Complaint: At the end of XX/XX/2017, after Hurricane XXXX hit the Texas coast, we applied for a disaster modification through Caliber Home Loans because my husband was unable to go to work for an extended time. At the time, we were told our account would be approved and not to worry about being behind on payments. The representative we spoke to told us to continue to make our escrow payments if we were able.While on the phone, I asked the representative if we should make a full payment for the month of XX/XX/XXXX, if we were back to being financially stable. She point blank told me no, and that all I needed to do was make escrow payments. After this, I called in at the XXXX of every month for the next 6 months to check on the status of our modification and to make an escrow payment. Each time, I was assured that we would get approved and to ignore any foreclosure paperwork we received in the mail, which was at least one letter every week. Flash forward to XXXX, and we received notice via mail that our modification was denied and that we owed a total of almost {$9000.00} in back payments. When we called in to check on this, we were told that our payment would increase with the modification, so it was denied. This possibility was never even discussed with us. On XXXX XXXX, we were told that we could reverse the escrow payments we had been making for the past 6 months to apply to the amount owed, and that if we did this, we would still owe around {$4500.00}. We pooled our savings accounts, and my husband took a loan out against his retirement account to come up with the {$4500.00} we were told we actually owed. On XXXX XXXX we called in to make this payment. We were again assured that the amount of {$4500.00} was all we owed since the rest was in our escrow account. 5 days later, I called in to make our normal monthly payment. At this time, I was told we owed an additional {$67.00} to what we had already paid. Without arguing, I paid the extra {$67.00}. I was again assured that our account was current because the rest of the funds were in our escrow account. On XX/XX/XXXX, we called back in because we received a letter stating we were in preforeclosure. Again, we were told this was an error, and that our funds were in the process of being reversed. We were told to call back on Friday,XX/XX/XXXX to check on the status of our reversal. When I called on the XXXX, I was told that no one was available that could provide information about this process, but was yet again assured that it ( escrow ) was in the process of being reversed. Today, XX/XX/XXXX, we called back in to again check on the status of this reversal. This time, we spoke to a woman named XXXX who told us that the reversal was impossible because our escrow account had already been adjusted and audited for the year. She stated that this took place on XX/XX/XXXX and that the other agents we talked to were probably not privy to this information. We are now being told we still owe them this {$4000.00} ( thats weve continuously been told not to worry about ), and that the process of reversing our escrow now ( if its even possible ) will take months. At this point, our delinquency has not been reported to the credit bureaus, so our credit has not been affected. Yet. However, this entire issue could have been resolved if someone had better explained the disaster modification to us ( and the fact that we could be denied ), or if we had not been told we could reverse our escrow, or if there had been consistent communication on the part of Caliber Home Loans, period. At this point we are seeking the help of legal consul because of this gross miscommunication and lack of disclosure.

Complaint: Caliber Home Loans, Inc., keeps ignorning all my pre- and post-petition payments for the Chapter XXXX Bankruptcy filed in XX/XX/XXXX. Caliber began servicing the loan in XX/XX/XXXX I I had a balance in both the Unapplied Funds and Suspense Accounts for {$920.00}, and {$1100.00}, and and additional {$100.00} and they failed to post them as regular payments. Further, a payment was posted to the loan in XX/XX/XXXX, yet Caliber continued to attempt to foreclose on my property, without complying with all HUD requirements nor proving they have standing to do. I attach a copy of their recent letter stating some of the regular payments I made during XX/XX/XXXX along with an IRS XXXX FORM showing interest and taxes paid to date, and therefore request an audit of the loan. The loan originated on XX/XX/XXXX, with a principal balance of {$310000.00} with a non existent lender called XXXX XXXX XXXX, dba XXXX. The previous servicer of the loan was not XXXX, but another company called XXXX XXXX, XXXX. Caliber allegedly became the servicer of the loan on XX/XX/XXXX. The loan according to them was contractually due for the XX/XX/XXXX and subsequent monthly installments when I filed Chapter XXXX Bk in XX/XX/XXXX. I then proceeded to make all my pre and post-petition payments to the Trustee and Caliber Home Loans as agreed during XX/XX/XXXX as you can see in their attached letter, and non the less, they have continued to foreclose and a sale date is currently scheduled for XX/XX/XXXX. I have requested clarification many times and they continue to ignore me. The payments posted in conjunction with the Chapter XXXX Bankruptcy ( Case Number XXXX ), is now in Appeal with the Bankruptcy Appellate Court ( BAP ). On XX/XX/XXXX. Caliber claims it has not received evidence to support all post-petition plan payments in accordance with the Chapter XXXX Bankruptcy plan, and yet presents them all in the letter attached. Caliber filed a Motion for Relief on XX/XX/XXXX based on misrepresentations, which was granted by the Bankruptcy Court and recorded on XX/XX/XXXX, and Appealed immediately thereafter. Another suspense balance of {$1600.00} during this year XX/XX/XXXX was applied to the XX/XX/XXXX, contractual installment of {$1600.00}, which should have been posted to the regular payment in XX/XX/XXXX. All payments have not been correctly applied to the loan, and Caliber has failed to provide copies of the true post-petition payment history, as well as the loans consolidated transaction history for verification ; therefore, an additional audit is required. It is also important to note that they have failed to establish standing to pursue foreclosure proceedings, and have failed to verify that all foreclosure proceedings have been conducted in accordance with federal and state laws. Their alleged Single Point of Contact ( SPOC ) is never the same person and the Manager named XXXX at extension XXXX at that Department on XXXX fails to return my calls. For the above reasons I request a full audit be carried out immediately on the loan by the CFPB and they order that this unlawful foreclosure be stopped while the BK Appeal is pending.

Complaint: I have tried to due a loan modification with Caliber home loans they have gave me the run around and request document after document from telling me to keep sending in more documents and having me speak to a number of different people leading me to believe they will work with me only to have me fall farther behind and then tell me they cant help me and try to foreclose on the property leading me to more late payments. I am more than 90 days behind the bank will NOT accept a mortgage payment over the phone or online portal. I summited my 1st request for a loan modification on XX/XX/2017, as my mortgage payment increased, caliber home loans home loans sent me a letter acknowledging, all documents were received then turning around and saying additional documents were needed. I then open up an online portal on the caliber loans website to upload documents they needed after looking at the portal caliber home loans still had the same request for those same documents I called the point of contact and they acknowledged documents were received, caliber home loans continue to extend the process. I have contact Caliber home loans and have brought it up to their attention and they have continued to lied. I have many documents, one recording and a phone call log of caliber home loans not answering my call and dropping the call after transferring over to a representative.

Complaint: Dear Sir or Madame, I am a university professor and am under contract to sell my home and purchase a new home that would significantly improve my commute.
I applied for a mortgage with Calibar Home Loans. I initially received a pre-approval letter. My contract to sell includes a contingency clause to back out for failure to complete the purchase but includes a {$2000.00} penalty to do so. I entered into this agreement only after having consulted with my loan consultant regarding risk. He suggested there was " none ''.
I later received an approval for an FHA loan ( attached ). It was presented to me as a " commitment ''. It was presented to me a month before the anticipated closing date of XX/XX/. A week and a half ago, the mortgage consultant I was working with suggested that my " commitment is very clean ''. I presented it as such to my attorney, who, in turn, presented it as such to my seller and buyer.
At the eleventh hour, the month of the closing and after having presented me with an FHA anchored loan commitment, Calibar tells me that they made a mistake and that my student loan debt creates an untenable situation with DTI ratios. Having been through FHA mortgages before, I was well aware of the historical complications with respect to ( and changes made to guidelines respective to ) the calculation of Income Driven Repayment ( IDR ) and Income Based Repayment ( IBR ) payments. Before even proceeding with the loan application, I flagged this issue for discussion with the loan consultant. He told me in no uncertain terms that the calculation was currently based on the monthly payment made reported on the credit report. In the end, Calibar is now stating the proper calculation is to take 1 % of the debt and amortize it as a 30 year loan and use that hypothetical monthly payment for underwriting purposes.
I have good credit ( XXXX FICO ). I have consulted with an outside mortgage broker and they are optimistic that they can find an investor so long as my partner ( Civil Union NJ ) is included in the application. Calibar said they won't underwrite my partner. The problem, of course, is the time this will now take and whether all parties are willing to wait.
I wrote executive officers on XXXX and was promised communication at the executive level. I never received this.
In short, I have been put in a very precarious situation due to Calibar 's *very basic and documented error* and Calibar should be doing everything they can to close the loan. They carry portfolio loans and sell their own products.
I am starting to wonder if my name weren't XXXX and if I weren't in a XXXX relationship if I would be treated with such disregard.
I look forward to a resolution to this situation.

Complaint: Caliber home loans is reporting to the credit bureaus that they have had my mortgage since XX/XX/XXXX and that I was 120 days late on my mortgage in XX/XX/XXXX and prior to XX/XX/XXXX. They have only had my mortgage since XX/XX/XXXX. They bought my mortgage from XXXX XXXX. My mortgage was never late with Caliber Home Loans but in the comments section on the loan it says that I was 120 days late. I have never had a late payment with Caliber Home Loans. I have requested Caliber Home Loans to correct this matter with the credit bureaus. I have also reached out to the credit bureaus to have them correct the information but caliber home loans has been unwilling to correct the matter. I would like for Caliber Home Loans to only report my loan from when they acquired it which was XX/XX/XXXX. XXXX XXXX is reporting my mortgage from XX/XX/XXXX until they sold it in XX/XX/XXXX so there is no need for XXXX XXXX and Caliber Home Loans to report the same data and it is inaccurate for both creditors to report the same data.

Complaint: Caliber Home Loans sent me the attached letter dated XX/XX/XXXX proving that they violated the FDCPA by sending out signed Notices of Trustee Sales and posting them on my property without any individual taking responsibility for trespassing on my property. It is clear evidence that a company called XXXX XXXX allegedly signed a CERIFICATE OF POSTING without a real human being signing it violating the FDCPA. Also, in their extensive letter Caliber fails to address how I had a balance of {$920.00} plus {$1100.00} and paid them {$4900.00} in taxes, as shown on my XXXX XXXX IRS Form if as they alleged in the Chapter XXXX BK I filed I did make the payments as agreed during XXXX? Also they violated Federal BK Laws by not applying my post petition payments correctly and charging my at least {$410.00} in late charges and other fees of {$350.00}. I would like an Accounting done on all regular payments made during my BK in XXXX asap.

Complaint: My house has an FHA loan through Caliber Home Loans. I have been trying to get reviewed for homeowner help programs for many months but Caliber has never completed this review. Every time I call in I talk to someone different. When I send in the paperwork they always lose or misplace it. When I ask to talk with a XXXX speaker I get put on hold and don't get anyone to help me. I am frustrated and now have a sale date on XX/XX/XXXX. I had a temporary hardship but now want to fix this problem and begin making payments again. Caliber has not given me access to the government programs that are set up to help homeowners in my situation like modification and forbearance and others. They are supposed to help me and let me have an account manager who speaks XXXX and review my financial information but they have not done this.
I bought this home about 2 and a half years ago with an FHA loan through XXXX XXXX XXXX that was immediately transferred to Caliber by the time of the first payment. I had a good full time job working in a XXXX when I buy the home along with my wife and adult daughter who live here with me. I had problems when I got laid off from my job in the summer of XX/XX/XXXX I could not keep up and began missing mortgage payments. I did side jobs and XXXX jobs to feed my family but could not find full time work for several months. I tried applying as soon as I went late and sent all of the paperwork in to Caliber but nothing ever happened. I would send in all of the papers but then be told that something was missing so I would have to send that in and this happened over and over and then they would break off contact and then I would have to start over. I never had a dedicated point of contact, it was someone different every time. I had requested to work with a XXXX speaker since that was my native language but that was literally impossible for Caliber to do for me.
I am now working full time doing XXXX and XXXX and in a better place and able to afford a fair mortgage payment. The problem is that Caliber gives me the false statements and ignores my requests for help. Instead of doing a review of my financial information they set me for foreclosure sale.

Complaint: We are currently in Bankruptcy and our mortgage was transferred from XXXX XXXX to Caliber Home Loan in XX/XX/XXXX. We pay an interest rate 7.13 % on this mortgage, however when we receive our yearly XXXX tax form for XX/XX/XXXX from Caliber it was for the amount of {$15000.00} for that year. Caliber just starting letting clients in Bankruptcy receive mortgage statements and have access to their statement online accounts. On this first mortgage statement Caliber stated ( recently paid interest ) {$31000.00}. But this is not the amount on our XX/XX/XXXX ( XXXX ) tax form and they had not posted 3 months of payments to our account online at that time and still show XX/XX/XXXX payment due when we are current. I am making this complaint about Caliber Home Loans, because I feel the interest rate being reported to IRS is not accurate and in their statement they are adding unexplained fees past amount when the mortgage payments are being made each month in full.

Complaint: Originally submitted loss mitigation application on XX/XX/XXXX. Was informed that paperwork was incomplete ( stated that the pay stub submitted for XX/XX/XXXX had been cut off and was not showing all of the deduction information ). Re-submitted XX/XX/XXXX paystub and XX/XX/XXXX paystub on XX/XX/XXXX. Also informed customer service that I was a XXXX and was paid only once a month. At that point, I was informed to re-submit the application, noting that I was a XXXX on an 11 month contract. I re-submitted the application on XX/XX/XXXX and included XX/XX/XXXX pay stub in addition to XX/XX/XXXX and XX/XX/XXXX. On XX/XX/XXXX I contacted the company for an update and was told that i needed to provide the correct tax form. I submitted the tax form on XX/XX/XXXX. I contacted the company for an update and was told once again that my pay stub was missing information. I informed the company that my pay stub was complete and that I explained to the customer service rep how to read my pay stub and where to find the info that was needed. The rep made a note in my file for the underwriter. The rep also informed me that I needed to submit a new paystub for the month. On XX/XX/XXXX, I submitted my pay stub for XX/XX/XXXX. I called a week later for an update and was informed that the pay stub was incomplete. I explained once again how to read my pay stub and was told that a note would be put in my file. On XX/XX/XXXX, I received a letter informing me of my denial with the reason being incomplete package. I called the company on XX/XX/XXXX and was told that the denial was due to my pay stub being incomplete. Once again ( for the third time ) I explained how to read my pay stub and informed the rep that I am only paid once a month. The rep put me on hold and came back to the phone to inform me that there was nothing she could do and that I would have to submit a new application and start the process over. Complaint: I was a part of the disaster recovery modification program since my home was damaged by the storm. In XXXX Caliber Home Loans started me on a three month trial plan. That I successfully complete in XXXX of this year. They sent the letter the second week in XXXX and then said it was due XX/XX/XXXX. A letter that must be notarized for the application to be complete. With transit time, I had less then two weeks to return the notarized application.
I returned it on XX/XX/XXXX and sent it priority mail. I did it as quickly as possible. Fast forward to today and I am getting a foreclosure notice on my home and Calber Home Loans are demanding the {$11000.00}. First, less then two weeks to get a notarized paper back and forth is highly unrealistic. I did the best I could and spent my own money to send it priority mail. Second, today they are telling me that I am no longer eligible for the disaster modification, because I did not get the paperwork back on time and that I have to start all over with a new modification process. After an hour with them on the phone, everyone said I had to start the process over and that the time during my disaster recovery would count against me on my credit report.
I don't want to lose my house so I tried to jump through their hoops, I go to upload the paperwork they want and it wont let me. It says I have to call, error XXXX. It is like they are doing everything they can to try to ensure I go in to foreclosure. How many other people are they doing this to? A two week turn around for a vital document like a notarized loan modification isn't fair and I think illegal. They should be ashamed of themselves for trying to take peoples home who have done everything they have asked of them.

Complaint: We have lived in our home for 34 years.
We made a Loan with XXXX in XXXX of {$100000.00} XXXX was the Lender & the Loan Servicer.
Each month we would receive a " statement '' from XXXX to make our payment.
The payment was {$740.00} In XXXX we filed for Chapter XXXX Bankruptcy in XXXX, MO with Attorney, XXXX XXXX XXXX.
XXXX was NOT included in the Chapter XXXX Bankruptcy, as we were prepared to make our monthly payments to XXXX as usual.
XXXX was notified of this.
We paid off the Chapter XXXX in XXXX Since XXXX XXXX ceased ALL communication with us.
XXXX sent NOTHING No " statements '', No mail, No phone calls, nothing.
We tried calling XXXX for over 6 months We tried to find out where to send payments, but every phone call to XXXX was met with " we can not talk to you about your account while you are in Bankruptcy ''.
We wrote letters to XXXX with no replies from XXXX.
We were always prepared to make the Payments as agreed.
Our Bankruptcy Attorney, XXXX XXXX XXXX, called XXXX and was met with the same answer.
Our Bankruptcy Attorney XXXX XXXX XXXX, told us the XXXX will contact us after the Bankruptcy is finalized.
We paid off our Chapter XXXX in XXXX and still " nothing '' from XXXX.
It has now been " over 10 years '' since our last communication with XXXX and we received a " notice of Foreclosure '' from XXXX.
It is then I contacted our " now '' Foreclosure Attorney, XXXX XXXX.
XXXX has since sold the Loan to Caliber Home Loans, who has filed Foreclosure.
Caliber Home Loans has since sold the Loan to XXXX XXXX, who has filed Foreclosure.
XXXX XXXX XXXX has tried to have us evicted.
Our Attorney, XXXX XXXX, had the Court set a Trial By Jury for XX/XX/XXXX.
XXXX XXXX XXXX has since filed a Unlawful Detainer.
XXXX XXXX XXXX informed our Attorney that they may settle for apprx {$65000.00}.
Knowing that we can not get a Loan while under Foreclosure.
We have no other avenues, as we are on Social Security now.

My opinion : XXXX was supposed to be the Lender & Loan Servicer, but has since turned into a Loan Collector and aggressor.
There is nothing in our Loan agreement that states XXXX has the right to cease ALL communication & not continue to send statements for us to pay the loan.
XXXX caused the loan to go into Foreclosure and made demands " after 10 years '', knowing full well that we as the Borrower did not have sufficient funds to pay the loan off.
Our rights as a borrower has been denied by XXXX & has caused " irreparable harm '' to our credit, home and livelihood.
XXXX has committed fraud on us, as the borrower.
The methods used by XXXX was fraudulent, and designed to obtain a Foreclosure which goes against many Lender / Borrower rights & laws of the State of Missouri.
Had XXXX kept with our agreement and made contact with us, instead of denying contact, we would still be making our loan payments and not be in the position XXXX has put us in.
We contend that XXXX never intended to service the Home Loan in good faith and instead became the collector / aggressor to make the loan move into Foreclosure thru fraud.
Why else the NO communication, phone, mail or any other means from XXXX?
Why else the " over 10 years '' of NO communication, phone, mail or any other means from XXXX?
We have continued to pay our Home Insurance & Home Taxes every year.
We also contend that Caliber Home Loans and XXXX XXXX has NO stake in the ownership of the Loan or our Home, because of XXXX failure to Service the original Loan and having NO contact for over 10 years with us, XXXX has yet to offer any excuse.
XXXX XXXX XXXX " inherits '' XXXX & Caliber Home Loans mistakes.
We should be the " Plaintiff '' & should have the right to sue them for all this XXXX.
We were always prepared to make the Payments as agreed, but " how could we ''? ... ..They would not talk to us or even offer to start making payments in XXXX or even when we received the Foreclosure Notice.

Complaint: This is a follow up on my previous complaint XXXX.
We have a mortgage with Caliber Home Loan ( https : //www.caliberhomeloans.com ), account number XXXX. The mortgage consists of loan and escrow accounts both. OnXX/XX/XXXX, the loan officer XXXX XXXX informed us the escrow amount was wrong. The overall monthly payment should be {$5900.00}, down from the wrong number {$7100.00}. Therefore the monthly mortgage I paid is {$6000.00} from XX/XX/XXXX. However Caliber home loan does not update its system and think we are short of the monthly payment. The consequences are : 1. Our payment balance was messed up, both the loan and escrow account balance by wrong late fee and penalties which caused by Caliber itself. Please refer to the attached account payment history. According to my calculation, till XX/XX/XXXX, my loan balance should be {>= $1,000,000} and escrow balance is {$7000.00}. But Caliber shows the loan balance is {>= $1,000,000}. escrow balance is unknown. 2. Caliber careless mistake leads to both my husband and my credit score sharply drop from XXXX level down to XXXX level. 3. On XX/XX/XXXX, Caliber sold the loan to central loan administration and report ( XXXX ), and passed all the wrong information like escrow amount, loan balance and escrow account balance to XXXX. Although Caliber promised to fix it for us, one month after the transaction, the mistake in XXXX has not get corrected. The record from XXXX still shows our monthly payment is {$7100.00}. After the loan selling to XXXX, CALIBER did not inform us to pay XXXX afterwards. Without the right payment information, we paid our XXXX mortgage {$6000.00} to Caliber still. Although Caliber claimed that it forwarded the {$6000.00} to XXXX on XX/XX/XXXX, XXXX has not received it ever since. When both XXXX and us asked CALIBER to provide the express mail tracking number and check number, CALIBER just could not come up the numbers.
Upon our earlier request to CALIBER on the closing statement and update both loan and escrow balance, we received the update on the escrow account today. It does NOT update anything at all, it does not adapt the new monthly escrow amount of {$1200.00} but using the wrong {$2400.00}. The XX/XX/XXXX payment does not show on payment history. The right escrow number for XXXX and XX/XX/XXXX should be {$1200.00} *2 = {$2500.00}.
How careless and arrogant can a company be by totally ignoring the customer 's request?! When we pointed out there was error on the payment history, they update us with the wrong and current history AGAIN, as a response?!

Complaint: I am behind on my mortgage, but am going to catch up, on XX/XX/XXXX, I spoke with POC XXXX with Caliber. She asked what us my plan for the property. I told her that I will be catching up on my house, that XXXX will be sent to them by friday the XX/XX/XXXX. I asked if I could make a debit card payment online and she told me that I was unable to because of having a bounced check in XX/XX/XXXXof XX/XX/XXXX. XXXX also asked when I could send yhe rest of the money, I said around XX/XX/XXXX, I will be able to send another XXXX and she said good that will catch you up. I asked if that would avoid foreclosure and she said yes. So then I told her that I will have to overnight the payment. I went to USPS on Friday the XX/XX/XXXX, paid to have the cashiers check overnight, Caliber recieved the check on Monday, XX/XX/XXXX at XXXX. On Thursday, I received a call and I forgot his name but he asked what were my intentions with the property. I explained that I talked to XXXX on the XX/XX/XXXX, told her my pkan and the above conversation, and said you recieved the payment on the XX/XX/XXXX.
Then the representative stated that they will not accept single payments as my house is in forclosure and that i need to pay 7 plus grand in full and the attorneys fees in order to get out of foreclosure. I asked why, when on the XX/XX/XXXX, I was told as long as I sent big payments, I would avoid forclosure. He had no answer for that and said my checks would be returned because its not the full amount and unless I have the full amount plus attorney 's fees, then I can get out of foreclosure. I had to end the call because Im so frustrated and stresses.
