Complaint: After I obtained my Mortgage with Caliber Home Loans I filled out an application to withdraw my payment on a certain day of the month. My first application I filled out was for the XXXX of the month because that's when I got paid. It was approved, however, they started to automatically withdraw a couple of days before the XXXX of each month. In XX/XX/2018 I contacted my loan processor XXXX to which she suggested that since my check didn't come in to my bank until the XXXX, to redo the application to reflect the XXXX of each month. The Mortgage company approved the payment deduction to reflect a XXXX date of the XXXX of each month. In XX/XX/XXXX I contacted my loan processor again and at that time, she contacted Caliber to which they replied that there was nothing wrong on their end and suggested that I contact my financial institution. I called my bank and the CFO to ask the procedure to which she replied that they do NOT take out payments early, they take them out when the debit it submitted. Since XX/XX/XXXX, Caliber has taken my payment early and I cant seem to get a response to find out why, although they did call me to talk about refi programs. I do not understand if you give someone the option to make a payment on a certain date then take it out as you please then why offer it in the first place. When it comes time to refi, I may have to question whether or not I will go with a company that wont stand by what they offer.

Complaint: Due to my divorce I am unable to pay the mortgage I made an attempt to pay the mortgage but the servicer Caliber Home Loans returned the payment. My kids live with me and we are afraid we will be left homeless during the holiday season. I retained a real estate agent who has had the property for sale since XXXX but due to the house not having a garage and being in front of a elementary school it has not been sold. We've also reduced the price of the property significantly in order to make it more marketable and we are still unable to sell it. The agent requested to stop the foreclosure process with my servicer but my servicer continued with the process.

Complaint: In or around XX/XX/2018 XXXX XXXX was approved for a loan modification. On XX/XX/2018 XXXX XXXX submitted an appeal of the loan modification offer. Pursuant to Regulation X, 12 C.F.R.
1024.41 ( h ) ( 4 ) a loan servicer is required to keep an offer of loan modification open until no less than 14 days after the loan servicer completes the appeal. On XX/XX/2018 XXXX XXXX, an attorney for Caliber Home Loans, notified Mr. XXXX that, since he rejected the modification offer, " your default can not be cured '' and the property was now subject to foreclosure. XXXX XXXX did not acknowledge the right to appeal or the deadlines prescribed by Regulation X. Caliber then advanced foreclosure while the appeal should have been pending in violation of Regulation X, 12 C.F.R. 1024.41 ( g ).

Complaint: I have a mortgage on my home with Caliber Home Loans, XXXX XXXX, OK. I have been trying for several years to get a loan modification application approved to get my mortgage payments lowered and a better interest rate. The VA is also on the mortgage as my husband was a XXXX XXXX veteran. Unfortunately, my husband passed away in XX/XX/XXXX and the mortgage is in his name ONLY. Caliber sent me a loan modification agreement with a letter dated XX/XX/XXXX. The agreement had signature lines for my husband 's name only. Caliber had already supposedly put the account in my name as " Successor of Interest '' for the mortgage. My husband passed away XXXX. I called Caliber to ask them about my husband 's name being on the signature line of the loan mod agreement. The representative I spoke to did NOT have a copy of the agreement on his computer, but told me to just cross out my husband 's name and sign my name on the agreement. I signed the agreement in front of a Notary Public and then mailed the agreement to Caliber in the overnight mail. I did not hear from Caliber and called them on XX/XX/XXXX. The Caliber representative informed me that the agreement was dated for XX/XX/XXXX and Caliber was NOT going to accept the agreement and they were proceeding with the Sheriff 's sale of my property. I spoke to a VA representative on XX/XX/XXXX in XXXX who is servicing this account. That rep informed me that she could see on her computer records that Caliber had APPROVED the loan modification application in XX/XX/XXXX and again in XX/XX/XXXX. I never received this approval from Caliber nor did I receive an agreement from Caliber. My husband was still living in XX/XX/XXXX so he would have been the one to sign the agreement, but we did NOT receive that agreement. This is a super mess and has been ever since we started doing business with Caliber Home Loans several years ago. I have submitted NUMEROUS loan mod applications over the years and Caliber holds onto the documents long enough for them to become outdated, and then they request new, updated documents so I have to start the loan mod application all over again. I have over twenty-five ( 25 ) years ' experience in the XXXX field and am currently XXXX for XXXX XXXX. I keep very good records of everything which has taken place during this process. We had asked for a modification when my husband retired and I was not working. I have been XXXX for XXXX XXXX for the last four ( 4 ) years and am able to make my mortgage payments on time each and every month. But Caliber has never been interested in that fact. They prefer to play games and keep me on a merry go round and in suspense as to whether or not I will be able to keep my home. I did a XXXX search on Caliber Home Loans and a large number of lawsuits and class action lawsuits popped up where customers have sued Caliber for many of the same issues I am having with them. The rep at the VA suggested I file a complaint with you so that maybe you can investigate this terrible mess and possibly help me to keep my home. Complaint: My home was damaged by a massive tornado and hail in XXXX. I have been very sick and out of work since XX/XX/XXXX. I used my mortgage payments to pay for removal of massive trees that were uprooted and thrown on my home due to safety concerns along with repairs to deck railings. The insurance company sent funds to mortgage company and mortgage company will not pay my arrearages nor will they return my funds to me to pay them. They keep giving me different stories and holding my funds. There are still Thousands of dollars in repairs to be done, but contractors will not even come out for estimates now because they know they will not get paid and they cant afford to wait 6 months for their money either. This is fraud on part of the mortgage and insurance company.

Complaint: Caliber is my mortgage company for my primary and only residence. Last year and this year, the mortgage company did not pay my property taxes ( although they are impounded into escrow per our contract ).
Last year, after discovering my property tax bill was in default, I contacted Caliber who eventually paid the default bill. Caliber responded by raising my monthly payment and forcing me to pay $ 500+ in late propert taxes. This year I discovered my property tax bill was once again in default. Despite me paying my mortgage on time, Caliber has not paid the taxes or responded to my many request. I am in great fear they ( Caliber ) may not pay the default tax bill or raise my mortgage once again despite the valuation and tax rate remaining the same and a fixed FHA loan. I can not afford for my mortgage to be raised again.
I believe Caliber is committing fraud. Please help my family and I.

Complaint: I have repeatedly requested information on 1 ) how to remove escrow from my mortgage account with Caliber Home Loans, 2 ) and have twice requested by written letter it be removed.
I requested the escrow account be ended on at least 2 separate occasions before I received instructions on the required process. The first was over the phone after I recast the loan following a very large principal payment on XX/XX/XXXX that put the mortgage account well over 20 % equity. That was followed by messages submitted in the online messaging center and over the phone in XX/XX/XXXX and XX/XX/XXXX. This was a long, drawn out process due to the fact that at every step of the process I was given incomplete information ( e.g., it took two months and multiple requests for the required recast request form to be sent. When I submitted the recast request, I included a note to remove the escrow. This was ignored. Eventually, I decided to wait until my homeowner 's insurance and property taxed were paid before removing the escrow account.
On XX/XX/XXXX, I sent a signed letter with the instruction to remove my escrow account to the address provider ( Caliber Home Loans, Inc Attn : Escrow, XXXX. XXXX XXXX, XXXX, Ohio XXXX ) On XX/XX/XXXX, I sent the request again via certified mail which was delivered on XX/XX/XXXX at XXXX XXXX.
I am today filing this complaint with the Consumer Finance Protection Board and sending a letter ( via certified mail ) to Caliber 's inquiry and dispute address : XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX.

Complaint: Recently, our mortgage account was transferred from XXXX XXXX XXXX XXXX to Caliber Home Loans. Caliber Home Loans have rejected our payment claiming that the amount due is {$45000.00}. We entered into a contract with previous servicer and is therefore binding. I have attached the repayment agreement on which i have abided by terms under the new contract. The contract states the repayment plan expires on XX/XX/XXXX, yet caliber Home Loans are requesting an amount the does not comply with our contract. Caliber Home Loans have engaged in Floridas deceptive business practices. The servicer continues to deny that such contract exist and moving forward with the foreclosure action. On XX/XX/XXXX, i have been making payments timely accordantly to the contract, however the foreclosure case was never dismissed. When a defendants enters into a repayment plan the foreclosure action must be dismiss because the defendants have entered into a loss mitigation agreement with servicer. The foreclosure action has not been dismissed and Caliber is seeking a sale date yet i have been making timely payments since XX/XX/XXXX. We ask the Consumer Financial Protection investigate this matter, it is clear on its face that Caiber Home Loans have engaged in Fraudulent banking and business practices.
