Complaint: Caliber Home Loans failed to pay our annual property taxes for XXXX but all year have been dispersing funds from our escrow account. We received a deliquent tax notice with threats of foreclosure. I provided this information to the Caliber Tax Department via phone and fax on XXXX/XXXX/XXXX. Spoke to supervisor XXXX XXXX who promised to resolve immediately and call me back to update me on the status on XXXX/XXXX/XXXX. It is now XXXX/XXXX/XXXX, I have left 3 message with Supervisor XXXX XXXX with no return phone calls and the Tax Department customer service representatives claim they will have someone call me back but no communication. Currently our escrow account shows that funds have been paid out and the Mortgage Company can not account for nearly {$6000.00} worth of our money paid into the Escrow account but the money is now no longer there but our taxes were not paid.

Complaint: I had filed and was awarded bankruptcy in XX/XX/XXXX. Included in the bankruptcy was a home that had been awarded to my ex-spouse during the divorce under XXXX XXXX. My credit report shows the loan was discharged due to bankruptcy in XX/XX/XXXX and XXXX discontinued reporting on my credit report. My ex-spouse had stopped making payments on the house and subsequently, the loan company started foreclosure proceedings. I was no longer responsible for the loan, with the discharged bankruptcy on court record however, in XX/XX/XXXX, XXXX XXXX sold the loan to another company, Caliber Home Loans. Caliber proceeded to put me back on the mortgage, even with the discharged bankruptcy and began reporting on my credit report XX/XX/XXXX that the loan was over 180 days past due. I contacted Caliber, gave them my bankruptcy information, my attorney 's information and asked them to remove the information from my credit report. I was not a part of that loan when they acquired it in XX/XX/XXXX as the discharge was in XX/XX/XXXX. They have failed to do so even at the request of my attorney, proof of the bankruptcy discharge and request of myself. The are still reporting on my credit report.

Complaint: I originally had a mortgage with XXXX, and requested a modification, after numerous conversations and requests for paperwork I was working with a specific person, we spoke daily, and suddenly I got a letter that my loan was then with Caliber, after sorting that all out, I had to begin the mod process all over again with them. I filled out the application and sent the documents they requested. shortly after I received a letter that the request was received and is being processed, after that almost daily and sometimes XXXX a day, I would receive letters from Caliber, some saying everything was received for my request for a mod and it is being processed and a date that I should hear back, the next letter would say that my request was received but some documents were missing and are needed and a different date of deadline would be on that letter, and then another letter after that stating al had been received it is being processed and yet another date of when I should hear something by. I had to call and sort it out, and was told correctly and sent what was if anything needed, and tat it was being processed and that I would received information in the mail regarding the next steps, the only thing, however tht I have ever received from them has been letters requesting more, already sent information, or a letter saying its all in and being processed, or a monthly statement. I have never received a mod decision, or my options, in XXXX actually 3 months after I spoke with them about the letter I had been receiving, I received a packet about my options because of missed mortgage payments and a modification application. I called in questioning this, and was told that they never received everything they requested and if I want to move forward that I needed to send in another application, as confused as I was, I sent in the application and all documents yet again, and received a letter stating it was being processed. since then I have received monthly statements from them, I received a letter from the attorney representing them about a publication notice, but never a thing from Caliber in regards to it, nor have I received anything from anyone explaining that any further. I then got a letter stating that XXXX Bank XXXX was now the servicer of the mortgage, just as I had received when XXXX sold to Caliber, that was In XXXX, and since then I have been waiting to receive information to resume or bein the mod yet again with XXXX Bank. I have never been set a decision or options for a modification, I have sent it any and all information regardless of how many times I have already done so. I have been waiting to hear from Caliber so that I can move forward, as I have full intentions to pay for my mortgage, but I had a change in my situation and needed some help. I have heard that I am now supposed to leave my home, I am being evicted, yet I do n't know why, or when this happened. because I have heard nothing, like I said I have waited on a decision for mod that I have never received, the options that I am supposed to be given, were not given, " keep homeowners in their homes '' is apparently not at all what anyone wants to do.

Complaint: I have an old complaint number of XXXX submitted XXXX/XXXX/XXXX and I have a new complaint number of XXXX filed XX/XX/XXXX. " THIS IS PART OF THE DISPUTE " On or around XXXX/XXXX/XXXX received package of information via XXXX. However the only newly requested document in the package was a Certificate of Incumbency for XXXX XXXX. The other names in a Request for Information letter sent dated XXXX/XXXX/XXXX, a Certificated of Incumbency / Corporate Resolution Authorizations / Power of Attorney for court case # XXXX in the County of XXXX N.C. was not sent. Also, XXXX XXXX was not an Employee or Rep. for XXXX XXXX XXXX of North Carolina or XXXX XXXX XXXX at the time of this transfer and Assignment Of Deed of Trust on XX/XX/XXXX ( see enclosed ). At that time according to Resolution Of The Board Of Directors Of Vericrest Financial , Inc. A/K/A Caliber Homes Loans, Inc. XXXX XXXX XXXX was an employee of XXXX. XXXX XXXX ( see enclosed ). Therefore XXXX XXXX XXXX was still not an employee or rep. of XXXX or XXXX, So as a consumer I am still trying to understand how this transfer on new assignment of deed of trust was done " Legally ", ( see enclosed ). I have also enclosed a copy of what I am not sure that my name and address appears on, this is the only other document that was sent by Caliber that might could be an Cert. of Incumbency ( see enclosed ). At this time I am also enclosing lawsuit that I have removed myself from but still remain in the settlement class ( see enclosed ). I have also enclosed a copy of first QWR dated XXXX/XXXX/XXXX the last page. At this Point I as the consumer really would like to see how all of these transfers and filing of documents was done legally but at this time there seem to be a missing link??? Maybe If we can get the transfer paperwork referred to in your last letter dated XXXX/XXXX/XXXX in the " Previous Correspondence '' section page XXXX, which states that " My Loan Was Transferred From XXXX XXXX , XXXX to XXXX Master Participation Trust and then from the Trust to XXXX XXXX, XXXX. as Trustee for XXXX ( see enclosed ). I am also enclosing a letter from XXXX XXXX giving Caliber Homes the Authority to dispose of these matters as it concerns XXXX XXXX XXXX , XXXX, NC XXXX.

Complaint: I have been fighting a wrongful and fraudulent mortgage foreclosure since XX/XX/XXXX in the Court of Common Pleas XXXX County Pennsylvania. The judge has not considered any of the prima facie evidence of a fraudulent assignment and lack of standing of the plaintiff. I have submitted in my case and has not granted a hearing. Now the opposing counsel has entered their Motion for Summary Judgement. The plaintiff 's attorney 's are or have filed an In rem action lawsuit against my wife and me. In a In rem jurisdiction the defendants have no rights because their action is against the mortgage, and not the note. So they do n't have to produce the original note ( if there even is one ). Listed below are the material facts in controversy that the judge and the plaintiff 's attorney 's have completely ignored : Issues Relating to this Foreclosure On paragraph XXXX of the said complaint, the plaintiff alleges that the Mortgage was assigned to it by way of the XXXX mentioned assignments. There is no mention of the manner with which the note was transferred to the plaintiff. The plaintiff did not state in the complaint that it has possession of both the Fixed Rate Note and the Mortgage. The trustee for the XXXX Master Participation trust is XXXX. Nowhere in the complaint is a mention of XXXX. Examiners ' Comment No. XXXX That the plaintiff, which is the trust itself and not represented by its trustee, did not state anything about the note in the complaint, coupled with the fact that the assignments were executed only six to seven years after the assignments, brings into question whether the mentioned endorsements and assignments did in fact effectuate actual physical transfers of the note and mortgage or whether this entity is actually in possession of them. These documents must be presented in court, in the presence of the borrower and/or counsel, and if demand is necessary in order to effectuate the presentment, that demand shall be addressed to whoever represents XXXX Master Participation Trust, which may not be XXXX, the trustee. There is currently no holder in due course ( as defined by the Uniform Commercial Code ) of the subject loan given the alleged robo-signing noted in paragraph XXXX. 16. Multiple parties could claim ownership of the financial obligation associated with the subject note : a. the alleged Assignment of Mortgage discussed in paragraph XXXX is void assuming the document was in fact robo-signed, which points to the original lender as the holder of the note. b. the complaint for foreclosure claims that XXXX Master Participation Trust is entitled to collect on the financial obligation. To protect the borrower from multiple claims of ownership, further information is necessary to determine the true holder entitled to enforce the subject note. Complaint: Four and a half years ago, I attempted to short sale my property and vacated the residence. I let the bank know that I was unable to maintain the mortgage for the property as well. At some point the property was secured. XX/XX/2015 I was informed that Caliber Home Loans had taken over the home. I reached out to them to find out how to get the home out of my name and to find out if they would be foreclosing on the property. They could provide no timeline as to when things would progress, when they would attempt to resell the property or if they would foreclose. At this time I still have no information and am burdened with additional financial hardship because the home continued and still continues to accrue Condo Association fees since the time that I vacated. I have not received any documentation that it was still accumulating and thought that since the bank had taken possession and changed the locks that they would now be responsible. It was not until I found out a judgement was granted against me for over XXXX dollars and a they started taking XXXX % of my check each pay to pay the judgment amount that this was not the case. In the mean time the Condo fees continue to accrue. I do not know what period the XXXX even covered so I may be subject to more past due balances that I do not have the funds to pay. I spoke with a realtor to possibly relist the property as a short sale because I owe almost 3xs as much as the current market value and because of the lien/judgment she stated that this may not be the route I wanted to take due to the amount of time it could take to even get an offer which would then have to be accepted at a time when the market is low in the neighborhood in which this home is.. I am pleading to get the process moving forward to get this home foreclosed on or what ever the appropriate measure may be to get it out of my name and stop the bleeding with regards to the condo fees. I can not move forward with my life and start over until the bank does what they need to do with regards to home.
