Complaint: XX/XX/XXXX, I lost my husband to XXXX. Until that time, we had XXXX incomes and decided we wanted to buy a home, both of us in our XXXX 's, decided it was time and coming into the age of retirement. I worked for XXXX for 15 yrs. and my husband worked as a XXXX. In the course of my job, I got injured on the job, and had XXXX XXXX, which left me declared XXXX my Social Security and my XXXX, who represented the courts. My job was unable to accommodate me anymore, and was forced into an early retirement. My husband passed in XXXX XXXX, and we had discussed that we wanted to live and retire where I currently livig now.
I contacted XXXX XXXX XXXX XXXX and applied for a loan. I had been visiting the area where I currently lived for 6 months on weekends looking at homes. My realtor let me know of this XXXX home that I might be interested in, and I came out and viewed it, loved it and proceeded with the financing application, in which I got from XXXX XXXX.
The deal went through, I got my home and was thrilled. This home is in a rural area and was not aware of the costs that exsist with rural living, being I lived in a big city all my life. The expenses were high, propane, fire insurance, yard cut backs for fire prevention, firewood, certain moduels had to purchase to be able to get phone service etc.
Being on a fixed income, these depleated my income quickly, but I found certain programs that would help me, being XXXX and a XXXX, to cut back my electric bill and water, and go to the dump to dispose of garbage instead of garbage service.
A couple of months later, XXXX XXXX, sent me a letter stating that my loan had been sent to another Lending company, Caliber Home Loans , Inc., and that they would be my new lending company and my payments should be sent to them instead. They gave me all the information, and where to send payments.
The first 2-4 months were fine, being it was XX/XX/XXXX and none of the other expenditures had come into affect yet. After the first year and the other expenditures came into affect, is when I found myself with little to no money at times. At this point, Caliber knew of my income status and bought my loan.
Around about XXXX XXXX, I contacted Caliber Home Loans, and asked for a modification, to try and reduce my mortgage payments to something a bit more workable. They gave me the information I needed to apply for a modification and I proceeded to provided them with what they needed to make a determination of my request. They kept in contact with me, asking e for more documents and I would fax them to them. A few weeks passed, and they would be requesting those same documents over and over again. Sent them banks statements, letters from my retirement plan, which is a lifetime benefit that states that on the letter, social security benefits letters, which is a lifetime benefit, hardship letters, budget assessment etc. We have gone back and forth with these same requests for over a year. Finally, got a letter of denial and foreclosuer notices, commencing in XXXX XXXX to current date of XXXX XXXX, which just received another notice of postponment to XXXX XXXX.
I have talked with attorneys and have been told that they have proceeded with my foreclosure in an unlawful way. I ca n't afford an attorney to help me with this matter, so Im trying to get some assistance to save my home..I do n't want to loose it, its all I have. If they could just lower my mortgage payment by {$300.00}, we both could be happy ... they get money and I could keep my home. Please assist me in any way you can ... need help and quickly.

Complaint: I chose Caliber Home Loans as my lender to buy a condo. I had 53 days before I closed on the condo. The seller chose a long closing because she had not found a place to move at that point. Although I had 53 days before closing, in order to make my offer attractive I did a 21 day financing contingency. Caliber was well aware of my 21 day financing contingency and ensured me it would not be a problem. I followed up with my loan officer everyday to make sure everything was going smoothly. She ensured me that everything was fine and we would be able to close on time. Not once during this process was there any issue or alarming matter or any kind. The appraisal was completed and came back clean at the offer price. I checked in with her to make sure that everything was in line and that there were no issues especially close to the end of my financing contingency. She again ensured me my loan was good to go and there were going to be no issues. I received a very alarming call from the loan processor, asking for my credit card information to pay for the HOA questionnaire and budget that had to be obtained online. Since there had been no mention of this previously, I assumed this process had been done a month earlier during the appraisal and financing contingency. Any lender who does their due diligence knows that when purchasing a condo, that is the first thing to look into. Caliber proceeds to tell me less than 24 hours before we were supposed to close that there is a huge HOA issue and that I would not be able to obtain a loan. The contract had to be terminated the day we were supposed to close and I lost all of my earnest money. If Caliber had not been so negligent in processing my loan and had worked in a timely manner, the contract would still have been terminated but I would have received my large amount of earnest money back, and not have been out of a place to live.

Complaint: I fell behind on my mortgage payments due to illness, I started working with a housing counselor in XXXX 2015. She submitted a a completed workable solution packet to them. Maybe a month or two later, I received a call from my lender requesting I send in more papers. I did that. We have been to court here in XXXX.
eight times and only to be told they need more papers. I have done what they asked me over and over again. The housing couselor also sent them what papers they asked for. I only want to start making payments to save my home.

Complaint: My husband was approved through our XXXX to be exempt from property taxes here in XXXX XXXX XXXX Va as he is a XXXX veteran. The problem is that Caliber home loans is continuing to take out the taxes, and will not adjust our loan to reflect the exempt status. I have called several time and each time they advise they will " open a new inquiry '' through their tax research dept. I am then advised to call back in a week because they are an inbound call center only. When I call back I enter the same loop again. I talk with someone who has no clue, am told they will open another inquiry, and I have requested to talk with a supervisor but am always denied.

Complaint: Caliber offered a permanent modification, it was signed, notarized and sent back on XXXX XXXX, 2016. On or about XXXX XXXX, 2016 the payment was increased by about {$150.00}. When Caliber was questioned about this on XXXX XXXX, 2016, the customer service representative said it was because of an escrow shortage. They also said that an analysis was done in early XXXX, so the analysis was requested and the rep said she would not send it out. She finally relented and said it would be sent out, but to this day the analysis has not been received. It was questioned as to why the shortage was not included in the monthly payment or the balloon payment, the final mod was offered XXXX XXXX, 2016, but when that question was posed, the rep abruptly ended the phone call. Now the payment has been decreased to the original modification monthly payment.

Complaint: I issued a complaint against XXXX XXXX about the title transfer of my mortgage and not being informed of a foreclosure. XXXX has contacted me and stated they can remove the foreclosure from my records with proof of improper title transfer and supporting court cases. These have been sent to XXXX. My loan was sold from XXXX to Caliber Home Loans when they never legally had the title to actually transfer. This is to inform Caliber Home Loans of the incorrect foreclosure they have on record on my name.
Here is what was relayed to XXXX Bank as to the issue : The title of my loan was not transferred from XXXX XXXX to XXXX until XXXX XXXX, XXXX, which is attached to this fax from XXXX County Clerk. I also have all other amendments that were filed with the court, NOT INCLUDING foreclosure proceedings. This is when foreclosure proceedings supposedly began against me but I was never given written notice of this.
According to multiple court cases, the title transfer was incorrectly done and should not have been transferred in XXXX when foreclosure proceedings began without my knowledge. XXXX XXXX did not have proper rights to the title of my loan. It was not assigned to XXXX XXXX according to the trust agreement. This gives plausible inference that the assignment was improper. I am not looking to get my home back or for any financial reimbursement. I just want to get the foreclosure removed from my name.
After much research, there are a tremendous amount of court cases that state this exact thing happened to them and were rewarded for their damages. You could also refer to a website called XXXX, which directly addresses issues with XXXX XXXX and XXXX deceiving homeowners during the time I was foreclosed upon.
Four years after pledging to clean up wide-ranging foreclosure abuses, XXXX XXXX, XXXX XXXX, XXXX XXXX and XXXX other banks still are n't complying with consent orders imposed by a federal regulator, reported the XXXX XXXX XXXX ( XXXX XXXX, XXXX ). As a result, the Office of the Comptroller of the Currency has restricted mortgage servicing operations at XXXX XXXX, XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX XXXX and XXXX XXXX.
Banking regulators obtained the consent orders in XXXX in response to scandals involving the robo-signing of foreclosure documents by token officials without knowledge of the facts, lost paperwork, illegal fees, and other legal shortcuts that became common after the mortgage meltdown.

Complaint: To Whom It May Concern, This letter is to inform of misconduct and poor business practice on the part of our mortgage company, Caliber Home Loans.
Three years ago, new to the area, we chose Caliber as our mortgage company on the advice of our realtor. At the time they had an office locally where we could have any questions resolved without incident. Our checks were due on the first of the month but not considered late until the XXXX of the month. In XXXX 2016, we received word that Caliber Home Loans was incorporated and we were to hence forth send our checks to XXXX Texas. The local office was closed.
On XXXX, XXXX 2016, I received a call from a representative of Caliber stating my check had not arrived.
While on the phone line I reviewed my internet checking and discovered the check had indeed arrived at the post office in XXXX on XX/XX/XXXX.
The man assured me they had not received it and ask me to stop payment on the check and wire their payment.
I drove straight to XXXX XXXX XXXX XXXX XXXX ( FCU ) and requested a stop payment on my check.
While in line at the FCU to wire the funds I checked my Caliber account on my phone and lo and behold the check had been received.
I immediately returned to the bank officer and cancelled the stop payment and returned home and called Caliber to inquire about the payment. They confirmed receiving the check.
Two days later Caliber called back and stated they had not received my check.
I explained in detail what had occurred and they at first suggested the check had insufficient funds and then after heated discussion suggested the check was a " stop payment. '' I contacted my XXXX and they assured me no one had ever attempted to deposit my check.
I again contacted Caliber demanding to speak to a manager and expressed concerns about the company 's accounting practices endangering our credit rating.
She was very rude, offering to email me a link to XXXX. I suggested that perhaps she needed the credit counseling.
She finally informed me that even though they had never submitted the check for payment it had ( inadvertently I assume ) been stamped " stop payment '' and they would require another check and assured me my original check would be returned to me ( it never was ).
She also assured me the incident would not be reflected on our credit.
I complied and sent another check for my XX/XX/XXXX payment and the next day sent our XX/XX/XXXX payment early to avoid repeat confusion.
Last week we received word from a credit agency that our credit rating ( both in the XXXX 's ) was compromised by a complaint from Caliber Home Loans.
I urge you to investigate Caliber 's business practice and chastise them for their wanton disregard of their customers and insist on having our credit rating restored to its former state.

Complaint: I got my last mortgage statement, with a significant increase in payment, from XXXX to XXXX. When I tried to inquire about this issue with Caliber Home Loan, which requires your loan number, all forms of communications, voice, on-line, do not recognize the account number, XXXX, on my mortgage statement. When I try and e-mail XXXXXXXXXXXX, found on my mortgage statement, there server refuses the e-mail.
I seems to be no alternative other then mail, to contact this firm.

Since we travel extensively, I returned to the condo on XXXX XXXX and found several delinquency notices presumably to me from a company called XXXX. They bore an incorrect middle initial. Complaint: Caliber Home Loans, Inc. assumed the servicing of our mortgage from XXXX XXXX on XXXX XXXX, XXXX. We had our Chapter XXXX bankruptcy discharged by Judge XXXX XXXX XXXX of the XXXX District of New York, United States Bankruptcy Court on XXXX XXXX, XXXX ( Case No. XXXX ). An order of Final Decree was issued on XXXX XXXX, XXXX. In a letter dated XXXX XXXX, XXXX, XXXX XXXX XXXX, attorney for XXXX states, " I have confirmed with XXXX that its pre-Petition arrears claim was paid in full, and that the debtors are up to date with respect to remittance of their post-Petition mortgage payments. '' This letter was addressed to XXXX XXXX XXXX, XXXX, XXXX XXXX Bankruptcy Trustee regarding the Notice of Final Cure Payment and Completion of Plan Payments.
From XXXX XXXX, XXXX to XXXX XXXX, XXXX both XXXX and Caliber hid from us an agreement they had, that placed responsibility for errors in our home mortgage account with Caliber including the time period that XXXX was the servicer of our mortgage. During the period up to XXXX XXXX, each company 's representatives would say that the other company needed to be contacted to correct the errors. Finally on XXXX XXXX, XXXX in a phone conversation with XXXX XXXX ( XXXX ) of XXXX was the agreement revealed to me. When I stated that I had a letter from XXXX XXXX, Vice President, Customer Service dated XXXX XXXX, XXXX that in order to have our concerns adequately addressed, we should contact our prior servicer directly. XXXX requested that I send her the letter and she would contact someone at Caliber to take care of the matter. I also told her that we had a similar letter from XXXX XXXX, Asst. Vice President, Customer Support and Escalations dated XXXX XXXX, XXXX.
Next we received a letter dated XXXX XXXX, XXXX from XXXX XXXX, Vice-President Customer Disputes of XXXX in which she states, " In addition, we have been advised by Caliber that XXXX XXXX 's single point of contact is XXXX XXXX, who can be reached at XXXX. '' We never received this information from Caliber. XXXX XXXX was named as our single point of contact in XXXX XXXX but he never completed any work on our behalf to resolve our issues.
We did call XXXX XXXX, Vice President of Single Point of Contact and he confirmed that there was an agreement in place with XXXX to take responsibility for their mistakes. However even after he contacted XXXX XXXX directly and reminded her of the agreement she has repeatedly sent us letters - XXXX in one week - in which she tells us to contact our prior servicer directly to resolve the issues. XXXX XXXX is attempting to address some of our concerns and has made some progress but it has been very slow. He is working to get some of our money returned to us that was improperly received and recorded.
There is a concerted effort by Caliber Home Loans to hide the agreement to take responsibility for the errors in our account most specifically by XXXX XXXX, Asst. Vice President, Customer Support and Escalations. The entire company has tried to confound and confuse us and discourage us from seeking relief. XXXX has agreed that there are serious communication problems within the company and with customers.
