Complaint: XX/XX/2018 My complaint involves the deceptive information used by XXXX XXXXXXXX XXXX XXXX XXXX XXXX at XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, New York XXXX telephone ( XXXX ) XXXX XXXX, to induce XXXX XXXXXXXX to create a mortgage. At the time that the XXXX XXXX was creating this fraudulent mortgage I was XXXX and unemployed. I notified XXXX XXXX that it was impossible for me to continue my mortgage payments and asked him to confer with the bank, XXXX XXXXXXXX, to arrange a program that would allow the sale of the property and the settlement of the outstanding mortgage. What was represented as a form of modification turned out to be a financial arrangement that was onerous and draconian in its cost in fees and new taxes and future interest rates. The result is that the bank is now at the brink of foreclosure and they have issued a to the court a {>= $1,000,000}, which if executed will leave my wife and myself without any equity and we will be subject to abject poverty. Our most valuable asset will be taken from us and the bank will collect {>= $1,000,000} in fees. My wife and I will be destitute based on a mortgage that I would never have gotten based on the true facts rather than the fabrication that the XXXX XXXX used to create an application that the XXXX XXXXXXXX would accept. This was no more than a way for the bank and the mortgage broker to garner tens of thousands of dollars in fees, with no regard for the laws that demand a truthful disclosure of facts, or the negative impact on the people on the other side of their deceptive behavior.

Complaint: I have lived in XXXX, Alaska all of my live and love our state as it offers an ideal life for my family. We vote, pay our taxes, strive to be solid citizens and are bring up our children with good values. However, we have run across a problem and need some help from a person in your position to get us through the storm. We fell behind on our mortgage payments at the beginning of this year and we have not been able to deal with our mortgage servicer directly. Caliber Home Loans tried selling our home early this month, but we were able to stop the sale and we are afraid they will ultimately take our home away if we can not get them to speak with us. Its not entirely their fault as we hired an attorney to help us negotiate our delinquency, but he has done nothing and Caliber said they can only speak to my attorney. I fired him, but Caliber still wont open any discussion that would allow me to keep my home. They have strongly indicated that they will help me with home retention options, if they can speak to me. I am asking for your offices assistance to help me communicate with them to get the ball rolling to save my home from foreclosure. I do not need you to negotiate or get involved in any way except to open the door for me to speak with them. I purchased my home in 2008 and everything was going along fine. My business was doing well and the two rental properties I own were bringing in positive cash flow each month. However, the last two years have been a nightmare as I unfortunately had two very bad tenants. They both stopped paying rent and separately destroyed the homes they rented from me. One tenant brought in over ten homeless people and it was a legal and financial nightmare that cost me tens of thousands of dollars in direct costs, lost wages from all the time I had to deal with the issues and lost rental income. I finally ran out of money getting them out of the home and finishing off the repairs to bring the properties back to a rentable state. This caused me to fall behind on my mortgage payments. I truly did not have an option as I need the rental income to provide for my family. I thought I was doing the right thing when I was contacted by a law firm who promised they could help to get my loan modified. I paid them {$4000.00} and they apparently did nothing. I know I am deep in foreclosure, but I am certain something can be done to save my home for my children.

Complaint: My loan with Caliber Home Loans was transferred to XXXXXXXX XXXX XXXX XXXX after the security was acquired by XXXX XXXXXXXX XXXX. I've been informed by XXXX that there are 2 months of payments missing and that they are waiting on a wire transfer from Caliber in order to reconcile my account. Caliber did not transfer all of the funds associated with my loan and as a result, my account is showing an incorrect balance. XXXX has requested the wire transfer. Caliber has either been obstinate are incompetent in completing the request.

Complaint: Caliber Home Loans has refused to deal with me regarding my mortgage loan delinquency and impending foreclosure. I have been trying to get Caliber to provide me with assistance on our home mortgage, but they have turned their backs on our situation and we are going to end up losing our home through foreclosure if things keep going this way. My wife and I went through some very difficult times in our relationship and ended up separating. During this time we fell behind on our mortgage and were not able to get things back on track quickly. Fortunately, we are back on our feet and can now afford the mortgage payment. However, when I attempted to work with Caliber, they simply ignored my requests for assistance and now I am in a situation where we may lose our home through foreclosure. I have XXXX young daughters and nowhere to go if we are kicked into the streets. Our backs were against the wall and the agents at Caliber couldn't care less. We have asked for a loan modification but it seems they can not get their process together well enough for us to finish the process. I would even take a forbearance agreement to give my family a chance to get caught up, but Caliber has closed the door on that option. I have tried repeatedly to get Caliber to provide us with a solution through a modification, but they are refusing to open a review for assistance. We believe that we have the right to have our loan reviewed for retention options and to obtain a mortgage statement. Their representatives just want to get us off the phone and will engage in discussions to save our home, even though our mortgage loan clearly qualifies for a modification based on the government guidelines. We have never had a single point of contact and we are very frustrated. The end result appears that we will just lose our home through foreclosure unless you can step on and ensure that they service our loan properly. Your agency has made the parameters of loan servicing very clear and we refuse to lose our home through foreclosure because Caliber is failing to properly review our loan for assistance.

Complaint: In XX/XX/XXXX, I received a letter from Caliber Home Loans informing me that my escrow account was severely deficient and that my month mortgage payment was increasing from $ XXXX/month to $ XXXX/month. The reason given was that the new payment would account for the deficiency. I immediately contacted Caliber Home Loans and spoke to their support. Initially, I was informed that my property taxes probably went up and that this was common. I demanded for this to be escalated and was able to get a tax agent on the phone. They informed me that they didn't see an issue, so I logged into my account online and noticed 4 tax disbursements from my escrow account in a matter of 8 days. I asked what those were and after some hesitation by the agent, was informed that there was an investigation going on with my account. I asked for more details and after not receiving any, requested the issue be escalated immediately. I was told that it was being escalated internally and someone would contact me. XX/XX/XXXX - I was contacted by a XXXX in the tax department for Caliber. She informed me that somehow there was a glitch in their system and some parcel numbers for other townships were submitted and taxes were paid for other properties. XXXX informed me that she would be contacting the townships involved to request a refund. She informed me that these payments were all against my escrow account at this time. I requested a follow-up from XXXX on XX/XX/XXXX and XX/XX/XXXX, even if there were no updates, to which she agreed. She also informed me that one of the payments appeared to have already been refunded back to the account in the amount of {$3300.00} Tax payments were disbursed as follows : - {$3500.00} ( XX/XX/XXXX ) - XXXX XXXX ( not my township or my property ) - {$3300.00} ( XX/XX/XXXX ) - XXXX XXXX ( possibly my property, although amount is higher than usual ) - {$3300.00} ( XX/XX/XXXX ) - XXXX XXXX ( a neighboring property, from what I was told. Not my property ) - {$3400.00} ( XX/XX/XXXX ) - XXXX XXXX ( not my township or my property ) XX/XX/XXXX - XXXX called to inform me that she had no updates XX/XX/XXXX - XXXX called to inform me that she had no updates XX/XX/XXXX - XXXX called to inform me that she had no updates, but that she was waiting for a call back tomorrow from XXXX and XXXX townships. I asked what happens if they don't call tomorrow. Her response was that she's contact them again and then wait. I then asked XXXX five questions : 1. What happens when my own property taxes need to be paid again, because they are due in XXXX. She informed me that at the present time, there are no funds in the escrow account and it is actually negative. 2. I asked XXXX why Caliber isn't refunding my escrow account since this was a clerical ( " glitch '' ) on their end. She responded saying that Caliber doesn't do that and that I'll have to wait until the funds are refunded from the townships involved. 3. I asked XXXX what happens if this situation isn't resolved next month because I keep receiving letters from Caliber saying they are changing my monthly payment to increase to $ XXXX/month due to this issue. XXXX informed me that there wasn't anything she could do about that and that would be my new monthly payment until the issue is resolved. She told me she understood how frustrating this is and she has instructed her internal parties that this will cause a hardship on me, but repeated that there wasn't anything she could do about it. 4. I asked XXXX what would happen if I changed my mortgage company and go somewhere else. She informed me that my escrow account is currently negative, so it would remain that way and there isnt ' anything she can do about that. 5. I asked XXXX how to escalate this further as I can not afford that monthly payment and it's going to affect my credit. She said that she is handling it. I told her that it may be time to get a lawyer involved. Her response was, " if you choose to do that, you will no longer be working with me and you will be contacted by someone else that will take over your case ''. She asked if that's how I want to proceed, to which I said yes and she said okay, then this conversation is over. As of XX/XX/XXXX, I have not been contacted by anyone at Caliber Loans.

Problem with a credit reporting company's investigation into an existing problem

Complaint: I am a customer of Caliber and have been for XXXX XXXX years. I need to express my disappointment and reach out to you regarding an issue I am hoping you can correct. We purchased a home back in XXXX of XXXX. We applied and were approved for a 30 year mortgage. 5 days before we closed we received a call to let us know our score dropped due to the consultant pulling out credit too many times. XXXX to be exact and needed to come up with XXXX or go to a 15 year mortgage to be approved. We accepted the 15 year and have been making payments on time ever since. Recently we ran into some medical issues for our son and contractor issues. Because the payment has us on a pretty tight budget we wanted to see what Caliber could do for us. They suggested we apply for a forbearance. We were approved for 6 months and a lower payment. The paperwork was confusing so we called to find out what this would do to our credit. We have a stellar payment history and did not want this to affect it. We were told by several associates that it would show up as a forbearance not a XX/XX/XXXX etc day late. We were told it would not impact our credit that way. We decided to do it. Made our first payment and were reported 30 days late. We have acquired the money to get caught up and we are canceling our forbearance and paying the balance this week. I want caliber to remove this 30 day late due to the incorrect information given to us by your staff. We would have never entered into this agreement if we were given correct info. XXXX ID XXXX was one of the reps we spoke to last Wed. We also had a recent issue with our XXXX fees not getting paid. We have been chasing caliber since XXXX. We have XXXX late fees with our XXXX company. We finally received a letter saying it was paid. The amount of {$48000.00}. Our HoA fees are {$180.00} a year!! They paid someone elses bill out of our escrow. Im furious. Im so disappointed in this company. There seems to be issue after issue. I want this late removed!!! I have emailed and Am waiting on calls back from supervisors in customer service but they never respond. Caliber is an unethical and not looking out looking out for their customers best interests.

Complaint: I took out a home loan on XX/XX/XXXX with a principal balance of {$310000.00} with XXXX XXXX XXXX dba XXXX. The previous servicer of the loan was XXXX XXXX. Caliber Home Loans claims to have became the servicer of the loan owned by XXXX in XX/XX/XXXX. A Chapter XXXX Bankruptcy ( Case Number XXXX ) was filed on XX/XX/XXXX, while an Appeal from a previous BK is pending for oral hearing on XX/XX/XXXX and Caliber has yet to appear before the Court. Caliber sent me the attached XXXX and you can clearly see the post-petition payments during XXXX were made and they have ignored this. The federal employer identification number ( EIN ) reflected on the XXXX Form XXXX does not correspond to Caliber, but rather to their 401k Employee 's Account and this needs immediate clarification. Caliber has failed to post all payments made since XX/XX/XXXX, my credit has been negatively impacted, and the loan balance has been increased by {$50000.00} due to unlawful fees and costs charged with no Court Approval or Order to do so. XXXX XXXX si the owner of the note and has not notified me that the loan was attempted to be sold. The loan went through a XXXX loan modification and is thus a non-negotiable instrument pursuant to the UCC 3. XXXX XXXX can not legally sell the Note. The Assignment of Mortgage and Note endorsements are fraudulent, therefore I request a full audit of the loan. The attached subpoena has been sent to all the parties involved. Caliber has failed to properly report my payment history and information to the Credit Reporting Agencies ( CRAs ) regarding the loan since becoming the loans servicer on XX/XX/XXXX. According to Caliber the loans uncollected fee balance is {$3000.00} as of the date of this letter? We continue to contact their Single Point of Contact ( SPOC ) Department at XXXX and have not received any adequate reply to our concerns.

Complaint: I filed bankruptcy which results in the note being canceled. After bankruptcy I noticed I have a new account number that says my loan had started completely over. At this point I started researching. Ive been in the house for 4 years, paying more money every month than my mortgage statement said I owe. How is it possible after bankruptcy I have a new loan number and my debt started over from the beginning. I DIDNT AUTHORIZE A NEW LOAN. If the loan started over why wasnt I reimbursed the money I had paid towards my loan for the past 4 years. I started questioning the servicer. The servicer did not answer any of my questions directly. I paid money towards a modification and the servicer claimed they lost my documents so I had missed the deadline. I sent the documents over 3 times. I have files to prove my claims. I am aware that a promissory note is equivalent to cash value once signed. I am aware that value has to be given to secure rights that are set forth in the mortgage contract and no value was given in this case. I am aware that without the original note the mortgage contract is null and void because both instruments are required by law to lawfully foreclose on the mortgage contract. I am aware that UCC 3-501 requires a servicer to show authority to make a demand for payment. If the servicer will not exhibit the note or perform other legal requirements when requested to do so by borrower, the borrower is allowed to discontinue payments without dishonor until such time as the note holder or servicer complies with ALL laws or contract provisions. I am aware UCC 9-203 ( b ) defines attachment and enforceability and in order for the security interest to attach the collateral value must be given. I have contacted the servicer via mail with a certified QWR several times without proper correspondence. I need CFPB to help me get the answers I seek before this servicer attempta to foreclose on my mortgage illegally and evict me from my property unlawfully so that they can file an insurance claim on a debt that was never valid.

Complaint: Three years ago I purchased a house for XXXX. I recently sold it for {$220000.00}. Yesterday I received the HUD and it showed a {$13000.00} second mortgage that I didn't know I had. So, in essence I would have to come to the closing with {$10000.00}. I received a loan modification an year and a half ago, they told me that that Mortgage would be tacked on the back of my loan. I never received copies of any documents after this was completed. I kept inquiring and they said it takes months to get the documents back. Due to Hurricane Irma, losing my roof and losing my job I applied for another modificiation last year. In XXXX they denied me first because I had already gotten a modification then they denied me again because I had my house for sale. All this time my interest is accruing and I am ready, willing and able to pay my mortgage. I called to get my payoff, they told me it was {$200000.00} and NEVER mentioned anything about the second mortgage payoff. I also never received anything in writing either, it was verbal over the phone. If I had actually received a letter I would have read the teenie tiny fine ( an 8 or 6 font ) print on the second page that states " if you have partial claim that amount will not be reflected in the payoff ''. How would I know what a " partial claim '' is? I never received copies of any of the executed documents. I reapplied for another modification and then sold the house. Now Im at the closing table and I see this second mortgage that I didn't know existed as nothing was ever explained to me, my payoff is {$200000.00} ( plus {$13000.00} due to HUD for second mortgage ) when I financed {$200000.00} 3 years ago. I call Caliber about this and they say you are in a Loan Modification, I said how can that be I was never informed. They said they sent out a letter on XX/XX/XXXX which I also never received. I had tenants living with me that I made leave, I had to relocate my daughter and sell my house because I was denied. I have sold all the contents of my house and here I am at the closing table needing {$10000.00}. Caliber tells me now that I can do a Short Sale and walk away with nothing. Then they suggest that I get the Buyer to pay XXXX more for the house or perhaps get the Buyers realtor to come down in his commission. Caliber had not apologized for providing inaccurate information, they SAY they send correspondence and dont. Now the Buyers realtor is also their Landlord so it is believed that he isn't presenting the full picture, he is okay with waiting on the Short Sale because he still gets his rent while they wait. Caliber has given me two different modification decisions, they gave me an inaccurate payoff quote. I would NOT have sold my house for less than what is owed under any circumstances. I called Caliber to ask who I spoke to that day so I could get his name, their " conveniently '' isn't any record of the call. Im am sick to my stomach, there has to be repercussions. I am not preforeclosure, if they even waived a small portion of the late fees and interest we could help get this loan closed. I don't know what to do but I do know that this is VERY WRONG and what they told me was wrong and now I make nothing off my house. I have asked them for copies of my denial letter and my approval for the modification letter, they said they had to get clearance to produce it.
