Complaint: I received letters from XXXX XXXX XXXX XXXX ( Indiana ) in XXXX and XXXX stating that I owe a debt in the amount of {$3900.00}. I disputed the debt in XXXX and XXXX. XXXX XXXX, XXXX XXXX XXXX XXXX filed suit in Indiana XXXX Court. XXXX XXXX, there was a hearing I denied the debt. I asked for XXXX and found out that XXXX and XXXX ( Not Located in Indiana ) are actually suing me. AT NO TIME did XXXX XXXX XXXX XXXX make it known that they are representing XXXX. XXXX of the documents from XXXX XXXX XXXX XXXX, states the client is XXXX XXXX XXXX and the Original Creditor is Discover Bank. Another document from XXXX XXXX of Discover Bank dated XXXX XXXX, XXXX states " findings were forward to Attorney XXXX XXXX XXXX. Never once has any of Discover Bank 's documents listed XXXX XXXX XXXX XXXX as the attorney. I requested " terms and agreement, '' contract between XXXX XXXX XXXX XXXX and Discover Bank, contract between XXXX XXXX XXXX XXXX and XXXX XXXX XXXX and between Discover Bank and XXXX XXXX XXXX. I have not received any documents giving XXXX XXXX XXXX XXXX or XXXX XXXX XXXX the legal right to sue me. There is no contract, terms and agreement, no credit card statements for XXXX, XXXX and XXXX they ca n't provide me with any proof of transactions XXXX, XXXX, and XXXX. XXXX XXXX XXXX XXXX FAILED to name all necessary party and misrepresentation. I do not know who the real lawyer is and feel it is illegal practice.

Complaint: Discover Card XXXX. XXXX XXXX XXXX XXXX, OH XXXX XXXX : Discover Card Account # Ending in XXXX To whom it may concern : This letter serves to clarify matters regarding the Discover Card account ending in XXXX listed on my credit report. Please note that the Discover Card account of which I am now a joint account holder is reported inaccurately. I applied for a Discover card in XX/XX/XXXX and was denied. Later, my former spouse applied and was approved. The account was initially opened by my spouse in XX/XX/XXXX after which I was added as an authorized user. We specifically requested that I be added as an authorized user so that I can be issued a card. We were under the impression that there was no way for me to be on the account as a joint account holder due to the fact that my application was denied. After requesting documents to add me to the account, we spoke with a representative from Discover that explained that although the account may appear on my credit report, I would be added only as an authorized user. The account appeared on my Experian credit report on XX/XX/XXXX with me listed as an authorized user and on the same report ; the same account is listed again as a 'joint with XXXX ' account. Later, the account status changed several times. The account had been paid on time through monthly drafts from my checking account until XX/XX/XXXX. XX/XX/XXXX, I was unable to process a payment and made contact with Discover to attempt to pay on the account. A Discover representative explained that the account was involved in a bankruptcy and that I could not be provided any details regarding the account. It was then that I learned that my ex-spouse had filed for bankruptcy which included the Discover account reported as a joint account at that time. Because of the nature of the bankruptcy filing, I was not permitted to receive any information on the account ; however, the account still appeared on my credit report as an account in good standing with no payment history. Although I had called several times XX/XX/XXXX to inquire about the account, I was not able to receive information or updates regarding the account. XX/XX/XXXX the account appeared as a delinquent account and was reported as being closed in XX/XX/XXXX. I have disputed the information reported on the account with little success. I am requesting that Discover Card investigate the account thoroughly and furnish me with documents that prove that I have authorized Discover Card to add me as a joint account holder instead of an authorized user. I have spoken to a representative who informed me that there is no record in the system of this documentation. If through your investigation, you find that this is the case, I am requesting that you remove me as a responsible party from the account immediately. Complaint: My understanding of the current laws with regards to applying payments to credit cards is as follows - Any payment amount left over after the minimum payment is applied must go toward the highest interest rate.The minimum payment itself typically goes to the balance with the lowest interest rate. Any excess of the minimum payment is applied to the highest interest rate. There is XXXX exception to the CARD Act 's excess payment rule : If you buy something under a delayed interest plan -- such as " no interest if paid in full in six months '' offer -- then you can choose to apply your excess payment to that balance instead of the balance with the highest interest rate, so you can take advantage of the deferred interest. Otherwise, the credit card company is required to apply the XXXX payments before the delayed interest period ends to the delayed interest balance, in their entirety. If this is correct, I have recently had an issue with Discover Card. As I have a deferred interest offer that is expiring on XX/XX/XXXX. I also had a balance at a rate of 4.99 %, which did not expire until XX/XX/XXXX. I paid in full the amount of 0.00 % interest offer in XXXX and asked that it be applied to the 0.00 % that was getting ready to expire. However, they applied the payment to the 4.99 % interest balance expiring in XXXX XXXX not the balance expiring in XXXX XXXX. I have both spoken to them and have written them and this is their response. " With your payments, we generally apply any amount that exceeds the minimum payment due toward balances subject to higher Annual Percentage Rates ( APR 's ) before balances having lower rates as of the date we credit your payment. Payments are applied at our discretion, including in a manner most favorable or convenient for us. In all cases, we will apply payments and credits as required by applicable law. We regret to inform you we are not able to move the payment to the 0 % APR. " Based on my understanding, this is against the law. If you could help me clarify, that would be great!

Complaint: Discover card lowered my credit line on or about XX/XX/XXXX without any notification, causing me to incur fees for rejection of automatic scheduled payment. On or about XX/XX/XXXX Discover had sent me an e-mail asking me for income information, which I supplied. Complaint: When I was late with payment to Discover, a representative called and got me to schedule a payment on my next regular payment date. Still underemployed, I ca n't afford to make the payment this month. The Discover web site says " Payments made online or by phone must be edited or canceled by XXXX XXXX on the payment posting date for changes to take effect. ". Since I arranged this payment by phone, I assumed I would be able to cancel the scheduled payment on the payment posting date, but the representative claimed she could not cancel it. Now I 'll have to pay my bank {$35.00} to stop payment. The information from my bank details this payment as " Phone Pay '' The following is transcript of chat with representative : XXXX : at XXXXXXXXWe submit the payments electronically to your bank on the date the payment is scheduled for. Once submitted, your bank takes over the payment and depending on how they process the payment will determine when the payment will hit the account. '' I find it hard to believe this payment ca n't be edited or cancelled also, since today is the payment posting date. Complaint: Discover is reporting to my XXXX report that it was settled for less than agreed. Discover was very aggressive in collecting on this account. I told them I would pay it off for the agreed amount if they agreed not to report it to my bureau. They agreed and we proceeded. I 've recently learned that it was only charged off by around XXXX dollars. I offered to pay that off in full and they said they 'd take the money but not remove it. I feel this was a deceptive practice and they 're not willing to make it right. They 're also unwilling to work with me on paying off the former charge off. I honestly do n't understand why they would n't want my money at this point. I 'm attempting to repair past wrongs and they were very rude about it when I called.

Complaint: Discover Financial services is excessively running credit inquiries from XXXX. They are inquiring at least once every two weeks, in once case twice in ONE day, in a couple of cases, one week apart, and apparantly have done so for at least several years. They are no longer a creditor to me, has not been since XX/XX/XXXX, and I will never be a cardholder of theirs again. In addition, according to the credit report, they plan on continuing to be on my record until XX/XX/XXXX. I have since had another creditor raise my APR due to, at least in part, this excessive and needless practice. I need them to not only stop running these inquiries, but remove me from any list they may have me on as a prospective customer, and also need to remove themselves from my report altogether, as I have not been an account holder for over 7 years. I tried to report this to Experian, but their website is not working correctly to do so, and there is no actual phone number to contact a real person.

The agent told me it need to take 6-8 weeks to investigate. Ok and then I wait and contacted them lately ( more than two months ). Complaint: Hello, I am a 2011 graduate of XXXX XXXX University with a student loan outstanding debt of a small house in the country. The only problem with that is the outstanding amount the loan company asked me to pay every month, which I was n't able to do. It 's the equivalent to a monthly lease on an apartment. This caused me to be referred to a lawyer firm to " collect debt ''. I 'm constantly being harassed that I should settle or increase my payments. Both of which I ca n't do because I do n't make that amount of money to be able to do just yet. I 've asked to be on a lower payment plan ... denied. I 've asked what other options I have that could be worked out with me having to pay rent, eat, actually go to work to make money, etc. Nothing is really being done apart from the phrase " if you do n't increase your payments soon, there is n't much I can do. I 'm doing what I can, but clearly it is n't enough. The flip side to that is that I did n't land a job in the field that I graduated from. I 'm using what I did go to school for just a little bit. In all reality, I could 've just purchased software and used trial and error to figure this thing out. Now I 'm stuck paying this super huge amount of money back and the only thing I feel like was actually worth asking for a loan was the living expense that helped me get started in a new city as a young adult. At this point, I 'm sure I 've paid off that amount of living. In all reality, I do n't believe that XXXX XXXX University is worth taking out this much debt unless you already have something established prior to attending. After doing research and hearing the amount of complaints with this school and the graduation rate ... the proof is there. I have contacted other student loan help ( which worked ) concerning federal loans ( subsidized, unsubsidized ), now I would like to have my private loans reviewed to hopefully get a similar result.
