Complaint: My home is in a DECLARED NATIONAL DISASTER area due to the wildfires, I have applied and requested disaster assistance and forbearance but in the middle of the review my loan was transferred to a new servicer and they will not push or hold the sale date to review the disaster request. I have tried to contact them for over a week but they kept telling me that they do not see my account information because it is in the transfer process. I have a sale date in 3 days, but I am a disaster victim. Please help me

Complaint: My husband and I obtained a mortgage as co borrowers. he was later diagnosed with XXXX. when he passed away I made the mistake of furnishing a death cert. the account then changed to the estate of my husband. In 2018 I paid off the mortgage with an escrow balance. the balance was sent to me in the name of THE ESTATE OF ... .I CAN NOT CASH THE ESCROW REFUND. I am told I have to open up probate in order to cash the check ... II have tried several times to fix this, I hired an attorney to try and straighten this out. since I am co borrower the title goes to me. the lender never contacted me about the attorneys letter and the return of the check. the lender never voided the returned check, and will only issue a check in the estate of my husband. I am told I have to open probate for one check. everything else was put in my name because he knew he was going to lose his fight with XXXX. Is there anything I can do? I need help. being a widow is bad enough on social security without having to take care of things like this. the lender was supposed to pay the property taxes out of escrow and did not. forcing me to take money I dont have out of pocked to pay the property taxes on time. this is a hardship. please help

Complaint: We took out a mortgage with XXXX XXXX XXXX in XX/XX/XXXX. In XX/XX/XXXX it was purchased by XXXX XXXX and the alleged servicers have denied this fact so they have committed fraud on the Court and violated FDCPA, RESPA, TILA, FAC, etc. We have requested further information regarding the CANCELLED NOTE and they have yet to provide it so we have contacted the FBI to investigate. We have an automatic stay in place with the XXXX XXXX and have filed for an Order to Show Cause ( OSC ) why the Servicers and Trustees are not in contempt of Court for violating the automatic stay and have repeated that we want all the documentation regarding this loan including the CANCELLED NOTE as soon as possible.

Complaint: I applied for a loan modification, after falling back on my payments. I submitted documents for a modification in late XX/XX/XXXX. I sent ALL documents the bank requested, as I was cognizant of the faxf that a full application package has to be received prior to 37 days of a scheduled sale date of XX/XX/XXXX. On XX/XX/XXXX, the bank had confirmed that they have a complete package, therefore bearing the 37 days threshold. I was further advised that the underwriter may request other documents during the process if needed. Contribution letter and paystubs from the contributor were requested and sent immediately upon the request. The underwriter then asked for a lease to be completed. When I spoke to XXXX at the bank, he said the lease for the amount of {$900.00} is not complete. XXXX tried fi find XXXX reason the underwriter said that, by examining every page of that lease. He then said its the tenants initials that were missing on page 5 of that lease. I immediately obtained the initials and sent back. XXXX had said it was the last piece of document they were requesting. On XX/XX/XXXX at XXXX. I called in the same day, AND also the day after New Years Day. and it was confirmed as recieved. Fast forward to today XX/XX/XXXX, when I called in just to make sure things were moving, and was told nothing is being processed because we are within 16 days to sheriff sale, and the underwriter was asking for something else he FAILED to request when he indicated that the initial on the lease was the last thing he needed! Please note i sent in the last document on XX/XX/XXXX and it was confirmed as recieved. Underwriter failed to request specifically what he needed, so kept on asking for docs that obviously didnt satisfy the issue he had, which up until this minute, we havd no idea what that is. Allbwe know is that we sent ALL documents requested immediately as they were requested and was done befits their designated 16 day day window. It is the banks fault, not ours.

Complaint: We fell behind due to Hurricane Irma and received a " Special Forbearance '' and have submitted packages 5 times to resolve this issue each time we are told we have to submit another package which we do. We were told in XX/XX/XXXX all we had to submit was a pay stub from XX/XX/XXXX before Irma and a recent pay stub along with proof that the work on the work had been completed which we did. We had our authorized third party XXXX XXXX XXXX call in XX/XX/XXXX and no one there remembered what we had discussed. So they said it was " the holidays '' and to call back afterwards. We called on XX/XX/XXXX and we were told that they were still looking into the issue and to call back in a couple of days so they could log those pay stubs and info on the home repairs on the system. We called today XXXX and we were told we could fill out a new package if we wanted to avoid foreclosure. This has been going on for over a year now and we don't want to lose our home, but it is apparent this company does not care.

Complaint: Caliber Home Loans is using faulty information in the servicing of this mortgage loan Caliber Home Loans has failed to deliver required foreclosure protections. Caliber Home Loans has engaged in the prohibited practice of dual tracking while having received timely all the required documents and financial information from the borrower. The CFPB issued amendments on XX/XX/2014, The rule issued establishes new protections for consumers, including requiring servicers to notify borrowers when loss mitigation applications are complete : Whether a borrower is entitled to key foreclosure protections depends in part on the date a borrower completes a loss mitigation application. If consumers do not know the status of their application, they can not know the status of those foreclosure protections. The final rule requires servicers to notify borrowers promptly and in writing that the application is complete so that borrowers know the status of the application and have more information about their protections. The CFPBs new rule clarifies that, if a servicer has already made the first foreclosure notice or filing and receives a timely complete application, servicers and their foreclosure counsel must not move for a foreclosure judgment or order of sale, or conduct a foreclosure sale, even if a third party conducts the sale proceedings, unless the borrowers loss mitigation application is properly denied, withdrawn, or the borrower fails to perform on a loss mitigation agreement. Complaint: A few months after we closed on our new house I received a tax bill. When I called Caliber I was told that they pay our taxes automatically and that I didn't need to send them our bill. I mailed them the bill anyway and assumed that it was taken care of. At the end of XX/XX/XXXX, I received a notice from the tax collector that our taxes were passed due and that we would need to pay a 10 % penalty. The notice also said that if the taxes were not paid by XX/XX/XXXX, liens would be filed against our house. I contacted Caliber on XX/XX/XXXX to notify them of the issue and to ask them to resolve it. I called more than 10 times since to check on the status of my tax payment. From XX/XX/XXXX to XX/XX/XXXX, I was told that the tax department was trying to contact the local tax collector and that they were unable to reach her. I talked with the tax collector many times during that time period, so I'm not sure why they had so much trouble. After a month of calling I was told by Caliber that my taxes were paid at closing and that I needed to talk with the title company to resolve the issue. I contacted the title company and after reviewing the closing statement, we determined that not only were the taxes not paid at closing, but Caliber had failed to escrow the amount necessary to cover the taxes. I called Caliber again and was told that they were still trying to contact the tax collector. I asked what information they needed and they told me that they needed to confirm the amount due. I told Caliber the amount due numerous times but this time I offered to upload the tax bill. I uploaded the tax bill on XX/XX/XXXX and called back on XX/XX/XXXX to confirm that Caliber received the bill. The person that answered confirmed that they had the bill but they still needed to contact the tax collector. I asked to speak with a manager because if they haven't been able to contact the tax collector for more than a month, they probably wouldn't be able to contact her in the next week. The manager, XXXX, apologized for the mix up and said he would personally follow up to ensure that my taxes were paid. I called back on XX/XX/XXXX to confirm that the check had been sent out but the person I talked to said that they still needed to contact the tax collector and the next follow up was scheduled for the following week. I was so frustrated by this point that I hung up on the guy. After XXXX on the XX/XX/XXXX, I called again. This time I was told that Caliber needed to contact a third party tax collection company to handle the issue because the taxes were delinquent. I talked with the local tax collector numerous times and she never mentioned this third party company. I again asked to speak with a manager and this time I spoke with XXXX. XXXX told me that he would do everything he could to resolve the issue and that he would call me back to follow up. XXXX did call to follow up and left a message saying that they still needed to contact the third party company to determine how much was owed. I called Caliber back on XX/XX/XXXX and I was told that they were unable to contact the tax company and that they were scheduled to follow up on XX/XX/XXXX. I told them that wasnt good enough and that liens would be filed if they didnt send the check. I called the third party company and the message said that their office was closed until after XXXX XXXX. I called Caliber back and asked to speak with XXXX. XXXX is a manager in a call center and there was a limit to what he could do. I was not able to speak directly with a representative from the tax department. I ended up paying the taxes out of pocket. I had to pay the 10 % penalty instead of the 2 % discount I should have received if Caliber had done their job. If the money had been withheld properly at closing, which is Calibers responsibility, this wouldnt have been so bad. But having to pay this much money at this time of year really hurts. Im going to continue to call Caliber to get the difference between the discount and penalty amounts but Im not confident that they will make it right.

XXXX XXXX was to take over my payments XX/XX/2018 caliberhomeloans told me to make the XXXX payment to caliberhomeloans and they would transfer the payment to XXXX XXXX ... .now its XXXX and caliberhomeloans will not transfer the payment and XXXX XXXX is starting i am behind in escrow and they have to raise my payments ... XXXX XXXX has been holding all my payments in a suspend account not applying my payments. I told XXXX XXXX i made XXXX payment to caliberhomeloans and XXXX XXXX said they would get the money from caliberhomeloans but its XXXX and XXXX XXXX has not solve the problem and stating my payment will go on top of my monthly payment i paid XXXX XXXX estra dollars to try to solve the problem but XXXX XXXX did not apply theXXXX dollars to my escrow i want to know why caliberhomeloans did not transfer my XXXX mortgage payment and why XXXX XXXX is holding my payments in a suspense account ... ... also i have received caliberhomeloans and XXXX XXXX documents with the same address and same po.box number something is wrong here..can someone please help solve this problem

Complaint: XX/XX/XXXX Dear Sir or Madam : I am writing to dispute late payments reported on my Mortgage account with Caliber Home Loans. ( See attached documents showing payments made on the account. ) Caliber Home Loans is stating that I have been late in my payments to them for the last two months. However, this information is not correct. It is inaccurate. I am requesting that the item is removed and that these payments are updated as being paid on time. Enclosed are copies of payment confirmations from Caliber Home Loans and my bank which note the payments were paid to Caliber Home Loans for the two months in question. I have also included statement information from Caliber which shows under the Trans Nam e and Trans Amt the payments I have made to Caliber Home Loans during the months they have stated that I paid the account late. I have been making lump sum payments above and beyond the required amount to pay off this loan over the last several months. In XX/XX/XXXX I paid the account in the amount of {$4000.00} In XX/XX/XXXX I made a payment of {$390.00} In XX/XX/XXXX I made a payment of {$1000.00} I have highlighted these items for your review. Also included is a copy of the payment confirmations from Caliber Home Loans of these payments. I have also reached out to Caliber Home Loans to try to settle this issue over the last 4 weeks. After being told repeatedly over 11 times prior to XX/XX/XXXX, that this matter would be resolved, and my credit reporting would be updated as being paid on time, I was told that the deferred balance which was part of a loan modification agreement obtained in XX/XX/XXXX was due in full and that the credit reporting would continue to be reported as delinquent. I stated to Caliber Home Loans that there wasnt any notice given to me during the time period I was talking to their Supervisors and Customer Service Representatives and that these items would be reported negatively. Also, in reviewing my loan modification agreement, it states that the final amount due on the maturity loan is in XXXX not at the completion of payment of the principal payments. Additionally, Caliber Home Loans has now sent me a letter on XX/XX/XXXX, stating that there is {$.00} owed on my account, which has been paid as evidenced by the letters showing confirmation payments by Caliber Home Loans where they are stating if I do not pay the {$.00} by XX/XX/XXXX, my property will go into foreclosure. Here is a history of my calls with Caliber Home Loans to resolve this issue since XX/XX/XXXX, when I became aware that they reported my account as being paid late : 1. ) XX/XX/XXXX, @ XXXX XXXX XXXX - Teller ID XXXX Discussion of the past due amount of {$.00} on my account which is causing the account to be reported as late. XXXX stated that for XXXX and XXXX they would backdate the payment and update the credit report to report the payments as made on time. Please note a confirmation of payment {$.00} was made on XX/XX/XXXX, sent via Caliber Home Loans, and a copy of this payment is attached in the enclosed documents. 2. ) Contacted Caliber Home Loan on XX/XX/XXXX, @ XXXX XXXX XXXX Teller ID XXXX The balance on the account is {$3900.00} XXXX noted she would escalate this manner to her Manager. She said they would have to manually go through cashiering to take the XXXX ( {$.00} ) out, but the credit report would be updated as well to reflect timely payments. I was also advised that I could dispute this matter on my credit report too. She also noted that the lump sum payments which were made in the system were applying as a short payoff each time, reporting the payments delinquent as {$.00}. Cashiering was applying it to the principal balance. I was advised to make lump-sum payments over the phone so they could put it in the system manually. There was also an open ticket for cashiering to correct the payment as a current payment and to keep a balance in the principle which keeps the account active. The manager said they would work on it with a target completion date of today ( XX/XX/XXXX. ) I was advised to call back on XX/XX/XXXX, via the XXXX number between XXXX XXXX - XXXX XXXX Monday Friday. 3. ) XX/XX/XXXX - @ XXXX XXXX XXXX Teller ID XXXX He noted that the full payment amount noted of {$4100.00} on the account brings the balance to {$3900.00} with a cashier credit. He also noted that a fax was sent to get the information corrected. They waived the {$34.00} late fee as the cashier credited that the payment was paid on time, but it was noted incorrectly in accounting. He said to send a letter to the following to dispute the information on my credit report : Fax ATTN : Credit Reporting Dispute/ Customer Service Loan # XXXX - Erroneous 30 days late - ( XXXX ) XXXX Fax Teller ID - XXXX XXXX. ) XX/XX/XXXX @ XXXX XXXX Teller ID - XXXX called me back Accounting decided to back up one of the payments and apply some of the principal to the deferred amount which should automatically fix credit report for the late monthly payments. The change will be reflected and updated in 24-48 hours. Someone from Caliber Home Loans will call back and note that it is reported to credit reporting agencies on the first of the month. 5. ) XX/XX/XXXX @ XXXX XXXX - XXXX Teller ID XXXX I made an additional payment on the telephone manually to the Customer Service Department to ensure the payment was credited appropriately to my account. I made a payment to the Customer Service Representative of {$1000.00} and the confirmation # XXXX given to me for the payment. 6. ) XX/XX/XXXX XXXX XXXX I was told that the Manager readjusted the XXXX payment and it would be updated on my credit report as paid one time. The Managers name is XXXX XXXX - Teller ID XXXX Credit reporting may take up to 10 days to reflect an update. 7. ) XX/XX/XXXX @ XXXX XXXX - XXXX SPOC ( Single Point of Contact ) Teller ID XXXX Called back and left a message to speak with XXXX or Manager further to check on the status of correction on my credit report. She said she would send a message to both of them. 8. ) XX/XX/XXXX @ XXXX XXXX XXXX Teller ID XXXX XXXX advised me to send a screenshot to show that my credit reporting was not reporting correctly to her to share with her Supervisor. I faxed in copies of the screenshots of this information for Calibers Supervisory Team. I sent the information to XXXX Supervisor at Fax ( XXXX ) XXXX 9. ) XX/XX/XXXX @ XXXX XXXX XXXX Teller ID XXXX No updates or conclusion to the investigation. 10. ) XX/XX/XXXX XXXX - Supervisor Teller ID XXXX Advised me they are looking into the matter, issues has been escalated, and to call back on Thursday as they should have an answer 11. ) XX/XX/XXXX XXXX Teller ID XXXX - XXXX took notes to send over to XXXX for resolution. 12. ) XX/XX/XXXX @ XXXX XXXX XXXX ( Supervisor ) Teller ID XXXX XXXX finally informed me for the first time in the series of calls I have had with Caliber that the reason my loan was being reported late was because I am making payments on the deferred balance which was part of a loan modification which was done on this loan 7 years ago. He stated that the deferred balance has to be paid in full as the principal on the loan has been paid in full. I let XXXX know that there was not a prepayment penalty on my loan nor any information in the loan modification to state that I had to pay the deferred balance in full upon payment of the principal amount on the loan. XXXX stated that the account will be reported late until the deferred balance is paid in full and will show as delinquent on my credit report. I asked why this wasnt communicated to me over the last month when everything the Customer Service Representatives told me was the opposite and that the credit reporting would be reported on time as I have made payments on the account. He stated that it was due to the principal of my loan being paid off which has now made my deferred balance due immediately. I told him I was very upset because this language was not in the loan modification agreement, and the loan modification stated that the loan was due at the maturity date of XXXX. I noted to XXXX that in my loan modification that I didnt see anything that stated that the deferred balance was due once the principal was paid. And since I have been making payments in lump sums several times over the past several months in which there wasnt a principal balance, I couldnt understand how this could suddenly change without notice. I also mentioned to him that Caliber has had a history of making credit reporting errors with my account in the past and reiterated I had no notice that the deferred balance had to be paid in full once the principal was satisfied. Finally, I asked XXXX since no notice wasnt given and if I made the payment of the entire balance would Caliber in good faith be able to correct the reporting? He said they would not correct the matter. He said this is the final outcome, but I could write a letter to the Customer Advocacy Department. Here is the information XXXX provided to me about the loan : Customer Advocacy ( XXXX ) -XXXX send in a complaint letter 13. ) XXXX, XXXX, XXXX @ XXXX XXXX Called and left a message with XXXX Teller ID XXXX to have XXXX call me back who was the original customer service representative who was working with her Supervisor to resolve this issue and have the credit reporting updated to reflect that I had made my payments on time. I wanted to speak with her about my options of updating the information. 14. ) XX/XX/XXXX @ XXXX XXXX XXXX Teller ID XXXX ( Single Point of Contact ) SPOC The request is still open to investigate this matter in the system and there has been no resolution according to the notes. Verified that loan modifications usually have to be paid by the Maturity Date which is XXXX for my loan and noted on the statement and that there is no prepayment penalty on the loan. 15. ) XX/XX/XXXX @ XXXX XXXX Single Point of Contact ( SPOC ) Teller ID - XXXX She stated that XXXX tried to call me three times, but didnt get a response. I let her know that I did receive a call twice from the bank, which could have been XXXX, but when I picked up the call it disconnected the call both times. She sent an instant message to XXXX who stated she would call me on Monday, XX/XX/XXXX or before the close of business tonight XX/XX/XXXX. I did not receive a call back from the bank on Friday, XX/XX/XXXX. Look forward to bringing this matter to a resolution soon. Let me know if you need any additional information.

Complaint: I had always been able to make my mortgage payments and pay my other bills on time until I lost my job and invested in a business that failed a few years ago. Both of these events caused me tremendous finance loss and I fell behind on my mortgage. My mortgage loan was recently transferred from XXXX to Caliber Home Loans. I recently found out that I apparently was offered two loan modifications by XXXX. This is news to me, as I would have happily agreed to them had I known about the offers. Unfortunately, XXXX never sent me the offers or contacted me and, thus I was unaware that there were options to correct my deficiency. I have overcome my financial difficulties and I am currently in a very good position financially and will be for the foreseeable future. When I became delinquent on my mortgage, I didnt know at the time that I could reach out to my mortgage servicer and receive mortgage assistance, as the thought never entered my mind and I was busy with other things in my life. After taking a look into this, it appears that they should have reached out to me or sent me documentation advising that I had options to get my loan caught up. If so, this would have been resolved a long time ago, but I never had a single point of contact or any other action that would have saved my home from going through foreclosure. I unfortunately was forced to protect my assets legally by filing for bankruptcy, but this is a temporary solution and I need Caliber to work with me so solve my delinquency.

Complaint: On XX/XX/18 I discovered that Caliber home loans XXXX XXXX XXXX XXXX XXXX XXXX TN XXXX, XXXX XXXX XXXX have put together a loan package in my name with personal information stolen from XXXX XXXX XXXX XXXX XXXX XXXX XXXX TN XXXX XXXX XXXX XXXX. This illegal loan was originated by Mr XXXX XXXX lic # XXXX, NMLS # XXXX, of Caliber home loans, our ( my XXXXyr old ) was given to Mr XXXX XXXX by XXXX employee XXXX XXXX ( loan officer ) who was terminated by XXXX on XX/XX/18, Mr XXXX XXXX is and was unlicensed in TN. My FTC complaint # XXXX my XXXX complaint # XXXX my cfpb reference # for XXXX XXXX-XXXX. I have had to freeze my credit right in the middle of the home search. My identity and credit are now in permanent Jeopardy and have suffered irrevocable harm by being passed around. I have never met Mr XXXX XXXX and have never heard of Caliber home loans. I did not give anyone permission to run credit and I have not filled out any mortgage applications with XXXX or Caliber home loans. This loan package was then transferred back to XXXX by XXXX XXXX, ( where our information was stolen from in the first place ) onXX/XX/18. The personal information was given back to XXXX in PDF form, it was stolen from XXXX in paper form ( hard copies ).

Complaint: XXXX XXXX XXXX XXXX XXXX XXXX XXXX, FL XXXX XX/XX/XXXX FHA Case Number : XXXX Service Loan Number : XXXX Attention : Caliber Home Loans : XXXX XXXX XXXX XXXX XXXX, OK XXXX Dear Caliber Home Loans : This letter is to bring to your notice that the increase in our mortgage payment from the regular monthly payments of {$1500.00} to {$1800.00} ; an added increase of {$250.00} per month, of which you now imposed on us, starting XX/XX/XXXX, is not affordable, and will cause multiple hardship including serious impact on our credit rating and credit score. I see this as elements of continued harassment you inflicted on us in the pass with multiple phone calls for one of the trial period payments shown below, that was already made. Your action then, resulted in me and my wife experienced bad credit ratings, and as a result, I had to hire an attorney who filed a case against you resulting in a local court charging you a fine, for being unjustly unreasonable. My wife and I has been clients of yours since XXXX of XXXX. We experienced hardship ; and did get behind with our mortgage payments. However, we did our best to make payments after getting behind three months ; at which time you refused to accept payments until our deficits to you was more than {$14000.00}! At that point you filed a foreclosure against us, but the XXXX who we serve and trust, hear our prayers and helped us to remortgage our home through the Home Affordable Modification Program ( HAMP ). Notwithstanding, our present mortgage payments are not as affordable as the original mortgage ; but we had no choice ; we need a roof over our heads, and the good Lord in whom we trust, helped us keep our home. The original Mortgage was suspended then, and we accepted the opportunity to enter into the conditional trial period plan under the FHA ( HAMP ), and as stated in the agreement : a trial period plan, that encompasses a three months period for making payments was formulated and put place as noted below : First payment {$1600.00} by XX/XX/XXXX Second payment {$1600.00} by XX/XX/XXXX Third payment {$1600.00} by XX/XX/XXXX We fulfilled the above trial period on time, but was harassed for the XXXX payment after it was already paid. As a result I was forced to file the above mentioned law suit against you, and we were compensated with a small restitution as ordered by the court. Moving forward since the trial period, the regular monthly payments has been {$1500.00}. 27 of which includes escrow for taxes and insurance and or PNI/MIP fees. Hence, the principal and interest adds up to {$1000.00} ( Mortgage payment ). I will remind you that this deal is not as affordable as the first mortgage of XXXX, of which was {$220000.00} ; and as you are aware, the present mortgage amount is {$230000.00} of which our present mortgage payments only apply to XXXX ( First mortgage ), because the remaining {$25000.00} is processed as a second mortgage and does not includes these payments, but will be accounted for, at the sale or remortgage of the property, as noted in the contract. As mentioned earlier, the present increase/hike, in the monthly payments you imposing on us, is not affordable! I am therefore asking you to keep the payments as they were because our monthly payments include Taxes and Insurance as calculated in the monthly payments and verified in the past statements to date. Please be advise that for this unreasonable action imposed on us, I filed a complaint to the Consumer Financial Protection Bureau ( CFPB ). Complaint: XX/XX/18 - Contacted by XXXX XXXX XXXX at Caliber Home Loans regarding applying for a USDA mortgage. He assured me that his firm was familiar with the bankruptcy/foreclosure exceptions and exemptions for USDA loans involving regular or manual processing with or without GUS. The property in question was not reaffirmed in the Chapter XXXX. XX/XX/18 - XXXX XXXX reported that my mortgage application was denied due to the foreclosure. He stated, " USDA is a hard no until your foreclosure is 3 years old '' ( XXXX XXXX Mon, XX/XX/XXXX, XXXX XXXX ) and " I dont think you get It! I had USDA underwriting look at it and they dont feel your reason for the hardships are sufficient enough reason for foreclosure '' ( XXXX XXXX XX/XX/2018 ). The foreclosure is an irrelevant issue as stated below in the USDA guidelines. Further, XXXX XXXX has ignored my requests to receive further explanations from the party ( ies ) that made the erroneous decision. My bankruptcy was caused by unemployment ( layoff ) followed by underemployment, plus the three-year window has already passed for the Chapter XXXX. Again, the denial for foreclosure was an error by Caliber. USDA Guidelines - " When a Chapter XXXX bankruptcy absolved the mortgage debt for the applicant, any foreclosure or remaining foreclosure pending is an action against the property, not the applicant. The foreclosure action is not considered as an indicator of unacceptable credit in the applicants evaluation. A loan underwritten with the assistance of GUS will not be required to be manually down-graded when the bankruptcy discharge included the mortgage debt. ''
