900.00} I must pay, in order to become current. As this is my third time, seeking assistance from your agency, as it pertains to Ditech and their lack of adequately handling my account, these practices from Ditech is beyond unprofessional. As such once again, my account, I have encountered another setback, due to their negligence ; Needles to say, Im beyond upset and disgusted. I would like to file a formal complaint. I received a call XX/XX/XXXX from Ditech, XXXX, ( stated she did not have an extension number ) The call was in reference to my XX/XX/XXXX mortgage payment and the late fees totally {$78.00}. I conveyed that I had the payment scheduled through my XXXX on-line billing for XX/XX/XXXX ; late fees scheduled for XX/XX/XXXX through the same entity method. At that time she advised that my mortgage payment increased totaling {$1700.00}. I indicated to her that there must be an error. She attempted to debate me on this subject and placed me on hold to investigate. XXXX, returned to the line and apologize for the error ; however, she explained to me that her records indicated my monthly payments are {$1400.00}, however, of 4.2 rate her records indicate 5.2. She advised me to speak to a representative in modification department. I was transferred to XXXX, I believe her name was. She advised that the error would be corrected to reflect the permanent modification amount. I placed a follow-up call to Ditech, when I arrived home from work and spoke with XXXX x XXXX. Her professionalism was commendable. She placed me a hold, read the entire notes on my account and realized that this issue began in XXXX-XXXX ; in addition, she was able to clearly articulate, explained and advised the issue and how this could be resolved. XXXX spoke with her supervisor, XXXX to review as the issue as well. They both saw the signed permanent modification and advised that me she or her supervisor would call me back once the proper department and team reviews, on XX/XX/XXXX. XXXX advised, that I should receive a call by Thursday, XX/XX/XXXX. XXXX, did provide some relief by stating that the executed permanent modification was scanned to my case file and clearly noted the mortgage amount of {$1400.00} I called XXXX XXXX once again to assist, me with the investigation and navigate on my behalf. Your agency has assisted me twice with issues I experienced with Ditech and always provided step by step updates and resolving the issue. I have samples of the many correspondence, ratifying back to XXXX to Ditech. I wanted to share with you. Complaint: Credit not being applied to load balance. Ditech keeps making excuses ; they verify they have the payment, but refuse to use it. I tried several times to have them apply this amount to the next monthly bill, ended up having to make late payments because they didn't apply as they had been asked to do. The issue may have started in XX/XX/XXXXbut was exacerbated in XX/XX/XXXX. Two payments were applied in XX/XX/XXXX. Both are acknowledged by Ditech when talking with them on the phone. This acknowledgment has done by several agents in the multiple phone calls with them to resolve the problem over the overpayment. In previous phone calls, it was understood that the over-payment would be applied to the next month 's mortgage bill. Instead, it was not, and late fees have been applied. I am providing the invoices so that the new interest charges for XX/XX/XXXXcan be seen. XX/XX/XXXXwas the month the overpayment should have been used. Ditech had the entire month to apply this over-payment, instead, they chose not to apply it for XX/XX/XXXX. Another couple of phone calls were made. We were told that an investigation needed to happen, and they wanted back statements to prove what they had already acknowledged as a payment in their system. Again they were asked to apply that over-payment to the bill immediately. They did not. They were asked to use it for the XX/XX/XXXXpayment, and they did not. After multiple phone calls in XX/XX/XXXXand XX/XX/XXXX, they still have not completed this supposed " investigation '' on their part. I called twice this week. Today I was on hold for a supervisor for 55 minutes before they hung up on me. I see multiple complaints about them delaying/making excuses about applying the credit toward the monthly payments. It appears this is the method they are using to rack up late fees. Things seem to have gotten worse since their chapter XXXX filing. I am looking for a solution to this overpayment, which they acknowledge but refuse to refund or apply to the monthly mortgage payment. Please let me know what info I can provide to help with this recovery of funds paid. Thanks for any assistance you can provide.

Complaint: On XX/XX/2019, Ditech sent me a notice that they had a computer problem and that my payment for XXXX was returned to XXXX XXXX XXXX and to please resubmit the payment. I did so immediately. However they lost the payment and kept saying I was behind and overdue with my monthly payments. I have receive several calls and letters stating such. I called Ditech and explained to them the situation and shared the fact that I have never been late on any payments and was up to date. At their request I had XXXX XXXX XXXX XXXX Ditech proof of payments and XXXX XXXX XXXX manager spoke to them in detail that it was their fault. Finally they got it and said I was correct and that it would be taken care of. It is now the end of XXXX and Ditech still has not corrected the problem and continues to send letters stating that I owe them payments. I have talked to eight different representatives of Ditech and all they do is keep putting off the problem. They are now stating that XXXX XXXX XXXX will be servicing my mortgage beginning XX/XX/XXXX. I have proof of payments and XXXX XXXX XXXX has talked to Ditech several times but nothing is being accomplished or resolved.
