Complaint: I have been working with Caliber Home Loans very closely for months. Every single time I call Caliber I am given different information and then the rep says I am sorry you were misinformed. This is unacceptable. I want the calls reviewed that are recorded for quality assurance. These are not quality calls if the consumer is constantly being told something different. Most recently I was told that I had funds sitting in an unapplied cash account that would be applied to my first payment of my new loan modification once my paperwork was received. In the meantime part of the money was applied to the loan. This is not what the rep I spoke with told me would happen. Why do all of your reps give a different story? Additionally - everytime Caliber sends out documents they are never received. All other mail is delivered except for Caliber documents. One of you reps even said " we hear that a lot, we dont know what USPS is doing with the documents ''. This is unacceptable from a company that is managing such large assets.

Complaint: Caliber Home Mortgage will not rewind to loan modification request and also paperwork that was turned in on XX/XX/2018 and again on XX/XX/XXXX. They have refused our calls and payments. We had a XXXX loan and they advised us to terminate the fist contractor because he abandoned the job. He filed a lawsuit against me and the bank. I retained a lawyer @ {$10000.00} in cost to me, at which time Caliber refused any of our calls or payments. They have sent us foreclosure paperwork. I have no where to go and only want to back payments to be placed in the back of the loan. Also I as told that they received XXXX XXXX in TARP and only used XXXX XXXX. They have not tried to help us at all. Nor take responsibility for th contractors lawsuit causing us to retain a lawyer which I no longer can afford. The past few years, this hardship has cause a separation, XXXX, leav f absence from work. Can you help us keep the house

Complaint: I left the Active XXXX in XXXX and took a lower paying job. My property tax and other fees increased and by XXXX I was struggling to keep up with my mortgage payment. I've been working tirelessly with Caliber Home Loans, company who holds my mortgage, and they are forcing me into foreclosure even when I've finally received a pay raise and enough money to keep my property. They refuse to allow me to submit a loan modification with my new finances which would allow me to stay in my home and avoid foreclosure or bankruptcy. Caliber Home Loans is putting a veteran out on the streets for no reason.

Complaint: My XXXX Mortgage payment was due XX/XX/2019. I paid the mortgage on the XXXX XXXX which is 29 days after the due date ( Only 28 days in XXXX ). My Mortgage company has filed a report stating I was 30 days late. This is incorrect. I queried it with the mortgage company who agreed that it was paid on XXXX XXXX and that it was 29 days late and not 30, but their policy is to report it if it goes into the next month. My Payment history on the web site shows it was paid on the XXXX XXXX - 29 days late, not 30. The statement on my credit report that I was 30 days late is incorrect. It was 29 days, regardless of the mortgage company policy. I filed a dispute with XXXX and it was denied by the Mortgage company. I called XXXX and explained the situation and the gave me the FTC number.

On XX/XX/XXXX, the Consumer Financial Protection Bureau forwarded me a " response '' to my complaint ; this response is submitted by the Executive Office of XXXX XXXX XXXX. Attached to XXXX XXXX XXXX XXXX XX/XX/XXXX response ( as evidence ) is a copy of a XXXX XXXX XXXX, XXXX. promissory note ; this promissory note supposedly correlates with my XX/XX/XXXX XXXX XXXX XXXX, XXXX. mortgage ; the promissory note is not endorsed ( annexed as EXHIBIT A ). Complaint: The reason for this complaint is three employees of Caliber Home Loans fraudulently misrepresented terms of the loan that were not disclosed on any of the paperwork or disclosures sent to us for this refinance. On XX/XX/2019 I was approached by my mortgage lender, Caliber Home Loans, to do a refinance on my home. I was told by XXXX XXXX ( XXXXXXXX ) the benefit to refinance include about a {$1100.00} refund from the PMI company because we were refinancing under a certain period of time, a refund of our escrow at closing, which was approximately {$4700.00}, and we would be skipping the subsequent month 's payment. The total cash benefit to us was about {$7000.00}. In addition to this XXXX indicated we would be saving over $ XXXX/month on the total mortgage payment and eliminate PMI. XXXX said, from what she could see, the home value was at a place that refinancing made sense, despite my concerns of being approached by Caliber representatives before and others stating it was not. She said it was. With these representations I agreed to allow them to run my credit. She ran my credit while on the phone. During this same conversation, we discussed adding my husband to the deal. She ran his credit as well. We decided at the time it did not make sense, and we agreed to move forward with myself as the sole borrower, and I paid a {$99.00} appraisal fee. The appraisal was conducted, and came in lower than XXXX assured me it would. Then, on top of that, she claimed to have read my credit report wrong and all of a sudden saw my car loan which has been on my credit report since XX/XX/2019. XXXX unilaterally then tried to change the terms of the refinance, claiming I no longer qualified for what she presented on XX/XX/XXXX. We then agreed to put my husband back in the mix as co-borrower, and XXXX promised she would use the same credit reporting done on XX/XX/XXXX. Almost immediately after we hung up the phone, we learned XXXX ran my husband 's credit again, and that caused his score to drop significantly. Two hard inquires in a short period of time was a hit. XXXX flat out lied, and we had provided proof to Caliber home loans, and their associate XXXX XXXX ( XXXXXXXX confirmed for me Caliber did run the credit twice, proving XXXX lied. After days of attempting to have a reasonable conversation with her, of which she is incapable of doing, I was able to speak with her manager, XXXX XXXX ( XXXXXXXX ). He became my POC from that point forward. He said he would take over the file and work with underwriting to make the deal work, as XXXX initially presented to me. It took a couple weeks going back and forth because of the addition of my husband to the file, the lower appraisal, and the review of our credit reports, however, XXXX eventually confirmed he was able to work with underwriting and the initial presentation of what XXXX had provided to me did not change. We were still able to have the same program, same interest rate, etc. Nothing changed. We agreed to move forward. After more weeks of providing an unreasonable amount of paperwork and jumping through several hoops for XXXX 's document requests, we were able to schedule closing on the loan. I have reviewed every disclosure provided from XX/XX/2019 up to and including the date of closing. At no time in this paperwork did we agree to, sign with authorization, or get provided any sort of document allowing Caliber Home Loans to take our escrow fund, which was not their money to use, and apply it to the principal of the loan. The loan closed on XX/XX/2019. We went through every document with the closing specialist and even discussed the escrow refund with her, and no document did not indicate this was happening. I followed up with XXXX XXXX on XX/XX/2019 to clarify a few follow-up details - when would the escrow refund be processed, when would my loan be visible on line, and when would the refund from the PMI company be processed. It was during this email conversation that XXXX XXXX disclosed Caliber Home Loans used the escrow balance of approximately {$4700.00} to put money toward the principal of the loan. Caliber Home loans never disclosed this, nor did they have permission from me to use the money set aside in the escrow account for taxes and property insurance to pay the principal of the loan, to serve their needs, not mine as the mortgage consumer. It is apparent that XXXX XXXX, XXXX XXXX and XXXX XXXX made misrepresentations and withheld significant details in order to close this loan. We were required to sign an Anti-mortgage Fraud Statement certifying everything we represented was true. I had to sign a statement that said the funds used in the closing were not obtained or borrowed from any source not disclosed on my application. I never agreed to allow Caliber Home Loans to use these funds as closing costs or down payment. Further we were asked, by the closing agent, to sign a " borrower 's certificate of refinance loan benefit '' certifying that one of the statements were true. Everything about this loan went up - interest rate, principal & interest payment, total debt obligation, etc. There was no benefit to the loan except for these three things ( {$1100.00} back from the PMI company, skipping XX/XX/XXXX 's payment, and the {$4700.00} refund on escrow ), which was outlined in the last bullet indicating cash back at closing on this refinance certification, and why we were doing this in the first place. We relied upon the statements we would receive money back after closing, with an eventual total of about {$7000.00} when all said and done. We were misled by these three people into a refinance that was fraudulently represented. Had any of this been disclosed before or at closing, we would have not moved forward as there is absolutely no benefit to us. We feel that Caliber Home Loans owes us the refund of the escrow balance on the account as of XX/XX/2019, which was {$4700.00}.

Complaint: XX/XX/XXXX I called my Caliber Mortgage Company to accept there Loan Modification Trial Payment Plan which my partner and I had applied for. The letter we had received from Caliber Mortgage regarding the Loan Modification three month trial plan said to call to accept the plan if we approved and when we called and said we accepted the plan on XX/XX/XXXX the representative told us we did not need to make any payment until XX/XX/XXXX which was the first of the Trial Payment plan. At this time we were not behind on our mortgage. We would have ordinarily made XXXX and XXXX mortgage payments but she said we didnt have to make a payment until XX/XX/XXXX. In XXXX we got a letter from Caliber Mortgage stating that we were 2 months behind on our mortgage! We were in shock because of what the representative at Caliber Mortgage told us about not making a payment until XX/XX/XXXX! We called and talked to Caliber Mortgage several times complaining that this representative told us incorrect information during our XX/XX/XXXX conversation about not making a payment until XX/XX/XXXX and they have not been accountable for this incorrect information told to us!! On XX/XX/XXXX we received a letter from XXXX XXXX XXXX Mortgage stating that the servicing of our mortgage loan was transferred from Caliber Home Loans to new a servicer called XXXX XXXX XXXX XXXX. I have called and talked to XXXX XXXX XXXX to see if they will put the two months we are behind at the end of the Loan after we are done with the three month Trial Plan which we only have one more month left to pay on the three month trial plan. The representatives I have talked to can not tell me if they will do this! I would like to know if Caliber Home Loans has a recording of our conversation with their representative XX/XX/XXXX telling us that we did not have to make a payment until XX/XX/XXXX. Caliber Home Loans representatives in the Modification Department tell me they dont know how far back the recordings are saved. I was told this today XX/XX/XXXX. This has adversely affected my credit score and caused us much duress! We have been current on our payments the past five years having just completed a Chapter XXXX Bankruptcy in XX/XX/XXXX and we were looking forward to improving our credit and now are devastated by the misinformation the Caliber Home Loan representative gave us on XX/XX/XXXX making us two months behind. Can Caliber Home Loans be held accountable for this misinformation?

Complaint: caliber home loans XXXX - Loan was originated as an FHA and on XX/XX/XXXX, as of XX/XX/XXXX I had paid the balance down to less than the 78 % as required by the FHA to remove PMI. I sent a letter ( enclosed ) to Caliber to have the PMI removed and they send back that is was. My payment went down the {$320.00} as you can see from the screen shots. On XX/XX/XXXX an additional {$940.00} was taken out as an FHA payment and even though I have been promised several times that either documentation of some kind will be send to me explaining why this was taken out or that the funds would be refunded nothing has happened. I have been promised several call backs from " senior associates '' that could explain what had happened but have yet to hear back. What makes this even worse is now the loan is being sold to XXXX XXXX services as of XX/XX/XXXX, and my concern is that they did this to keep from having to explain or deal with me on the missing ~ {$950.00}.
