Complaint: I returned an item to a catalog company called XXXX XXXX . They had to refund my money by check instead of putting it back on my credit card. At some point in the mailing process someone got their hands on the check and cashed it signing their name to it. I called the bank to report the problem and they told me to call XXXX XXXX that they could not help me, nor do they have a fraud department I could speak to.

Complaint: In XXXX XXXX The IRS notified me I had not reported interest income from CIT Bank for tax year XXXX . I checked my records and they were correct. I had NOT received a form XXXX form from CIT B ank. I made payment. I called CIT and reported not having received the XXXX for tax years XXXX and XXXX . Of course my XXXX tax return had already been filed, and without t he CIT Ba nk interest reported. CIT then sent me the missing XXXX . In XXXX they did send the XXXX for tax year XXXX as it should have been. In XXXX XXXX I received IRS notice that I had not reported interest income from CIT Bank for tax year XXXX , the second year I had failed to receive a XXXX form from CIT. This bill included {$860.00} plus {$38.00} interest. Included was {$430.00} penalty. Predictably, CIT says they sent the XXXX so I suppose it is just my word against theirs. However, I received XXXX or more XXXX every year and because the CIT was for a CD and not a account with active transactions I did not miss not receiving it, or have reason to look for it. I simply did not receive it. Not receiving the XXXX from CIT for two straight years but never having had a problem with any other XXXX takes this beyond mere coincidence.

Complaint: 1 ) I recently submitted a Notice of Error under RESPA to my mortgage servicer, Financial Freedom, a division of CIT Bank. In response to my Notice of Error, my mortgage servicer indicated that there was no error. According to RESPA 12 CFR 1024.35 ( e ), " If the servicer determines after a reasonable investigation that no error occurred [ t ] he servicer must state that it determined that no error occurred, the reasons for its determination, and the borrower 's right to request documents relied upon by the servicer in reaching its determination and how the borrower can make such a request, " In the servicer 's response, they did not include a statement of my right to request documents relied upon by the servicer in reaching its determination and how I can make such a request as required by 12 CFR 1024.35 ( e ). Thus, because of Financial Freedom 's omission, I have no way to know how to request those documents as is my right under federal law. 2 ) Furthermore, RESPA 12 CFR 1024.35 ( e ) also states that the servicer " provide contact information, including phone number, for further assistance. '' I informed Financial Freedom of the aforementioned issue via the contact email that they included in their response for further assistance. I informed them that because of their omission, I did not know how to request those documents. In the email itself, I informed them that if their email was the appropriate vehicle to request those documents that they should take my email as an official request. They have remained completely and utterly unresponsive and have not provided further assistance as is their obligation under federal law. 3 ) I also recently submitted a Request for Information under RESPA to Financial Freedom. In response to my Request for Information, they did not fully comply with my request. They listed exceptions that might allow them not to comply with my request for information as follows : " Your letter also appears to be presented as a Qualified Written Reqeust ( QWR ) pursuant to RESPA. Please note that federal courts have determined that demanding a laundry list of information or making overbroad requests for documents does not constitute a QWR under RESPA, nor do demands for documents relating to the origination of a loan or challenging the validity of loan documents. { See XXXX, XX/XX/XXXX XXXX ( XXXX XX/XX/XXXX ) ( requests seeking documents to " audit '' a loan or challenging the validity of the loan are not QWRs ; also note that requests using almost identical information to the requests in your document, did not provide sufficient information for servicer ) ; XXXX, XX/XX/XXXX XXXX ( XXXX XXXX ) ( demand for a " laundry list of information '' ) was not a QWR, requests were not related to the servicing of the loan, but rather more generally to the allegations of predatory schemes in the mortgage industry ; overbroad categories of information ( e.g., complete life of loan history, etc ) did not assist the bank in identifying what to investigate and was not a proper QWR ]. '' According to RESPA 12 CFR 1024.36 ( f ), " [ i ] f a servicer determines that any of these five exceptions apply, it must provide written notice to the borrower within five days ... after making that determination, including the basis relied on. '' In Financial Freedom 's response, they list several possible exceptions to their obligation to comply with my request, but they never explicitly state which exception applied to my specific request, nor did they indicate the basis for their determination as required by 12 CFR 1024.36 ( f ). Unfortunately, it appears that because I submitted the Notice of Error and Request for Information by myself and not through a lawyer, Financial Freedom believes that they can take advantage of me and deny me certain rights under federal law under the guise of being compliant.

Complaint: My mother had a reverse mortgage through Financial Freedom a division of CITI, after she passed away I worked with Financial Freedom to inform them of the passing and the trusts intent to sell the home to settle the lien owed. I was informed that I had 6 months to square away the property and that I could apply for two 90 day extensions. After three months they ( Financial Freedom ) referred the home to foreclosure. I was told it was just a formality and that I indeed had 6 months with the two extensions. I hired a real estate agent to sell the property and notified FF that the home was up for sale. Because of the pending foreclosure I was place in an interesting position with trying to sell the home. I received only low offers on the home and countless ad 's from attorneys offering to " save the property. ' On XX/XX/XXXX I faxed over my request for my first extension under HUD 's guidelines. The extension was due XX/XX/XXXX. I called FF the following week to check on the status of the loan and was told I had been denied. When I asked why they stated that I had not gotten the request to them in time. The agent admitted in a recorded phone call that the request had sat on the fax machine for 4 days before anyone had found it. Also, they were unwilling to stop the foreclosure and auction of the home. And now with an auction pending, I received offers far less then the asking price, an average of {$100000.00} below market value. It took over three weeks to find out the status of the loan with FF due to their lack of response, I called 12 times between XX/XX/XXXX and XX/XX/XXXX every time I was told " there was no one available to talk to me. '' With the auction pending I took out a personal loan on behalf of the trust and paid off the lien in order to complete a sale of the property. Even after the loan was paid in full FF failed to send any payoff to notice to the trust and ignored 6 attempts by my title company to request a letter stating that the loan had been paid and they were issuing a reconveyance of the title in order to sell the home. It was only when I retained an attorney that FF provided a payoff statement.

Complaint: I had a CD with CIT bank that matured on XX/XX/XXXX. I received a letter from CIT on XX/XX/XXXX that they had forgotten to send me a renewal notice for this CD when it matured, so it automatically renewed at the same interest rate of 1.153 %. At that time, CIT bank 's interest rate for a 1 year CD was much higher than 1.153 %. I called CIT today, and asked them to retroactively apply the then current interest rate. They refused. Why will a customer lose interest money over a bank forgetting to communicate to customers when CDs mature? I have a couple more issues against CIT bank : 1. They have this concept of ramp-up CDs, where they do not automatically renew the interest rate, when interest rate goes up. Only when customers call in, will they raise the interest rate. How will customers know when the interest rates go up in a specific bank? 2. Also, customer service does not seem to very helpful and polite in responding to questions.

Complaint: They continue to claim my Father ( XXXX XXXX ) is no longer residing at the property. This is totally incorrect, and i have jumped through major hoops to proove it. They refuse to answer any questions as to how they recieved the false information, and continue to threaten, file court docs, send out process servers and continue to harrass my XXXX year old father and our family.
