Complaint: ditech sent me a Notice of Serving Transfer letter dated XX/XX/XXXX19. I received this letter on XX/XX/XXXX19 which is less than 15 days from the transfer effective date ( XX/XX/XXXX2019 ). I've received mortgage Serving Transfer notices from other banks usually 60 days before.transfer effective date. Ditech 's delay in sending out this notice gives me very little time to react to the impending transfer to XXXX XXXX XXXX XXXX, VA. For example, I may elect to payoff my mortage or refinance to avoid doing business with the new mortgage servicer. In this case, XXXX XXXX appears to have poor customer rating which concerns me. Complaint: Good afternoon, I want to start by saying that I'm not those who complain, but DITECH has no respect for the consumer. When you call the XXXX you can easily be an hour waiting for someone to answer. I'm escalating this situation to you after unsuccessfully trying, for more than two months, to get an answer from this company. I received a letter from DITECH dated XX/XX/2018 informing that a new APR was calculated for my mortgage changing XX/XX/XXXX. Based on their explanation the new interest is the addition of the margin 2.2500 % and the LIBOR published that day at the XXXX. According to DITECH, the LIBOR XX/XX/18 was 3.10388 %. However, looking at the site it shows 2.18175 % for the day ( almost a point difference ), 2.36813 % for a week and 3.05275 % for 1 year. Not even close to the 3.10388 % they indicated. See the official LIBOR at XXXX XXXX XXXX link. XXXX XXXX XXXX XXXX As a result, the APR should NOT be 5.37500 % ( 2.22500+3.10388 and 0.125 rounded up ) as communicated. Instead, it should be 4.43175 % and 4.37500 % after rounded. It is a full point difference. For more than two months I have been battling with it. I have sent 5 emails, called more than 8 times ( waiting almost an hour every time I call ), but neither the customer service rep, not the supervisor provides a solution. They understand the Math after checking the XXXX site but the response has always been, " It is under review and someone will get back to you ''. I proposed to keep my previous payment until I get a final answer but the supervisor XXXX XXXX batch # XXXX, said the payment won't be accepted therefore my credit will be reported and damaged as a result. I didn't have any other option than paying the new APR. I honestly can not understand why DITECH is taking so long. Im also concerned about how a Financial institution can charge whatever they want without supervision and wondering how many others are in the same situation without even noticing. Complaint: This problem actually started in XX/XX/XXXX when I received notice of escrow shortage in the amount of {$3700.00} when they raised my payment amount from {$540.00} to {$700.00}. Then XX/XX/XXXX they sent another escrow shortage notice in the amount of {$2500.00} and raised my payment slightly from {$700.00} to {$700.00}. Then XX/XX/XXXX I received another escrow shortage notice of {$1500.00} and raised my payment from {$700.00} to {$710.00}. Then XX/XX/XXXX I received another escrow shortage notice {$2600.00} and they are raising from {$710.00} to {$880.00}. The notice states exactly this : " Our review shows your escrow account has a shortage of {$2600.00}. Once we pay your upcoming insurance and/or tax payments, your escrow will fall below the required minimum balance. See Section 4 for details. Your monthly mortgage payment is also changing XX/XX/XXXX. Your new payment amount depends on which option below you chose : " Choices are pay the escrow shortage balance {$2600.00} in full by XX/XX/XXXX or monthly payments raises to {$880.00}. I have called repeatedly since XX/XX/XXXX to try to resolve this issue. And in just this last 2 weeks have left several messages online and on voicemails to have someone contact about this very serious issue. I have asked to cancel the escrow account since I have now been paying directly to the insurance agent the homeowners insurance since XX/XX/XXXX. They still have not contacted me, they still have not closed the escrow account. I sent a certified letter in the mail directly to their office on XX/XX/XXXX requesting them to close my escrow account and provided proof of Homeowners insurance that is paid through XX/XX/XXXX that I paid from my pocket ... not the escrow account. No one at this company returns calls, no one answers when transferred to their customer care line. It says there is a 20 minute wait but it actually hours ... then still no one ever answers. I've sent online messages to have someone contact me from the escrow department many many times and more recently within these last 2 weeks yet no one has ever contacted me. This payment is double what is should be. And they are stating that this escrow shortage is to cover what is going to be paid ... .when really nothing will be paid from the escrow account since I am paying the insurance agency directly. Please help me.

Complaint: Ditech has constantly mismanaged my escrow fund account. I received an Escrow Account Disclosure Statement, dated XX/XX/XXXX. I had an escrow surplus of {$6400.00} as I had more funds than needed to cover my minimum escrow balance. This statement said that I would receive a separate check for this surplus amount, as long as my account was current and if my account was past due, the surplus funds remain in my escrow account. My account was current and I did not receive a refund check and although I did not receive a check the surplus funds did not remain in my account. The first attachment is this statement. The second attachment is my escrow history where even though I had an escrow surplus, ditech was constantly doing an escrow advance and then an escrow advance repay to make it seem that my escrow account was in arrears. The third attachment is my payment history that shows that my escrow payments were incorrectly or not at all applied. The fourth attachment is an Escrow Account Disclosure Statement, dated XX/XX/XXXX showing that I have an escrow surplus of {$7900.00}. The negligence and misappropriation of funds by ditech needs to be addressed immediately along with an explanation of where my {$6400.00} surplus from last year, {$7900.00} surplus from this year, along with all of the escrow advances and repays is, including why there were escrow advances and repays when there has been an abundant surplus all along. And before ditech says that they are not servicing my loan as of XX/XX/XXXX, I am very well aware of that. This is not a complaint about the future. This is a complaint about ditech while they were servicing my loan and the mistakes that were made by their company and documented during that time.

Complaint: I have been paying a mortgage service provider ( Ditech Finical LLC ) FOR 14+ yrs.. I have been trying to contact them for 10 days without being able to do so to pay off my mortgage of approx. {$160000.00}. I finally had someone come on the phone yesterda after waiting on hold for more then an hour. She told me they were having computer problems & that was the reason for the long hold time. She then tried to guide me into their that account website which I had been trying to do for 10 days, to no avail. She then gave me information to give to my Financial institution to do a wire transfer through their bank " XXXX ''. After being cautioned by my financial institution the there are international " wire fraud scams '' going on, I decided to contact XXXX to confirm that the information given to me by Ditech was correct. After being able to outsmart the robot I was able to reach a human who informed me that the routing # was correct but the account # was not. At this point I asked for a supervisor who told me she could not confirm or deny that the account # existed. I asked for a manager when she then informed me that I was talking to the wrong dept. And it could take many days for my called to be returned.

Complaint: This is a continuation of complaint # XXXX. It involves at least 2 companies, XXXX and DiTech. XXXX has been very informative with regards to figuring out what exactly happened with this loan. XXXX had this loan from XX/XX/XXXX until XX/XX/XXXX. Due to the lack of information provided to me, is when the loan went into default. However, DiTech did not buy this loan until XX/XX/XXXX. Account # XXXX. Why was there a 4 year lapse in collection of this loan. Until this day, I have no idea why there is no recorded information with regards to who bought this loan, who owns this loan and of the foreclosure status on this loan. Is there a second mortgage on this loan and is there a lein on this property.

Complaint: I live in a condo. I have own this condo for at least 15 years. The condo was in my corporation 's name which is XXXX. XXXX XXXX. I refinanced 4 years ago but had to take the condo out of the corporation 's name and put in my name. At the time that I refinanced I was not aware nor did Ditech tell me that I had to have insurance to cover the inside of my condo. XX/XX/2017 the entire building caught a fire and the fire marshall made all 24 famlies move out. I wrote Ditech and sent all necessary information concerning the fire in order to get a delay of payments. They denied that request. Since the fire I have been paying my mortgage even though I am paying rent for another location. In XX/XX/XXXX Dtech wrote me and ask for proof of insurance. I told them that My Condo Association have insurance and have agreed to replace the building including the insides. Apparently that answer was not sufficient. I tried getting insurance for the inside of the condo but the insurance company told me that I would have to wait until the building is rebuilt. Meanwhile Ditech added inside insurance for my unit. My question to you is how can they add insurance to a burn down building and I am not allowed to nor can i stay there? Isnt that illegal. The building is still vacant and boarded up per the city.

Complaint: Ditech Financial sold my loan to a new mortgage servicing company without providing me with any notice. I received notice of the change on XX/XX/XXXX. The change occurred on XX/XX/XXXX. I called the new mortgage company and they have no record of my account. I tried to call Ditech and waited on hold for 15-20 minutes and no one ever did come to the phone. Ditech is also holding over XXXX of my money and the insurance companies money and has not released it so I can pay the contractor as my home is repaired from the house fire that occurred in XX/XX/XXXX. Ditech is a terrible company and basically does whatever they please. I am in the process of paying off my home loan. I have to wait until the due date every month to make the loan payment or they will put the money directly towards principal even if I make multiple payments for the exact payment amount. Last month I paid over XXXX on the loan. I currently owe XXXX on my loan and Ditech acts like they have some major interest in my house. They don't. My home is worth XXXX and their share is XXXX. Ditech is a bunch of crooks and should be put out of business. They are currently filing for bankruptcy so it looks like they are headed that way.

Complaint: For the Past 3 months XX/XX/2019, XX/XX/2019 and XX/XX/2019. My mortgage company " Ditech '' has failed to provide my with a PROMPT statement for my account. My bills are due the XX/XX/XXXX of the month and Ditech is not even generating a statement until after the XX/XX/XXXX of each month. This seems to be a violation of the Consumer Protection Act and the Periodic Statement Rule. I've reached out to Ditech about this matter each month and they still continue to delay my statements.

Complaint: I have an issue with my current mortgage company, Ditech. We were one of the folks impacted by the XX/XX/XXXX Flood here in XXXX XXXX. We did and still have Insurance with XXXX through XXXX XXXX. We processed the Checks from XXXX and the money is being held by Ditech. They have been very slow in releasing the disbursements to me in which to restore my house. I found out Monday ( XXXX ) that Ditech maybe selling my mortgage to another Company, XXXX. My fears are confirmed, I have received Notice from Ditech on XX/XX/XXXX. It would appear there are many lawsuits against this company for the same issues I'm currently having with Ditech. I do not Trust Ditech!!!! I really feel like I've been taken advantage of by these loan company practices, and at XXXX years of age I feel like I should not have any issues with getting my money to restore my house! I've been an employee of XXXX for over 40 yrs. What I would like is some direction on how to proceed with getting my Insurance Claim Money so I may finish restoring my house. I am also fearful that my Insurance Money that is being Held by Ditech will get LOST in the Transfer to XXXX, or worse, that Ditect Maybe trying to Keep My Insurance Money. I have Tried Contacting Ditect Many times since the XX/XX/XXXX Flood. They will not Email me any information, all I have received from them are Form letters asking for the same thing over and over again, For Example : A Form to verify my address! Makes no sense to me since I have given them that form already! The Forms they send to me are at my Address, which they are asking me to provide to them! I would be happy to send any pictures of my house during the renovation or if anyone from any office or agency would like to come and inspect and take pictures, that would be welcomed. Complaint: My previous loan servicing company Ditech had my loan ( XXXX ) and they were receiving the payments automatically by XXXX XXXX ( biweekly mortgage program ). Ditech sold the loan to XXXX in XX/XX/2018. Ditech then forwarded the XXXX payment to XXXX But on XXXX they kept thenpayment and did not forward the payment. XXXX has confirmed that they received XXXX payment but NOT XXXX. Ditech refuses to assist my husband and I. Due to this issue we were not able to refinance our FHA loan to a VA loan like we were hoping to do so since my husband is a XXXX veteran who is not getting any better per Veterans affairs. So to help our family I started the process to refinance and all this has come to light. Both companies are pointing fingers at each other now {$1900.00} has gone missing because they took the money from our account. Ditech claims they received it but forwarded it to XXXX XXXX and XXXX has confirmed they never received it. Ditech will not provide any proof that they sent it and hung up on my husband and I today.

Complaint: Very poor communication and readiness of Ditech Financial LLC in communication with customers in the changes in account structures, new account numbers and customer service. First, in XX/XX/XXXX received the lump sum payment as was practice for both mortgage and insurance and applied the entire amount to principle as opposed to mortgage and insurance payments. This was resolved after finally getting customer service on the phone with extended wait time. XX/XX/XXXX, received notice of new account number for insurance payment and that we would also receive a new account number for mortgage all still with Ditech and to be made separately to different addresses with new account numbers for future payments and notice of Chapter XXXX for Ditech. XX/XX/XXXX, new account numbers not yet provided and informed to still send lump payment and told by customer service they would still separate and the online account services would be unavailable for a few days while upgrades were made. Ditech received the lump sum payment as of XX/XX/XXXX ( due XX/XX/XXXX ) and did not post the mortgage payment as paid until XX/XX/XXXX and still showing on line the insurance payment due which is not correct as all was sent. Email customer service and never get a response other than a letter without resolution.

Complaint: RE : LETTER OF CANCELLATION OF DEBT To : Consumer Financial Protection Bureau My name is XXXX XXXX, Im filing this complaint against Ditech Financial LLC located at XXXX XXXX XXXX XXXX XXXX. XXXX, XXXX AZ, XXXX. My complaint is regarding not receiving a debt cancellation letter from the company because they foreclosed on my home and mailed me a 1098-A. In XX/XX/XXXX I requested a modification from XXXX XXXX XXXX ( See Attachment A ) these are the individuals I purchased my home from in XX/XX/XXXX. At the time of the request XXXX XXXX loans were serviced by Green Tree Services. I went through the XXXX Program ( XXXX XXXX XXXX XXXX XXXX ) in XX/XX/XXXX to get refinanced for a lower interest rate on my home. After submitting paperwork through XXXX and to Green Tree, Green Tree responded by saying We service your account on behalf of an investor XXXX XXXX XXXX or group of investors XXXX XXXX that has not given us contractual authority to modify you account under the HAMP ( See Attachment B ). I re-applied in XX/XX/XXXX for the HAMP program through a new servicer for XXXX XXXX which is Ditech Financial LLC, after completing the request to refinance through the HAMP program they responded by saying We service your loan on behalf of an investor group of investors that has not given us the contractual authority o modify your loan under the HAMP ( See Attachment C ). After being refused for refinancing for being in my home over 16 years, the home was foreclosed in XX/XX/XXXX ( See Attachment D ). In XX/XX/XXXX I received a collections letter from Ditech indicating that I stilled owed {$41000.00} on the foreclosed property ( See Attachment E ). I reached out to them via certified mail requesting information regarding the foreclosure ( Attachment F ). The responded by indicating they were looking into the matter ( Attachment H ). In XX/XX/XXXX I received a Form 1099-A for XX/XX/XXXX( Attachment G ). The 1099-A form indicates that its for Acquisition or Abandonment of Secured Property which is completely wrong. As I have indicated with proof I have tried to refinance through government programs to save my home. However, they were never accommodating to any request. The XXXX program indicated to me that since they wouldnt comply with government regulations that I couldnt use them for modifications or refinancing of my home. Im requesting a letter of cancellation of debt from Ditech since the company has submitted a 1098-A that has to be filed with my XX/XX/XXXX taxes. They refused to help me on several occasions, therefore anything outstanding per Ditetch, this debt should be cancelled ( Attachment E ).
