Complaint: I contacted Caliber Home Loans last week & asked them to send me a copy of my original mortgage note. Upon my 1st call on XXXX/XXXX/16, I was told that it would take a month to be received. I spoke to my legal council, was told that I was provided false information, & encouraged to call them to escalate the concern. By XXXX/XXXX/16, I had a manager on the phone who tried telling me the same month time frame, but I shared with her the statues & laws they were breaking by not providing me a copy of my mortgage note upon my immediate request. Notes were then made on my account that I would finally receive my mortgage note by tonight ( XXXX/XXXX/16 ). Needless to say, I still did n't receive my info & as such, I escalated my concern with Caliber to XXXX, badge number XXXX, & was told that " no one '' knew why I did n't have my mortgage note by now. He then told me that I could have it faxed to me & in reply I said that the manager from last week told me that Caliber COULD N'T send me a fax -- another company contradiction. XXXX could n't provide an explanation for this & he has yet to send me a fax copy of my mortgage note. Caliber Home Loans ' inability to provide me a mortgage note in a timely manner, per their advisements, is negatively impacting my ability to do a refinance on my home. And if I am not able to complete my refinance as scheduled, I intent on holding Caliber responsible, legally & monetarily, to the fullest extent that local, state, & federal laws will allow.

Complaint: My current mortgage company, Caliber Home Loans, took over my mortgage in XXXX, XXXX from XXXX XXXX, and they have perpetually miscalculated my mortgage payment / escrow, which has resulted in both insurance and monthly payment issues that have significantly affected my finances. Shortly after taking over the loan from XXXX XXXX, Caliber failed to make payments to my homeowner 's insurance company ( XXXX XXXX XXXX ). XXXX sent me notifications threatening to cancel my insurance due to a lack of payment. Several phone calls to XXXX, XXXX, and Caliber revealed Caliber had an incorrect address to which payments were supposed to be sent. For the years XXXX had my loan, there was never an issue. XXXX had passed along all the appropriate addresses and information, but Caliber chose to use a different address. Aside from lost time, we had to pay a large lump sum to XXXX to have our insurance continue while Caliber figured out their issue. From XXXX to XXXX XXXX, our monthly payment remained the same as it had with XXXX. In XXXX, XXXX, Caliber notified us of a new monthly payment, which was less than what we had been paying. In XXXX, XXXX, we received notification from Caliber our escrow account had insufficient funds to make payments ; therefore, our monthly payment was increasing to cover escrow costs. This new payment was an increase of {$790.00} per month! This was a XXXX % increase in the monthly payment ... a very significant amount with huge impact to our family budget. When I called to discuss the issue, I was told the error was my problem / fault. The implication was they could not be expected to calculate an accurate payment. Any error in their calculation, they claimed, was my issue for not ensuring they, as a mortgage company, could do proper math. Their error, in fact, was completely omitting payment of homeowner 's insurance. ( ANOTHER issue with insurance ... ). I absolutely understand that a monthly payment can change due to taxes, etc., but to change by 37 % is exceptional and egregious. There must exist some reasonable expectation between the consumer and the company ( especially a mortgage company ) that basic calculations are done correctly. Their error reflects institutional incompetence ; their attitude shockingly indifferent. They admitted the mistake, but offered no solutions that held themselves accountable for it. I 've never missed a payment. I did not ask or seek the relationship I am stuck in with Caliber. As a XXXX, I can not accept their ridiculous lack of accountability. Their comedy of mistakes has and is affecting our ability to save for our children 's education and our retirement.

Complaint: I believe Georgia law has not been followed concerning a Foreclosure. I believe I am going to be victim of a Wrongful Foreclose as of XXXX/XXXX/XXXX. I dispute the lender Calibur Homes sending a current notice that specify the default, action required to cure the default, 30 days notice to cure the default and that failure to cure may result in acceleration of the sums secured by the Security Deed. The notice shall further inform me of the right to reinstate after acceleration. Caliber Home Mortgage attorney provided me today XXXX/XXXX/XXXX with a letter from XXXX/XXXX/XXXX when the loan was with Vericrest stating an amount to be paid of {$3900.00} to be paid by $ XXXX/XXXX/XXXX to cure the default may result in acceleration. A chapter XXXX was filed as they had ignored the attempts at modification that had started with XXXX, then sold to Vericrest and I had to start the modification process over again and then sold to Caliber over a one year period. Caliber ignored my attempts and cont. to harass me by stating they did not have correct documentation, which was not true, and started the acceleration process, unless I could bring the loan current. I converted to a chapter XXXX and was discharged in the fall. Caliber Homes has accepted payments since the letter from Vericrest on XXXX/XXXX/XXXX and exceeded the amount of {$3900.00}. Caliber homes never notified correctly as I believe XXXX states. I do not feel I have appropriate time allocated to pursue a potential buyer whom has interest, or to have been given an specific dollar amount that needed to be paid to reinstate my loan. Thank you

After going down to the courthouse, I learned that XXXX XXXX had a judgment on my home. The debt was paid on XXXX 2015. In XXXX 2015 Caliber received documentation that the debt was paid and there was no lien on my home. Caliber still denied the remodification due to a lien.

Complaint: I keep getting monthly statements that say the amount due is {$2000.00} every month. I modified my loan and have not missed a payment thereafter. My payments are {$360.00} per month. I call into customer service and the automated system tells me the amount due is {$360.00}. BUT I still receive monthly statements every month that say I owe {$2000.00} which is very unsettling, nerve racking, and intimidating. I am being harassed by these monthly statements that say the amount due is {$2000.00} every month. I am never able to talk to a live person because it takes so long to get through and they are only available during regular business hours.

Complaint: I recently bought a home in XXXX XXXX. My mortgage company is Caliber Home Loans. The escrow payment was {$500.00} per month ( includes taxes and insurance ) based on a {$330000.00} purchase price. Because I bought an older home, the assessed value the previous year ( XXXX ) was lower BUT my escrow payment and property tax payment was based on {$330000.00} and what I would pay in XXXX and on ( not the lower value ). A couple months ago I received a supplemental tax bill, which was n't surprising, but there was enough in my escrow account to cover it because my mortgage payment was based on a property tax bill of 1.1 % on {$330000.00}. My FIRST tax bill was based on the previous value/purchase price of the home ... the supplemental tax bill was due to the difference of the previous ( older/smaller ) tax bill, and the value of the home when I purchased it. It appears that my tax department does not know what a supplemental tax bill means ... the reps at the tax department of my mortgage company are CLUELESS, some barely speak XXXX. The supplemental tax bill was billed in installments ( first installment due in XXXX, second installment due by XXXX XXXX ). Unfortunately, my mortgage company paid the entire supplemental tax bill ( both installments ) months in advance. That brought my escrow balance down to {$500.00}, which is fine, because I 'm still paying into my escrow account and it will build back up by XXXX ( when the next tax bill is due ). HOWEVER, my mortgage company now thinks my escrow account will be short ( it 's not! ). They do n't think I am paying enough every month to cover my taxes ( I am! ) so they are requiring an extra {$160.00} per month. I know that my assessed value and homeowner 's insurance have increased about $ XXXX/month ... not {$160.00}. There is no reason to increase my payments by {$160.00}!!!!! Because my mortgage company paid my supplemental tax bill 6 months early, they are insisting that I am short when I 'm NOT. I do n't have a tax bill due until XXXX and at that point, I 'll have enough to cover it. ( I 've already paid homeowner 's insurance for the year ). The reps in the tax department do n't understand the mistake they have made and they seem unable to figure out that there is NO shortage. I do n't think they even understand how property taxes work. They keep insisting that I need to pay more money, when I do n't. If I were swimming in money, I would just pay the extra money and hope that it would get figured out down the line, maybe a year from now when they do the next " escrow analysis. '' However, I simply ca n't afford an extra $ XXXX/month, we are barely making it now. I 've spoken to three different people and they all say the same line " We pay your taxes ... you do n't want a lien, do you?, '' but there was never a danger of a lien. They make no sense whatsoever and instead of taking the time to look at my account and understand what they did, they are brushing me off like I do n't know what I 'm talking about. This is really frustrating! I ca n't get them to take 5 mins to look into the problem, if they did, this would all be over. Please help! What can I do??? I do n't want to lose my house because of their stupidity!

Complaint: I have been fighting in court now for 8 months over major and clearly illegal discrepencies in my home mortgage. The Lenders involved are XXXX and Caliber home loans, while some of my complaint happened while my loan was under XXXX, caliber is doing the exact same issues. I am going to attach evidence I am submitting to the courts tomorrow, I have been working with an attorney, but if I had not been under the protection of a chapter XXXX bankruptcy I surely would have lost my home. I can not believe that the CFPB has not stepped in at this point to do something about this account, undisputed evidence of inflated fees, flat illegal treatment of my original mortgage contract, theft of monies I paid to my mortgage that were intended to go to principal on my loan, illegal stay relief action taken on the part of caliber home loans, pyramided late fees in excess of XXXX dollars, fraudulent " home inspection fees '' over XXXX of them in my loan history, forcing of using XXXX to pay my mortgage, illegal reinstatement fees, and fees for batch filing have already been provided, if the CFPB would merely LOOK at the evidence I and XXXX has submitted they would undoubtedly find a huge number of violations of law. I will continue to submit complaints until something is done about BOTH calber and XXXX, not all homeowners are under the protection of a chapter XXXX, or have the tenacity to fight as long as I have. In my attachments you will see XXXX cleared payments through check and money order and another years worth through bank statements, NONE of these have been applied to my account, you will also see XXXX XXXX transactions three of these were not applied to my account. In the accounting that caliber and XXXX provided to the court ( attached with my notes ) you will see over XXXX instances in which an illegal action happened on my account. OVER XXXX TIMES THESE SERVICE 'S BROKE THE LAW ON MY ACCOUNT ALONE! Please do something about this. My advice to homeowners, NEVER ALLOW EITHER CALIBER HOME LOANS OR XXXX TO HOLD YOUR MORTGAGE!!!

Complaint: I was a customer of the XXXX XXXX program where they submitted payments to the mortgage company on your behalf in an effort to pay off your mortgage earlier. The program worked great until they were sued. XXXX sent me an email letting me know they had been shut down but they already had my funds and they would make my payment. XXXX never made the payment and before I realized they did n't I was reported 30 days late with Caliber Home Loans. I have tried to dispute the charge but they refuse to remove it from my credit report. They said it is my fault I used a XXXX party company. I have filed XXXX disputes with Caliber home Loans and XXXX disputes with all three credit bureaus. Caliber refuses to remove it despite my good payment history in the past.

Complaint: In XXXX of XXXX I was making payments under a modification yet I was denied by XXXX XXXX XXXX, citing that I had not mailed back the modification packet. They immediately proceeded with a foreclosure that occurred that same month. After investigating the facts they found that they had not mailed me the documents they were requesting and proceeded to rescind the foreclosure. At the same time the loan had been transferred to a new servicer, Caliber Home Loans. XXXX stayed in closed communication and in early XXXX XXXX I spoke with the trustee who said the rescission had been completed, I further verified it with the new bank as the loan had gone from the XXXX department, who was in the process of an eviction, to the reqular servicing department. I was told by XXXX that I 'd have to start the modification process all over, since the previous modification had not been fully executed. I contacted Caliber to obtain copies of the XXXX application to apply and was told what was needed and where to submit it. As I am completing the application, I receive a Notice of Trustee 's sale from Caliber with a sale date scheduled for XXXX XXXX, XXXX. They have never called me or reached out to me, I began the communications and told them I 'd send in the loan mod application. They have n't given me an opportunity to apply for the loan mod. I would like to keep my home and be reviewed for a loan modification and be offered something similar or better than what was received from XXXX.

Complaint: STATEMENT OF COMPLAINT : With this complaint, XXXX XXXX XXXX is requesting the Consumer Financial Protection Bureau bring enforcement action, both civil and criminal, against Caliber Home Loans , Inc . For purposes of this complaint, " Caliber Home Loans, Inc. '' means any principal, partner, shareholder, attorney, contract attorney, representative, agent or employee performing any service or work related to any foreclosure, past or present, connected to any mortgage loan, deed of trust or any document submitted to the Public Trustee of XXXX County relevant to the real property located at XXXX XXXX XXXX XXXX in XXXX County, Colorado. Relevant state and federal court records and documents establish that Caliber Home Loans has knowingly and intentionally engaged in coordinated debt-collection activities to collect a debt in violation of state and federal laws including, but not limited to, the Federal Fair Debt Collection Practices Act ( FDCPA ). Complaint: After suffering financial hardship due to divorce and reduced work hours, I requested my mortgage company to approve a short sale on my house. A foreclosure sale was scheduled in 14 days ( XXXX XXXX, 2016 ) but we had just received an offer for {$210000.00} that would pay off my loan with them ( Pay Off Amount is {$200000.00} ) and only leave them to pay part of the commission to the real estate agents and other closing costs. My agent sent them the purchase contract along with other documentation they requested and asked them to please postpone the foreclosure sale until they have time to thoroughly review the offer in hand and make a decision as to short sale approval. They informed my agent that since we only had 14 days until the sale and their internal process required 15 days to stop or postpone a foreclosure sale, they could not stop the sale. This is AFTER we had just told them we had an offer in hand from a qualified buyer. They still said because we only had 14 days, they probably could n't do anything. My agent told them all they had to do was pick up the phone and call the trustee and tell them to postpone the sale for 30 days and that should not take 14 days! I am furious and very confused as to why they would not just postpone this foreclosure when they know they have an offer in hand that will pay them off in full minus a XXXX dollars in closing costs. PLEASE HELP ME. I just need them to postpone the sale at this point, for 30-60 days, to give us time to get the short sale worked out.

Complaint: I fell behind on my mortgage because I had lost my job. I am employed again now. I am confident that I can make the payments on my mortgage even if my servicer rolls the past due amount into the loan and uses the current market interest rate to determine my new payment. I was in the process of a modification with XXXX XXXX when they sold my loan to Caliber Home Loans on XXXX XXXX, 2015. XXXX XXXX explained that they had not yet made a decision on my modification when they sold the loan. They said that they would forward the modification application to Caliber Home Loans. I called Caliber immediately on XX/XX/XXXX but they said that they did not have my loan yet. I called a week later and they said that I should resubmit my application. I sent in all of the documents required on XXXX/XXXX/15. I received a letter a few days later dated XXXX/XXXX/15 that they had received all of the requested documents and that my application was considered complete and that I would receive a decision within 30 days ; I did not. I can not get a straight answer from Caliber Home Loans. Sometimes when I call in they say that my application is being reviewed, sometimes they say that it was mistakenly denied and that they would re-review it and get back to me. Last week I received a " notice of intent '' to foreclose even though the XXXX/XXXX/15 letter said that they would not start foreclosure proceedings. Now I receive hang up phone calls from Caliber Home Loans every few days. I have requested to talk to a supervisor on several occasions and they inform that a supervisor will have to call me back and guarantee the return call with 24 hours ; the return call never comes. I would like to file a complaint against XXXX XXXX for not sending me a timely decision on my modification request. I would like to file a complaint against Caliber Home Loans for not sending me a timely decision on my modification request, for pursuing foreclosure while I was under review for a modification. It seems that Caliber wants to foreclose on my house and keep me in the dark to prevent me from taking action against them until it is too late. I would like to modify my mortgage or work out a repayment plan or figure out a way to stay in my house. Unless someone else gets involved I am concerned that they will continue to confuse the situation until they can take my house. I want to stay in my home. I am confident that I can make the payments if we can modify my loan.
