Complaint: I filed previous complaint number XXXX.
If I have to go through foreclosure, both XXXX XXXX and I are both losers. We both will lose a lot of money if I go through foreclosure.
Due to the fact that Caliber Home Loans did not tell me the XXXX XXXX Guidelines up front is the reason that I am in this situation. Had I known the guidelines, I would have made a different decision. I am now facing foreclosure. I had wanted a modification but Caliber did not tell me the XXXX XXXX Guidelines, The property was rental property and I had an agent ready to rent the property out. Even though it was in pre-foreclosure status, I could have caught it up by now. While waiting for a modification more months went by and I got further behind. If Caliber had just told me the XXXX XXXX guidelines I would not have even applied for the modification that took many months to get processed. Additional months went by while I applied for a modification that I was not going to get anyway. Now we both lose money -- XXXX XXXX and I.
When I filed the previous complaint, Caliber did not address my complaint but instead only sent copy of my files.
Initially all Caliber had to do was say " this is a XXXX XXXX loan and these are the guidelines ''. They could have told me the limit for the modifications. Caliber failed to disclose the XXXX XXXX guidelines when they should have known the guidelines. It was not necessary for me to go through a modification process for Caliber to know the guidelines.
Also Caliber did not adequately address Compliant # ( number XXXX ) See that complaint for additional detail. 1 ) Could your CFPB agency respond to it this directly? Could you let me know if Caliber should have given me the XXXX XXXX Guidelines up front? I do n't understand why they did n't. They knew that it was a rental property and I could have rented it out for enough to pay the mortgage. If I had known all the information, then this problem would have been solved a long time ago.
Since I will make no money on a foreclosure and no money on a short-sale either could someone send me the written guidelines showing why I have to go through a foreclosure versus a short-sale if there is a buyer. If I am not making any money on the deal either way, then what is the reasoning behind the foreclosure? Going through a foreclosure would cause me to have to go through another hardship that affects my permanent record of having a foreclosure versus a short sale ( all because in the beginning Caliber did not tell me the XXXX XXXX guidelines ). Could the law or guideline to this be sent to me in writing?
Could CFPB investigate this complaint and let me know directly whether or not you agree that Caliber should have told me the XXXX XXXX guidelines up front ( before I even submitted modification papers ). They said that I did not get a modification because of XXXX XXXX guidelines, but they did not tell me those guidelines in the beginning. They gave me the false hope that I could get a modification. Do you agree with what I am saying? Please indicate your comments.
My hardship now could have been avoided because at that time I could have got it rented and it would have paid the mortgage on the property. Now we are both losers -- XXXX XXXX and I. Could CFPB address this and tell me directly whether or not Caliber was in violation? Your response shall be greatly appreciated.

Complaint: Our mortgage was sold to Caliber Home Loans from XXXX. We were to begin making payments to Caliber. We authorized our first payment to Caliber to later find out that Caliber turned the payment over to XXXX to cover a past due payment. I called and questioned why the payment did not get credited to the account number and company that I authorized it to go to and was told that Caliber. After questioning serval for phone agents I did not recieve satification in their responses. Since the payment would not be credited to the account I began to apply for a modification because we would now be behind with Caliber. After submitting modification paper work I was told that I need a profit loss statement because I received a XXXXmisc at the end of the tax year. I explained that I did not have a company and worked as a testing administrator as needed. I was told to find one online and fill it out. I found a generic form and filled it out averaging the total for the year in 2 statements and submitted the forms. Still upset that the payment did not get credited as authorized I was then told that I need to resubmit forms with my signature.

Complaint: We have been struggling with Caliber Home Loans since XXXX XXXX to correcting errors in our account. Prior to XXXX XXXX, XXXX our loan servicer was XXXX. They made numerous mistakes during the period of XXXX XXXX to XXXX XXXX, XXXX. During this time period we were not only current but paid through XXXX with {$500.00} in our account for XXXX 's payment. Caliber told us that our account was behind. It took quite awhile for Caliber to research it and then we were told that XXXX had made some mistakes. We struggled with XXXX to get our records to pinpoint where the problem was located in our account.
XXXX repeatedly told us that we needed to work with Caliber because they were the servicer. In a letter dated XXXX XXXX, XXXX, from XXXX XXXX, Vice President, Customer Service, Caliber Home Loans, she states : " Furthermore your allegations are regarding the previous servicer and not Caliber. Please be advised Caliber is unable to confirm any actions or provide any answers in regards to the previous servicer as we are not affiliated with them. In order to have these concerns adequately addressed, you should contact your prior servicer directly. '' The previous servicer ( XXXX ) is refusing to address the issue. Today I spoke with XXXX XXXX at XXXX and she informed me that they had an agreement with you to resolve any issues or complaints or misappropriation of our funds. So I spoke with XXXX ( XXXX ) at Caliber who immediately realized that the problem needed to be addressed by a manager. After waiting for quite some time XXXX ( XXXX ) took my call. She was not especially helpful. She said there is an open complaint and it would take an additional 30 days to " research ''. I let her know that this is unacceptable because we have been waiting for a response since XXXX XXXX that will resolve our issues. She balked at sending us copies of our monthly statements and financial payment history. I requested the records because Caliber has assessed fees and late charges that she says do not exist but I see them on the copies of the statements that I have. She also refused to do a follow up phone call or email to keep us updated on how the research is progressing. She said that Caliber is unable to speak by phone between the research department and customer service. Customer service is also not allowed to phone customers or email them. This does n't seem like customer service to me. XXXX is telling us that we have a single point of contact at Caliber when this XXXX XXXX has never spoken to us nor returned our calls.

Complaint: My loan was originally with XXXX XXXX Bank, I have submitted modification applications with XXXX a few times and have always submitted the paperwork they have asked me for. XXXX held on to my paperwork without any action, so I assume they knew they were selling my loan to another bank. I have done financials over the phone with Caliber Home Loans since they have assumed my loan from XXXX, I have also faxed over to them financials and have asked what information they need from me. I spoke with a Supervisor from Caliber XXXX XXXX and explained my hardship to him and another agent. I was involved in a serious Bus accident that left me XXXX XXXX which has led me to have a XXXX hardship. In XXXX I spoke with a female representative at Caliber Home Loans that was extremely rude to me and did not explain things properly to me after I asked many questions regarding my rights and options to save my home. At that time I asked for the supervisor I mentioned. I forwarded my SSI reward letter to Caliber and the other documents they sent me in their packet. At the same time I contacted the HARDEST HIT FUND who was also assisting me with trying to obtain a modification to save my save. I have suffered through XXXX XXXX in the past 2 years and can barely get around at this point especially when I 'm trying to heal. I have explained my situation to Caliber after they sent me a letter that came to my home around XXXX XXXX, XXXX. They letter stated that I should go online and see what documents I needed to give them. When I tried to go online that night, it said that I had no access. I called the hard hit program ran by XXXX to see what I should do because I 've submitted all of my documents to them including my wife 's Profit and Loss statement. I have explained this to Caliber XXXX XXXX, XXXX and they told me that it was too late because they need 15 days to review documents. I explained to them that I am XXXX at the moment because of my XXXX being just several months ago and that I would be able to fax what they needed right then and there and they were not willing to work with me. I also went to XXXX County Court to try and get a Sheriff sale stay and when the judge called the Attorney for the bank, the bank said they were not willing to work with me. I have suffered major hardships over the years and I was just asking for assistance now that my wife is helping me pay the bills and mortgage. My home went on sale XXXX XXXX, XXXX, no one purchased the house according to the Sheriffs office when I called today. The property has went back to the bank. Myself and the company helping me contacted the bank today to see if there was a way that I can continue with trying to get a Modification and the representative from the bank said no. I need help to please try to overturn the sale date that just happened yesterday XXXX XXXX, XXXX and only want to exercise my rights as a XXXX man with a family who 's only trying to get back on track. If I lose my home, I will have no place to go. I feel that the representatives at Caliber were not being helpful as I kept receiving different information from different representatives. I also do n't understand how and why when I sent applications for Modifications even before Caliber purchased my loan got totally ignored. I have also applied with Caliber XX/XX/XXXX and still received no help. I am able to pay a reasonable mortgage payment at this time. I have left my phone number with them and asked for the rep to contact me if I was missing something and I have n't heard from them so I assumed that everything was ok and my paperwork was being processed. Complaint: i applied for a loan modification with XXXX XXXX under the making home affordable program, in fact my loan was in process for that program until the servicing was change to CALIBER HOME LOANS once they took over every thing change instead of loan modification staying within the Hamp program they took upon themselves to put it into a forbearance agreement and offer me a higher interest rate and payment that is {$1300.00} a month higher then my orginally loan payment, so i rejected it and appeal it because it is not making my loan more affordable this loan modification is designed for me to fail, it is not helping me it`s hurting me i want to keep my home not lose it, XXXX never had a problem with my request for the Hamp program so why is caliber trying to put me in a bad deal, and as of today I got a notice of sale on my home while i am still trying to modify my loan, i have a job and income to pay a mortgage payment again under the HAMP PROGRAM GUIDELINES not a payment that almost doubles what i had before

Complaint: I have a mortgage that was sold to Caliber Home Loans last fall. I pay into an escrow account to cover property taxes and insurance. In XXXX XXXX I sent Caliber a copy of a property tax bill that I received from XXXX XXXX, VA, as instructed by Caliber. In XXXX of XXXX I received a delinquent notice from XXXX XXXX. I called the Tax Department at Caliber, giving them the pertinent information and was promised that the bill would be paid. On XXXX XXXX I received a second delinquent notice from XXXX XXXX, with penalties added to the amount owed. I called Caliber on XXXX XXXX and again was promised that the bill would be paid, but remain skeptical. As of today, I have an escrow account balance of {$3500.00} and the tax bill is for {$1900.00}.

Complaint: I have made at least three requests for modification of my mortgage with Caliber Home Loans, all of which have been denied. They have not provided sufficient reason for the denial and three appeal letters have always resulted in a denial. I am concerned about the practices of Caliber Home Loans and their possible discrimination against certain type homeowners. They appear to want to appeal to all homeowners and say that offer help for distressed mortgages etc, but they have made no effort to assist us as evidenced by all the denial of modification requests. They only have been servicing our mortgage since XX/XX/XXXX and since this time have been not been helpful in ensuring we can remain in our home.

Complaint: A credit information consolidator, acting on behalf of my mortgage company, made a number of improper " hard '' credit inquiries in 2016 resulting in subsequent adverse credit decisions including denial of credit or higher interest rates. XXXX inquiry was specifically not approved and during the application process multiple inquiries were made within a 30-day period. I authorized 1 inquiry. I contacted the reporting credit bureaus who referred me to the credit information consolidator. The credit information consolidator refused to remove the unauthorized inquiries because they were acting on behalf of the mortgage lender. I contacted the mortgage lender and they now refuse to remove the credit inquires. I do not dispute that I applied for the loan and authorized a credit inquiry. The dispute is about the number and timing of the other unauthorized inquiries.

Complaint: I was on XXXX and applied for a loan modification XX/XX/XXXX/XX/XX/XXXX to get the payments of 3 months attached to the back of the loan. The company would take 5-7 days to process any documents that were uploaded and then send out a letter taking another XXXX days asking for more documentations. I called several times asking for a list of everything they needed so that I could get it all done at once. It is now XX/XX/XXXX and the company is still asking for more documents. on XXXX/XXXX/XXXX Caliber stated the last thing Underwriting needed was an updated XXXX which was completed and uploaded on XXXX/XXXX/XXXX because it took them until XXXX/XXXX/XXXX to process it Caliber is now needing more documents and an application because as of XXXX/XXXX/XXXX the file was 90 past initial start. I have documents of over XXXX pages of uploaded documents they have asked for. I was also approved for XXXX california but because of my past due amount Caliber refused to approve keep your home california which would have given us assistance for up to 18 months.

Complaint: My husband qualified for homestead exemption, and we have tried since XXXX to get Caliber home loans to readjust our mortgage payment. Nothing has happened. Trying to reach these people is horrible. You have to know ahead of time which division you need before calling. Their phone system is confusing and getting to a real person is time consuming. We have spent hours trying to talk to someone. We are paying {$380.00} more than required. Also, my husband likes to send extra money but they wo n't apply it to the mortgage unless it is a full payment.

Complaint: First, the Buyer needed a POA for his wife. We sent it to Calibur Home Loans for them to approve and complete with whatever requirements they have for a POA and make sure the names where what they were going to require. We sent a XXXX XXXX to the wife in Colorado at a cost of {$170.00}, we received it back Wednesday and now XXXX is saying it does not meet their Criteria. This loan should have closed at the end of XXXX, they are still not ready to close it ; however, they are going to lower the interest rate by XXXX today and say they do not have to Re-Disclose for that and that the wife is now going to have to sign in Colorado and that is another {$170.00} cost to the Borrower. We still do not have any documentation from them at all.
We also have another closing set with them for XXXX and the Buyer just got here we have no docs for that closing either, because they need to raise the Seller Concessions by {$1600.00} and that just came up today.
I do not understand how Lender 's especially Calibur is Disclosing and the people are not even approved for the Loan and we do not get the documents in time for their set Closing Time.
I thought the whole point of all the new CFPB Guidelines was to eliminate that kind of stress from Borrowers.
It has not accomplished XXXX thing for most borrower 's with this Lender especially.
This seems to be the normal way they do business.

Complaint: On XXXX/XXXX/XXXX, I received a modification of my mortgage from XXXX Mortgage based on a medical hardship. I was approved for a loan modification under the Home Affordable Modification Program. New trial payment was to be {$810.00}. The first payment under this modification plan was due on XXXX/XXXX/XXXX. On XXXX/XXXX/XXXX, the loan was transferred from XXXX to Vericrest Financial. On XXXX/XXXX/XXXX I received notification from XXXX that the loan was transferred to Vericrest Financial and that all my payments should be made directly to them.
On XXXX/XXXX/XXXX, I attempted to make my first to make my first ( 1st ) trial payment & I was told Vericrest Financial had no record of my modification or new payment from XXXX. I was advised that not all files have been updated into the Vericrest Financial computer system and was advised to fax over my approval letter. I faxed the approval letter on XXXX/XXXX/XXXX to the attention of XXXX or XXXX, Modification Department. Fax number XXXX and XXXX XXXX/XXXX/XXXX I tried to make not only the 1st trial payment but I tried to make the 2nd trial payment and was told again, that there was, no record of modification from XXXX. My payments were denied and returned. Unfortunately, in XXXX.
XXXX I was told by XXXX ( ID XXXX ) that I needed to resubmit a whole new modification packet to Caliber Home Loans. After numerous packets faxed, mailed and /or uploaded to Caliber Home Loans website and months go by, I received a modification in XXXX, XXXX. Because accrual of late fees, interest and expenses, the amount of the modification was well above what I was offered by XXXX prior to XXXX transfer of my loan to Caliber. I made all XXXX of this new payment and continued until it was impossible to continue with this high payment. Because of my medical condition and hoping for a different outcome, I once again started a modification packet before I fall too far behind in payments. I contacted Caliber immediately in an attempt to explain the situation and once again attempt a modification. I have again done everything Caliber has asked and again. I have submitted package after package to Caliber and have been told on numerous occasions that they need more information because of their inability to review the package timely. They continue to ask for updated information that would have been current if they reviewed the package when it is submitted. However, because of their lack of review when the package is received, the documents become stale & a whole new package needs to be submitted. It is extremely frustrating & there is no XXXX single person that is willing to assist.
Caliber eventually began foreclosure proceedings and I requested mediation.
After hearing the story and showing the correspondence regarding the prior modification approval from XXXX and then the unwillingness of Caliber to honor that modification amount, the Administrative Law Judge continued the mediation and the foreclosure stay was not lifted. I was given the opportunity to submit a complete package & come back to mediation to discuss it again. I did everything timely & a complete package was submitted. We again went to mediation and we were told at mediation, by a representative from Caliber, that the package was complete and that it would be reviewed by an underwriter. This was confirmed by the attorney for Caliber both before and after mediation. After the mediation was closed, a few days later I was advised again by Caliber that they did n't have all my paperwork and that I had to submit new paperwork. Caliber continued to give me the run around from when they began servicing my loan, the fees, interest and late charges have accrued to such a large amount that the debt has reached a staggering level. I have been attempting to work with Caliber on this for two years.
