Complaint: My husband was diagnosed with XXXX XXXX in XX/XX/XXXX and XX/XX/XXXX after a check up at XXXX XXXX XXXX XXXX XXXX in XXXX, AZ XXXX. He was laid off of his job and stayed XX/XX/XXXX and XX/XX/XXXX in AZ receiving daily XXXX XXXX. He was able to draw unemployment and I am very secure in my job but it was n't enough to cover the truck payment or mortgage. We started a process with Caliber Home Loans for assistance and asked for a loan modification or extension, this went on for 3-4 months with the final result being that they were unable to help us. So it was n't that we were not paying our bills we were unable to pay them and asked for help with no good result in the end. We are not dead beats I have had my job for 8 years and he had no choice with the XXXX XXXX. Caliber Homes told us they would help us since we filed tons of paperwork with them that it would not effect our credit but obviously that was n't true.

Complaint: My spouse and I have been struggling with our mortgage and XXXX offered us a plan to get caught up. We agreed to make payments for 6 months to get caught up - 'good faith payments ' they were called and after the 6 months of payments ... we would be evaluated for a modification. Or so they said. 4 months in, we made all 4 payments on time and had two more to go, our mortgage was sold to Caliber Home Loans. We did receive a letter stating that the mortgage was sold. Since we were on a payment arrangement with XXXX, we called Caliber to make sure the payments were still going to be deducted automatically from our account and to make sure they had our account information. However, when we called my spouse spoke with someone named XXXX and XXXX stated our home was going into foreclosure in 7 days if we did not pay the {$7800.00} that we were behind with on our mortgage upfront. If we had the {$7800.00}, we would not have been on a repayment plan. My spouse tried explaining this and he was told that if we did not have it in writing from XXXX, that arrangement could not be proved as valid. So then I stepped in and called Caliber and spoke with someone and I was told the same thing, we needed the agreement in writing and to fax it over if we could in order for us to continue with the original XXXX repayment plan. I tried explaining that every month we would get a 'notice of right to cure default ' and the notice states that " If you have made arrangements to cure the delinquency of your mortgage and the agreement is kept, you may disregard this notice. '' We called XXXX the first couple of times we received this letter and they assured us that the payment was made and all was fine. Caliber Homes ( new mortgage company ) stated that did not count. So we call XXXX to inquire about receiving a record of the agreement ... my bank account reflects 4 payments automatically deducted as agreed by the way, but XXXX tells us they no longer have any trace of our records because the mortgage has been sold. At this point, I am ready to call a lawyer but my spouse calls Caliber homes one last time and speaks with someone named XXXX, extension XXXX, and XXXX states that XXXX ( original rep from Caliber homes we spoke to first ) was wrong and literally states verbatim that XXXX does not know what she is doing and XXXX is wrong. We are still on the original agreement schedule with XXXX called a 'step to modification ' according to XXXX . We are supposed to adhere to the XXXX agreement and then discuss a modification according to XXXX. Okay, a big sigh of relief right before XXXX. However, later that same day - XXXX from Caliber Homes calls my spouse on his cell phone and states that XXXX is incorrect. My spouse disagrees and states he does not want to deal with XXXX anymore and would like to continue with XXXX because XXXX seems to know what she is talking about and apparently XXXX had our records from XXXX and was quoting verbatim our initial and original payment agreement that we had with XXXX. XXXX stated that 'nope ', XXXX was wrong and our foreclosure was imminent. What in tarnation is going on here.

See, in relevant part, this section of Maryland Code : MD Comm L Code 12-109 ( 2013 ) What 's This? 12-109. ( a ) ( 1 ) In this section the following words have the meanings indicated. ( 2 ) " Lending institution '' means a bank, savings bank, or savings and loan association doing business in Maryland. ( 3 ) " Escrow account '' means an expense or escrow account which tends to protect the security of a loan by the accumulation of funds for the payment of taxes, insurance premiums, or other expenses. ( b ) ( 1 ) A lending institution which lends money secured by a first mortgage or first deed of trust on any interest in residential real property and creates or is the assignee of an escrow account in connection with that loan shall pay interest to the borrower on the funds in the escrow account at an annual rate not less than the 6-month average dealer bid rate on nationally traded certificates of deposit, as published by the Federal Reserve in " Selected Interest Rates ( Daily ) - H.15 '', as of the first business day of the calendar year.

Complaint: Caliber Home Loans paid property tax that had already been paid. They deducted the funds from my escrow account during a refinance. For 2 months now, I have been making phone calls in an attempt to resolve the matter. A couple of weeks ago Caliber denied receiving a refund check from the county. Caliber recanted when I provided the check number, the amount, and a statement from the county stating the check was cashed. Caliber now admits they owe me the money, however multiple phone calls have resulted in no specific date I will be sent a check. I spoke to a very rude supervisor named XXXX today. He claims he will call me back with a date, however past promises of a phone call by Caliber have resulted in no call back. I believe it is horrible to take a veteran 's money and hold it during this time of the year when many purchases are made. It is a slap in the face to all current and past service members.

Complaint: My mortgage loan was transferred over to another service, it went from XXXX to Caliber, when the mortgage was still will XXXX, I signed an Deed in Lieu of Foreclosure agreement, that said I would vacate the property on XXXX XXXX, 2015, in return I would be paid {$10000.00} to help in relocation expenses. In good faith, I vacated the property on the given day and left the house in broom swept condition, I took photos for proof. Then a few weeks later I received a letter from XXXX stating that my loan was being transferred to Caliber and that they would be handling the loan from now on. I was assigned a Deed in Lieu Representative XXXX XXXX XXXX XXXX, I have called numberous times to find out status on the loan. I finally got a hold of XXXX on XXXX XXXX, 2015, she said that since a new servicer ( Caliber ) took over the loan, that a new Deed in Lieu of Foreclosure agreement had to be drafted. On XXXX XXXX, 2015, I called and spoke with XXXX again, she said new Deed in Lieu aggreement should be sent out today or Monday from the attorneys, she did say that the same attorneys were working on the paperwork as before. If we do not receive the paperwork by Wednesday, call her back. She said once paperwork has been signed and is sent back to the attorney 's and then to Caliber, the process to close the loan should move quicker. On XXXX XXXX, 2015 I called the Attorney 's handling the paperwork on XXXX XXXX, they are the same firm that drafted the paperwork when the loan was with XXXX. They said that the loan paperwork were on hold because they were waiting for a document from Caliber. On XXXX XXXX, 2015, I called Caliber, hoping to have them shed some light on the situation. XXXX was unavailable, explained to the agent XXXX, that I spoke to the attorney 's office, she said she would note the account and let the Deed and XXXX agent know to follow up with the attorney 's office and get back to me. On XXXX XXXX, 2015 I called Caliber again, spoke with XXXX, explained the situation, he advised me that XXXX was out sick until Monday, he said the document in question is most likely an Assignment of Mortgage, and that it is most likely in the Attorney 's Foreclosure Dept. He said to follow-up on Wednesday if I have not heard back from XXXX. I told him that I was worried that someone might break into the house now that it was empty, and since I lived in XXXX XXXX, and in light of the shooting that occurred there, I did not want anything to happen to the home, causing me to loose my moving expenses reimbursement, He also said they have a preservation team that monitors the state of the property, and that they have photos of the property of when they secured it, and that they will reference them when the loan is finally closed out. I did not hear back from XXXX on Monday,, or Tuesday, or Wednesday, I finally got ahold of XXXX on XXXX XXXX, 2015 and explained that I wanted closure on this, and that if the process could be expedited, I also explained what the attorney 's office told me. Her answer was that the date was entered incorrectly on the Assignment of Mortgage and that they were waiting for XXXX XXXX XXXX to sign off on the paperwork. She says that this could not be expedited, nor could she give me any other answer of when this was settled, she left me high and dry.

Complaint: `I am trying to do a repayment plan with Caliber Home Loans. I have called in many times and was told I was " approved for a 12 month repayment plan '' They told me the downpayment of {$70000.00} must be in by XXXX XXXX ( I was told the letter is in the mail and I should receive it on XXXX XXXX a day after it is due to be there ) as of now II have received no paper work from them at all. I am reluctant to release {$70000.00} to them with out anything in writing stating that the NOD will be removed, further they said I must pay $ 9600 month on the balance owed which should be {$39.00} and should be divided by 12 months.which comes to much less that {$9600.00}. the reason why I asked for a 12 month repayment plan was to have affordable repayments. It turns out that they are charging me more money than the statement says I owe and they are charging me late fees for the months I am behind in addition to the late fee on the statement charging me for those same months. They also are computing the 12 month repayment plan on 11 months which is unfair and raises the monthly payment. I am unable to talk to anyone besides a point of service person who tells me that all the numbers are computer generated and no one can make any changes.

Complaint: I have a Mortgage with Caliber Home Loans I had numerous unsuccessful attempts at a loan modification, I was turned down again and a NOD was filed on my house. I called the bank and want to do a repayment plan with a substantial downpayment and I asked for 12 months to repay the balance I called many times to set up a repayment plan. each time getting a different : '' point of contact specialist '' Most of them were very inexperienced and gave me wrong information. I called with my lawyer on a conference call and got yet another inexperienced " point of contact person '' She put down numbers and submitted them for approval for a 12 month repayment plan ... well, she did n't have her numbers correct and she did n't account for money that was in the account for unapplied payments. causing me to be approved for a huge unaffordable monthly payment of almost {$10000.00}. When I called in to have this corrected, the first person I got was a trainee who did n't know what to do and then I got her trainer who too had wromg info and numbers.. Also, each person I talk to adds more fees on to the total. The bank is trying to charge me for late fees that were included in the total due. This means that I will be paying late fees twice for each month or double late fees. Also, I was OVERCHARGED from my XX/XX/XXXX statement to XX/XX/XXXX statement. by {$3000.00}

Complaint: I originally had a mortgage with XXXX, and requested a modification, after numerous conversations and requests for paperwork I was working with a specific person, we spoke daily, and suddenly I got a letter that my loan was then with Caliber, after sorting that all out, I had to begin the mod process all over again with them. I filled out the application and sent the documents they requested. shortly after I received a letter that the request was received and is being processed, after that almost daily and sometimes XXXX a day, I would receive letters from Caliber, some saying everything was received for my request for a mod and it is being processed and a date that I should hear back, the next letter would say that my request was received but some documents were missing and are needed and a different date of deadline would be on that letter, and then another letter after that stating al had been received it is being processed and yet another date of when I should hear something by. I had to call and sort it out, and was told correctly and sent what was if anything needed, and tat it was being processed and that I would received information in the mail regarding the next steps, the only thing, however tht I have ever received from them has been letters requesting more, already sent information, or a letter saying its all in and being processed, or a monthly statement. I have never received a mod decision, or my options, in XXXX actually 3 months after I spoke with them about the letter I had been receiving, I received a packet about my options because of missed mortgage payments and a modification application. I called in questioning this, and was told that they never received everything they requested and if I want to move forward that I needed to send in another application, as confused as I was, I sent in the application and all documents yet again, and received a letter stating it was being processed. since then I have received monthly statements from them, I received a letter from the attorney representing them about a publication notice, but never a thing from Caliber in regards to it, nor have I received anything from anyone explaining that any further. I then got a letter stating that XXXX XXXX XXXX was now the servicer of the mortgage, just as I had received when XXXX sold to Caliber, that was In XXXX, and since then I have been waiting to receive information to resume or bein the mod yet again with XXXX XXXX. I have never been set a decision or options for a modification, I have sent it any and all information regardless of how many times I have already done so. I have been waiting to hear from Caliber so that I can move forward, as I have full intentions to pay for my mortgage, but I had a change in my situation and needed some help. I have heard that I am now supposed to leave my home, I am being evicted, yet I do n't know why, or when this happened. because I have heard nothing, like I said I have waited on a decision for mod that I have never received, the options that I am supposed to be given, were not given, " keep homeowners in their homes '' is apparently not at all what anyone wants to do.

Complaint: I submitted and it was confirmed that all documents requested were received and on XXXX XXXX, 2015. Caliber was supposed to cancel the sheriff 's sale date set for my home on this date, it is now XXXX XXXX, 2015, the Caliber web site states the following about my account : " At this time, all necessary documents to complete the review of your request have been received by Caliber Home Loans , Inc . The review will take up to 30 days to be completed and a decision provided to you. '' Again, it is now XXXX XXXX, 2015 and will be XXXX XXXX, 2015 on Monday. Caliber has not cancelled the sheriff 's sales as required by Minnesota law. My HUD agency and housing specialist at XXXX XXXX XXXX, XXXX XXXX called Caliber to inform them that Minnesota law requires their cancellation of the Sheriff 's sale once a modification review begins and all documents are received. XXXX also called Caliber 's law firm : XXXX, XXXX, and XXXX at XXXX to inform them that Caliber is breaking the law by not cancelling the sale once all mod documents are received and a review is underway.
