Complaint: I paid my mortgage online at XXXX with Caliber Home Loans on XXXX/XXXX/2014 for XXXX payment. They did n't apply payment til XXXX XXXX which was at 31 day period. They have me as a 30 day late on the credit bureau. I submitted my payment well enough time for them to issue credit. This is not my fault my payment was submitted on a thursday they do not need that many days to apply payment. It was done online in there system. I have begged them to correct this 30 day late on my credit report they have now said that if they change it, they would be in violation of the laws made up by the credit reporting fair act. I 'm so mad.. its dropped my score so low, and I was n't late. Im attaching the proof of when I did my payment. I did n't read the date on there they were crediting the payment, I did n't feel I was in any jeopardy. I see it now but again I do n't feel they are right. I want this late removed from my report please help me.

Complaint: Letter to complain.
Caliber Home loans is committing consumer fraud by using an inflated value for XXXX and refusing to modify my loan. I wrote several letters to the company and still no reply. they are not following RESPA. They have a date set and want to foreclose on a home that I want to keep. No fact finding was completed during the XXXX process and therefore the adviser did not have full knowledge of property estimate in the complex area.
Please reply to this letter within XXXX days and investigate my complaint. Because in 2006 I was sold a sub-prime mortgage when in fact there was nothing wrong with my credit history and I had never been refused credit before. Please help me get help from HUD as well. My email is XXXXXXXXXXXX.

Complaint: Beginning the house buying process we were pre-approved with this lender. After finding a property and having our offer accepted, our lender, we thought, started the paperwork. During the month between the offer and closing, our loan consultant changed jobs XXXX times. Being our first home, we did n't know what to expect and our agent assured us consultants change jobs a lot. Our consultant did n't ask for much documentation after gathering the essentials in the beginning. Our appraisal was done late, on our part. Our consultant assured us she would get everything rushed. The day after the proposed closing date, the consultant started to ask for more income and credit based documents. She also was no longer reachable by phone, our agent could n't even get in touch with her. After submitting income-verifying documents, she attempted a Rapid Re-score to get the credit score from a XXXX to a XXXX. In the process she actually lowered the score to a XXXX! She also then blamed the drop on something else. At the end of being completely frustrated we saw the XXXX inquires she put on our credit. We inquired with her first company, to see if they could straighten out the mess. She then informs us, by email, that they might could help us. So she basically figured she could stall the process and in the meantime our credit score would go up the XXXX points. All the while not keeping us up to date and being illusive.

Complaint: I 'm filing a complaint surrounding violations to the terms of the National Mortgage Settlement ( NMS ). This matter is also consistent with violations identified within the California Bill of Rights ( CBOR ) specifically designed to protect homeowners from lender abuse and negligence. As part of a Nationwide reform which forced XXXX XXXX XXXX ( XXXX ) to comply and implement specific servicing standards requiring a single point of contact, adequate staffing levels and training, better communication with borrowers, and appropriate standards for executing documents in foreclosure cases, ending improper fees, and ending dual-track foreclosures for many loans.While my loan was being serviced and owned by XXXX, my loan modification was approved for recapitalization on XXXX XXXX, XXXX. At the time of the approval our loan was delinquent for approximately $ XXXX fact this was primarily due in part to the implementation of both the XXXX and XXXX was XXXX of the reasons that we chose to make three consecutive payments of {$2800.00}, paid XXXX XXXX, XXXX, XXXX XXXX, XXXX and finally on XXXX XXXX, XXXX. ( See Exhibit " A '' proof of payments ) Once my XXXX payment was posted to XXXX on XXXX XXXX, XXXX, my loan was immediately sold to an entity by the name of XXXX XXXX, on XXXX XXXX, XXXX and subsequently transferred to Caiber Home Loans ( CHL ) on XXXX XXXX, XXXX, from XXXX. ( See Exhibit " B '' Mortgage Transfer Notice Dated XXXX XXXX, XXXX ) In addition a qualified written request QWR, was served against CHL on XXXX XXXX, XXXX, for aforementioned mortgage. CHL 's office, has failed to provide requested documentation, that furnished the XXXX Letter as required by the industry during the sale or transfer of debt along with any associated addendum 's to the promissory note ( to include the allonge ). The provisions set forth by TILA, 15 U.S.C. 1641 ( f ) ( 2 ), require the creditor, new owner or assignee of the debt to notify the borrower in writing of such a sale or transfer. Additionally and to further support the request, the Uniformed Commercial Code ( UCC ) also requires that " within 30 days of each assignment, transfer, or sell, the assignment of true sale must be recorded under States ' statute. The dates of the allonge endorsement ( s ) and the notarized assignment ( s ) must match to prove true sales before a foreclosure can legally occur. '' The fact that the loan was sold in the middle of our transaction with XXXX, we believe directly contributes to the overall miscalculations and misapplication of payments and amounts.Furthermore according to the records and conversations provided by CHL 's loan modification department, they allegedly procured a permanent loan modification which is perceived to follow the terms set forth under the NMS. This loan modification offered by CHL, is alleged to be as a result of making our payments of {$2800.00} in 3 consecutive payments.The problem is that not only were we paying toward 3 trial modification payments under the making home affordable ( MHA ) program, which should have been accompanied with a principle reduction based on the National Mortgage Settlement ( NMS ) of XX/XX/XXXX. The calculations have added additional unfounded, exacerbated, with unexplained amounts factored into an outstanding excessive balance in the amount of {$720000.00}. Our loan was not as far behind as these calculations represent at unpaid amounts of {$270000.00}. This modification offer is a bait and switch from what was originally supposed to be offered by BAC, and the terms of NMS and CBOR. This is simply a ploy for BAC, to avoid from granting us reliefs infused into the terms of the NMS and CBOR as such. Immediate aid to homeowners, in dire need of loan modifications especially loan which originated with Negative amortization features undisclosed to unsuspecting XXXX time homeowners.

Complaint: I was a customer of Caliber Home Loans. When I refinanced, they failed to fully return my property tax escrow. I went to the county tax assessor and confirmed that a disbursement Caliber claims they made was never paid out. Twice I have opened a case with Caliber. They tell me I have to wait two weeks for a resolution and that they are escalating. Twice now they have 'accidentally ' closed it and told me I have to start all over again. I feel they are trying to keep my money ( over {$2000.00} ).

Complaint: In XX/XX/XXXX my mortgage was sold by XXXX ( XXXX ) to Caliber Home Loans. I had been working with XXXX to catch up with a couple of missed payments ( in XXXX ) when ( also in XXXX ), the mortgage was sold to Caliber. In XXXX, I caught up on my payments and brought the loan current. In late XXXX, Caliber began to claim that when they purchased the loan from XXXX, there were unpaid property taxes and several months of missed mortgage payments due. I strongly argued that I did NOT owe anything else and provided proof on multiple occasions. See the plethora of attachments for complete history. Caliber would not accept what I kept telling them as truth and in early XX/XX/XXXX began returning my mortgage payments with notes that I owed more than the monthly payment. I have now been served with a foreclosure notice and am in desperate need of assistance. I am at a loss of how to proceed. The toll this situation has taken on me personally and financially is immeasurable. I ca n't sleep. I have been communicating with Caliber for months with promises they would make things right, but I can not get anyone to " hear '' me or respond to my multiple fax and fed ex package delivery of proof. The documentation is attached as requested.

Complaint: I believe I was a victim of mortgage fraud. My ex wife obtained a refinance/loan modification without my knowledge or consent. This occurred on or about XX/XX/XXXX. She either forged my name or electronically signed my name and provided my information without my knowledge. She obtained this loan through Caliber Home Loans, who sold the mortgage to XXXX on or about XX/XX/XXXX. This loan was obtained with forgery and false information and approved by XXXX. XXXX also ran my credit, doing a check resulting in a " hard hit '' to my credit without my knowledge or consent. XXXX also approved and processed the loan without my presence, written or verbal consent.
