Complaint: This is a new complaint and not a duplicate.
On XX/XX/XXXX Caliber sent me the attached letter and payment history clearly stating that on XX/XX/XXXX I had {$2100.00} ( $ XXXX+ $ XXXX+ {$100.00} ) in my account and they failed to post it as a post-petition payment on my account. This triggered a lift of the automatic stay of my Bankruptcy which has made me incurr in additional Attorney fees and costs, economic and non-economic damages, and punitive damages.
According to the recent XXXX ruling on XX/XX/XXXX in XXXX, Illinois at the XXXX XXXX XXXX United States Court House, XXXX XXXX was awarded {$500000.00} in compensatory damages, {$70000.00} in non-economic damages, {$12000.00} in economic damages and {>= $1,000,000} in punitive damages. XXXX XXXX XXXX, XXXX, XXXX XXXX XXXX, XXXX, and XXXX XXXX XXXX, XXXX. led the litigation team on behalf of XXXX.
My case is very similar in that in XXXX encountered financial troubles and defaulted on the loan in late XX/XX/XXXX. In early XX/XX/XXXX, XXXX XXXX attempted to foreclose on the property. XXXX filed a Chapter XXXX bankruptcy in order to stop a foreclosure and to catch up on the mortgage arrears on her residence. The plan of reorganization was confirmed by the court and XXXX began to make both her contractual mortgage payments along with her Chapter XXXX plan payments. XXXX 's mortgage loan was serviced by XXXX XXXX XXXX for XXXX XXXX until XXXX XXXX transferred the servicing rights to XXXX in XX/XX/XXXX. XXXX made all of her plan payments through the Chapter XXXX trustee and made every single mortgage payment directly to XXXX XXXX XXXX ( XXXX XXXX ) and subsequently to XXXX once XXXX took over servicing rights.
The jury, after deliberating for approximately 7 hours, determined that XXXX breached its contract, violated RESPA for failing to adequately respond to XXXX 's Qualified Written Request, violated the FDCPA and committed both unfair and deceptive acts in violation of the Illinois Consumer Fraud Act. XXXX XXXX was awarded {$500000.00} in compensatory damages, {$70000.00} in non-economic damages, {$12000.00} in economic damages and {>= $1,000,000} in punitive damages. Complaint: Caliber Home Loans currently holds my mortgage loan. I contacted them a couple times to refinance from FHA to conventional loan ( brand new built home 2015 ). They advised each time to wait another year for home value to increase. The house on the next block, same floor plan, sold for $ XXXX more than the purchase price. I contacted Caliber again requesting to refinance. They could not see the home that recently sold in their system and came back with comps in the area that were much lower than actual. After hearing the same spiel " to wait another year '' once again, I contacted another mortgage company ( within a few weeks time from last contact with Caliber ). Apparently the new mortgage company had more up-to-date data, software - they immediately saw the significant increase in home value and began the process for refinancing. As part of a NECESSITY to determine my current loan amount, the new mortgage company contacted Caliber for a payoff amount. They subsequently made a second request, just prior to closing, as I had made a mortgage payment in between the two requests. Caliber charged to me, personally, a {$5.00} fee for each request. This was noted on my statement as " Fee billed ''. Not know what the fee was at the time, I called to inquire. Turns out it was a FAX fee charged to me for the new mortgage company to obtain the payoff amount from Caliber Home Loans. This is gouging the consumer - especially considering the exorbitant fees associated with mortgage loans.
I have worked in healthcare for nearly 40 years. When a physician requests my medical records from another physician, there are no costs charged to me associated with the copies/request. However, if I request copies of my medical records myself, a fee is charged. The same should hold true for a mortgage company to mortgage company request for payoff information. I did not make the request. That piece of information is required in order to pay off the loan. Why gouge the consumer? Had I requested the payoff information myself, sure, charge me. I made no request for a FAX payoff from Caliber and received no FAX, document or service from them, yet was billed {$10.00} on my next mortgage statement - billed directly to me. This, again, is gouging the consumer.
If this is found to be a legitimate charge based on current laws and practices in the mortgage industry, then this practice needs to be reconsidered. I request a refund from Caliber Home Loans in the amount of {$10.00} for FAX fees, in which I made no such request, nor did I receive any goods or service from them.

Complaint: Hi, im in workers compensation and insurance adjustor stopped my checks illegally with out notice to me or my lawyer, the financial hardship its not on my control at that point, i contacted caliber home loans which is the mortgage company and explain to them what has happened, it so happens that my lawyer had my checks reinstated, and i paid all my bills XX/XX/XXXX and XX/XX/XXXX, my credit score dropped from XXXX to XXXX, i disputed with all 3 bureaus experian send me a letter of not clearing the late payment of XX/XX/XXXX, i know is my financial responsibility but it wasnt on my control, i need help fixing this issue cause since i never had problems before with any, once anyone sees my credit history it speaks for it self and my credit is a very caluable asset more than anything, i would like to make a complaint

Complaint: Hi, I am a home owner and this home was financed by a mortgage company on XX/XX/XXXX and the purchase was closed. During the time of the purchase I made 10 % down payment towards the mortage. On XX/XX/XXXX, I made a substantial and significant payment towards the principal and the LTV came down to 11.64 %. I am requesting the mortgage company to cancel my PMI based on the LTV and also have made a written request. But I am being constantly asked to perform an appraisal of the property or the date on which the PMI will expire is on XX/XX/XXXX which does not make sense to me. Because if I continue to make my mortgage payments as agreed the remaining loan balance will not stand until XX/XX/XXXX and will be paid of byXX/XX/XXXXor even before if I can make additional principal payments. The expiry date as they say is based on the original amortization and as I know the PMI has to be automatically cancelled when the LTV hits below 80 % and in my case it is right now at 11.64 %. I am requesting to cancel the PMI based on the original appraisal which happened about 8 months back in XX/XX/XXXXand even the county 's appraisal yearXX/XX/XXXX for the purposes of the property tax is higher than what it was during the time of purchase. I am wondering as per the HPA is it not a protocol to the lender to automatically cancel the PMI based on the LTV. And again the LTV is 11.64 % at the time of this writing and I am current on my mortgage payments and I had never missed a payment. The bottom line is why should I need to go for an appraisal when the LTV is at 11.64 % compared to the original appraisal of the property and I do not think that the new appraisal will be below the principal balance which is far low. I am in total loss as to what kind of eligibility requirements I am supposed to have for removing the PMI when the LTV is at 11.64 %.?

Complaint: I closed on the sale of my home on XX/XX/XXXX. The title company representing the buyer ( True Title Company ) sent a payoff check via XXXX overnight to Caliber Home Loans on the same day. The check was in the amount of {$170000.00}, which was the amount stated on the Payoff Letter provided by Caliber with a good-through date of XX/XX/XXXX.
The payoff check was received on XX/XX/XXXX - confirmed both by XXXX tracking as well as Caliber themselves. Caliber returned the check to XXXX XXXX XXXX that same day, citing a payoff shortage. AT NO TIME DID CALIBER CONTACT ME.
This in spite of the fact that the payoff check was sent with a letter from me, instructing them to deposit the check even in the event it was " short '' for any reason.
XXXX XXXX did not process the return of the check ( which was sent only via standard USPS mail ) until XX/XX/XXXX. At that point XXXX XXXX contacted Caliber to demand that they honor the original payoff letter. Again, XXXX XXXX 's check was returned to XXXX XXXX - and only then - on XX/XX/XXXX - did Caliber contact me.
XXXX XXXX finally learned that the reason for the shortage was a payment to my insurance company 4 days prior to my closing ; Caliber never updated their payoff statement.
In the end, to ensure that the lien was paid off for the new purchaser, XXXX XXXX paid off the home loan for {$170000.00}. XXXX XXXX is now requiring that I cover the shortage in the payoff from the date of closing through the date of the original rejection letter - meaning I owe XXXX XXXX {$680.00}. ( XXXX XXXX has agreed to pay the remaining balance for the time it took to contest the short payoff ).
Caliber 's behavior has been unacceptable. They : - failed to honor their payoff statement ; - failed to follow my signed, Letter of Direction ; - failed to contact me in a timely manner ; - caused me a monetary loss of {$680.00} ; - caused stress, time and other issues.

Complaint: The Whole process buying my house was horrible, I was treat really bad and the numbers were confuse from the beginning to the end, plus a lot of blank addendum pages, ( no signed for me ), never either I got a decent closing Packet documents.
One year passed.
I made some improvement to the house.
plus the house per appraisal had a higher value at closing time. Sold {$210000.00} and the appraisal was {$220000.00}. The balance now XXXX XXXX.
plus I have a lot of byer right now they are offering me {$300000.00} for the house as it is. The only thing that I want The PMI off. I am a single mother in need to reduce the monthly payment I called the mortgage with question about the PMI company, I was told Caliber Home Loan, I said Why? is that correct? that the seller and the PMI company be the same. Contract under my name and Caliber Home Loan.
then I was told that I had a XXXX XXXX Mortgage, I said no, My house was a bank owned house, I bough to Caliber Home Loan. ( there is long sad history about my process buying a house, that I want to share with you because I want others learn from my experience but I will send a letter later to you ) about the seller they say I have Freddy Mae mortgage and I do not know anything about Freddy mortgages and no documents showing that information.
I request documents/information about the PMI being removed from my mortgage and they sent it to me looking good and fair.
But then immediately to that I receive a Shortage letter asking me for {$3300.00} for the taxes last year. I called them and they told me was the insurance and the taxes, the Home insurance no possible I paid in advance a whole year payment {$800.00} at closing time plus I have been doing payments every month for a whole year no possible ( I have the documents from the Insurance company with same amount for XX/XX/XXXX until XX/XX/XXXX ), finally is related to the taxes from last year XX/XX/XXXX.
Taxes for the house Year XX/XX/XXXX {$100000.00} XX/XX/XXXX I am not sure about how much was it. ( I did receive a notice from the XXXX county when a proposed amount for XX/XX/XXXX between {$3000.00} and {$3200.00}, nobody understand why the taxes went up more than 50 % for the house, I do not have even a middle school close for my son, all are far away form the house.
I paid in advance {$700.00} for 7 months at closing time and I paid 8 months from XX/XX/XXXX to XX/XX/XXXX. I can not be short for that amount. I did request an Escrow account disclosure per month from the first day. I did request a mortgage documents. I waiting for them right now.

XXXX started collecting my payment since XX/XX/XXXX. On or around XX/XX/XXXX I called into experian to dispute the account still showing open, yesterday I got my an email about the results of my dispute and the dispute came back verified no changes. I don't know how they can verify the account still open Caliber Homes Loans have sold the loan. The Loan needs to report closed paid in full from all 3 credit bureaus XXXX, XXXX, and XXXX.

Complaint: On XX/XX/XXXX I entered a signed agreement with XXXX XXXX XXXX ( XXXX. ) to represent me in a loan modification program to avoid foreclosure. In this agreement I had to make ( 4 ) four scheduled payments of {$970.00}. Three of four were paid via e-checks. The fourth payment was stopped due to the fact I received my notice of foreclosure from XXXX County PA.Sheriffs Department on XX/XX/XXXX. On this same day I agreed to enter a signed petition under the XXXX County Residential Foreclosure Diversion Program. I have already attended one Conciliation/Case Management Conference with legal counsel XXXX XXXX. The conference was scheduled for XX/XX/XXXX. At this time the plaintiff XXXX XXXX XXXX XXXX had counsel present who requested my proof of income and banking statements for three months. The next conference is scheduled for XX/XX/XXXX Based upon the aforementioned facts XXXX has failed to provide any services to avoid foreclosure. After they discovered the final payment was stopped because I was served with a foreclosure notice. XXXX immediately claimed they got me approved for a temporary trial loan modification of {$1100.00} for ( 3 ) months and no guarantee for a permanent modification or an amount. At this point my attorney agrees that XXXX. is just providing false hope of staying in my home while paying a collection agency known as Caliber. The courts have never been notified of any loan modification temporary or otherwise. Therefore, it is my contention that XXXX. has not provided the necessary services to avoid a foreclosure or Restructure my Mortgage '' as they claimed would be the case in Pennsylvania. Furthermore, they provided documents proving that they are merely assisting the Caliber collection agency to gather three payments of {$1100.00} starting XX/XX/XXXX. Complaint: we were advised our mortgage lender put us under forbearance due to hurricane disaster relief in Florida in XX/XX/XXXX for 2 months, and put payments on the end of loan. when it was time to pay, they extended again stating we can have more time since we were getting roof repaired and not to pay until XX/XX/XXXX XXXX in XX/XX/XXXXthey asked for paystubs since they were under impression myself or spouse job changed. we both have been employed in same job over 5 years. we did send stub what they asked for XX/XX/XXXX and current XX/XX/XXXX. we received a call XX/XX/XXXX, & XX/XX/XXXX collection call stating all of the funds were now due. Asked why, they stated forbearance was closed or denied due to lower income now than it was in XX/XX/XXXX. I stated that was impossible and why was this not questioned or asked prior to them closing it. They said we can apply for a loan modification and if cant afford it will sell the home in short sale. Complaint: I have a mortgage with Caliber Home Loans, since XX/XX/XXXX. The escrow amount for the mortgage had recently increased by about {$500.00} per month due to an increase in property taxes. The payment was {$2600.00} but increased to {$3100.00} effective XX/XX/XXXX.
While Caliber did notify me via postal mail, I did not notice that my payment was going to increase. I typically always pay more than the minimum amount due on this mortgage in order to pay it off sooner, but it wasn't enough to cover the new minimum payment due.
My normal payment of {$2700.00} was received by Caliber onXX/XX/XXXX, but was held in 'unapplied ' status until the remainder of the payment was received on XX/XX/XXXX.
And as you can see from the attached statement, it still is in some sort of limbo status, and my principal balance is not reflecting the payment. ***I have been accruing additional interest due to their failure to post the principle and interest payment when they recieved it on XX/XX/XXXX, and still not posted as of today XX/XX/XXXX.
Caliber made no attempt to call or leave a voicemail on my phone until XX/XX/XXXX.
I have never been late on a mortgage payment. And Caliber is being predatory with this late payment, that was due to a recent change in escrow and the minimum payment due.
