Complaint: I initially contacted XXXX XXXX ( XXXX ) on XX/XX/XXXX about securing lending for a new home purchase. This was on recommendation from my real estate agent XXXX XXXX ( Sears ). XXXX had contacted XXXX and explained what the builder 's lender XXXX XXXX was offering and asked XXXX if they could meet or beat the deal. XXXX assured both XXXX and I that the interest rate and credits would be matched and that I had no worries going forward. XXXX then contacted me by phone and said that in order to make the deal work for her upper management that she needed a " good faith '' deposit to lock in the deal. She assured me that the money would be applied to the loan at closing and that if Caliber could not fulfill their promises with regards to the credit and rates then the money would be refunded. I asked her several times about this through the loan process both in person and over the phone. She was even bold enough to state " don't worry about what any of the disclosures state, what I tell you is what matters ''. Therefore, I did everything she said and signed everything she told me to. I paid my " good faith '' deposit of {$1900.00} on XX/XX/XXXX. On XX/XX/XXXX I was contacted by XXXX because we were within 30 days of closing. This was the first time she told me that she was not going to be able to match the rate she promised. After a week and a half of emails going back in forth XXXX finally admitted that she was not going to follow through with her promises and could not match the rates or credits from XXXX. She even made me re qualify through XXXX hoping that I would not meet their requirements ( but I did ). After realizing she wasn't going to be able to scam her way through the end of the loan, she told me that she was too " emotional to help me ''. She then referred me to her boss XXXX XXXX ( XXXX ). XXXX did his best to try and repair the broken deal but still could not meet the rates offered by XXXX. XXXX also refused to document our phone conversations and only would discuss rates, or deposits over the phone. I realized why he did this when I asked to end my relationship with XXXX and have my " good faith '' deposit returned. It was at this point that XXXX told me the deposit was nonrefundable and they would not return the money. When I asked XXXX why he told me that the money was a " lock rate fee '' and therefore nonrefundable. When I explained that this was not the agreement I had with XXXX when the money was paid, he told me I should have gotten everything in writing. XXXX misrepresented herself and Caliber in order to benefit both financially and with her career. That in itself is the true definition of fraud. I am not seeking any financial gain from XXXX or Caliber. I just simply want the {$1900.00} I paid in good faith to be returned to me as it should be.

Complaint: I bought my home in XX/XX/XXXX and refinanced with XXXX dba XXXX in XX/XX/XXXX which sold the loan to XXXX in XX/XX/XXXX. There have many different Servicers and the most recent on is Caliber.
Caliber asked us to provide them evidence that we paid them during XX/XX/XXXX to XX/XX/XXXX, but they denied receiving it See evidence attached. They charged fees and expenses during my active Bankruptcy, which is presently in appeal before the XXXX Circuit and we are going to Court Ordered Mediation. ( ADR ) Per RESPA, TILA, FDCPA, FAC, CAL CIV CODE, etc. We requested further information from Caliber and XXXX XXXX XXXX, allegedly acting as a Trustee for the XXXX XXXX XXXX Trust, and they have failed to provide it and disclose detailed information about this Trust which we require for Mediation.
We have also demanded a copy of their most recent Proof of Claim ( POC ) and rectification of what they have stated in the attached documents.
Also, they keep attempting to foreclose on our property even though my wife has filed a Chapter XXXX BK and has an automatic stay in place.
They have even sent drones and taken pictures of my family and home without our permission which is totally unlawful in XXXX. We filed a complaint with the XXXX Police Department with evidence, and they must now disclose the information of who was/were the individuals that flew the drone ( s ) over our home near the XXXX Airport, and deliver the originals to the Police Department in XXXX, or run the risk of any employee of XXXX XXXX DBA XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX, CALIBER HOME LOANS, et al being arrested. We are in the process of filing a Temporary Restraining Order ( TRO ) against them.
We await all the documentation requested as soon as possible.

Complaint: Since my loan was transferred I have been making every effort with Caliber to help me apply for disaster assistance, I was impacted by the Woosley Fires, and my area was declared to be in National Disaster are in XX/XX/XXXX. Caliber told me that because they did not have the disaster assistance application I could no longer apply for it. I submitted the application to the previous servicer, but my loan was transferred while in review. Caliber informed me that they did not have the application from XXXX and that I could not send it in, it was too late - they would have needed it from the servicer. I lost a good amount of time because caliber did not have my loan information for 1-2 weeks after the transfer, but still refused to postpone my sale date until they did have it. Luckily, the initial sale date for XX/XX/XXXX was postponed bc of the XXXX hold, not bc of Caliber. So I applied for a modification, since they would not review me for disaster assistance. I submitted all the requested documents by XX/XX/XXXX. On XX/XX/XXXX I was told that they needed me to change my profit & loss and to send in a lease extension. I submitted the documents on XX/XX/XXXX.
On XX/XX/XXXX Seterus, the previous servicer had finally sent Caliber my Disaster Assistance application.
I called XXXX on XX/XX/XXXX to advise the agent that I submitted the additional requested documents which should complete my modification application & enable me to have the sale date postponed, so that I can have my application reviewed for assistance. The response from Caliber was very concerning. I was told that they are extremely backed up and they dint know when they will be able to review the documents I submitted on XX/XX/XXXX, and that it may happen after the sale date, which he said would be unfortunate, but there is nothing he could do. Even though I submitted what I was asked to submit, they were too busy to get to it and it is actually the last day for me to submit any documents. This is not okay, I did what I was told to do and if Caliber is so backed up then they should postpone the sale date.
I called almost every hour on the final day to submit documents, XX/XX/XXXX and my submitted documents, via email ( the fastest method ), were still not uploaded. There wad no one available to help me, I tried to escalate it & I was told that even if I submitted all my paperwork on time, to be reviewed for a modification, that the sale would not be placed on hold or rescheduled if they had not had a chance to review. I am given the run around and no options for any help, even after doing everything I was told to do, in order to be considered for assistance. On XX/XX/XXXX I was told to wait until XXXX to have an update for me, but that is only TWO days before the SALE date and they indicated they are so busy that there is nothing they can do about that. I also requested a reinstatement amount, which I never received and how can I reinstate if I wont have an update until 2 days before a sale.

Complaint: I had a decrease in my salary last year because of my employment changing. My previous employer laid me off because of the company down sizing. I've requested a mortgage modification and submitted my financials several times to my mortgage servicer Caliber Home Loans.They have sent me 2 modification offer with trial payments plans. 1st-Trial payment plan for XX/XX/2018 gave me a payments but they were filing a private mortgage insurance claim in the amount of {$51000.00} per Customer Service Caliber Loans, at that time I was delinquent {$3300.00} why is Caliber filing a PMI claim in the amount of {$51000.00}. I filed a consumer complaint and resubmitted a modification request with financials to caliber. I received XXXX the 2nd Trial modification with the trial payments, I called Caliber Mortgage Customer service they stated hey were filing a private mortgage insurance claim in the amount of {$39000.00}. my mortgage is delinquent in the amount of {$9000.00}. Again why is Caliber mortgage filing a private mortgage insurance claim for that amount when I'm not delinquent for that amount. I want to pay my mortgage obligation but I don't want to be taken advantage of financially. See Attachments Please! Please! Please Help

Complaint: Name : XXXX XXXX DOB : XXXX LAST 4 OF SOCIAL : XXXX REPORTING COM : Caliber Home Loans On XX/XX/XXXX a mortgage company posted 30 days late on my account " Caliber home loans '' They haven't received my check And called me 7 days before the 30 days due date, I made the payment right away with their rep on the line, he DID NOT inform me that with the payment method I chose it will take them 7-14 days to receive check, they got the check 1 day after the 30 days due date and reported 30 days late.
Lack of communication on their side while I was completely registered with them, including email and phone number and alerts.
Tried to speak to their supervisor right after incident and they kept saying he or she is sick, took me 2 weeks to speak to a supervisor.
I tried to dispute this and they are not cooperating with the beaural attempts to resolve this.
Was reading other people complains online and I'm not the only one.
I have two mortgage companies I'm dealing with, and a problem like that never happened, I take my credit very seriously and because of their lack of communication I got into this situation.
They keep saying that because it was 1 day after the 30 days than it's not an error, instead of taking responsibility for their actions, informing me sooner they haven't received payment and most importantly telling me to choose a different payment method so the payment will be reflected right away.
Sent them a proof already that payment was made at the date of their call ( 7 days before the 30 days ) And a letter from the bank indicating I had over 30k in my account at the time, so there wasn't any problem with my ability to make payment.
Please help me resolve this matter and to remove their late payment from my report.

Complaint: In XX/XX/2019 we paid {$8000.00} in order to put our equity >20 %. We wrote a detailed letter to the Caliber Escrow Dept. seeking elimination of PMI ( complying with their required BPO house value estimate, at a {$100.00} cost to us ) and also requesting elimination of our escrow ( we had done this with our previous house with XXXX XXXX because of similar problems ). We never received direct answers to these inquiries in our letter. We have repeatedly been given the run around, or canned answers that don't answer our questions. We are current on the loan and have never been even a single day late with our payment.
Tired of the escrow abuse. This happened with our last house ( XXXX XXXX ) and is happening again with Caliber Home Loans. Currently, they are in receipt of {$2000.00} they initially paid to XXXX for home insurance ( they paid them but XXXX returned it because we paid it along with our auto insurance ). We believed we would be able to eliminate the escrow and pay taxes and insurance ourself. Also the PMI should be eliminated based on our paying {$100.00} for a BPO estimate. This of course ties into the escrow. If we pay insurance -- and we didn't even request reimbursement from the escrow for the {$450.00} flood insurance after Harvey we already paid for -- then without PMI too, the escrow amount should be around {$700.00} per month not close to {$1000.00} as it is now ( taxes of about {$8300.00} ). What is Caliber doing? Pooling everyone 's escrow to their benefit. There is no reason the {$11000.00} should sit in an escrow account without earning interest, especially when their calculation of the escrow is wrong.
Caliber from day one has gotten their end of the bargain -- timely mortgage payments of principal, interest and escrow. Also after Harvey we have maintained both homeowner 's and flood insurance. Now, we simply want the escrow to reflect accurately the account or, preferably, be eliminated as we are able to easily pay the year end taxes.

Sometime prior the forclosure was processed XXXX XXXX XXXX sold our loan to Caliber loans but XXXX loans quickly gave it back to XXXX XXXX XXXX and our foreclosure is with XXXX XXXX XXXX. Caliper loans said on our credit reports that our foreclosure was with Caliber loans also. We only had one house and there was only one foreclosure and it was with XXXX XXXX XXXX not Caliber loans. They need to remove this information off of our credit reports because it looks as if we had two foreclosures and we did not.

Complaint: This is a follow up to complaint XXXX, for which Caliber Home Loans provided an explanation, but in which Calibers assertions about amount due are incorrect. I refer the CFPB to both my complaint and to Calibers Response there. Caliber has : 1. Consistently failed to inform me of problems with the account or given me incorrect information : ( a ) payment increase was made effective for XXXX 's payment, when I had been informed that this payment of {$2300.00} would be due at the end of XXXX for XXXX. ( b ) when a 3rd escrow analysis was performed in late XXXX, and the payment further increased, made retroactive to the XXXX payment ( due 30 days before the decision of the increase ) this was not communicated to me - I only received notices of delinquency.
2. Mismanaged my payments. Monies received for my payments were placed elsewhere and not applied, creating a cause for delinquency in Caliber 's system. This money was never correctly applied. Escrow monies mailed with the voucher to ensure that they were applied to escrow were applied for other purposes, beginning this confusion and leading to several calls and mailed notices claiming delinquency.
3. Made incorrect assertions of payments due. They claim that I owe XXXX, plus the payment for XXXX of {$2300.00}. Their convoluted explanation aside - please see their response to complaint XXXX - the basic math is this.
Correct payments according to Caliber : XXXX {$2300.00}, XXXX {$2300.00}, XXXX {$2300.00}. Total due : XXXX.
Payments from me which they have received, and which I made according to the instructions of their representatives : XXXX. {$2200.00}, XXXX {$2300.00}, XXXX {$2300.00}. Total paid : {$6900.00} Amount of the {$6900.00} paid that Caliber did not apply to or consider a " payment '' but instead applied to principal, leading them to claim delinquency : {$1700.00}.
Amount Caliber considers " paid '' ( the amount I paid, less the amount they put into principal instead of considering it a " payment '' - i.e {$1700.00}. ) - {$5100.00}.
Amount that Caliber says is due for XXXX, XXXX, and XXXX ( {$XXXX} ), less the amount Caliber considers/has applied to " payment '' ( {$XXXX} ) -- - = {$1800.00}. This should be the amount that will make my loan current through XXXX.
Amount Caliber says that to be current through XXXX I should pay them XXXX 's payment of {$2300.00}, plus the {$14.00} that they say is outstanding for XXXX. = {$2300.00}.
I continue to call Caliber and will pursue an explanation I have now invested over 8 hours in calls with Caliber and 3-4 hours additional in pursuit of this complaint and straightening out Caliber 's math. Yesterday I called four times, spoke with five different respondents, and had two of the calls dropped ( not by me ). Even though they assured me they would call back, no one called me back. Today I called and spent 1 hour and fifteen minutes with a Caliber person with no resolution. Caliber has no way to call one person to try to follow this through, and extensions of interlocutors are not given out.
I would like to have one interlocutor with whom I do not have to explain the problem and wait on the phone for 1-2 hours while they sort out Caliber 's tangling of this issue. I would like Caliber to provide a simple explanation of why there are payment increases. And I would like their claims for payment to match their own figures.

Complaint: Caliber Homes Loans ( XXXX XXXX ) is trying to collect on a debt that has been charge off, while debt was still being paid on auto pay, with out having the complete file they claimed was transfer they have start foreclose without sending, breach, acceleration, nothing.
My mother had credit insurance on the mortgage that was filed in Official Land records of XXXX County. with no corrective or any paperwork to prove there claim that she did not have it. after finding out that a trust ( XXXX XXXX XXXX XXXX ) is not an actual bank, but a trust with no documents. refuse to supply information requested.
Asking for Validation. as the records in the county do not support what they are claiming as investors.

Complaint: I was impacted by 2 CA wildfire national disasters, one in XX/XX/XXXX & XX/XX/XXXX. I have been requesting disaster assistance but have not been told I can not apply for disaster assistance, but to apply for a modification. I was told that if I submit all the documents, my sale date would be postponed while my documents are reviewed. I submitted all te documents within the time frame-but the sale date has not been delayed & I have not been able to discuss my options with a representative. I am also concerned bc of a transfer date error by caliber, which caused delays in my obtaining assistance from the correct servicer, please see attached documents, since my loan was transferred during the disaster.

Complaint: I would like a full on investigation on Caliber Home Loans, this is the second complain I will, the company has purposely and intentionally founds ways to retaliate against me. I filed a law suit in XXXX, due to the company asking for documentation sent more than once for a loan modification, XXXX XXXX filled a law suit and option a trail payment plan that would end in XX/XX/XXXX when we contact Caliber after the last payment the first point of contact stated that they denied modification due to not receiving a subordination letter from Keep Your Home California, they stared that the letter was send to my attorney back in XXXX, we including my attorney never got any subordination letter from Caliber Home Loans. I went ahead and contact Keep you Home California compliances Department and they have never seen the letter either. On XX/XX/XXXX Rep XXXX # XXXX was advised to open task for subordination letter by first point of contact. Complaint: We have done four loans thru Caliber homes loans, the experience up until this point has met my expectations. We have paid three of he four loans off. Unfortunately, my home suffered significant water damage in early XXXX. One would think that the insurance company would be difficult party when trying to repair your home however, caliber home loans has proven to be the nuisance. My insurance company worked swiftly in identifying the problems and providing a payment for repairs. Caliber has taken over two months to release the payments and I have had to pay a significant amount of money out of pocket while waiting for caliber. While caliber may do an acceptable jobs underwriting a loan there customer service has completely failed me and my family. We have perfect credit and have never missed or made a payment late in 30 years. Because we have paid so much out of pocket to try and fix our house we are struggling to make our mortgage payment. Caliber should not be allowed to write mortgages if they can not provide adequate customer service. They are clearly acting in bad faith.

Complaint: As XX/XX/XXXX mortage company sent me overage payment from escrow which was about {$4000.00}. I called to ask why and got the run around. After that the payment went up. As of XXXX XXXX i was sent another check of overage about {$150.00}. Did not try to contact mortage company because of the first attempt to at calling.After recieving check the house payment went up for the second time. As of XXXX XXXX I was still sent another overage of {$150.00} and payment will go up in XXXX about from {$1700.00} to {$1700.00}! Last check that was sent i am sending back to escrow to be applied to escrow. As of XXXX. Keep in mind this is a F.H.A. fixed rate loan! I have never had a loan go up like this for a fixed rate loan. convental or f.h.a. loan. Keep in mind the starting loan amount was {$1600.00} and has repeatly went up since the loan was inatiated. There should be no reason or explaination for the loan amount to go up!!! If they can not maintain this loan i will be forced to go into foreclosier because i am on XXXX right now.
