Complaint: I applied for a home mortgage end of XX/XX/2018, beginning of XX/XX/2018 and was pre-qualified. I found a home to purchase and entered into a contract XX/XX/18. Caliber Home loans was handling the financing loan for this new purchase. They requested the usual documentation such as the most recent XXXX 's for the past two years, most recent 30 day paystub from employer, last two months of bank account statement, etc. etc. Every document requested was provided to the company. I was selling my property in order to finance a conventional loan with 20 % down and this was disclosed from the beginning of application to loan officer. We were expected to close the same day on both properties, that is my old home and new purchase on XX/XX/18. My property being sold closed but I could not close on the new property being purchased due to the underwriter delaying funding of my loan. She kept on requesting documents at the very last minute, some of which had already been provided to the loan officer, and she kept on questioning information on my application that was clear and evident from documents that I provided to them. She would take 48hrs to review one piece of document and would then request more therefore delaying the close of my escrow on the new purchase even more and causing me to incur extra financial charges by delaying the move to the new property as I had to rent back my old property. She delayed the close of my Escrow on new property by almost a week and this caused a financial hardship for me and my family not to mention a severe amount of physical, emotional and mental stress that caused me to suffer physically by XXXX XXXX XXXX supply as a XXXX XXXX which affected my 6 month old baby. I felt like I was being discriminated against for being a single XXXX XXXX XXXX of XXXX. She requested the child support order that was not even consider in the application as a mean of income for repaying the loan. Even at the time of signing my documents with the notary she wanted me to provide another statement from my retirement account even though the most recent had already been provided. It was the most stressful and horrible experience of my life as I was almost forced to move out of my old property without having a new place to move into and no preparation as she delayed the entire process and I felt like I was being evicted out of my old home and had no certainty as to when I would close and receive the keys to my new home. I have never had such an experience with a home mortgage and I have refinance several times. I would never finance again from Caliber nor would I ever recommend to my family, friend, co-workers or the public in general.

Complaint: I have a 30 yr mortgage with Caliber Home Loans for the past 3-4 yrs. As of XXXX-2018, they began adding on a {$3.00} fee per month for paying the mortgage online. This doesn't seem fair to me. They state that if I setup a scheduled monthly payment cycle on a certain date then the fee won't apply. I'm not able to do this - I manage my mortgage payment based on pay dates between my wife and I. I don't feel that Caliber should be able to add this fee on. Please advise. Thank you.

Complaint: First, thank you for your assistance. Last fall we were victims of the two hurricanes that struck the XXXX and sustained substantial damage to our home, requiring us to relocate for seven months. At the onset of this disaster I contacted my mortgage company to discuss financial options. I was told that due to the calamity that we could be placed in a forbearance to allow additional resources to be committed to our recovery. I was also assured that the payments that would be deferred would not simply become due all at the end of the forbearance, as I specifically asked the question during this discussion. Had I been told that modifying the loan to add deferred payments to the end of the agreement was only an option and or that it was possible that I may have to pay all deferred payments back as a lump sum, I would have declined this offer in lieu of continuation of my monthly mortgage. Subsequently at the end of the forbearance period I resumed my monthly payments and have not missed any. I submitted an application for modification of my mortgage agreement and have had to submit multiple documents for this package to be termed complete. Several time I had been told it was completed only to then get another request for more information. I am still awaiting the determination of the application and now have been placed in a foreclosure status with the deferred payments being referred to as delinquent. I vehemently disagree with this terminology and foreclosure status as I have not MISSED any mortgage payments! I have been called by my personal lawyer stating that he has noticed a listing of my house being in foreclosure status in the public record. So now, not only is this inaccurate description of my account distasteful but publicly disgraceful. The effects on my credit are an issue of concern as well! All of this is compounded by the unavailability of anyone in the supervisory role of my account to even discuss this issue, despite my requests to speak to such party. I have followed all of the instructions that I have been given in the aftermath of what should have been the disaster, this financial wake is proving to be even more burdensome than the storms.

Complaint: My mortgage increased abruptly. I called the mortgage company and I was told that the reason for the increase is due to the home owners insurance. I then called the home owners insurance company and informed them about the increase. the Home owners insurance company set up a conference call with my and the mortgage company. The mortgage insurance lied on the conference call and informed the home insurance company they never received payment. Please be advised my Home owners insurance is deducted every month along with my taxes on my mortgage. I will also upload all documents. The conference all was conducted around XX/XX/2018.

Complaint: Our goal is to prevent a foreclosure on the above property, currently scheduled for XX/XX/XXXX and to obtain a settlement of the alleged default. We are in possession of information which strongly demonstrates that errors during the servicing of the note have occurred and lead to violations of my clients due process and statutory rights. We therefore insist that you suspend foreclosure proceedings for 60 days in order to adequately investigate these errors and make suitable corrections. Dual Tracking has taken place. Dual Tracking is where a servicer is simultaneously evaluating a customer for loss mitigation options at the same time that it prepares to foreclose on a property. With the foreclosure date as XX/XX/XXXX, this is a clear violation of Loss Mitigation Procedures ( XXXX RESPA Servicing Final Rule ) which prohibits dual tracking. Further, in accordance with Error Resolution Procedures as stated in 12 CFR 1024.35 A qualified written request that asserts an error relating to the servicing of a mortgage loan is a notice of error for purposes of this section, and a servicer must comply with all requirements applicable to a notice of error with respect to such qualified written request. This is also goes on to say that the responsibility of the Servicer at this point is to resolve this notice of error Prior to the date of a foreclosure sale or within 30 days ( excluding legal public holidays, Saturdays, and Sundays ) after the servicer receives the notice of error, whichever is earlier. We are requesting a postponement of the foreclosure. The sale date for my home is XX/XX/XXXX. It is abundantly clear that it would be a huge error on the part of the Servicer and that I would suffer material harm if the foreclosure sale were not stopped. If the foreclosure action is not suspended, we will seek an injunction in the appropriate Court for injunctive relief to prevent such foreclosure and to ensure that all the appropriate rights and protections of the Mortgagor have been met.

Complaint: I filed a previous complaint with the alleged Servicer and they have failed to reply. In my inquiry, I stated that I have not received documentation proving that the original promissory note was sold by the original investor to XXXX and then from XXXX to anyone else. I stated that I have submitted various modification requests during this year with no response. I further stated that the {$6300.00} paid directly to XXXX XXXX by the bankruptcy trustee and is unaccounted for on the loans payment history. Additionally, you I provided a copy of a document from the United States Bankruptcy Appellate Panel ( BAP ) regarding Subpoena prusuant to FRCP 45, for an evidentiary hearing and oral argument on XX/XX/XXXX. Loan Background and Status The loan originated on XX/XX/XXXX, with a principal balance of {$310000.00} with XXXX XXXX XXXX dba XXXX. The previous servicer of the loan was allegedly XXXX XXXX, XXXX. XXXX allegedly became the servicer of the loan on XX/XX/XXXX. A Chapter XXXX Bankruptcy ( Case Number XXXX ) was filed on XX/XX/XXXX and an automatic stay is pending. In a previous response Caliber, failed to addressed concern regarding the payments submitted by the bankruptcy trustee, and they failed to verify that all pre- and post-petition payments were accurately posted to the loan and were reflected on the loans payment history. Caliber failed to provide the United States Bankruptcy Appellate Panel ( BAP ) the requested documentation. I told Caliber that I had submitted a loss mitigation application to be reviewed for a loan modification during a conversation with them in XX/XX/XXXX ; however, they claim they did not receive any documentation from me to initiate the loss mitigation process until I filed a complaint the the CFPB, and finally received documentation for a loss mitigation application package on XX/XX/XXXX. Now they claim that additional documentation is required, so they advised of such required documents which have been addressed and remitted and I am waiting for a reply. For additional information or clarification regarding the required documentation, they asked me to contact their Single Point of Contact ( SPOC ) Department at the number below. The documents were submitted by fax to XXXX, and mail to their Loss Mitigation Department at XXXX XXXX XXXX, XXXX XXXX, OK XXXX, by email to : XXXX, or by uploading them through their website. Also they stated if I have additional questions or concerns regarding the loan, to contact their SPOC Department at XXXX. I attach a copy of the BAP Order they have ignored.

Complaint: On XX/XX/XXXX I filed for Chapter XXXX Bankruptcy. Included in bankruptcy was my mortgage from XXXX XXXX XXXX During the bankruptcy proceedings I offered to reaffirm my mortgage with XXXX . However the courts never approved the reaffirmation so the mortgage was never reaffirmed. Caliber Home Loans purchased the account from XXXX after bankruptcy was filed. Caliber claims loan was reaffirmed, it was not. Caliber keeps showing on my credit report that home was " foreclosure '' and " Derogatory '' and " Reaffirmed ''. Mortgage was given back to creditor through Chapter XXXX Bankruptcy. I have contacted Caliber on several occasions and have sent several certified mailings challenging their purposely wrong reporting to credit bureaus. Caliber said they don't have to prove anything and refuses to properly report. Now I just received an alert from my credit monitoring company that Caliber Home Loans, on XX/XX/XXXX, filed a court action against me as a brand new bankruptcy with them. They reported that fraudulently incorrect information on purpose to mess up my credit further.

Complaint: On XX/XX/2018 we closed on our house. I signed a piece of paper in our closing paperwork agreeing to make a payment by XX/XX/2018 in the amount of {$1100.00} of which I paid on XX/XX/XXXX. I received a statement in the middle of XXXX from Caliber home loans that stated the next payment wasn't due until XX/XX/2018. I received another statement in the middle of XXXX that stated once again that the payment wasn't due until XX/XX/2018. I received monthly statements in the middle of XXXX, XXXX and XXXX that all stated our monthly payment was {$1100.00} of which all were paid on time. At no time did it ever say we were behind on any payment as you can see in the attached statements. We were always current up until XX/XX/2018. On XX/XX/2018 I received an email that said thank you for your payment on XX/XX/XXXX. Since I hadn't made my monthly payment yet I logged online to follow up and that's when I noticed that we had a bill for {$2300.00}. I then called Caliber 's customer service line and was told all of a sudden that I had always been paying a month behind. Upon further research I noticed that as of XXXX all of our payments had been reversed and applied to the month previously as shown on the attached payment history. I also discovered the maturity date had been changed on the bills from XXXX to XX/XX/XXXX, which at no time did anyone request this change. I spoke with a supervisor who advised me to send in a dispute letter. Later on that same night I called back to follow up and was advised to make our same payment of {$1100.00} until they could investigate the problem. After not hearing anything, on XX/XX/2018 my girlfriend of whom is also on the loan contacted Caliber Home Loans customer service and was told the dispute department received our letter the day before. We were advised to give it more time for investigation. Later on during the day both of us received notifications that our credit scores had dropped considerably due to 30 day late payment on our mortage. Then again on XX/XX/2018 we contacted caliber home loans customer service once more. At this time the representative advised us that on XXXX an error had been found on the account and was fixed which was causing us to be 30 days behind so we asked to speak to a supervisor who admitted there had been an error corrected but was unable to explain why it had taken 4 months to catch. She then stated that our payment of {$1100.00} paid on XX/XX/2018 was applied to XXXX bill instead of XXXX bill which explained why we were a month behind. The only solution offered was a payment plan or waiting for further investigation to be done from our dispute letter. We were then transferred to the collections department who offered repayment added onto each month for 3 months or payment in full or we could also wait for a resolution from our dispute letter however she indicated errors in the transaction history, but at no point was the damage to our credit scores acknowledged. As this time I stated I was going to file a complaint and contact my attorney. When our attorney contacted customer service within 10 minutes of the last phone call, she was unable to speak to a supervisor. Our attorney was advised that a representative from Caliber Home Loans legal department would be contacting her the next day, XX/XX/2018, via telephone. As of today, XX/XX/XXXX, our attorney nor us have been contacted by the legal department. We did however receive a letter in the mail stating we are 2 months behind even though our XXXX payment was paid on XX/XX/XXXX which is within the 15 day grace period. Upon looking online we see that XXXX 's payment was paid to XXXX.

Complaint: My Equity Loan was originally w/XXXX XXXX XXXXXXXX which they eventually sold my load to Caliber Home Loans. XXXX XXXX XXXX had made many, many, many inconsistencies w/my loan before they sold it & Caliber Home Loans continued to make many more inconsistencies & even made demands that I pay {$2200.00} immediately or they would foreclose on my home. I have always paid my Loan payments on time w/XXXX & Caliber & I always tried to ask both Banks many, many, many times for answers as to why they always charge me late fees, extra interest, Lawyer fees, other fees & also why are my monthly payments increasingly larger. You will see in the documents that I have sent that they have been unrealistic & make no attempts to rectify these issues. I tried in vain many times to talk w/these people at Caliber Home Loans & nobody has ever given me an answer or any help at all. They always turned me away.
