Complaint: I received a delinquent tax bill for an extra parcel of land that was included on our mortgage. It was supposed to be escrowed out of our payment, however it was not. I notified my mortgage company Caliber Home Loans of this in XXXX XXXX and a research request was submitted. I called back in XXXX XXXX after receiving yet another delinquent tax bill. They informed me the research request was still pending from XX/XX/XXXX. I have called back again on XXXX/XXXX/XXXX and today XXXX/XXXX/XXXX and still no action has been taken, according to the representatives with whom I have spoken. I have faxed in 3 Qualified Written Requests with no response from their company. Meanwhile, my delinquent tax bill is accruing more late fees. This is a direct violation of RESPA, as my account is not being escrowed properly and I have notified them on XXXX occasions that this needs to be remedied.

Complaint: I have had an ongoing issue regarding my mortgage which ended up with Caliber, prior to which it was with multiple other services.
For some reason, over the years, I find that forced property and flood insurance ends up on my account. This has happened not only with Caliber but servicers prior to Caliber, even though my property is not in a flood zone.
Forced placed insurance was recently put on by Caliber in early 2015, after which I called them and told them about the problem. They admitted their error and insisted that the loan had to be " modified '' in order for the forced place insurance to be removed. Even though I volunteered to make my monthly payments as usual, the rep told me that during the modification, I am not to make any payments and that I would be contacted once the modification had been completed to alert me payments were due.
I was sent statements and began to make payments when my loan was modified after XXXX 2015. However, on recently checking my credit report I found that Caliber has marked me 90 days late from XXXX 2015 on my credit report. I have brought this issue up with Caliber recently, unfortunately their loan modification department replied that they had accurately reported the account as late on my credit report.

Complaint: I have received an incorrect XXXX for XXXX from Caliber Home Loans. The property was purchased on XXXX/XXXX/XXXX for {$56000.00}, paid on for 11 years and sold at a short sale for {$20000.00} on XXXX/XXXX/XXXX. I have authorized my partner to talk to Caliber in trying to resolve this issue to no avail. This has been going on since XXXX/XXXX/XXXX and here it is XXXX/XXXX/XXXX. We have called at least 3 times but have been given the run-around by employees and supervisors. We have talked to Customer Service and Short Sale Department, but no one was willing to listen and re-send a corrected XXXX. We asked Customer Service to send us an itemization of how they came up with the {$100000.00}. We finally received the information requested a month later and quickly discovered the error made by Caliber. The amount written off on XXXX/XXXX/XXXX was {$52000.00}, and it was also written off on XXXX/XXXX/XXXX in the amount of {$53000.00}. Then, the XXXX were added together to total {$100000.00} which is supposedly the amount of debt canceled by Caliber. When I explained this to Customer Service who then explained to her supervisor, the response was they did not write the loan off twice and that the $ XXXX was fees and actually hung up on me. This is totally bogus and should be corrected immediately so we can file our XXXX income tax return. I have attached a copy of this itemization and underlined the errors along with XXXX XXXX.
I will not be able to testify at a hearing because I am the XXXX for my wife who was XXXX and would not be able to travel to XXXX, TX.
I would like Caliber Home Loans to overnight a corrected XXXX for XXXX.
I can not file XXXX income tax return until this is settled. I would like Caliber to over night the corrected XXXX.

Complaint: I am not receiving mortgage statements from my mortgage company even though I have brought this to their attention two times once I realized it. This has caused me to miss 2 payments because I do not keep up with bills unless they are mailed to me or I have them set up for automatic withdraw. There is a reason for statements being sent to home buyers or they would never be sent to anyone. I recently noticed that I have not been receiving a mortgage statement since the last one I received for XX/XX/XXXX. This is the same month that the contractor that I hired to do my fire damage repairs on my home from a fire on XX/XX/XXXX, decided to put a lien on my home and sue myself and my mortgage company because I refused to release the rest of my insurance money for the fire repairs because he said he was XXXX % completed and wanted the rest of his money. I refused because I new there was no way he was XXXX % completed. He then told me he had an inspection result from the latest insurance inspector that proved it. When I refused he cussed me out and called me names. Let 's back up a little ... ... so much has happened with this problem, sometimes I forget certain details. When I first met with the contractor at my home, he looked around and said that all my furniture would be fine, he would just have his workers move it all from room to room as the work was being completed. The next day the workers started removing sheet rock and ceilings and dropped all the blown in insulation on everything I owned. I did not push the issue about my ruined furniture because I was living in a camper at the time and I just wanted the job done. Little did I know this was only the beginning of my troubles. When the insulation fell on everything it fell on a portable air conditioner that I needed to use in the camper and on a window unit. I never could get the portable air conditioner to work correctly again since it was full of insulation beyond the filter. The window unit was still being used by a worker and eventually I threw it out. I had to purchase a window unit for the camper because it was over XXXX degrees outside and I had XXXX small dogs living in the camper with me. All this was very inconvenient. When the contractor cussed me out and called me names I told him not to step foot on my property again. He then put a lien on my home in the wrong county, then he put it on my home in the correct county. He showed up at my place of business and tried to scare me by standing behind me quietly just smiling while I was counting the money in my cash register. I felt like someone was behind me, I turned around and was surprised by it being him, he began to try and hand me a paper while he was trying to take a picture of him handing me this paper. I called the police and they suggested I get a No Contact Order on him. The paper ended up being the lien on my home in the correct county. Then I get served a sopeino that myself and my mortgage company are being sued by this contractor. I was served this at my place of business in front of all of my customers. I contacted the mortgage company to tell them this. I sent them back the insurance check for the repairs that the contractor was trying to make me sign over to him. I told them I was being sued but the papers also said the mortgage company was also being sued. The mortgage company would not release anymore money until I either got the contractor to agree to completing the job as contracted or he agreed he was paid in full. This did n't happen so between that and the fact that I can not have anyone else do repairs until the lawsuit is over, my home still has at least XXXX % of fire/smoke damage to this day. I found out that the insurance company that works for the mortgage company had sent an inspector out and he gave the contractor a XXXX % complete inspection based on what the contractor told him. It was a lie

Complaint: I have been working with Caliber Home Loans on a mortgage modification. I had requested a fixed rate mortgage but they gave me an adjustable rate mortgage. I think that their practices are predatory. I want a fixed rate mortgage. They also did not give me enough time to examine the mortgage modification paperwork. I received the paperwork Friday, XXXX XXXX and they required that the documents were received back by them by Wednesday, XXXX XXXX. I had wanted to appeal the modification to get a fixed rate and a more affordable payment but they purposefully did not give me enough time to review the paperwork or to have an attorney review the paperwork. When I called them requesting more time they denied my request and told me that it was " take it or leave it ''. I believe that this is is another one of Caliber Home Loan 's predatory lending practices.

Complaint: My mortgage company sent me a modification offer which I signed and accepted. My total monthly mortgage payment is supposed to be {$1600.00}. Caliber Home Loans just called me and told me that my total mortgage payment due is {$2300.00}. I asked why it was that much and they explained that they had forgot to add fees to mortgage modification so {$2300.00} is the amount due ; this can not be legal. Caliber Home Loans needs to waive any fees that they " forgot '' to add to our executed mortgage modification agreement. Caliber Home Loans took more than 90 days to approve my modification so they had plenty of time to check their work to make sure that they were offering me the right modification. I should not have to pay for Caliber Home Loans mistakes or for fees that I did not agree to and that were not part of our agreement.

Complaint: We received a letter dated XXXX XXXX, XXXX from XXXX XXXX XXXX that we met the criteria of applying for loan modification under DOJ National Mortgage Home Settlement as a result of a lawsuit filed against XXXX XXXX XXXX ( pls see exhibit A ). XXXX reaches comprehensive settlement with U.S. Dept. of Justice & State Attorneys General to resolve mortgage-related litigations & investigations. The settlement includes on the securitization, origination, sale & other specified conduct relating residential mortgage backed securities ( RMBS ) ( pls. see attached-Exhibit B ). In the SETTLEMENT, BORROWER RELIEF WILL BE IN THE FORM OF MORTGAGE MODIFICATIONS, INCLUDING FIRST-LIEN PRINCIPAL & FORBEARANCE FORGIVENESS & the CONSUMER RELIEF WILL BE SUBJECT TO OVERSIGHT BY AN INDEPENDENT MONITOR.
And so we submitted a completed loan package to XXXX on XXXX XXXX, XXXX under the Dept of Justice National Home Mortgage Settlement review ( pls see detailed DIARY LOG ). But on XXXX XXXX, XXXX, we received a call from XXXX that our loan has been transferred to Caliber Home Loan. On XXXX XXXX, XXXX, we received via fedex a letter of approval of home modification from XXXX. The trial payment was higher than before and the income used was grossly miscalculated. From XXXX XXXX, I have tried to called XXXX but I could not hold of my CRM. And finally on XXXX XXXX, XXXX, I was able to get hold of rep from XXXX, but she has told me that I should write an appeal to Caliber Home Loan, since loan has been transferred to them. I told XXXX rep XXXX that in XXXX website, if the clients are part of DOJ National Mortgage settlement, and even if the account is transferred, XXXX should assist. She said that she 's not aware of that. And the next day that note from XXXX FQA disappeared.
And so the nightmare begins with Caliber Home Loan on XXXX XXXX, XXXX. Again, please see attached DIARY LOG. Caliber home loan representatives have given me the run around. I have to re-fax all the documentations over and over again for 3 months until XXXX XXXX, XXXX until my loan modification was denied due to incomplete documentations WHICH IS NOT TRUE. I have complied to every request and re-fax necessary documentations. Caliber HL responded that they have sent me letter of missing documents IN WHICH I DID NOT RECEIVE. I ALWAYS CALLED CALIBER HOME LOAN WHAT DOCUMENTATIONS ARE MISSING AND RE-FAX THE NECESSARY DOCUMENTATIONS. IT TOOK 3 MONTHS BEFORE THEY SAID it 's denied.
On XXXX XXXX, XXXX, we were reviewed again for in-house mod, and Caliber HL denied the modification due to house has equity. I submitted a letter of appeal and while on appeal, Caliber Home Loans filed an NOD which is a clear violation of CA Bill of Homeowners ' right. We re-applied another loan mod & submitted everything on XXXX XXXX. When I called on XXXX, per XXXX ID # XXXX, they received all XXXX pages. They received everything in 1 day when in the past it took 3 months before they finally said they had everything. Something was not right. True enough, we got denied again, and incomes were wrong. When I told the rep that they were wrong, he said it does not matter, for incomes are irrelevant, for we are going to be denied anyways due to the fact that house has an equity already. This is truly an UNFAIR LABOR PRACTICE of CALIBER HOME LOANS. They are to foreclose the property just because there 's already an equity of the house. We have been trying to get mod with XXXX since XXXX when the market was down and now that there 's an equity of the house, we are being denied. Where 's justice? Was it our fault that the mod has been dragged for 6 years plus, and now that there 's equity, it can not be modified? There 's so much greed in such a way that they 're hurting consumers like us. We need help please from federal govt. Little people like us can not fight them.

Complaint: In XXXX, my mortgage server was XXXX XXXX. They sent me literature on the XXXX modification program, I filled out the application and was approved for a modification. My payments were {$1500.00} a month and was reduced by {$250.00} dollars. I successfully paid on time per the guidelines on the modification. Six months later, I received a letter from XXXX XXXX stating that my modification was denied for a permanent modification, and the reason i was denied was because my monthly income exceeded the guidelines. Then, XXXX XXXX sent me a letter indicating that my payments that were made during the modification were considered 'incomplete '. I was charged late fees, penalties, etc. A week later I received another letter from XXXX XXXX demanding that I pay the amount owed during the modification trial period, which exceeded {$5000.00} dollars. I reached out to XXXX XXXX and asked them to work with me. Unfortunately, I was informed that there was nothing XXXX XXXX could do for me. I then reached out to an attorney, XXXX XXXX, and inquired an alternative to foreclosure. XXXX XXXX, explained to me to reach out to the Lost Mitigation Department at XXXX XXXX. To see if there was anyway they could work out a plan with me to repay my debt. Which I did, to no avail. I then recontacted XXXX XXXX and explained the situation to him. XXXX suggested that I file a Chapter XXXX Bankruptcy, which would put a hold on my foreclosure and give me an opportunity to repay my dept to XXXX XXXX over a five year period. I filed for Chapter XXXX Bankruptcy in XXXX. My payments were {$420.00} a month which i successfully completed over the five year period. However, during that five year period I fell upon a hardship and lost my job, which caused me to make partial payments to XXXX XXXX during the five year course of the Bankruptcy. However, I made all my payments on time to my trustee. During the bankruptcy I was in contact with my attorney in regards to my situation.
In XXXX, XXXX XXXX transferred my mortgage to Caliber Home Loans and I was notified by mail of the transfer of my mortgage. I then received a welcome letter from Caliber informing me that my mortgage payments should be mailed directly to Caliber after the XXXX of XXXX. I reached out to Caliber respectfully requesting my mortgage coupons so I could make my payments in a timely matter. Caliber Home Loans never sent me my mortgage coupons. A week later, Caliber started the foreclosure process on my home. I then reached out to the XXXX XXXX and I was directed to a company called XXXX. XXXX submitted a modification to Caliber in XXXX of XXXX. I was in contact with XXXX and Caliber Home Loans in regards to my modification application. Caliber informed me that they never received my application from XXXX. I then reached out again to XXXX and explained to the counselor that Caliber informed me that they never received the application. Shortly after my conversation with XXXX the XXXX resubmitted my application. I followed the instructions that were given to me and stayed in direct contact with Caliber Home Loans as well as XXXX. During that time I was employed and my application for modification was denied once again because my income was 'too much '. XXXX XXXX XXXX I lost my job. In XXXX I started receiving my unemployment benefits. I stayed in contact with Caliber the whole time that my mortgage was in their hands. In XXXX XXXX, I spoke to an agent from caliber and explained my situation again. I still did not receive my coupons from Caliber. I was then informed to submit a letter and request Caliber to send me my mortgage coupons, so i could start making my payments. I have records of Caliber receiving all the documentation. Now I 'm in contact with a certified XXXX councilor in an attempt to resolve this issue and save my home.
