Complaint: I was granted a loan modifiation. The stipulations was that if I missed no more than 3 payments in 5 years, then I will have {$5000.00} of the loan balance forgiven. I have never missed or was late on a payment! In the fall of XXXX, my loan servicing was transferred to Greentree, now known as XXXX. In XXXX XXXX, I noticed an error in my escrow account. I ask them to fix it. This let to a living nightmare!. They redid my escrow 3 times in 4 months with mounting errors and problems. ( Enclosed ). In XXXX, XXXX, I paid what I thought was the correct amount. This company cashed my check, but did not notify me of any errors. On XXXX, XXXX, I paid the same amount. This company, without my permission, took part if this payment and applied it to the XXXX payment. I did NOT get any com. From them Then, I sent them 3 checks, one to cover the remainder of XXXX and one to cover XXXX and another to cover escrow. Then, This company this 3 things. 1. Reported to the credit bureau that I was 3 months behind, 2. Denied my loan reduction. And 3, denied my request to pay my own taxes. I want this company to 1. Fix my credit report to report the truth. My report does not even show a reason for the 2nd month. They were being vindictive. And 2. grant my loan reduction. Oh, by the way, they are transferring my account, but they made this error and they should fix it.

There are over 100 payments were {$0.00} was applied to the principal. There are over 150 payments were the principal+interest+escrow+other are less than the payment. Complaint: I made a {$1000.00} payment to Ditech Financial LLC on XXXX XXXX XXXX that has not been credited to my account ( XXXX ). I have sent a copy of my bank statement showing the payment. Ditech told me this was not good enough proof and they could not find the payment.They instructed me to go to my bank and get a check or tracing/tracking number which I faxed to them on XX/XX/XXXX. I am still not getting results from all the information I've given them. I am also being charged late fees. they have recently transferred my account to XXXX XXXX ( XXXX ). I feel as though Ditech is giving me the run around and making me jump through hoops to avoid doing anything about my " lost '' payment especially since they transferred my account. Please help me correct this matter.

Complaint: This is not my first complaint. My former complaint was XXXX This is an escalation, due to the mishandling of my monies received by my insurance for a fire claim resulting from the Campfire wildfire in XXXX, CA.
Here are the facts : I opened a claim with Ditech mortgage, to submit a check I received from XXXX XXXX insurance for reimbursement for fire remediation repairs to our home that survived the Campfire wildfire. What did not survive was a seperate structure equaling 1200 sq ', and based on our policy, we were paid for a total loss of that structure, {$100000.00}.
The check was cosigned to Ditech mortgage. I was promised before sending the check, that the check would easily be signed back to us, so I sent it to them. That was the first lie.
Next I am sent on this crazy goose chase of submitting proof of service, with Lien Waivers, and receipts and W9s. Which I get was neccesary for the repairs but nothing to do with the total loss. It was clear on my policy and the claim letter from the insurance that we were paid for total loss and no repair or rebuild was necessary.
I spend months calling, asking for clarification for why my total loss for seperate structure was not returned. They finally informed me after I submitted a claim through this agency, that they required that the check used to rebuild the lossed structure or used to pay down the principal, based on XXXX XXXX rules ( since XXXX XXXX was the ultimate lender ).
After fighting this with XXXX XXXX, because we felt it was unfair given that we paid for the build of the sep structure with cash and no financing, they persisted, and we gave in. We agreed to have the claim money used to pay down the principal of {$120000.00} on XX/XX/XXXX.
I have been calling every week sometimes 2-3 times a week since XX/XX/XXXX to track the processing of that claim money, since they also have been mismanaging the monies owed to us for the reimbursement for the fire remediation of the surviving structure. I will not provide highlights of that mismanagement, because these events combined are either a demonstration of how dysfunction this organization is, or whether this is just a elaborate scheme to hold onto the claim money instead of refunding the money to use.
XXXX included in the check that was cosigned to them, the estimated fees for cleaning of the home, and replacement of the insulation.
It was only after I filed a complaint with this agency that they finally informed me that all the paperwork I submitted resulted in them sending me checks. But, they conveniently sent the checks to the wrong address. The wrong address I believe was a rouse, since I had them repeat the new address to me, when I gave it to them. We were staying at a temporary address since we were displaced from the wild fire, and the post office was causing great delays in forwarding mail to our new address. Therefore I informed Ditech of our new address, which was XXXX XXXX XXXX XXXX. They sent it to XXXX XXXX XXXX XXXX. Which is a vacant residence, and ultimate the post office returned the envelope to sender. It's now XX/XX/XXXX and I have yet to receive that money either. Those checks total {$22000.00}.
Week after week, I am promised that they are being processed or in the mail, just to find out there are more excuses for why they are still not sent. My last communication with Ditech on Friday XX/XX/XXXX, they informed me that they could not locate the checks. On more than one occaision they change the story, and tell me they need to cancel the original checks and rerequest them, when I inform them that had been done more than 2 weeks ago.
Again, I don't know if this organization is that inept and dysfunctional or whether they are lying as a major game to keep this money in their possession.
The final and agreegious complaint is something I found out, but not by Ditech. In all the conversations I have had with them, never did they bother to inform me that they have sold my mortage to another company. SOLD my loan! How in the world were they planning to pay down my principal when the principal balance was sold to another company.
The nightmare that I see, and why I am filing this complaint, is that the {$100000.00}, which was ordered to be paid towards the principal on XX/XX/XXXX is lost in their organization. When I spoke to them about where it was specifically, they said vaguely that the money was ordered to a vendor to be sent to Ditech and they don't know where it is right now, because the mailing address on file does not match the physical address on file, so the vendor supposedly did nothing. By the way, I did not know at the time of that discussion, that my loan is scheduled to be in possession of another finance company by XXXX, XXXX, and last they told me it would take another 7 - 10 business days to be processed, so how are they going to pay off the principal when they no longer have the note. What is to happen to that {$100000.00} I spoke to a Ditech claims superviser on Friday, he gave me his personal extension and promised to get back to me. He did not call back, he did not inform me that my loan was sold to another company, he had no idea where any of the checks in question were. It was a holiday weekend.
What is to happen to that money if they already sold my loan?
Why did they not inform me about the sale of the loan?
Why would they sell the loan in the middle of a claim processing?
What don't they know where any of the money is?
Why do they keep losing the money?
Did they intentionally mismail the check as a ploy?
Is it possible they are doing something illegal and they are hiding it with they elaborate schemes of hide the money and mistakes in processing?
I feel powerless to get straight answers, every week it's a new excuse. At one point I was promised that 3 managers were going to take ownership and get to bottom of things, and then suddenly one took a few personal days and then that was the end of that due dilligence.
Please help me. I have no intention to live in that home again. I have the house for sale. How could I possibly sell the home when the claim is left open and the mortgage is sold and the new company has no idea about the claim or worst is expecting me to wait while they become acquainted with the claim.
This has been a nightmare. I thought escaping a town on fire was my worst nightmare, but it pales to the pain these people have put me through. They've been playing this game of cat and mouse since XX/XX/XXXX. It's been 5 months of XXXX. You'd think they'd be compassionate since I am a wildfire survivor, but instead they have just compounded the injury.

Complaint: Due to divorce, I fell behind on my mortgage payments. I was given a reinstatement quote and deadline. I paid the quote before the deadline and informed the trustee attorney via email and telephone with evidence of confirmed payment on time. I was ignored. I then kept paying the mortgage monthly but they kept sending back the payments and kept giving new reinstatement quotes with {$5000.00} to {$8000.00} dollar fees every month. I continue to pay the mortgage and communicate with Ditech and they only send me more fees. Although they acknowledge the $ 18,000+ in my account unapplied to the mortgage, the foreclosure date comes closer and my XXXX children and I need a home. Complaint: It all started when Ditech changed my account number, previous to this change, I use to pay my mortgage and insurance together, to that same company. I use to pay XXXX XXXX every month but with the account change, it made paying my mortgage and insurance difficult. XX/XX/2019, was when my account number has changed for both my mortgage and insurance. I made payment via XXXX XXXX of {$340.00} on XX/XX/2019. On XX/XX/2019, I made two separate payments of {$280.00} for my mortgage and {$75.00} for my insurance via Money orders. with my XXXX payment Ditech combined these payments to my insurance and not my mortgage. On both of these payments I included separate account numbers for my mortgage and insurance. I don't understand how Ditech could have combined both payments, if they both included different account numbers. On XX/XX/2019, I got a notice that I was suppose to include {$15.00} to my payments for accidental death insurance, which I included in XXXX and for XXXX. I also made a XXXX XXXX payment to Ditech for XXXX for my mortgage and XXXX for my insurance on XX/XX/2019. On XX/XX/2019, I made a payment of XXXX for my combined mortgage and accidental death insurance. On XX/XX/2019, I received a notice from Ditech that I am delinquent on my mortgage for the months of XXXX, XXXX, XXXX and XXXX for the amount of {$1100.00}. I have proof of all my payments and have been losing sleep and being worried since I discovered that Ditech stated that they didn't receive my payments. I have done XXXX inquiries of who and where the Money orders have been sent and it was Ditech that received them. I have lost additional fund doing Money order inquires. I called Ditech been put on hold multiple times or no answers. I am trying to find out where XXXX insurance payment went, because they stated they did not receive it. In addition to all this fiasco, Ditech informed me that starting in XXXX, my insurance is to be paid to another company, world financial. But, according to XXXX payments, they included my mortgage payment in the insurance account.

Complaint: At the end of XX/XX/XXXX I refinanced my mortgage with Ditech. They received the wire to payoff my mortgage ( which was sent by the title company based on their payoff instructions ) on XX/XX/2019. I have the wire operations confirmation. The routing and account number the title company used was correct ( we verified that with Ditech. ) I received a late payment notice on XX/XX/XXXX stating that my mortgage payment was late, I was assessed a late fee, and it still showed the full balance of my loan. The {$250000.00} that was wired to Ditech was never credited to my account. After several HOURS on the phone with customer service I spoke to XXXX who claimed to be a supervisor. He said he has no idea what happened to the wire, but that it was not applied to my account. He said he could not verify that they received it. I asked to speak with his supervisor and he said she was on vacation and there were no other supervisors I could speak to. He said they would try to call me back in 3-5 business days.
I now have TWO MORTGAGES on the same house, and Ditech can not tell me what happened to my wire ( that I have confirmation that they received. )

Complaint: Ditech is the servicer of my loan. I have been trying to obtain information on when PMI will drop off my loan. I sent an email on XX/XX/19. I never received a response. I called the company on XX/XX/XXXX after not receiving a response. I spoke to a representative who essentially told me that I didnt get a response to my inquiry because my loan was transferring. They are still my loan servicer at this point. They should still be answering my questions. I asked the representative my question about my PMI. She then proceeded to tell me that I am at 103 % of my loan. I asked for calculations on how she was coming to that figure and she couldnt tell me. The loan was taken out for approximately $ XXXX and I have a balance of approximately $ XXXX. I am not understanding how she came up with her percentage. She couldnt transfer me to a supervisor or manager. She then told me she would let me go and I would get an email from their company with a response that day. It is now Friday, XX/XX/XXXX and I still have not heard a word from this company. I think they are trying to rip me off and charge PMI longer than they need to.

Complaint: To whom it may concern, I have sent Ditech Financial LLC ( " Ditech '' ) five different letters on XXXX ( XXXX, XXXX, XXXX, XXXX, XXXX, XXXX ) to the designated following address ( given by Ditech ) where mortgage loan customers are requested to send any Qualified Written Request, Notice of Error or Request for Information : XXXX. XXXX XXXX, XXXX XXXX, XXXX XXXX per resolution letter submitted to me.
Ditech finally sent a letter on XX/XX/XXXX to work out an option for a reinstatement and repayment plan along with a contact representatives name and number. I attempted several times to reach the person, left messages including e-mails to Ditech and have not received a response.
I have not heard back and as of today, XX/XX/XXXX, and, the only correspondence I have from Ditech in regards to the request is dated XX/XX/XXXX in a letter stating that they would get back to my request as their research has not concluded.
Again, I am trying to obtain a repayment plan for a nine ( 9 ) month period with an additional borrower to the account and with the understanding of moving forward with past-due amounts being spread over a set time frame onto the existing mortgage payments as inclusive of the monthly mortgage payment increase with future mortgage payments. The total due as of today is {$17000.00}.
Moreover, I am trying to obtain information from Ditech so that this matter may be expeditiously resolved. I have made Ditech aware and reiterated information that they already have where they can send information inclusive of XXXX XXXX , phone numbers ( secondary contact person, etc. ) along with e-mail. Complaint: I have already lost my home to foreclosure. I had XXXX XXXX XXXX and not only were they very hard to work with, I could never get a correct answer as to why my Mortgage that was at a fixed rate would go up. WHen I did get behind in PAyment back in XXXX. Shortyl after, my mortgage was sold and now I was paying XXXX XXXX XXXX at a much higher Mortgage amount than I was paying before. I was a first time home buyer and started with a first time home buyers program with the State of New Hampshire. We refinanced with Green tree and put on a new roof had the house panted and a few other things we needed. I was with Greentree from XXXX it was sold and then sold again when XXXX XXXX XXXX took over. They were no better. I ended up losing my house. My husband became chronically ill and end up XXXX this past XX/XX/XXXX at the age of XXXX. In the year XXXX I received a letter on a class action suit for green tree that I was part of and I have misplaced that letter. I even forgot about it when my husband of 28 years and together for XXXX at the time had XXXX XXXX and was in and out of the hospital in a XXXX for 14 days and thirty days in the hospital before his death.
I believe the class action suit was for when my mortgage payment went up without notice and may have been because I was being charged flood insurance.I tried to find that letter but I believe moving twice in a short span may have contributed to getting lost.. I do not how to go about getting the information on filing with that class action suit. I am not sure if everything is on a time limit and if I am too late. It just seems like I am made to lose. Even social security never approved my husband until he died and with that, after 12 years of trying, he got 7 months of social security after working 22 years for the same comapny.No severance pay no retirement no social security- one of the reasons we became late on our mortgage. If you could please help me in locating the class action suit and see if I am still able to file I would surely appreciate that. I am tired of struggling financially because no one wants to help. If I was due money from that suit I really can use it now. I did the best for a family of five on my income for the past 10 years. No other income from my husband. We were foreclosed on, lost our vehicles and I had to swallow my pride and go to local food banks. I could not get any state help because it goes by the years before taxes. Even if we were no longer making that money. My husband died XXXX. I am sure the stress of losing everything did not help.
This class action suit if I and my dead husband are owed I could use the money to bury him.
