Complaint: I am writing this complaint for my husband, XXXX.
I started working with XXXX XXXX, and XXXX at Caliber in XX/XX/XXXX ( when we still lived in XXXX ). We knew we were moving to XXXX and wanted to get a head start on house shopping. He pre-approved XXXX for a USDA home loan based on XXXX 's income in XXXX ( which was slightly more than it is here ). In case you do not know, USDA home loans are based on income ( https : //www.rd.usda.gov/files/RD-GRHLimitMap.pdf So we come here, put an offer in on a house with Due Diligence & Earnest Money ( Due Diligence money is paid to sellers in XXXX and is non-refundable ), pay for an appraisal and we are supposed to close on XXXX. I started seeing red flags about 2 weeks before closing ( like them asking for the employment letter for XXXX 's new job, which I sent to them in XXXX ) but when I asked XXXX he assured me it was no issue but did place the loan delay blame on his processor, XXXX XXXX.
I asked XXXX back in XXXX if all they needed to close was the offer of employment letter and he said yes. So fast forward, ( I will skip all the micro-details for now ), we have conditional loan approval from the underwriter ( attached ), the Initial CD ( attached ) is emailed to us on XX/XX/XXXX because we are closing on XXXX. Well the Initial CD has a close date of XXXX so I immediately call and text the loan officer and no response at all. Called and texted his boss, XXXX XXXX, same thing - no response. Now it is way past XXXX XXXX and I call a processing manager who's number I stumbled across and she pulls up the loan and said that they have everything except that they need a full month of paystubs from XXXX 's new job. Her name is XXXX XXXX. I asked XXXX if that is a USDA or Caliber condition and she told me it is a Caliber policy. She also told me that the loan can not be submitted to USDA for final approval until AFTER they have everything including 1 month of paystubs.
But I was already told by XXXX that the loan was submitted to USDA on Friday and it is now Monday. ( I have text from him proving this ) Then a few hours later I get a call from XXXX 's bosses boss - XXXX XXXX who tells me that the loan is denied because XXXX makes too much money and USDA rejected the loan because of that. But I was just told a bit ago that it was never sent to USDA.
We are getting different answers and XXXX makes less at this new job than in XXXX which is what was used for the preapproval.
Then XXXX tells me that they can switch the loan to an FHA loan but it will take a few weeks. At this point, we are past our due diligence date but we could not trust Caliber to do what they say so we cancelled the loan with them. We got preapproved with another company but XXXXXXXX XXXX credit score dropped too much ( from them pulling XXXX XXXX credit without permission, after this loan was cancelled ) and we did not like the interest rate so we cancelled the contract.
We have lost money because of them and we want to be compensated for our losses.
XXXX also never gave anyone at Caliber Home Loans permission to talk to me at all and they never contacted him, except for XX/XX/XXXX when XXXX called him about a fraud alert on his credit ( which never existed ). It was after the loan was cancelled and I started complaining to the Corporate Office that XXXX XXXX requested it.

Complaint: I called the XXXX XXXX XXXX ( XXXX ) on or about XX/XX/2017 with a home mortgage that was close to auction. Once my mortgage serviced by XXXX XXXX ( XXXX ), became more than a month overdue, they would not accept anything except all arrears paid in full.
A major illness, and subsequent hospitalization kept me out of work for a short time, yet long enough to affect my financial situation in a detrimental way. Shortly after this, my wife underwent costly medical testing and was diagnosed with a multiple health issues, 2 of which were serious.
I am informing you of this because it is important to know that I did not become delinquent due to lack of commitment to an acquired debt, or misuse, of any kind, of monies owed to creditors. To the contrary, I have always maintained employment, and when work slowed, I willingly sold assets to ensure my mortgage was paid. Therefore, the experience I have had with the XXXX feels like being kicked when down.
When I called XXXX, I initially spoke with XXXX XXXX XXXX. He was very helpful, seemed informed, and available and/or very quick to get back to me. He, after reviewing all of the requested paperwork I sent over, informed me that I was eligible for XXXX. XXXX XXXX XXXX understood that my mortgage servicer had been XXXX for several years and was very recently sold to Caliber. I was told that I would have to continue working with XXXX, but that by qualifying for this program, my payments would be reduced significantly, all arrears would be restructured into the loan, and I would be on a fixed rate between 2.5 % -3 %. He also stated that our first trial payment would be due XX/XX/XXXX. This was 3 months away. I was told that they would need {$2700.00} put into their account via XXXX wire transfer before any paperwork could be prepared to present to the lender. I did this. I was also instructed that for the process to move forward I needed to file for bankruptcy to halt the sale of the home. I was told how to and where to go to complete this process. I did this as well. I was informed by XXXX XXXX XXXX that if we spoke to our lender it would jeopardize the process. XXXX XXXX XXXX also informed me to not pay anything on the mortgage because it was not necessary until the deal was done. Then I was told to wait. I waited On XX/XX/XXXX, I was informed by someone named XXXX XXXX XXXX ( senior loan processor ) that my file was accepted and was in processing. Again, I waited and was told under no circumstances, to speak to anyone at the lending end of the mortgage. During this time I sent over additional documentation requested by XXXX XXXX. I inquired about how much time it would take to have everything in place and wasn't given a defined answer ; I was told to understand it would take a little bit of time, and it was reiterated that we must not speak with the lender/servicer on the mortgage.
On XX/XX/XXXX, XXXX XXXX emailed, stating that the " modification '' had been approved through Caliber. I thought this was strange, because it was stated that it would be a restructure through XXXX. Upon questioning her she refused to give me a clear response, instead saying aren't you just happy we saved your house?. She was very concerned that I fill out a BBB survey for her which I refused as I was not happy with the result. Moving forward, I called Caliber as instructed in the email sent by XXXX XXXX. I was told that my payment should be made by or before the last day of XXXX. I sent a cashier 's check, drawn from my credit union, on XX/XX/2017 directly from my local post office. On or about XX/XX/XXXX I received a phone call from Caliber stating that I had not signed the modification agreement. I inquired as to where they sent it. First I was told my residence, then it was said that it had been mailed to the lawyer. There was never a lawyer involved in this.
Subsequently, I was told that the mortgage was again in default, I received a refund check from Caliber in the amount I had paid on XX/XX/XXXX, with a letter stating that it was not the amount if the arrears in full and would not be accepted. I called XXXX and let them know about the situation. We had done EVERYTHING we had been asked to do to get this on track. XXXX XXXX XXXX stated at that time that the banks play these games he would talk to his manager and get things right for us at no extra cost. XXXX XXXX XXXX has never spoken to us since. We have emailed him several times in an attempt to pay our mortgage, at this point, XXXX will not respond as a company.
There was no mortgage relief in this, there was no assistance. If anything, a greater problem has been created by this company. I am out {$2700.00} and my home us back on the auction block.

Complaint: On XX/XX/XXXX, I communicated with my Loan Officer, XXXX XXXX of Caliber Home Loans.
We talked about locking the rate for the loan and we both agreed to lock it for 45 days at 4/05 % and I requested a lock rate confirmation from him.
I did not get any lock confirmation from him so I called him several times and he did not answer the calls. I emailed him again on XX/XX/XXXX asking for my rate lock. He finally answered my phone calls and said he was just busy and he would send the lock confirmation.
A few days later, I get some disclosure documents from him showing that my rate was locked at 4.05 % but on a 30 day lock. In effect he gambled on my rate and waited more than 2 weeks to lock my loan.
What XXXX did was dishonest, unethical, irresponsible and dangerous. I think it is also ILLEGAL. A shorter rate lock period is cheaper than a longer rate lock period. If we had locked the lock on XX/XX/XXXX for 30 days I could have gotten 4 % or better. On the other hand with today 's volatility, if he had waited a week or two more, I could have lost the rate we agreed on and we would be talking of a much higher rate I have emailed his bosses but have not received a reply from them.
This kind of practice should not be tolerated and XXXX XXXX should be held accountable for his actions.
I would appreciate your prompt action on this matter.

Complaint: I previously sent in a loss mitigation application with no response from Caliber. Now I have been served with a Sheriff 's notice and need a loan modification. The loan modification submission was not responded to. Caliber has now taken a position that they do not have to review me for a loan modification because of the proximity to the sheriff sale. I disagree with this premise because it is not in good faith. I do not have a large arrearage with Caliber and I have money to make a lump sum payment. I have been making payments to Caliber up until the middle of last year. I was never sent a loss mitigation package nor did I ever receive a Notice of Intent to foreclose.

Complaint: I had a major health issue due to failing XXXX and was on XXXX and as a result missed a mortgage payment. I contacted Caliber my servicer to explain and to try and get them to work with me to reduce my monthly payment since I was having health issues and only able to work part time for a while. Caliber told me they could not help me and that I could not apply for a modification because I was only one month behind. I then sent in the monthly payment and added {$200.00} extra to go towards the missed payment from the month before so I could begin paying this down. Instead of applying the payment to my account, Caliber rejected the whole amount because it was not the exact amount of my monthly payment. When I tried to resolve this I was told that now I needed to pay 2 full monthly payments at once as well as late fees. When I told them I could not do that I started getting the runaround. Bottom line is that I went back and forth with this company for months and never even got them to review my paperwork. They never assigned a dedicated contact and continually misplaced and lost my information. Now I am facing a foreclosure sale date on XX/XX/XXXX. This is completely avoidable -- I have enough income to afford a fair payment, but Caliber, the recipient of hundreds of millions of dollars in bailout funds is ignoring me.
I have owned this home for over 7 years and have not had issues with the payment until recently. I went through a painful and expensive divorce in 2014. Not long after I had an issue with a past employer and was wrongfully terminated and had to go back to work as a XXXX for a time. I never missed a mortgage payment during these times, but all my reserves and rainy day funds were used to stay afloat. I have worked in property management for over 15 years and have a steady job and also receive rental income. I have the ability to afford a fair and reasonable payment. The purpose of this complaint is to get my case noticed and made a priority, because the Caliber agents have dropped the ball and not followed through and given me an opportunity to be reviewed for all government, state and internal homeowner assistance programs that should be made available to people in my situation. As explained, I had major health issues due to problems with my XXXX and was on XXXX and incapacitated while recovering. Less than a month after I missed my payment I began reaching out to Caliber to try and fix this, but still find myself facing foreclosure. This is wrong and I am asking that you open an investigation of their handling of my situation.

Complaint: I entered into a HELOC with the XXXX XXXX in XX/XX/XXXX. XXXX put a lien on the property at the concurrent with the execution of the HELOC documentation. Later that year, I was forced to file a Chapter XXXX Bankruptcy due to the failure of my business, and I received no further communications from XXXX. In XX/XX/XXXX, My wife and I each received an IRS Form XXXX ( Cancellation of Debt ) from Caliber Home Loans indicating that the debt had been cancelled. I did an on-line search for Caliber and called the Caliber Customer Support number to clarify what the XXXX was and to request that the original XXXX lien be lifted. I assume that Caliber bought the debt from XXXX. The customer service rep could not find any listing for this loan in their data base and gave me a number for the lien/debt collection department. I called this number, got put on automatic hold, and eventually was disconnected. I tried calling 4 more times with identical results. I included the XXXX in my personal income tax filing for XX/XX/XXXX. I now have my house up for sale and have gone through a local Title Company to assist in getting the lien lifted. The Title Company was told by Caliber representatives that company might reinstate the debt collection effort.

Complaint: In XX/XX/XXXX I took out a loan with XXXX XXXX dba XXXX for $ XXXX. Since then I have made all my payments on time that have not been sent to the Investor/Beneficiary XXXX, XXXX, XXXX XXXX, TRUSTEE, XXXX TRUST according to them. Recent cases have stated that the Trustee XXXX XXXX must inform me in detail of all payments made since XX/XX/XXXX to my loan, including those from XXXX XXXX XXXX XXXX XXXX. They has been misapplying my average payment for {$2000.00} usd per month and not posting the correct amount to Principal which leads me to believe this is all fraud on the Bankruptcy court. Sometimes they post {$540.00} to Principal and sometimes {$460.00} which is absurd. Also the charge me fees and costs which I know nothing about. I went through a divorce in XX/XX/XXXX and filed for Federal Bankruptcy Protection in XX/XX/XXXX and have made all my post petition payments as agreed since then, but they have posted them to my pre-petition payments which are being made directly by the Trustee. On XX/XX/XXXX XXXX XXXX emailed me to inquire about my search for a home and to get my realtors information. By mid XXXX I had found a home I desired to put an offer on. I ( through my realtor ) reached out to XXXX XXXX to inform him and to inquire about the status of my loan. I was assured that with his " decades '' of experience my loan would close quickly. At no time prior to or during this process was I informed or advised of any adverse issues related to my loan. On XX/XX/XXXX my realtor emailed XXXX XXXX to inform him of our intent to enter into contract on a desired property. Still, there was no word from XXXX XXXX on any pending or potential adverse action related to my loan. On XX/XX/XXXX I entered into contract to buy a property. On XX/XX/XXXX, a copy of the executed contract was emailed to XXXX XXXX by my realtor. On XX/XX/XXXX XXXX XXXX emailed me of possible loan structuring options available to me. On XX/XX/XXXX during a phone conversation I requested the boiler plate terms and conditions for loan products offered by XXXX XXXX 's company, along with the terms of my specific loan, in writing. At that point XXXX XXXX became aggressive and combative on the phone, but assured me he would have the information I requested emailed to me the following day. On XX/XX/XXXX XXXX XXXX called to inform me my loan had been denied. When I inquired as to why, he stated reasons that could have been ascertained during our initial conversations in XXXX, XXXX. Complaint: Complaint against Corporate Headquarters of Caliber Home loans XXXX XXXX XXXX. XXXX, TX XXXX XXXX, TX XXXX On theXX/XX/XXXX I contacted Caliber home loans to inform the mortgage company that I was XXXX XXXX XXXX and XXXXl and had signed and approved documentation from the Commissioner of the Revenue 's Office. I was told to fax my document to the tax branch at Caliber Home Loans which I did immediately. I later went to the website and enrolled since I just bought a brand new home through XXXX XXXX which they sold to Caliber. After enrolling I sent a message online through Caliber 's Messaging System and attached a copy of the Document that I received from the Commissioner of the Revenue. After two days I called Caliber and was hung up on for no reason because I asked ask about my Exemption of Taxes. I called back and spoke with someone else whom seemed to get the information flowing so I thought. The person that was suppose to process my documents said he called and talked to " XXXX '' and she said I was not exempt and not to process my documents. So the Caliber agent called The Commissioners office to talk with XXXX XXXX Who is the Senior Administrative Executive to the Commissioner. She said on the phone that I was exempt and I will pay {$0.00} in any tax for my home. We hung up and I talked to a woman supervisor in the Tax Branch at Caliber and was promised to have it completed on Monday the XXXX of XXXX. Well today in Tuesday the XXXX of XXXX and I have been hung up on denied to talk to Supervisors and can not talk to anyone but agents that do not want to process my exemption because it doesn't have a dollar amount. They said it was Policy and I asked for a copy of the Policy and was told they don't have email accounts. Today I have made multiple phone calls to get someone to process my exemption as my Mortgage is due on the XX/XX/XXXX. Nobody at Caliber will assist me or let me speak to a Supervisor. I do feel discriminated against because I have never been treated this way before I was XXXX. I served in 15 months of XXXX with a XXXX XXXX 2 XX/XX/XXXXXXXX and a XXXX XXXX. I have been XXXX XXXX Multiple times and XXXX at almost everyday for 15 months. My injuries are forever and the stress that this puts on my family is just about overwhelming. There isn't one person at Caliber Home Loans that cares about XXXX veterans. I had an employee at Caliber say XXXX Your Service before he hung up. Who does that? My XXXX XXXX XXXX Saved my life and was awarded the XXXX XXXX XXXX that I wrote. On my way home tonight Caliber called me and said mine name and my wife 's name and said I can save you money on your mortgage as I hear people in the back ground and pool balls being broken with music in the back ground. Another thing is Where is there headquarters is it in XXXX Texas or XXXX Texas? I don't know what's going on at Caliber but its not fair to me my family, XXXX veterans like myself or be treated this way at all for anyone. My Mortgage is due on the first and my mortgage company will not accept my Benefits for being Tax Exempt and I feel that if I pay my Mortgage I won't get that money back to put toward the principle or even in the escrow. My Taxes from the County of XXXX was back dated and I probably won't get that back either. I feel that Caliber home loans won't process my Real Estate and Property Tax Exemption Document because I am a XXXX veteran. Why can't I talk to supervisors. Why don't they have emails? They don't have direct lines. When you look up this company you won't find specific departments you get a XXXX number to call and they route you around until you get sick and won't call back. I had a XXXX XXXX tonight after dinner because of the stress the Company has put me through. Dealing with this has probably caused me more ailments than I already have. Bottom Line, is I am XXXX XXXX XXXX and XXXXl I have Documentation that I provided to my County and then provide the Tax Document to the Mortgage Company. This is insane.

Complaint: I wrote a letter to the company via fax about putting money against my principal to lower my loan interest at the end of the year. Instead of me keeping my money in the bank with .o8 % interest versus my loan interest which is 3.375 %. The company, did not respond for about two weeks. I call up the customer service and I was told there is a fee of {$50.00} and I was also told that they have a procedure, called the " recast '' that I needed to follow. I told the lady whom I have spoken with to send me the instructions for me to follow.
I received the instruction asking me to pay {$250.00} for processing fee. When I applied for the loan. I remember there is no pre-payment penalty. All I want is to reduce my principal balance and pay my loan as soon as possible and do not want to go to their long process with a big fee. I wanted to pay my loan now but I am still short.
If needed, I can send you a copy of my letter to the company about my intent and a copy of their procedure with regards to this matter to be more specific. I have experienced to pay off my mortgage loan before at no cost with only a minimal fee for money transfer. Thank you.

Complaint: On XX/XX/XXXX XXXX XXXX came to XXXX Florida and we were without power in our home for 11 days. My husband was without work for 3 weeks. My husband is a XXXX XXXX employee in the car business. We called Caliber home loans immediately following the disaster and applied for a 3 month forebenace with the understanding that the payments would be deferred to the end of the loan. The representative advised that we would need to sign the documentation to modify our loan and send it back. I never received the documentations and would call caliber almost every week. When I called at the beginning of XXXX I called to make a payment as usual and they advised that I didnt need to make a payment until XX/XX/XXXX since I was approved for the modification. Keep in mind I havent signed anything yet. On XX/XX/XXXX I called Caliber and told them I still have not recieved the documentations. The Mail came that very same day and finally I received the papers. When I read the documents it stated that it was due on XX/XX/XXXX!!! I literally was on the phone with them and it recorded that I just had recieved it. I quickly went to XXXX XXXX and scanned and emailed the requested documents to Caliber Home loans and I CC my husband on it for his reference. I called back on XX/XX/XXXX just to follow up on the email. They advised that they never received my documents therefore FHA revoked their offer. I was very upset and I felt cheated. Since XX/XX/XXXX I call caliber everyday and one of their representatives ID # XXXX said she sees that the email on the documents was a correct email address but not the correct email for the modification department where all the emails and letters needed to be sent. How was that my FAULT!!!. The representative then told me to send her proof of sent email and the cc to my husband showing receipt of email. I called again on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX to have the same response each time ( that the offer is still revoked ). On Saturday XX/XX/XXXX I received a letter stating that if I do not come current with my loan I am in lieu of foreclosure. I really need help in this matter. I have XXXX kids and I do not work my husband is the sole provider of this family and we feel that Caliber home loans did not handle our acct fairly.

Complaint: My mortgage servicer Caliber is making false and fraudulent claims to me, to Congressman XXXX XXXX 's office and also to your agency. I filed a complaint against Caliber relating to my FHA mortgage loan a few weeks ago. Caliber says one thing in the letter, but the reality is something different and their agents tell an entirely different story. The bottom line is that Caliber has continually refused to conduct an ACCURATE review of my household 's entire financial circumstances and instead puts together bits and pieces. They claim transparency yet never disclose the figures that were used in their calculations. I work full time, my husband works full time and contributes 100 % of his income and my son receives SSI as well. Caliber 's claim that there are not any FHA homeowner assistance programs that we qualify for is demonstrably false. The numbers don't add up, the math just does not work, and I know that there are options such as partial claim or repayment plan that they don't even address, besides loan modification or special forbearance. Their response reaffirms all of my claims about their obstruction of this process. I am being denied access to government programs that should be made available to homeowners in my situation.
After filing complaints against Caliber with your organization I was finally able to get someone to pay attention to me. I was told on XXXX XXXX that they were willing to review me for a modification, and I quickly got all of my paperwork together and sent it in. Just a few days later I was told that now Caliber was REFUSING to review the information because I had a sale date on XX/XX/XXXX. Why would their agent tell me that I should hurry to get my information in for a review and then once they have it refuse to even look at it?
When it became obvious that Caliber was hell-bent on selling my home and not giving me a chance to resolve this matter I was forced to file bankruptcy. Amazingly, they begrudgingly agreed to begin working on my file again. However, I once again ran into issues as their agents were falsely claiming that many documents were missing. I got on the phone at XXXX XXXX XXXX and spoke with XXXX. After a very lengthy phone call and a heated discussion she went through all of the uploaded documents and found that ALL of the requested documents were there.
This company is a joke. XXXX is deliberately denying access to programs such as loan modification, partial claim, special forbearance and repayment plans. We have more than enough income to qualify for one of these programs, but they are more interested in foreclosing and cashing in on the insurance. That is not going to happen, we already have HUD investigating their servicing practices.
