Complaint: To avoid foreclosure XX/XX/XXXX Caliber Home Loans offered us a loan modification contract in which we had to pay 3 monthly trial payments of a certain amount, on time every month. We made our payments on time and the modification never happened. They sent us another agreement and another and another over the course of a year. When we went to make our payment for XX/XX/XXXX, the person on the phone said that the home had been foreclosed on and sold on XX/XX/XXXX. We had been led to believe that we were making monthly payments and working towards a modification when in reality CaliberHome Loans did what is known as " dual tracking '' and sold our home out from under us with no notification, no monthly statements breaking down our payments, no copies of the contract we signed, and no effort to make the modification we had been promised happen.

Complaint: To Whom It May Concern : I have been trying to get a modification with Caliber Home Loans. The representatives state that there was a payment missing but we have received proof that the payment was received by the previous lender XXXX. Then XXXX sold the loan to Caliber Home Loans.
As with most Americans our family was suffering a loss of income for several years. They denied the first modification which we are still trying to understand why. We called and spoke with a representative around XX/XX/2015 and were told there was too much debt. That did not make sense because they are only supposed to use income and current mortgage payment to arrive at an affordable payment. We were told to resubmit all documents again so we uploaded all the documents on their website and then received a letter indicating that they can not process at this time because you did not put your loan number on the documents indicated below. There are NO documents indicated below on the letter. Then they are asking to have the documents mailed, emailed, or faxed. They did not request this previously as the documents were uploaded to their website and this was easy. It seems now they are trying to make it difficult to get the documents to them in a timely manner. I need assistance in dealing with Caliber Home Loans.

Complaint: XX/XX/XXXX my husband and I filed for Chapter XXXX Bankruptcy. We had a 5 year plan and paid our trustee on time, never late for 5 years. We were discharged XX/XX/XXXX While in the bankruptcy we filed for a loan modification with our lender XXXX. After several months we were approved for a lower payment XXXX XXXX to XXXX ) and our account was brought current. We had to get this modification approved by our trustee..which we did. XX/XX/XXXX our loan was transferred to Caliber Home loans, who recognized and accepted our new payment amount of XXXX. However, they failed to bring the account current, without our knowledge. Prior to our case being discharged, Caliber was sent a letter to notify the courts and trustee if there were any errors as we were due to be discharged. They did not respond. Our bankruptcy was discharged free and clear of any past due amounts. XX/XX/XXXX, Caliber contacted us and said we were XXXX behind and threatened to foreclose. They made us do a repayment plan to get caught us and NEVER HONORED OR RECOGNIZED THE modification to bring the account current, although we provided documentation. We have been struggling for11 months making double and triple payments on money that was not even due or owed. We want to keep our home and feel that Caliber did not honor what was approved by the courts and they failed to comply with the rules that a debtor needs to be notified prior to discharge of any discrepancy. We have suffered an enormous amount of stress and agony just to ensure we are back on track not to mention the house is over XXXX over the amount it is worth. In addition, Caliber has reported late payments the entire time we have been with them even in the bankruptcy which I thought was against the law

Complaint: Borrower was notified XX/XX/XXXX by XXXX County Courthouse that there were past due taxes on the home. Borrower notified Caliber Home Loans via fax and phone of the past due taxes as well as included the statements from the courthouse of taxes due for XX/XX/XXXX as well as XX/XX/XXXX.
Contacted Caliber again XX/XX/XXXX and spoke with XXXX XXXX, manager of Customer Service regarding the unpaid taxes from XX/XX/XXXX as well as the now past due taxes for XX/XX/XXXX. Continued communication with XXXX XXXX throughout XX/XX/XXXX have yielded no results on taxes being paid. Now have been notified by XXXX County Courthouse that home is scheduled for auction if past due taxes are not paid by XX/XX/XXXX.

Complaint: My dispute is against Caliber Home Loans. Caliber used to service my mortgage loan, but it has since been traded to another company. I was reported late in 2014, once in XXXX and once in XXXX. I have spoken with them and they stated they would research and resolve the issue, but to no avail. I 've sent them supporting evidence, but to no avail. XXXX is the only agency reporting this derogatory information. It is my right to have my credit report match. Please note, I had n't missed XXXX payment prior to this loan being transferred to Caliber. I experienced many issues while they held my loan.

Complaint: There is a mortgage on my property, I am an owner on the property but am not the morgatgee. Several years ago we began having problems with the company servicing the loan on my property, XXXX XXXX. They were collecting escrow accounts on money that was not owed, the property was property tax exempt at the time but despite almost a year of paper work and meeting the problem continued. They also often held payments made to the branch on time for several days before processing as to incure late fees and overages. A short time after my mothers ex-husband filed for his own personal bankruptcy the bank would no longer accept payments on the mortgage nor provide any statements, written or verbal, as to the amount for the monthly payment that the mortgage had change to. Over several more months, everytime I went to any of the existing branches in my area, no one at the bank up to and including the manager could do anything but tell me to contact the escalations department in XXXX FL, as the account was locked from normal operations. The only contact at that number was a rude and completely dismissive customer service rep named XXXX, who in several months was the only person that would talk to me, never elevating my call to a higher level and demanding that the mortgage be paid, while simultaneously and repeatedly telling me that he would and could not give me the amount of the bill or where it was to be paid, only saying it had to go to XXXX bet he could not state where because that would be an effort to collect a debt. This continued for months and months, until notices came. No amount of calling or letter writing found anyone within the company to straighten out the no-mans land of lending we were in. At that time XXXX XXXX was dissolved and sold off to other banks, apparently first XXXX XXXX XXXX and then several other secondary companies. I do not know who holds the mortgage on my property at this point.
I am writing this because a foreclosure action was just apparently signed on my property and at no point in time with these hearings or plaintiff shifts was I notified or served. An order of sale is scheduled for later in XXXX and I was never included in any of the proceedings despite my rights and interests in the real property being debated. My rights to due process have been utterly ignored and no consideration, communication or reparation have be offered at all. There is no way it can be legal to force the sale of my property while never giving me an opportunity to defend my legal and financial interests and this is a gross XXXX.
Not only is my property being taken from me without due process, but the forclosure action included foreclosing on property that WAS NOT PART OF THE MORTGAGE at all! This is tantamount to theft!
My mothers ex-husband was never on the XXXX property, which is deeded and taxed completely separately, and could never have secured a mortgage on it in the first place as he was never a property owner. I have a right to be represented properly, notified, and not subjected to the whims of a kangaroo court style denial of my rights. This situation needs addressing IMMEDIATELY, as a foreclosure sale is imminent on my family home of the last 30 years and denying me the rights to my legal and constitutional rights is an insult to this country and the legal system it was founded on as much as it is an injury to me mentally, emotionally, financially and civilly.

Complaint: Brief history of problems with Mortgage CompanyIn XXXX my ex husband and I sought to refinance the original mortgage combining a second mortgage and securing enough to make significant repairs to the property. The house was not livable and my XXXX year old parents needed to be safe. My ex-husband and I applied to XXXX XXXX who had taken over the mortgage we had for the previous seventeen years.
The lender turned down the loan but within a few days they contacted my ex-husband and asked him to submit a second set of tax returns. They explained to him what he needed to do and he complied. The loan closed in XXXX of XXXX. In XXXX of XXXX my ex-husband moved out and refused to make the payments. I managed to keep the payments up and had no idea that there were any problems with the loan. The bank had been adding a late charge on the payments made in cash and directly transferred to the loan electronically. This is the system the branch manager set up for us. It was over a year before we learned about the added charges. None of the payments were late according to the stipulations in the note.
In XXXX the state of Florida granted XXXX service connected veterans a tax exemption for which my father qualified. This became the largest problem. We provided the bank with all of the proper documents in the first week of XXXX. In XXXX they were still escrowed for the taxes. In XXXX I received a check for {$700.00} approx. as a refund for the escrowed taxes. The taxes were XXXX a year so seven months would have been more than that amount. We never did receive an accounting for the funds.
Late in XXXX my ex-husband filed for bankruptcy in Federal court. This caused the demise of communication with the lender. They would not provide me with the information necessary to make the payments. Without knowing what the actual amount was I continued to pay the last known amount. During a telephone conversation with the loan processing center I learned that due to the fact the payments were not to the penny they were not posted to the loan but placed in suspense.
The last payment I tried to make they refused to take.
I sought an attorney to try and resolve this mess. This past week the judge signed an order of foreclosure against me. The day before the court date I received a loan payment statement from Caliber Home Loans. I eagerly called the number on the form to try and resolve this issue. They could not find any record of the loan by number, the property by address or my name. If I had sent them a check where would it have ended up?
In the foreclosure action they failed to notify my son who is co-owner of the property. Therefore he had no defense. And during the proceedings they amended the original mortgage to include a parcel of land never included in the original mortgage or any subsequent mortgages. It has a separate deed and tax number. Would n't this be considered theft?

Complaint: I had a negative experience with Caliber Home Loans. I first received a notice of delinquency from the County Assessors office in XXXX XXXX, indicating that my property taxes had not been paid for the XXXX property tax year. I contacted the lender several times, and was unable to get a clear answer on the situation. I was assured multiple times that they would be handling the issue, and paying the taxes, and that I would not be responsible for any late fees, and penalties as a result of this situation.
In XXXX XXXX, I received a certificate of redemption from the tax collectors office, stating that my taxes had finally been paid. However, after receiving the Annual Escrow Account Disclosure from Caliber Home Loans, I realized that they had paid the XXXX taxes, in addition to the late penalties, from my escrow account. I am not responsible for any late penalties accrued, due to late payment of the XXXX property taxes. I contacted Caliber Home Loans to let them know that they had erroneously withdrawn late penalties from my escrow account, and that I should not have been responsible for their mishandling of my account. In discussion with customer service, and after their refusal to allow me to speak to a customer service supervisor, I was told that the reason the taxes were not paid was due to the false allegation, that I had supposedly given them the wrong lot number for my property. Caliber Home Loans acquired my loan from XXXX in XXXX of XXXX. Caliber Home Loans paid the XXXX taxes upon receiving my loan, without issue. All the necessary information pertaining to my property is on the trust deed, which they 've had since acquiring my loan from XXXX.
In addition, as a result of their mishandling of my escrow account, the new Annual Escrow Account Disclosure statement activity for the next 12 month cycle indicates an unrealistic shortage amount, which is not in accordance with RESPA recommendations.

Complaint: I closed on my new home on XXXX/XXXX/2015. I was informed at the closing myrate was 4.1 %, this was not the APR. Just last week I received a " temporary '' coupon from Caliber Home Loans, no amount to be paid, very little information.
Today, I received a more official payment request, but again NO APR % rateon the form. When I called Caliber, they did not know what I was asking forand basically disconnected the call. I believe the APR rate should be includedon all documents relating to this mortgage. Why is the company being sosecretive about this number. Do n't I have a right to know?

Complaint: I was charged a late fee for a payment that was n't late. I have my mortgage payment on an automatic bill payment ( for the last several years ) and the records show this particular payment was sent on time ( XXXX/XXXX/15 ) and delivered four days prior to being late ( XXXX/XXXX/15 ). The first time I called the company they said they would not charge me the late payment. When I was charged, I called back and was eventually told by the CSR " I do n't have time for this '' and hung up on.

Complaint: I started with this mortgage company in 2007, after the death of my husband. Since I have been with them they have refused to refinance this adjustable rate mortgage, they are adjusting it more than every 12 months. Plus the company has changed their name XXXX times. They have not sold the loan, they have changed their name. It started out as XXXX, then they changed to Vericrest, now they are trading under Caliber Home Loans. Since I have been with them, they have charged late fees unsubstanciated. They never put an amount on any of their statements or their website as to how much the late fees would be, If I paid the mortgage on a Friday via the internet, it would not post until that Monday to my account. If Monday fell on the XXXX or later, they charged a late fee. I questioned them 2 years ago about what their late fees are, and how and when they were charging them. They sent me a breakdown from their own records, that showed XXXX lates on my record, but they have me owing them {$390.00}. Whenever I asked to speak with a manager they were either never available or someone would identify themselves as the manager, state they would look into it, and never call or write back. They also reported me late to the credit bureaus several times { I think to justify not refinancing me }, but eventually had to remove it from my report. It has been exhausting dealing with this company, the Attorney General 's Office has advised me to get an attorney, as well as contact your department for assistance. I have every monthly statement, as well as correspondence from them since 2007. I will attach the important ones, and hope something can be done. The last supervisor I spoke with there told me it was perfectly legal to charge a late fee if they do n't post a payment before the XXXX, no matter when I pay it online.
