Complaint: XXXX XXXX XXXX recently helped in getting my mortgage payments and to help avoid foreclosure. I signed the agreement and recently got notified that my pension would decrease {$760.00} in XX/XX/XXXX when I turn XXXX. Caliber did help me in trying to keep my home but the payments were changed from the trial amount to {$760.00}. Since I am loosing almost the amount of my mortgage payment I will still be facing hardship. XXXX said I qualified for a $ XXXX payment. Will u please work with me and lower my payments. Complaint: I filed a complaint, CFPB XXXX, against Caliber, # XXXX, months ago, received a " satisfactory '' response ( $ XXXX ) from VP Assistant XXXX XXXX on XXXX XXXX.
I changed insurance companies from XXXX XXXX $ XXXX ) canceled on XXXX XXXX, 2015, engaged XXXX on that same date and was quoted {$2000.00} on XXXX XXXX. They sent Caliber a proof of insurance letter in XXXX XXXX {$2000.00} ) but later they raised the premium ( {$2400.00} ) and I canceled on XX/XX/XXXX, I started XXXX homeowners on in XXXX XXXX ( {$1700.00} ).
I have sent Caliber {$4900.00} to clear insurance refunds along with my monthly payment XXXX {$850.00} XXXX every month, they misapplied the escrow funds, chaos ensured.
I have just received a mortgage statement XX/XX/XXXX from Caliber charging me a {$1200.00} monthly payment due XX/XX/XXXX and I had a past due of $ XXXX outstanding principle has increased from {$110000.00} in XXXX to {$120000.00} today.
I paid Caliber the refunds due them and lowered my cost of insurance from {$3000.00} XXXX XXXX to XXXX XXXX to {$1700.00} and my payments increased.
My calculations show me paid up-to-date and my escrow at a surplus of about {$600.00}. I have asked for and received no information from them. Can you help?

Complaint: Greetings, below is a copy of my Making Home Affordable appeal letter to Caliber Home Loans this week.
it is my understanding that a service is not able to sell your loan while you are in the modification process.
XXXX XXXX XXXX did this XX/XX/XXXX with my mortgage ( can you confirm, is this correct? See Below ).
In addition XXXX HUD certified counselors ran all my income and debt numbers and confirmed that I definitely qualify for a Making Home Affordable modification. XXXX denied me for a HAMP modification twice using the same numbers that the HUD counselors approved me for HAMP modifications with. XXXX now informs me that my home is in foreclosure and will not consider a HAMP modification.
Numerous infractions occurred that violate the Minnesota Homeowner Bill of Right by Caliber Home Loans.
Greetings, I, XXXX XXXX formally appeal the decision to deny a loan modification per the denial letter I received from Caliber Home Loans dated XX/XX/XXXX
The reason for modification denial states : " your current monthly debts exceed your gross monthly income. Per my completed Caliber modification application, my net monthly income is approximately {$4800.00} plus any commission and my total monthly expenses are approximately {$3000.00}. This generates a surplus monthly income of {$1900.00}. ( See XXXX attached direct deposit guaranteed draw/salary of {$3000.00} per month not previously provided ) plus any applicable commission attached.
As XXXX XXXX XXXX confirmed during our telephone conversation on XX/XX/XXXX, he is sending a new modification package to me to re-apply for a modification.
Per the receipt of letter I received dated XX/XX/XXXX, from XXXX, XXXX XXXX XXXX law firm, Servicers are prohibited from referring a loan to foreclosure until a borrower has been determined ineligible for HAMP. Since there has not been a final determination regarding HAMP eligibility for my loan, and I am appealing Caliber 's decision and Caliber is prohibited from referring my loan to foreclosure until after it has been determined ineligible for modification under HAMP. Caliber is bound by the XXXX XXXX XXXX service agreement with the United States Treasury Department.
Caliber received my loan from XXXX XXXX XXXX XX/XX/XXXX, per the Office of the CEO and President of XXXX XXXX XXXX and my single point of contact, XXXX XXXX XXXX. My mortgage was under active review for a modification with XXXX XXXX XXXX and the Office of the Ceo and President during the transfer to Caliber Home Loans on XX/XX/XXXX. XXXX XXXX XXXX assured me and promised that the transfer to Caliber would be seamless and that all modification documents were transferred to Caliber to continue the XXXX modification in process. After I voiced numerous concerns about the transfer to Caliber while my XXXX modification was in midstream, on both XXXX and XXXX, XXXX XXXX gave me her verbal assurance that my modification would proceed seamlessly and continue right where it left off with XXXX XXXX XXXX and be diligently worked by Caliber Home Loans, and they will continue to work your file and modification right where we left off. with XXXX XXXX XXXX and be diligently worked by Caliber Home Loans, and they will continue to work your file and modification right where we left off.

Complaint: Discharged Debtor filed Bankruptcy on XXXX XXXX, XXXX. An Adversary Proceedings was filed by Discharged Debtor asking the Court to Determine the extent of an alleged Lien asking the Defendants at the time ( XXXX ( alleged servicer ), XXXX XXXX ( alleged Trustee ), XXXX, XXXX, XXXX XXXX XXXX allegedly changed name to XXXX XXXX XXXX, XXXX ( a subsidiary of XXXX ) XXXX XXXX, XXXX ( Attorneys who had been harassing Consumer/Debtor through their unfounded practices ) ) to produce a ledgering/bill of particulars, or proof as Creditors according to the FDCPA. All the then defendants ' abusive practices were outlined in the said Motion. Attorneys at the time, XXXX XXXX, XXXX, were repeatedly and maliciously sending letters and notices threatening the family as alleged Creditors to Foreclose.
During the Adversary Proceeding as opposed to proving their creditor status to the U.S. Trustee and the U.S. Judge, they continued with their fraudulent behavior and transferred/conveyed to their affiliate/subsidiary company CALIBER HOME LOANS, INC., deliberately failing to notice the U.S. Judge, U.S. Trustee, or the court of their actions and violating the current automatic stay in the ( progressing ) Bankruptcy procedure. Discharged Debtor while under the Automatic stay started to receive new notices of yet another Servicer/Debt Collector CALIBER HOME LOANS, INC. continuing to ignore the delicate in session process. Their actions were brought to the Court 's attention and the alleged NEW servicer CALIBER HOME LOANS , INC was consequently added to the Adversary Proceeding.
The U.S. Judge in her Opinion and Oral Ruling made it clear that : ( 1 ) neither of the parties before her were Creditors nor had Security or Equitable Interest, ( 2 ) neither presented their Proof of Claims to the U.S. Trustee, and ( 3 ) did not attended the XXXX Meeting. The Case was eventually dismissed, but the Judge 's opinion was clear. They were not Creditors and DID NOT have security interest.
The Discharged Debtor received a Discharge on XXXX, XXXX pursuant to 11 U.S.C. 727. Approximately three ( 3 ) months ago this year of XXXX. Consumer/Discharged Debtor started receiving notices of Foreclosure Sale XXXX XXXX, XXXX, for the Discharged debt. This information was again brought to the U.S. Bankruptcy Court Motioning for Sanction in the form of a Motion to Show Cause on XXXX XXXX, XXXX ; outlining their violations of the above Debt Collectors/alleged Servicers/Agents and Assigned, because not one of the Entities have any type of standing to collect on an Discharged Debt.
Discharged Debtor has done extensive research into this matter and hereby request that alleged Servicer/debt collector CALIBER HOME LOANS , INC and their Attorneys XXXX be investigated and held accountable for their fraudulent, outright defiance, and disregard of the U.S. Bankruptcy Laws, the U.S. Bankruptcy Judge, the Fair Debt Collection Practices Act, the Uniform Commercial Codes and the Other State and Federal Debt Collection Laws. There criminal actions continue to this date as recent evidence - Notice the illegal Sale to collect in the XXXX XXXX XXXX. The conspirators have NOT legitimately proven any standing.

Complaint: To Whom It May Concern, Recently I learned some very disturbing information regarding my mortgage. I discovered this information because I am trying to avoid foreclosure. For the better part of this year, I learned that the entity attempting to foreclose on my home, is most likely without authorization to do so. As a result of that, I ordered a Property Securitization Analysis Report and I learned things were definitely not done according to the statutory foreclosure laws in the State of California. As a result of further research, I learned that the right to rescind my loan transaction was still available to me due to the fact that my loan transaction has never consummated pursuant to California Code of Civil Procedure section 1550. On XXXX XXXX, 2015 I took the first step in rescinding my loan by sending a letter of rescission to my servicer, Caliber Home Loans. Caliber Home Loans received the letter on XXXX XXXX, 2015. Pursuant to the Federal Truth In Lending Act, Caliber and/or the creditor was suppose to file a lawsuit against me within 20 days of the receipt of the letter and/or take the necessary steps to release and/or reconvey the deed of trust. They have failed to take any action to be in compliance with the Federal Truth in Lending Act. On XXXX XXXX, 2015, I mailed to Caliber a Notice of Non-Compliance, they have still yet to comply and they are attempting to foreclose on a deed of trust that has been canceled by operation of law. I do not understand how they can attempt to foreclose on a deed of trust that is null and void and yet blatantly disregard the law. I filed a complaint back in XXXX on another issue and I do not know what transpired on that complaint. I am filing this complaint with the Consumer Financial Protection Bureau because there is a clear violation of law and I hope that you can assist in this matter. It appears Caliber Home Loans will not adhere to the guidelines and laws that are set out before them unless there is a higher intervention. Violation of federal law simply can not be ignored. Your assistance would be greatly appreciated.

Complaint: I wanted to write you a formal complaint letter with regard to my loan modification. My loan was sold from XXXX to Caliber early this year. I completed an application for a loan modification following the sale. In XXXX, I received a proposal for a trial period of XXXX months. The problem was that monthly payment was the same as my previous, and the proposed terms was not a modification at all, but rather a 5 year interest only payment arrangement. During this time I was out of town for work, when I got back I immediately called Caliber homes to discuss that this was not a loan modification and that the monthly payments needed to be lowered, as due to divorce and other hardships I fell behind on my mortgage payment. However, I also stated that with the right loan modification, I would be able to make regular payments as I have good stable income, been with same company for XXXX years, and I want to keep my home and stay in my home with my XXXX kids.
Caliber informed me that there was nothing else they can do, because I have missed the XXXX week deadline for appeal, since then I was trying to work with HUD, and other mortgage counseling agencies, with no results.
I want to insist that Caliber homes review my file and hopefully provide a real land modification.
I am still working toward and want to find a resolution.

Complaint: My mortgage was sold XXXX to Caliber Home Loans after my bankruptcy. At that point I attempted to obtain a mortgage modification and this has been a year long process that has gotten me nowhere but further behind in my payments. No matter what documents I submit they ask for more. When they give me a list of needed documents, I submit them only to find out they need more. After my bankruptcy I began making my mortgage payments to keep the delinquency from growing and for XXXX months they accepted these payments and then all of a sudden they said they could not accept the payments anymore. Understandably the fines and fees continue to grow. On XXXX XXXX, 2015 I was told by their agent that if I came up with $ {$17000.00} and was willing to pay {$960.00} per month extra for XXXX year, we could settle the whole thing. I had to the end of the month to come up with the money. I called on XXXX XXXX, 2015 and all of the sudden the deal changed. They said they needed more money up front and could only finance the deficit for eight months. It seems as though they really do n't want to help me settle this.
