Complaint: CIT Bank, a bank that acquired ONE WEST Bank, has refused to validate information it is currently reporting to XXXX XXXX XXXX XXXX, Account number XXXX. I have requested this bank under the FDRA to validate the entry on my XXXX credit report and they refuse to do so. In addition, validation is not merely proof of my mailing address, but competent evidence that the information being reported is accurate.
I have made numerous calls asking customer services to assist me to no avail as well as received the letter attached.
Under the Fair Reporting Act, I do have the right to request the the original creditor validate information shared with the major credit reporting bureaus.

Complaint: 1. ) What is this complaint about? Illegal and Unlawful foreclosure 2. ) What type of problem are you having? I am having problems having authorities look into the procedures that were used to dispossess me from my property. It is my belief that the participants are debt collectors who do not possess the standing nor are real parties in interest and have conducted fraud against me and the court.
3. ) What happened? My real property interest was wrested from my in what I believe was an illegal and unlawful manner resulting in me being dispossessed from my home.

On or about XXXX XXXX, 2012 a foreclosure action was executed against my property in what I know to be an unlawful foreclosure by a third party debt collector. The foreclosure was initiated by XXXX XXXX XXXX XXXX and XXXX XXXX XXXX through their agent ; a Law Firm by the name of XXXX, XXXX. XXXX XXXX XXXX XXXX XXXX and XXXX XXXX XXXX XXXX XXXX XXXX XXXX are NOT a Creditor/Lender or A Mortgagor of mine, nor have I applied for or either received any services or credit with the aforementioned.XXXX XXXX XXXX XXXX XXXX and XXXX XXXX XXXX XXXX XXXX XXXX XXXX are debt collectors who do not possess the requisite standing or real interest to sue for possession of my real property in a court of law. The collection of this debt was attempted in violation of the FDCPA 15 USC 1692 ( g ) and all corresponding consumer protection laws.
The aforesaid entities have only provided copies of documents that are available through the public records that are easily accessible to anyone. I assert that those documents are forgeries and I am demanding that the debt be verified under penalty of perjury pursuant to the Fair Debt Collections Practices Act.
The above named entities have not, nor have ever cooperated in the verification of the debt, nor have have not presented unimpeachable evidence that they are truly a creditor with standing to sue in a court of law.

In your rebuttal letter you claimed that you submitted a request for the Mortgagee Optional Election ( MOE ) to the Office of Housing and Urban Development ( HUD ) onXX/XX/XXXX. Further, you claimed that HUD responded on XX/XX/XXXX, denying the MOE because XXXX XXXX was not married.
In response to your rebuttal, XXXX reached out to HUD to confirm the decision you claim HUD made on XX/XX/XXXX, and we were advised that HUD made no such decision. Furthermore, XXXX XXXX, Attorney-Advisor at the HUD Region IX office confirmed that the guideline, which was provided to you in our initial correspondence dated XX/XX/XXXX, was accurate and correct.
YourXX/XX/XXXXrebuttal not only misrepresented your actions to XXXX but also to the CFPB, the regulatory agency charged with investigating this complaint. Your rebuttal also misstated the actions of HUD, a federal agency that insures the above-referenced loan. Whether these actions were done purposely or through error, it impacted my client negatively. That said, my client continues to seek resolution to this issue.
To that end, on XX/XX/XXXX, Financial Freedom sent toXX/XX/XXXX a California First Amended Tolling, Forbearance and Release Agreement ( the Amendment ), which requiredXX/XX/XXXXto complete and return the Amendment to Financial Freedom no later than XX/XX/XXXX Although Financial Freedoms XX/XX/XXXX letter is addressed to XXXX XXXX XXXX XXXX has not received it to date.

During this telephone conversation a supervisor by the name of XXXX XXXX provided an extension until XX/XX/XXXX.
Later, on XX/XX/XXXX we again spoke with a representative of Financial Freedom and requested an additional extension for XXXX XXXX to review the Amendment. The representative again consulted with XXXX XXXX and provided an extension until XX/XX/XXXXand requested that XXXX request, in writing, written confirmation from Financial Freedom stating that Financial Freedom had provided the time extensions referenced above.

Complaint: In XXXX XXXX XXXX, a traditional IRA 2-yr CD ( Certificate of Deposit ) that I had with CIT Bank matured. Since CIT was no longer servicing IRA money they did not have any traditional IRA CDs to roll this money into. So they set up an IRA saving account that had a low rate and transfered my money into this account when the CD matured on the XX/XX/XXXX. Currently I 'm trying to transfer the money into a new bank ( XXXX XXXX XXXX XXXX ) that services traditional IRA money and CDs. I went to one of their branch offices and had an officer of the bank fill out a Traditional IRA Transfer request to transfer the money out of my CIT Bank traditional IRA saving account ( via check ) to XXXX XXXX XXXX XXXX. On XXXX XXXX XXXX I called CIT bank and spoke to a representative and explained that I was mailing a Traditional IRA Tranfer request and to find out if the Transfer document need to be notarized. She informed me at this time that the it would take 2 to 5 business days to process the Transfer. I sent the Transfer document on XXXX XXXX XXXX overnight mail and it was received by CIT on the XX/XX/XXXX. I called CIT on the XX/XX/XXXX to find out the status of the Transfer. It is at this time that the CIT representative informed me that the Transfer was still being processed and that also it would take an additional 5 to 10 business days to mail the check to XXXX XXXX XXXX once the Transfer document was approved. Thus I received inconsistent or partial information from the first person I talked to at CIT on the XX/XX/XXXX and the XX/XX/XXXX CIT representative on the XX/XX/XXXX. Since CIT was no longer offering Traditional IRA services, the time required to Transfer the money should be expedited since I was on the phone with CIT on 2 different occasions and they new what my intentions were. This delayed processing time appears to be nothing more that a blatant attempt to maximize their use of my money while behind the guise of processing time. The Traditional IRA Transfer application is only a 1-page document and should not take 2 to 5 days to process. Additionally, 5 to 10 days to cut a check and mail it to another banking institution is equally inadequate. Also if I had been given complete and accurate processing and mailing time I could have made other arrangements with another bank ( XXXX XXXX XXXX ) to make the transfer by wire of the Traditional IRA money.

Complaint: My father XXXX XXXX on XX/XX/XXXX, I as one of the heirs contacted Financial Freedom, CIT Bank, N.A. to notify the company of his passing and also requested to purchase the property back within the 30 day timeframe requirement. I was told that they would not even have an appraisal of the property or grant an extension until we were able to provide a notice of intent and proof of funds, and an offer letter or the home would foreclose. At that time I was advised that if the offer letter was not enough to satisfy the loan that an appraisal of the property would be done and we would be quoted an amount to satisfy the loan, ( which should be 95 % of the appraised value not the current loan amount ). On XX/XX/XXXX I faxed all the requested documents and waited for a response. We then received a letter requesting our intent with the property and additional information, this was faxed XX/XX/XXXX. I called XX/XX/XXXX to confirm receipt of the information and was told that we were declined for an extension and that we needed to list the property for sale or the home will soon foreclose. I advised that we need them to have the home appraised so we can get the amount needed to purchase the property, they refused to do an appraisal of the property so I advised that we have no way of listing or purchasing the property until we are quoted an amount. On XX/XX/XXXX I have sent a letter requesting in writing what the options are for the heirs, an extension of the loan, an appraisal with the amount due to satisfy the loan. We are close to the 90 days for foreclosure and we have sent everything requested, without an appraisal or an extension the property will soon foreclose.

Complaint: CIT Bank is denying access to my new online savings account. CIT Bank is heavily advertising its online savings accounts, especially on the internet. It is offering incentives for new accounts ( {$100.00}, if {$15000.00} or more deposited for three months ). I opened an online savings account on Saturday, XX/XX/XXXX and deposited {$100.00}. I received an e-mail on XX/XX/XXXX stating, " Your new CIT Bank account has been approved and is now activated. '' That same e-mail said, " To view your account online, click here. When prompted for your Online Banking ID and password, please use the same information that you created during the application process. '' However, when I click on the link, I end up in the endless of error messages, " Either your Username and/or Password do n't match our records or your account is locked.
I sent an e-mail to CIT Bank that said, " I am trying to verify my account with the micro deposits placed in another bank account. Your computer system will not let me access my CIT account. '' I am dissatisfied with CIT Bank 's reply, " Thank you for contacting CIT Bank. For assistance with Online Banking information please call our Customer Contact Center at ( XXXX ) XXXX Mon-Fri XXXX ET, Sat XXXX ET and Sunday XXXX ET. We are here to help! Complaint: I reported Fraud to One West Bank on XX/XX/XXXX. One West is always closed, computers down for days, hanging up on customers, etc. One West keeps LYING putting off CREDIT to my account. I went in and signed a Fraud Affidavit dated XX/XX/XXXX WHICH IS ATTACHED AND CALLED Fraud into Customer Service. Everyone said I would receive credit in 10 days. Then One West lied and CHANGED IT TO 10 BUSINESS DAYS. On XX/XX/XXXX XXXX XXXX, Supervisor PROMISED my account would be credited on XX/XX/XXXX. I HAVE NOT RECEIVED MY CREDIT.

I spoke with XXXX XXXX and he informed me my application was approved for a corporate account without a personal guarantee so he did n't get my personal information only my business information concerning my XXXX application ... He sent me the terms of the lease and also told me my application was good for 90 days ... on the same day I went back online and applied through XXXX XXXX ( not the XXXX site ) for a XXXX XXXX loan ... at that time the application asked for my personal credit information and I supplied it within the application ... within a few minutes I received a confirmation email saying my application was still processing and if I wanted and update I should contact XXXX XXXX in which I did to get the status of my application ... XXXX XXXX responded back stating that my XXXX application was not approved because of my personal credit, I immediately sent him a email back stating my personal guarantee information was only authorized for my XXXX XXXX loan and that I did not authorize my personal credit to be used in determining my XXXX Application ... he preceded to tell me that my personal credit could n't be ignored now even though it was n't originally authorized to use on my XXXX application ... due to what I feel an error on XXXX XXXX parts now I wo n't be receiving my XXXX products because he took it upon himself to combine my applications after he looked over what he really should not have been concerned with and only been concerned with my working XXXX application and not my XXXX application!

Complaint: On XX/XX/XXXX I purchased an investment property with a pay option ARM loan ( number XXXX ) with an option to increase my principal borrowed by 10 % which I could use to borrow against to help pay my monthly interest, much like a line of credit. During the years XX/XX/XXXX thru XX/XX/XXXX IndyMac Bank only reported the interest I borrowed on the original amount of the loan and not the additional borrowed interest, that they referred to as deferred interest. In XX/XX/XXXX OneWest Bank acquired IndyMac Bank and in XX/XX/XXXX when they foreclosed on my property they provided me with a Form XXXX that included the unreported interest ( Deferred Interest ) in the original principal amount which is reported in box 2. of the Form XXXX. The instructions for Form XXXX specifically do not allow for interest to be added to the principal in box 2. Therefore I am requesting IndyMac Bank-OneWest Bank-CIT Bank provide me with a corrected Form XXXX or corrected Form XXXX for years XX/XX/XXXX thru XX/XX/XXXX. I have attached copies of my documents and Bank documents. The Bank 's loan history documents match my figures to the penny.
