Fee problem
Complaint: This is not really a fee question, but you didn't list an appropriate category. My issue deals with advertised interest rates ( APY ) and many " direct '' ( ie online ) banks specifically, CIT Bank. CIT Bank currently advertises a 1.55 % APY. This applies to amounts of money of {$250000.00} and below, which is where I fall into ( see attached screen prints ), but when I login to my account, it shows them paying me 1.05 % APY. On their website, in the fine print, it states that interest rates may change at any time. In their 44 page Account Terms agreement, they state " Variable rate ( the interest and APY may change at the Banks discretion, at any time ) '' My 2 questions : 1. Is it legal to advertise a higher rate today and not pay that rate today? 2. When the bank states " at the Bank 's discretion, '' does this apply to all customers of that bank 's product or are they singling out certain customers? Could it be that for large accounts they reduce the interest rate because they don't want to pay out that money?

Complaint: The United States Treasury Department and other federal agencies established the Home Affordable Modification Program ( henceforth " HAMP '' ) as part of the Making Home Affordable Program as authorized and enable by 12 USC 5201 et seq. The HAMP are incorporated in the terms of the subject contract between parties. The Making Home Affordable, Handbook for Servicers of GSE and Non-GSE Mortgages, 4 2MP Process and the Supplemental Directive 13-05, G. Section 4 of Chapter V, 2MP Process state in relevant part : " When a borrower 's first lien is modified under HAMP ( Tier 1 or Tier 2 ) or a Standard Modification by XX/XX/XXXX. The 2MP servicer must offer to modify or extinguish the corresponding second lien ... .. In addition, if the borrower 's first lien is modified under HAMP or a qualifying GSE Standard Modification, the 2MP servicer must dismiss any outstanding foreclosure action on the borrower 's second lien. On XX/XX/XXXX, I enter into a loan modification agreement, therefore as per the mentioned Treasury Rules, the second lien holder One west Bank was supposed to either offer a loan modification or extinguish the debt. Ones west bank failed to do either and instead sold the loan to XXXX XXXX to enforce the debt. These actions are in violation of the precedent stipulated Rules set forth as part of the Loss mitigation Resolution by the treasury department. The record reveals that i entered into a loan modification agreement prior to XX/XX/XXXX, and that the lien holder one west bank failed to abide by the Treasury Rules in regards to the debt. At this time debt collector and its affiliates XXXX XXXX, can not enforce a debt that should have been extinguished at this juncture.

Complaint: Based on my research, I have experience a difficulties and mis communication in regards to taxes and insurance which I was directly to pay accordantly and on time, which I have been paying the taxes and insurance on time in timely fashion. However I have been sick prior toXX/XX/XXXX. I'm not late on my taxes and insurance. I was previously offer a modification with a servicer who I have a reverse mortgage currently with. I according to my research, I was told that If I'm in reverse mortgage I shouldn't be offer a modification, because servicer pays the mortgage. I'm responsible for only paying the taxes and insurance which is update. I have paid the servicer {$30000.00} by certified checks and nothing has been applied to my account and still want me to pay additional {$15000.00} which is in question, If not I would be put into foreclosure. There are several ultra violation and RESPA / Truth n Lending /Preditory lending practice/Dodd Frank Act.
