Complaint: We had a mortgage with XXXX and had difficulty paying due to daughters accident, and they offered us to apply for a modification from a phone representative, and said we pre qualified and we sent in all required documentation. And we were advised not to make payments on the file. Around XX/XX/XXXX we called to check status and they advised we were denied, but never got written confirmation, so we contacted an attorney, since they started the foreclosure process. We set up a mediation and attended and come to find out our loan was sold to Caliber, at this point me and the wife were in a separation of marriage, so she wanted to keep the house, we asked them if she could qualify on her own for a modification. She sent in all the required documentation again. This was around XX/XX/XXXX. Up to this point today our attorney still has n't received any written confirmation from the bank, and per law we should have received an acknowledgement letter within a few days confirming such. All she wants to do is keep the house under a modified payment that could be reasonable to her budget. I know some banks even process or approve a Principal Reduction type of modification as well to assist homeowners keep their house. Failing to acknowledge in writing is a direct violation of CFPB regulations. I am writing for assistance for her to keep this home with an affordable monthly payment

Complaint: Tried to modify home loan with Caliber Home Loans again, and again they keep losing the paperwork and or say they will send paperwork to fill out, but it never comes. We are now a few months behind, but have the funds to catch up on the loan, but Caliber Home Loans refuses to provide us with a statement of current balance. In fact, Caliber Home Loans has not mailed us a statement in over 6 months! How can we pay when our payment amount to catch up is unknown?

Complaint: My mortgage lender Caliber Home Loans sent me a letter stating that I need to contact them to opt out of communications that involve them sharing my private info with their affiliates. Their letter was confusing and stated that I could send an email to XXXXXXXXXXXX to opt out. I sent an email with that request but it bounced back with the following errorDelivery has failed to these recipients or groups : XXXXXXXXXXXX ( XXXXXXXXXXXX ) Your message ca n't be delivered because delivery to this address is restricted. For more information about this issue see DSN code XXXX in XXXX. They appear to be making it very hard to opt out for a consumer. Complaint: The current holder of my mortgage, a hedge fund, bought the loan from XXXX in an auction two years ago, no doubt at a substantial discount ( although I ca n't find out what they paid ). The servicer, in moving to foreclose, was required to go through Mediation by Oregon Law. In this process we applied for a mortgage modification to allow us to stay in our home. First HAMP was denied ( see attached for reasons- they gave us no information about how they arrived at not being able to fit a modification into the XXXX-XXXX % DTI ). Then we were denied for an in-house modification for the reason that the LTV was less than 70 %. This calculation is only based on the original loan balance and a drive-by BPO ( of which there were XXXX that varied by XXXX % in their valuation ). The holder of the loan is unwilling to consider the back interest and tax/insurance escrow owed in the basis of their calculation. If they did, the LTV would be between XXXX- XXXX %, depending on which BPO was used, well within their " standards ''. Their method seems a logical fallacy. Either the additional debt owed to them should increase the base loan or reduce the value of the home, because the net result is they we have less equity.

Complaint: I became delinquent with my condo association dues and in order to catch up a settlement stipulation was proposed and accepted. Approximately 6 months later the attorney who I was sending payments to was fired by my home owners association. At this time the balance owed was approximately XXXX dollars. The new attorney fees brought the balance up to approximately XXXX dollars. I was approved for a short sale by the mortgage company but received an estoppel letter from the home owners assoc attorney, demanding XXXX. After the sale was stopped the attorney demanded the XXXX in full ( even though i was making payments on the settlement stipulation ) or threatened foreclosure. They did foreclose and the association bought my condo at auction for XXXX dollars. Now the mortgage company is auing the homeowners assoc and me. In spite of the fact that I had received a modification on my mortgage and was current I believe my homeowners assoc and thier attorneys strong armed me out of my condo. I am niw looking at probably having to file bankruptcy due to their actions. Any assistance you can provide will be greatly appreciated.

Complaint: Due to a divorce I had to declare bankruptcy a little over two years ago. During the divorce proceedings we were told to stop making payments on the mortgage as neither of us would be able to afford the house on our own. That was XX/XX/2010. Since then the bank has never finished a foreclosure. They have started multiple times but just never finish it. I was under the impression that after my chapter XXXX bankruptcy went through that I would have to wait a minimum of two years before qualifying for a mortgage. I did everything in my power to repair my credit and when the time came my credit was good enough but they would not give me the loan due to the bank not finishing the foreclosure. I paid {$10000.00} to my landlord for the option to purchase and now ca n't purchase. It 's been nearly 5 years since we stopped making payments on the mortgage and my debt has been forgiven. Now the bank has sold the mortgage to another mortgage company and they are starting the process all over again. It 's already been six months since they have filed for foreclosure and I 've spoke to both the attorneys filing the foreclosure and the new mortgage company and they are not sure what is going on. All the previous attempts have just been cancelled without prejudice. Regardless even if they do get it finished I will have to wait an additional 3 years before I can apply for a FHA loan. I have done everything asked of me and because the bank can not finish their process I have been set back a minimum of 3 more years. How is that fair to the consumer. The mortgage companies need to be held accountable for the devastation they are causing the consumer. Thanks to this process I most likely will have to move and lose {$10000.00} in the process.

Complaint: There was a huge rush at the end to prepare my documents and the HUD statement kept going back and forth because the Caliber Team XXXX XXXX XXXX XXXX could n't get it right. They finally said they got it right and I thought I had just had the most wonderful experience ever. I found several months later that they dropped for the final HUD the XXXX HOA fees that were part of the estimates and part of the first several HUD statements as we moved towards loan closure. In the back and forth Caliber obviously dropped the HOA fees, but when I started calling to find out why they HOA was past due and not paid the troubles started. Caliber Customer Service told me I had to call their own company and figure this out. They refused to. After that enraged me at such poor and troubling customer service, a manager finally said I will do this out of the goodness of my own heart. No that is n't a good message to deliver to a customer. So I tried calling the mortgage broker and left messages until I got XXXX team. Only to be told they did n't do anything wrong but they would look at this to see what they could do to help me! Again not the right type of message to give a customer. XXXX only made matters worse when she did return my call she went directly to : We provided everything in the HUD statement and you signed it. Not anything like we might have made a mistake, let 's find out. The arrogance and lack of humility has been in every statement from XXXX since. Calm down XXXX and do n't get upset ; you signed the HUD statement and if you did n't catch it then it was n't wrong. Not one word in her text or emails have been ; let 's see what might have happened. I have all of the original HUD Statements showing the fees covered, so what am I to think but Caliber made a mistake. To add the arrogance of not even indicating let us help to find if XXXX was made or not ; No Caliber is n't the type of company you want to work with.

Complaint: My mortgage was transferred from XXXX XXXX XXXX to Caliber on or about XXXX 2015. I called Caliber XX/XX/XXXX to make a payment and they advised me that they did not have my loan in their system yet and they would send me a welcome letter as soon as they did and not to worry about making the payment in XXXX of 2015. My fist payment with Caliber was made on XXXX XXXX, 2015, the next three were made on XXXX XXXX, 2015, XXXX XXXX, 2015 and XXXX XXXX, 2015 ( on these dates the funds were taken out of my checking account - see attached ). I received a statement for XXXX 2015 wherein they stated that I owed {$18000.00} in arrears. My husband, XXXX XXXX called Caliber to tell them they made a mistake as we had been making payments to XXXX XXXX XXXX without missing a month and Caliber offered to review me for a mortgage modification even though we were not behind in our payments. The Caliber representative refused to listen to my husband who at that point got so frustrated that he agreed to a modification. Caliber e-mailed us the application which we never filled out nor sent it to Caliber for review since we were promised that they were going to look into the payments to see which payments were not credited to my account as they could not tell us what months were missing. I called Caliber on or about Tuesday, XXXX XXXX, 2015 and spoke to XXXX, ID # XXXX to inquire about if they found the missing payments and XXXX advised me that before they could look into the account, I had to bring it current and pay the {$18000.00}. I had advised XXXX that they were supposed to be locating the missing payments to be credited to my account and she advised me that my modification request was denied. How in the world can they deny something that was never submitted. She went on to tell me that my husband admitted to having missed 3 mortgage payments which was a total lie as my husband admitted to having not paid the XX/XX/XXXX mortgage upon their suggestion. I was advised to e-mail supporting documents to show the payments were made and I submitted XXXX checks remitted by XXXX XXXX XXXX and my checking account transaction history showing 4 more payments made to Caliber. I called again on XX/XX/XXXX to find out if they had received the documents and I again was advised by XXXX, ID # XXXX that unless I brought my account current, they could not look into their mistake. I advised her I did not have the {$18000.00} to pay and asked her why should I pay if I am not behind on my payments and she went on to tell me that unless I paid, foreclosure actions would commence against me on XXXX XXXX, 2015 and that I can make a payment even though my XXXX 2015 payment was returned which according to XXXX, should not have been returned. On XXXX XXXX, 2015 a representative from Caliber called my husband again looking for the full payment and when my husband stated that I was taking care of it and that I am in communication with Caliber, the representative denied that anyone called to speak to them about the account. The total ineptitude of Caliber representatives are jeopardizing my credit, my mortgage and my home. I had advised XXXX to locate a mortgage statement from XXXX XXXX XXXX and she did, she stated that it did not read like theirs therefore she could not tell what was due. Looking at the same statement which read " amount due {$2600.00} '' she could not admit that the account was current because she " could not understand the statement. '' I could understand why people get so frustrated in dealing with the banks that they would be willing to do anything to save their homes and do everything the representatives suggest, even though they are wrong. I asked both, XXXX and XXXX if they were recording the phone call and they both confirmed they were. A copy of the conversations should be obtained by CFPB.

During the trial, a representative of Caliber Home Loans testified and the Court entered a judgement without prejudice against them. Since that time, Caliber Home Loans XXXX XXXX, Ok XXXX has continued to report negative reports XXXX. In addition they continue to harass me and lie on me. As recently as XX/XX/XXXX XXXX, Foreclosure Specialist contacted my Attorney XXXX XXXX XXXX. inquiring whether or not he still represents me and said " that I expressed to them that I would voluntarily surrender the house via signed documentation. '' Why would I voluntarily surrender my home. That is a lie from the pit of hell and I wish your organization would look into their unscrupulous business practices.
