Complaint: Previously filed a complaint due to mismanagement of my escrow account by Caliber Home Loans. CFPB Claim number XXXX. Received a response from Caliber regarding refunds issued for the incorrect and lost payments withdrawn from my escrow account and correct payment issued on XXXX/XXXX/XXXX for my full XXXX property taxes. Before all the corrections were made, Caliber issued our XXXX IRS Form XXXX which reflected the incorrect amount for taxes paid. I disputed their initial response as well as emailed the Caliber complaint department notifying them of the incorrectly reported taxes paid for the year in block XXXX of our XXXX and I requested a corrected XXXX. I never received a response to either of my written requests. I then called the Caliber Tax department on XXXX/XXXX/XXXX and spoke to XXXX ( Teller ID # XXXX ) who informed me that she spoke with a manager and the manager stated that they would not be issuing corrected XXXX because Caliber does not report this information to the IRS and that I should go to my taxing authority to get the correct amount. I informed her that I do n't believe that is an appropriate answer as I am required by the IRS to use these forms provided to complete my tax return. They have incorrectly reported the amount in block XXXX and should issue a corrected XXXX. She stated they would not issue a new form so I advised that I would be filling a new complaint to address this because I do not believe that is appropriate business practice to provide false amounts on an official tax document used for tax reporting of my personal return for XXXX.

Complaint: I have encountered one problem after another with Caliber Home Loans since they acquired my loan around XX/XX/XXXX. Before then, my mortgage was with XXXX XXXX XXXX and was in the midst of a loan modification since XX/XX/XXXX. Literally, at the last minute after my loan mod. approval with XXXX, my loan ( unknown to me at that time ) was sold to Caliber Home Loans. My first permanent, modified payment was due with CHL by XXXX XXXX, XXXX. I made my first payment over the phone with their bankruptcy department on XXXX XXXX, XXXX. This was done due to the fact that I was ( at the time ) in active chapter XXXX bankruptcy ( I did not yet have an online account ) and also to ensure that my first perm. modified payment was received on time. This payment was drafted electronically from my bank account and I received a confirmation number from CHL verifying this payment. At this point, I figured all was well. Not even close. First, was the permanent loan mod. paperwork that needed closure. Since all of my approvals had happened with XXXX, all of my paperwork had XXXX letterheads on it and was supposed to go back to them. Since XXXX had already sold my mortgage to CHL and purged their computers of my existence, there really was n't any way to handle that other than to send the XXXX approved permanent loan mod. paperwork to CHL. I did so via fax after instructed to do so by CHL 's bankruptcy dept. I also faxed a copy of the signed paperwork to XXXX 's bankruptcy dept. just to be thorough. CHL sent me new paperwork a few weeks after receiving the XXXX paperwork, instructing me to sign and fax again! Wondering what the point of this was, I did so. At this point, I began making my new permanent, modified payments to CHL over the phone each month, on time and always getting a confirmation number to accompany each payment. I did inquire multiple times about creating an online account so I did n't have to call every month but was told that I could n't because I was still in active bankruptcy. XX/XX/XXXX ( I do n't remember the exact date ), I received a phone call from a rather frantic CHL rep. telling me that the signed permanent loan mod. paperwork that I had faxed in XX/XX/XXXX was n't good enough and that I had to send in the original signed documents. I did so, at my expense via XXXX Priority envelope. It seemed that all was well again, as CHL received my paperwork and no further phone calls were received. I continued making payments over the phone each month ALWAYS on time ( or even before ) and receiving confirmation numbers each time for the electronic drafts. On XXXX XXXX, XXXX my chapter XXXX bankruptcy was discharged as I had fulfilled its requirements and completed my repayments. I made my XXXX XXXX mortgage payment on the first of the month and also inquired as to whether or not CHL had received verification of my ch. XXXX discharge. I was informed that they had and that I could finally create an online account and resume a " normal '' rhythm of paying my mortgage online each month rather than by phone. On XXXX XXXX, XXXX my wife received a phone call from CHL 's collections department wanting to know where XX/XX/XXXX 's payment was??? Obviously, she informed the rather rude gentleman ( XXXX teller ID # XXXX ) that I had already made that payment and was up to date. He insisted otherwise and practically demanded the payment. After the emotional phone call she sent copies of our bank records showing ALL of the payments ( AND confirmation numbers ) to date and that we were current. That was then. As of today ( XXXX XXXX, XXXX ) there still has been NO resolution on this matter. I have spoken with a dozen people since then ( the latest person, XXXX XXXX ID # XXXX ) trying to prove to CHL that they are wrong and fix this but to no avail. At this point, my only option is to hire an attorney if resolution is not achieved soon!

Complaint: My mortgage is with XXXX XXXX XXXX, and my Condo Fee contract, is with XXXX XXXX XXXX. My bankruptcy was discharged in XXXX, XXXX. Both parties are fully aware of my bankruptcy, and the fact that I moved out of the condominium since XXXX, of XXXX, as instructed by my bankruptcy attorney. XXXX XXXX XXXX has refused to foreclose on the condo, and since it is still in my name, I have been told by several attorneys, and agencies, I have spoken with, that I am responsible for the condo fees. I now have judgements totaling over {$95000.00}, brought on by XXXX XXXX XXXX. I have done everything XXXX XXXX XXXX has asked of me. I have attempted short sale, deed in lieu, and loan modification. I even went to a " making homes affordable '' workshop, desperately seeking someone, anyone, who could assist me, in resolving this matter. XXXX XXXX XXXX has received several correspondence from me, both written and verbal, letting them know that I am in no way interested in any programs they have to offer, and that I need them to foreclose on the property. I have almost all the names, dates, copies of correspondence to and from XXXX, of the representatives, supervisors and managers I have spoken with, from XXXX. XXXX XXXX XXXX have received at least XXXX short sale offers on the property, which included payoff amounts towards the condo fees, but they were all turned down. In XXXX, XXXX, I received correspondence from XXXX XXXX XXXX, stating, " The servicing of your home loan will transfer to Caliber Home Loans , Inc on XXXX XXXX, XXXX. '' So after over six years, of moving out of my home, and waiting on XXXX XXXX XXXX to foreclose on my condo, I 'm being told by them, that they have turned over my mortgage to another company. Is that even legal, especially after filing a chapter XXXX bankruptcy? Today I spoke with XXXX, operator # XXXX, at Caliber. I told her that I had been receiving correspondence from them, referencing a total debt of {$340000.00}, and informed her of my bankruptcy discharge in XXXX, XXXX. She told me, that I will continue to receive correspondence from them, because the deed is still in my name, and that there is nothing that can be done about it. I just had to wait until they decide to foreclose. XXXX XXXX XXXX has had me dangling for over six years. It is downright cruel and unfair, that they are allowed to do that. They can not sue me for the mortgage on the property, but as long as the condominium is in my name, XXXX XXXX, can sue me for condo fees, for a place no one has resided in for over six years. How is that justifiable? I thought I was doing the right thing, hiring a bankruptcy attorney, because I wanted to make sure, that everything was handled correctly and professionally. I ended up filing bankruptcy, because I got scared, anxious, and desperate, especially since I had used up my 401k, and savings, in order to hold on to my good credit. My bankruptcy attorney told me to move out of the condo, if I did not want to be responsible for the condo fees, so after filing in XXXX, XXXX, I immediately vacated the premises in XXXX, and my case was discharged XXXX, that same year. XXXX XXXX XXXX has had amply time to foreclose on my condo, but they refused to do so. Now my deed is with another company, and I 'm still being sued by XXXX. When exactly can I expect this nightmare to end? I am hoping and praying, that I will be given the opportunity to prove that, to whoever will listen. Please assist me in getting this matter resolved.

Complaint: I filed Bankruptcy in XXXX of 2014 which excluded my home and truck : XXXX were exempt and it states it on the Court documents. My mortgage company, Caliber Home Loans, has listed my house on Bankruptcy status since that date for which it was exempt but I just found this out recently and the mortgage co. informed all the credit bureaus also that it, my home, was in Bankruptcy status also, which I have a recent letter from them stating they informed them, so when I was getting credit help they stated that prior reporting was accurate and the request to remove anything they were unable to do. I went to get preapproved for a home loan and the Loan Officer told me that it was under Bankruptcy so I would not be able to get a loan for 7 years. I have been in contact with my mortgage co. and they know it is exempt but will not remove the status and I have been shuffled from person to person. My credit is bad enough without this but not as bad without this on it. I want it to be taken off my credit reports, all XXXX, and reflect that it was knowingly put on the credit report information that was not correct. information.

Complaint: This is my second complaint for an ongoing issue. My first complaint # XXXX has not been settled. I declared bankruptcy in XX/XX/XXXX. My case was closed in XXXX of XXXX. Caliber Home Loans still refuses to lift the hold on my account. I have no access to my account. No statements or online access. I pay an amoumt every month not knowing if it is correct ir not. They have blatantly disregarded correspondence from my lawyer stating that they are in violation on the NY State bankruptcy codes. How do they get away with this????? I never missed a payment in 8 years. The only way I can pay them is through my bank 's bill pay option or I can pay on the phone for a XXXX dollar fee. This is my home!!! They keep saying that an abandonment of property was never filed. The NY State trustee on my case informed them that no such document is required once the case is closed. Yet they refuse to grant me access to my account. I have not seen a statement since XXXX of XXXX. I am beyond XXXX about this. On top if this my mither passed away in XXXX of XXXX and they are still sending tax documents in her name and sicial security number. They were sent her death certificate a year ago and I have called XXXX other times about it. How can a company get away with this.

Complaint: Because of economic reasons -- we have a lawn business that was hit hard when the housing crisis hit and folks were cutting back on services. As a result, we got behind on our payment. I have been trying for months to get a loan modification so we can get back on track and keep our home. Yet at every turn, Caliber Home Loans seems determined to take my house away. First they told me they would n't modify the loan because I could afford the monthly payments. Yeah. That 's what I was trying to get across to them. If they would just reinstate the loan, we could maintain the monthly payments. I also asked for a reduction in the interest rate of 7.999 % that we 've been paying since 2007, but no go. They set me up on a repayment plan that made the monthly payment more than our monthly income so I applied for another loan modification. With the sale date of XXXX XXXX approaching, I called on Monday, XXXX XXXX to check on the status. The Point of Contact called that department and they said to call back on Friday and they would hopefully tell me some good news. So I called on Friday and was told that because the loan modification request had been submitted within 2 weeks of the sale date, it was too late and gave me a month extension on the sale date. They could n't have told me this on Monday when I talked to them? Total deceit. They also neglected to tell me I needed to resubmit the loan modification and I have been waiting all this month to hear if they approved it when they have n't even been considering it.

Complaint: I have been trying to complete a deed in lieu of foreclosure on my property of nearly three years. I filed Bankruptcy in XXXX of XXXX ( XXXX in XXXX XXXX ). At the time my mortgage was with XXXX XXXX XXXX. Not long after my discharge XXXX sold my mortgage to XXXX XXXX XXXX Bank, who then sold it to Caliber Home Loans in XXXX of XXXX. Even though I had tried multiple to times to turn the home over, I immediately contacted Caliber to try again as soon as I received word that they were the new holders of the mortgage. I did this even though I was no longer financially responsible for the note due to my discharge from bankruptcy. Not only did each company along the way continue to call me in an effort to collect the debt ( against the law ), I have had the worst time trying to simply move on with my life by completing a deed in lieu. Once I contacted Caliber and completed the paperwork for the first time, they sent someone out to the property to inspect / appraise it. At the time they were unable to do anything because they stated there were people living in the property ( squatters ). They told me I needed to have them evicted. The building became vacant between XXXX XXXX and XXXX XXXX and I have still been trying to complete a deed in lieu. My attorney has had multiple contacts with Caliber to no avail. The have stated they did n't have all of the information they needed, so we sent them more. Then they said I had a sewer lien, so I contacted the city on a Friday. The city said there was no lien, but one would be placed the following Monday. Caliber at that point agreed to pay the approximately {$450.00} lien in exchange for a reduced relocation fee. I gladly agreed and waited for my paperwork, which never came. After more agonizing time goes by I received a call from my account manager who advised me now that there was a $ XXXX lien on the property. Why this never showed up before, I do n't know. I was advised the loan was taken out in XXXX, which was difficult seeing I did n't buy the house until XXXX. I dug in and contacted the title company that performed my closing. The attorney for the seller apparently never filed the discharge for that lien, though the loan had been paid. After about two months, I finally received a copy of the discharge and forwarded it to my attorney who then forwarded it to Caliber. This was on XXXX XXXX, XXXX. To date, neither my attorney, nor myself have heard from Caliber regarding my deed in lieu. My patience is wearing thin. It has been 2 1/2 years since I filed bankruptcy and I still have a house hanging over my head. I truly want nothing more than to move on with my life. Please help!!

Complaint: Crux of issue : XXXX calliber did not receive my proof of insurance. Somehow XXXX years later they assessed {$4000.00} to my escrow and evoked a payment though my insurance company. Escrow ballooned and so did payment..not to my knowledge. Additionally Caliber did an inaccurate tax forecast that ultimately needed to be corrected that contributed additionally to the inflated monthly payment. When I was able to connect with Caliber Customer service ( they had called several times but left NO messages ) It took XXXX calls and XXXX days for customer service to clearly state what the issue was. Reps who said they would call back never did. Their esrow department could not explain why there was huge spike in escrow, each representative had a different story. Ultimately Caliber held my on-time payments, did not post them to my account and did not return my checks to me ... and most importantly they did not apply my payments to my account. For the two months ( XX/XX/XXXX ) that this was being resolved they reported me late 30 days. I called and wrote them to review, I also disputed through XXXX. They denied my requests to remove the XXXX 30 day lates from my credit report. XXXX I contI was told by customer service that XXXX said that because it was reported late in the system she can not change it. Seems unreasonable Other - Payment was made on time ... caliber help my $ $ 's and did not return them

Complaint: I have my home loan with Caliber Home Loans. They placed Lender Insurance on my property without advising me. I already had home owners insurance with XXXX XXXX. They changed my monthly mortgage payment without advising me because of this insurance they placed on the property. They stopped applying my payments, which were set up on automatic payment, because of this increase. They were however cashing the checks but they were not applying the payments to my account. I called to complain after receiving notifications of a pending 30 day late. I sent in proof of insurance at that time. They advised after reviewing the insurance that they would start applying the payments but that I still owed them {$1100.00} for the insurance they placed on the property without my knowledge. They said they mailed me a letter, which I never received. They have my email address and my phone number but they did not utilize either ; only mail.

" In violation of Section 6 of the .... ( RESPA ), under Section 6 of RESPA, lender did not acknowledge my timely request within 20 business days. " Lender DID NOT and HAVE NOT acknowledge my timely request to date, long past the period required by the Act, to take advantage of my rights and prevent a notice of default being issued and putting me at risk of losing my home in foreclosure.2.
