Complaint: Account/Product Type : Mortgage Loan Complaint My mortgage loan has been sold for a 2nd time since XX/XX/XXXX of XX/XX/XXXX, Original loan holder was XXXX, the principal balance prior to the loan modification was XXXX after the loan modification was completed the loan went to XXXX with adding Escrow fees. Then in the process of closing the deal for the loan modification with XXXX the loan was sold to Caliber Home Loans after talking with them about the loan modification with XXXX they honor it and I started paying them the mortgage, Now I get a letter saying the loan was sold again to XXXX XXXX XXXX as of XX/XX/XXXX received that letter on XX/XX/XXXX mortgage has been sold again to XXXX but the balance was is XXXX what the heck! But Caliber Home Loan is still the servicer.

Complaint: Hello, My name is XXXX XXXX and I have an FHA loan, serviced by Caliber Home Loans, that I need assistance with. The loan, which is referenced as Loan Number XXXX by Caliber Home Loans, is currently in default status and Caliber is attempting to proceed with foreclosure on the home. In XX/XX/XXXX, I became unemployed. I did not resume work until XX/XX/XXXX, due to difficulty finding employment caused by unfounded negative references from my former employer. During this time I was approved for an FHA Special Forbearance Plan in regards to my mortgage. I worked with Caliber Home Loans to pay these payments between XX/XX/XXXX andXX/XX/XXXX. Each time I contacted Caliber regarding the payments, I was informed that the payments would be accepted and applied to my forbearance plan even though they were not received by the XX/XX/XXXX day of each month of the plan as long as the payments were made by the last business day of the month. I made all of the required forbearance plan payments from XX/XX/XXXX through XX/XX/XXXX by the last business day of the month, which were accepted and applied to my balance. In XXXX and XX/XX/XXXX when I contacted Caliber to make the payments, I inquired as to the need for any additional paperwork or documentation from me for the Forbearance process to be completed and normal payments to resume in XXXX. Each time I was informed that the process to complete the forbearance would automatically update once the last payment was received and no additional documents were necessary. In XXXX, I have attempted to make my normal mortgage payment only to be informed that my payment would not be accepted because my home is in foreclosure because I did not submit the required paperwork to process the end of the forbearance plan. In my most recent contact with Caliber Home Loans, on Friday, XX/XX/XXXX, I was informed that I should not attempt to make the XXXX payment because their policy was to return payments that were not made in full during the foreclosure process - meaning that if the payment I was going to make was not equal to the total past due amount ( now approximately {$15000.00} ) my payment would not be accepted. I would l like to continue living in my home and eagerly await the opportunity to resume normal monthly payments. Any assistance that you can give me on this matter would be greatly appreciated. The foreclosure should not have taken place as foreclosure paperwork was fraudulent in there was no disclosure of change of ownership. This change of ownership was no disclosed to the court. Additionally this is an unfair debt collection practice by the firm that represents Caliber Home Loans. In the case involving this particular assignment, evidence has surfaced that shows the XXXXXXXX XXXX XXXX XXXX is in fact not a trust holding beneficial rights to the Defendants loan, but rather it is an undisclosed Participation Agent for yet more undisclosed investors. Complaint: On or about XX/XX/XXXX a company called XXXX XXXX XXXX has posted a document on my front door which claims to have recorded a document ( attached ) called a NOTICE OF TRUSTEE 'S SALE, hiding its real address and information, without any signature, in violation of TILA and the FDCPA, having the alleged recorded document mailed to another company called XXXX XXXX, at XXXX XXXX XXXX, in XXXX, CA XXXX, when I have in fact, appealed the decision of the Bankruptcy Court and it is presently pending before the Bankruptcy Appellate Panel ( BAP ) in Appeal number : XXXX, against the order to lift the automatic stay. This all stems from the fact that the previous lender called XXXX failed to properly apply my post-petition payments made starting in XX/XX/XXXX, to the loan when it was transferred to the present servicer Caliber Home Loans, in or about XX/XX/XXXX. In fact, we have received payment and running balance statements showing that in XX/XX/XXXX there were still late charges in my account for the amount of ( - {$830.00} ) and increased to ( - {$1200.00} ) under Late Charges on XX/XX/XXXX, when the loan was released, and which should have never existed. Also, we must add that a recent letter from Caliber dated XX/XX/XXXX admits that there was a suspense balance of {$2100.00} in XX/XX/XXXX which should have been posted to the post-petition payments and not pre-petition payments of XXXX XXXX, XX/XX/XXXX. These payments, along with those made during XX/XX/XXXXwere misapplied and Caliber again has misrepresented in the attached letter that I am due for " twelve ( 12 ) post-petition payments totalling {$19.00}, XXXX. Please see their third ( 3rd ) amended payment history attached to the letter dated XX/XX/XXXX.

Complaint: I have been a first time home buyer since XX/XX/XXXX my initial mortgage was through XXXX It was sold soon after to Caliber home loan. I made consistent payments to for the loan since I've had my property. I started a refinance process Caliber back in XX/XX/XXXX I was alarmed because the initial loan officer XXXX XXXX submitted than drop my application and re ran my credit giving me two inquires. I allowed some time from now until then to pass and consider the option again after Caliber alerting me that I still qualified for refinance, wanting to pay some debt down with the equity in my home I started working with a new loan officer XXXX XXXX she started the application process for me again reassuring me that all would be taking care of and moving expediently fast to me making a payment for the appraisal of {$99.00} dollars because they had a prior approval for my refinance to now no contact of any sort and a letter of withdrawal that I never made to the company. this recent application has dragged my credit score down drastically and has left me with no communication for anyone on Calibers end. its very unfortunate that this company is allowed to treat there customers in this manner when we are making payments and effected personal by credit reports

Complaint: We have a mortgage with Caliber Home Loan ( https : //www.caliberhomeloans.com ), account number XXXX. The mortgage consists of loan and escrow accounts both. On XX/XX/XXXX the loan officer XXXX XXXX informed us the escrow amount was wrong. The overall monthly payment should be {$5900.00}, down from the wrong number {$7100.00}. Therefore the monthly mortgage I paid is {$6000.00} from XX/XX/XXXX However Caliber home loan does not update its system and think we are short of the monthly payment. The consequences are : 1. Our payment balance was messed up, both the loan and escrow account balance by wrong late fee and penalties which caused by Caliber itself. Please refer to the attached account payment history. According to my calculation, till XX/XX/XXXX, my loan balance should be {>= $1,000,000} and escrow balance is {$7000.00}. But Caliber shows the loan balance is {>= $1,000,000}. escrow balance is unknown. 2. Caliber careless mistake leads to both my husband and my credit score sharply drop from 800 level down to 600 level. 3. OnXX/XX/XXXX, Caliber sold the loan to central loan administration and report ( XXXX ), and passed all the wrong information like escrow amount, loan balance and escrow account balance to XXXX. Although Caliber promised to fix it for us, one month after the transaction, the mistake in XXXX has not get corrected. The record from XXXX still shows our monthly payment is {$7100.00}. After the loan selling to XXXX, CALIBER did not inform us to pay XXXX afterwards. Without the right payment information, we paid our XX/XX/XXXX mortgage {$6000.00} to Caliber still. Although Caliber claimed that it forwarded the {$6000.00} to XXXX on XX/XX/XXXX, XXXX has not received it ever since. When both XXXX and us asked CALIBER to provide the express mail tracking number and check number, CALIBER just could not come up the numbers.

Complaint: I had a forbearance on my mortgage payments for Hurricane Irma. In XX/XX/XXXXI called to start paying my mortgage. Was told by the teller named XXXX that there are only 2 options coming from FHA. One is a Cap and Extend which will modify the loan, the other is a lien on the house for the amount due during the forbearance. I was guaranteed by 3 representatives that these were the only options available and everything would be settled in 30 days max. I got a call from Caliber Home Loans a couple of weeks later telling me I was denied for all options and would have to start the process all over again. They never informed me that denial was a possibility. To the contrary they said everything would be complete in 30 days max. Now, in this time I have arranged for loan with the SBA disaster loan department for {$40000.00} and a lien on the home. I'm being told by the mortgage company that this lien will not stand because my home mortgage will be modified and a title search will be run, and when they run title and see a lien for {$40000.00} on my home they will not modify it again. I don't have the money to pay back now and becuase I relied on the statements of the company ( nothing was given to me in writing ), I might not be able to pay them back.

Complaint: Today XX/XX/XXXX, Caliber Home Loans has placed a fraudulent Notice of Trustee Sale on the door of my home. My elderly parents are very upset since this case is presently pending before the Bankruptcy Appellate Panel ( BAP ), therefore any collection activity was in violation of Federal Law. We attach a copy of the Appeal filed on XX/XX/XXXX since all Pre and Post-Petition Bankruptcy payments have been paid since XX/XX/XXXX Also, we have still not received a correct updated history of all payments made on this loan since the year XX/XX/XXXX. Nor have we received a correct XX/XX/XXXX for XX/XX/XXXX& XX/XX/XXXX, and information regarding the different investors including, XXXX, XXXX XXXX XXXX etc. We have two different signed NOTES and would like to know which is the original? None of these issues have been addressed per RESPA, FDCPA, etc. and we would like the CFPB to intervene. From what we understand XXXX XXXX has just been fined $ XXXX for unlawful foreclosures and fraudulent accounts.

Complaint: In XX/XX/XXXX, I initiated a refinance home loan now serviced by Caliber Home Loans ( Caliber ). I set up automatic payments to Caliber through the XXXX XXXX XXXX XXXX ( XXXX ), which used the iPay Bill Pay Service from XXXX XXXX XXXX XXXX ( XXXX XXXX ). Automatic monthly loan payments ( {$1300.00} ) started in XX/XX/XXXX. Monthly payments were routinely sent from the XXXX to Caliber, in check format as scheduled from XX/XX/XXXX, through XX/XX/XXXX, via XXXX XXXX. In XX/XX/XXXX, Caliber notified XXXX XXXX they would stop accepting payments in check format, and would begin only accepting electronic payments instead. [ THIS CALIBER INITIATED ACTION is root cause # 1 for the missed payments ] XXXX XXXX then stopped check number XXXX ( the XX/XX/XXXX payment in process ) to change the payment method to electronic. However, Caliber REJECTED the subsequent electronic payment from XXXX XXXX for XX/XX/XXXX. [ THIS CALIBER INITIATED ACTION is root cause # 2 for the missed payments ] This rejection DEACTIVATED the XXXX XXXX XXXX reoccurring payment to Caliber, that was previously set up. Caliber immediately reversed itself and notified XXXX XXXX to change the payment method back to check format, as they had NOT completed their set-up to accept electronic payments. Since the automatic payments were deactivated by the series of actions initiated by Caliber, the XX/XX/XXXXand XX/XX/XXXXpayments due to Caliber went unpaid. As I was on an XXXX XXXX in XXXX, and thinking my payments were automatic, I was not aware these payments were late until my return to the US in late XX/XX/XXXX. Upon my return to the US, I immediately scheduled the late XX/XX/XXXX and XX/XX/XXXXpayments. The XXXX 's XXXX XXXX XXXX again started sending payments in check format to Caliber, automatically as scheduled, as Caliber still had not set up to receive electronic payments. ONLY in XX/XX/XXXX, 3 months after their initial communication, did Caliber complete their set-up and begin receiving electronic payments from XXXX and XXXX XXXX. I have never missed any payments on this loan ( or any previous mortgage ) prior to, or after the payments impacted by the Caliber initiated actions. Had Caliber not rejected the first electronic payment attempt, made at their request, these late payments would have never occurred.

Complaint: I have made 17 consecutive on time payments of {$4500.00} to Caliber Home Mortgage ( Acct # XXXX ) on a 30-year fixed mortgage. However, in XXXX they increased the amount due to make up for an escrow payment for property taxes. I was not aware of the increase and my auto-bill pay sent the same amount. I was notified that I was late in XXXX, but knew I was current. However, I found out I the increase of {$54.00} was the difference in the increased amount that was late. Upon hearing the news I immediately paid the {$54.00} difference, in fact I paid {$190.00}, just to make sure no late fees or accruals would be attached. Then I saw they reported me as 30+ days late on my credit report. I asked them to remove it, but said due the Fair Credit Act, I must request removable by the CFPB and the Agencies. I sent a note to the agencies and to you as well.

Complaint: Dear Sir / Madam, I got a home loan from CALIBER HomeLoans on XX/XX/XXXX, due to some credit problems I got an interest rate of 6.5 % on a jumbo loan. Soon after I got the loan, I lost my job and got another low paying job, but never got late in making a mortgage payment. In XX/XX/XXXX, I approached CALIBER citing job loss and requesting relief as I could foresee trouble making payments in 3 months not then. CALIBER told me to stop making payments until the loan was modified. It took them 2 months to modify the loan and now forced me to be delinquent by 30 days on my payment, thus adding additional fees and hurting my credit score. I called them multiple times to ask them in XX/XX/XXXXand XX/XX/XXXXrequesting the amount due and the due date, but I never got an answer from them and they just asked me to wait. They finally switched me to an INTEREST ONLY loan at 6.125 % in XX/XX/XXXX. Since then I have been paying the interest only loan on time every month. IN mid XX/XX/XXXX, I called up CALIBER again to see if they can help me lower my interest rate as my credit score has become really good over the last year. They asked me to refinance, but I informed them that I am recently self employed and do not have income verification, but I have always been making my mortgage payments on time. So they suggested that I default on a payment and try for loan modification. They said that there is no other way. I find this incidence and advice weird, they are penalizing me now for being good citizen who wants to make all the payments on time. They are penalizing me with such high interest rate when all the payments have been made on time. My argument is that the risk for CALIBER is higher if the payment and interest rate is higher an it would be lower if they reduced my interest rate, as it would be easier for me to pay a lower amount. I am without a job and self employed in both cases, high interest and low interest rate. So why is CALIBER wanting to gouge me when I have made payments on time. Complaint: I recently submitted a complaint asking for answers and none of my questions were a addressed. Instead I received a letter which was a basic review of what I wrote and a recap of my history with Caliber. I want to know back in XX/XX/XXXX when I first contacted a single point representative and ask for help regarding a payment that was returned to do a problem I'm having with XXXX XXXX. At that time I submitted proof by uploading a letter from the manager at XXXX XXXX and took it a step further by initiating a conference call with myself the branch manager and a Caliber representative. All Calibers phone calls are rerecorded so this call can be reviewed. The phone conference call took place the same day the letter was uploaded. If you look at the documentation submitted in XX/XX/XXXX you will see the letter. I want to know Back in XX/XX/XXXX when the bank held my money for over a month and I contacted Caliber for help ... .. > Why would a representative advise me to do a modification knowing I was not qualified if according to what you stated in your answer that my loan could not be mortified because it was less than a year since the last notification >When the modification was denied, why was I told to appeal knowing under your terms it was less than a year since the last modification and again based on your policy I did not qualify?. >In your answer you state, that my debt had exceeded my income. that was impossible because with assistance from my Hud counselor I have less than a XXXX dollar monthly expense which allows me XXXX to pay on my monthly mortgage. > Loss Mitigation said there was no significant change in income with regard to the appeal ... .. That is 100 % in accurate, the reason for my appeal was to based off that missed calculation which put my monthly income payable to my mortgage at XXXX. A XXXX dollar increase is very significant according to the manger XXXX who I engaged in a 2 hour conversation. who promised to assist me with a repayment plan although I didn't qualify for one due to the misinformation information provided to me in the beginning which could of saved me from all this aggravation that ultimately led to foreclosure. I quote I asked her if we could use this conversation down the line and she said yes,,,,, PLEASE LISTEN<<<< because my plan is to have a judge listen to my conversations, This predatory loan originally from XXXX XXXX has been a nightmare ... Why was I reported to the credit Bureau 14 times when I was in litigation with this predatory loan 2 years ago????? >I was told not to let the account go over 120 days, but I wasn't informed that I could no longer make a payment over the phone or by computer which is what caused me to go over by 1 day? If I had these privileges taken from me why wasn't I informed ... Its like you do these things in efforts to make us fail. I have a video of my sister filming my daughter while I'm engaging in a conversation with XXXX on speaker and my sister basically stops in her trap as she hears how rude and ignorant a supervisor named XXXX is speaking to me. I hope I can let you hear how horrible and disgusting he is to me, when I ask to speak to his manager he flat out told me NO ... I told him I want this conversation reviewed and he told me No .... I as a customer look for help advise and assistance from your representatives but your allowing them to misguide, withhold and misinform us as customers which has severe impacts on us and you don't hold them accountable. I'ts not right because I have to look to Caliber for the answers and not being truthful or withholding info puts customers like me in a position to lose their home,,,,, which is exactly what is happening ... If it's your goal to mislead and guide customers into foreclosure I say this because there are over 3000 complaints against you and 800 have to do with your reps and misleading customers ... .over 600 with customer service. I'm hoping The CFPB will take the initiative ti look into the way your reps are talking and treating customers it's as if they want to deter them from seeking help and having options. Please do not apologize again for " if I feel that I was mistreated by your reps,, '', BECAUSE THE BOTTOM LINE IS I HAVE< ITS FACTUAL AND THE PHONE CALLS THAT ARE RECORDED PROVE JUST THAT ... .please listen to them .... Complaint: Mortgage Loan Number : XXXX XXXX Case Number : XXXX I am writing to request correction of the error described below in regard to the mortgage on my property at XXXX XXXX XXXX XXXX FL XXXX. I was a victim of Hurricane Maria and live in XXXX County Florida which was declared a disaster zone. I missed work due to the storm and received a letter from Caliber Home loans regarding payment assistance options. I opted to take advantage of this program due to the loss I suffered in income and damages from the storm. It is my hope that someone can assist me to remedy the awful situation that has ensued. On XX/XX/XXXX I received a letter which is attached that unequivocally states that I was approved for a Forbearance Plan without any further information or documentation needed from you ( me ). As ofXX/XX/XXXXI have been notified that the Forbearance plan aforementioned was actually not approved and my loan is now delinquent and could be foreclosed. This attached letter was misleading and deceptive and has caused me great distress in my life. I am currently XXXX and the stress and anxiety associated with your incompetence in handling this matter is causing me great personal grief. In addition, I am divorced from the co-borrower XXXX XXXX and have been awarded the home in the divorce. This is recorded on public record. No information from him will be given to the lender.
